Abstract

Law enforcement against corruption cases has always received special attention from the government, especially with the application of reversal of the burden of proof (omkering van het bewisjlast) as mandated by Article 37 of the Corruption Eradication Law (Law 31/1999 jo Law 20/2001). Investigation of corruption cases is the spearhead of law enforcement in eradicating corruption in Indonesia, but to find out law enforcement at the investigation level by applying reversal of the burden of corruption still needs to be examined more deeply. To find out and understand the implementation of investigations using reversal of the burden of proof, normative legal methods are carried out with field research, namely by using a statutory approach, case approach and concept approach, by examining legal materials obtained through literature review and online, as well as by conducting several interviews with investigators, then analysed using the deduction method and explained using descriptive analysis, to obtain comprehensive study results. From the discussion, an analysis of the existence of the reversal of the burden of proof in the investigation of corruption cases in the police is obtained that the information on the assets owned by the suspect is not all true, after obtaining information from witnesses who have been involved in corruption against the suspect, and only confiscation of property that is the result of corruption is carried out, then proven by the suspect at a court hearing (reversal of the burden of proof / Omkering van het Bewishlasj).

Abstract

Curah hujan merupakan faktor utama produksi garam rakyat di timur laut Jawa Tengah, Indonesia. Teknologi penguapan total dalam produksi garam dengan mengandalkan radiasi matahari. Kondisi ini menyebabkan produksi garam bergantung pada sinar matahari dan intensitas curah hujan. Analisis dilakukan untuk membahas dampak variabilitas curah hujan terhadap fluktuasi produktivitas garam. Penelitian dilakukan pada kabupaten yaitu Rembang, Pati, Jepara dan Demak pada tahun 2018-2023. Metode yang digunakan adalah deskriptif melalui perbandingan data produksi garam dengan data intensitas curah hujan. Data berupa jumlah produksi dan luas lahan garam diperoleh dari Dinas Kelautan dan Perikanan masing-masing kabupaten, sedangkan data curah hujan diperoleh dari BMKG Stasiun Klimatologi Jawa Tengah. Hasil analisis menunjukkan bahwa pada tahun 2018 dan 2019 curah hujan rata-rata sebesar 0,03 mm pada bulan Juli - Oktober menyebabkan produktivitas garam di atas 100 ton/Ha. Tahun 2020-2022 hujan terjadi sepanjang tahun menyebabkan penurunan produksi garam. Seluruh kabupaten penghasil garam di timur laut Jawa Tengah yaitu Rembang, Pati, Jepara dan Demak mengalami penurunan produksi garam rata-rata sebesar 26,76% pada tahun 2020-2022 dan terjadi peningkatan curah hujan rata-rata sebesar 15,58%. Sedangkan pada tahun 2023 terjadi peningkatan produksi garam sebesar 279,94% dari tahun sebelumnya dengan curah hujan yang menurun 27,28%.   Rainfall is a major factor in artisanal salt production in northeast Central Java, Indonesia. Total evaporation technology in salt production relies on solar radiation. This makes salt production dependent on sunlight and rainfall intensity. Analyses were conducted to discuss the impact of rainfall variability on fluctuations in salt productivity. The research was conducted in four districts namely Rembang, Pati, Jepara and Demak in 2018-2023. The method used is descriptive through comparison of salt production data with rainfall intensity data. Data in the form of total production and salt land area were obtained from the Department of Marine Affairs and Fisheries of each district, while rainfall data were obtained from the BMKG Central Java Climatology Station. The results of the analysis show that in 2018 and 2019 the average rainfall of 0.03 mm in July - October caused salt productivity above 100 tonnes / ha. In 2020-2022, rainfall occurred throughout the year causing a decrease in salt production. All salt-producing districts in northeast Central Java, namely Rembang, Pati, Jepara and Demak, experienced a decrease in salt production by an average of 26.76% in 2020-2022 and an increase in average rainfall by 15.58%. Whereas in 2023 there was an increase in salt production by 279.94% from the previous year with rainfall decreasing by 27.28%.

Abstract

This study examines the unclear role of wind-driven upwelling through Ekman transport and pumping, along with the combined effects of the Indian Ocean Dipole (IOD) and El Niño-Southern Oscillation (ENSO) trends on the warming rate of Sea Surface Temperature (SST) along the southern coast of Java. Using data from 1940 to 2023, we investigated how IOD, ENSO, Ekman transport, and Ekman pumping influence SST trends. Our results reveal a cooling trend in SST near the coast during the upwelling period and a warming trend across the entire area during the non-upwelling period. The cooling SST weakens the easterly winds passing through the coastal areas, reducing upwelling intensity, as indicated by the weakening of Ekman transport. However, Ekman pumping, another proxy for upwelling, shows a strengthening trend. Our comparison along coastal areas suggests that the increase in Ekman pumping is more robust than the decrease in Ekman transport, leading to an overall intensification of upwelling. Additionally, we observed positive trends in IOD and ENSO during the upwelling period. These trends significantly enhance the upwelling process and are responsible for the observed cooling trend in SST. Thus, while wind-driven upwelling through Ekman transport and pumping plays a crucial role as a key process, its intensification is primarily driven by the trends in IOD and ENSO.

Abstract

Blue whale and their subspecies is an endangered whale species that needs to be conserved by protecting their important habitat and migration corridor. Research about designing and modelling blue whale habitat for marine protected area has been done many times. However, incorporation of connectivity in marine protected areas design and management has been limited due to the complexity of methods used to model connectivity, therefore the implementation among practitioners is inconsistent. An alternative method to model connectivity of pygmy blue whale habitat is discussed through a combination of maximum entropy model and circuit theory. The habitat suitability models were made using satellite-tagged pygmy blue whale data (2012-2016) and oceanographic variables, such as sea surface temperature, chlorophyll, salinity, bathymetry, and seafloor geomorphology for four season that is March-April-May (MAM), June-July-August (JJA), September-October-November (SON), and December-January-February (DJF). The habitat suitability model shows different importance of environmental variables in their preference of habitat in each season, with distance from slope as the most influential parameter during the migration season (54.4% for MAM, 37.8% for SON), mean climatological chlorophyll during winter (31%), and mean climatological sea surface temperature during summer (54.7%). Habitat suitability result were then used to model connectivity, assuming that the whales migrate during MAM and SON. The migration model from Omniscape showed some pinch point, such as Sumba-Sape strait, Alor strait, Rote strait, Ombai strait. These pinch points can be seen as corridors with high potential of pygmy blue whale migration or high connectivity, therefore this area could become priority for conservation.

Abstract

Pekalongan terletak di pesisir pantai Utara Provinsi Jawa Tengah, dengan aktivitas masyarakat berupa UMKM serta perikanan, yang menghasilkan limbah organik. Pembuangan limbah organik langsung ke sungai tanpa pengelolaan yang tepat, sehingga menghasilkan suplai nutrien, khususnya wilayah pantai dan laguna. Unsur nutrien tersebut akan memicu peningkatan kandungan klorofil-a sebagai indikator kesuburan perairan. Penelitian ini bertujuan untuk mengetahui konsentrasi dan pola distribusi klorofil-a di perairan Laguna Pekalongan. Penelitian dilakukan pada tanggal 30 Mei 2024, pada 10 titik pengamatan yang berada di laguna secara in situ dan sampel diolah di laboratorium. Data primer sebagai variable yang diukur  secara  in situ adalah klorofil-a, sedangkan data variable sekunder meliputi angin, arus dan pasang surut. Hasil analisis kandungan klorofil-a selanjutnya diolah secara deskriptif. Sedangkan persebarannya diolah dengan cara mengoverlay hasil kandungan klorofil-a pada peta arus dengan pendekatan model MIKE-21. Kandungan klorofil-a di perairan Laguna Pekalongan, Jawa Tengah berkisar antara 4,1816 – 30,7238 mg/L dengan rata-rata sebesar 13,7224 mg/L. Nilai konsentrasi klorofil-a tersebut terkait dengan suplai nutrien di muara sungai Sengkarang dan berlanjut ke laguna sampai dengan lepas pantai. Persebaran klorofil-a secara horizontal di Laguna Pekalongan, Jawa Tengah menunjukkan nilai yang tinggi di daerah laguna dan garis pantai serta menurun di laut lepas. Hal ini sebagai pengaruh arus dengan pola dari Barat daya menuju Tenggara. Kondisi tersebut juga dipengaruhi oleh arus pasang surut dan kondisi morfologi perairan laguna.

Abstract

Material Padatan Tersuspensi (MPT) merupakan partikel yang melayang dikolom perairan dan terdiri dari berbagai komponen organik maupun anorganik. Kehadirannya menyebabkan kekeruhan air sehingga menghalangi sinar matahari yang masuk ke perairan, mengganggu proses fotosintesis dan berdampak negatif pada ekosistem. Pemantauan MPT secara temporal dapat dilakukan melalui pemanfaatkan teknologi penginderaan jauh. Nilai estimasinya sangat bergantung pada pemilihan sebuah algorithma.  Penelitian ini bertujuan untuk menguji kinerja beberapa algorithma sekaligus mengembangkan algoritma secara empiris menggunakan data MPT in situ dan nilai reflektan produk dari citra Sentinel-2 di Muara Loji. Hasil menunjukkan bahwa nilai estimasi MPT dari algorithma yang dikembangkan secara empiris pada penelitian ini menunjukkan kinerja terbaik dibanding algorithma lainnya. Algorithma yang dibangun menggunakan reflektan pada kanal hijau (B3) memiliki kinerja terbaik yang ditunjukkan dengan nilai koefisien determinasi (R²) = 0.422, RMSE = 8.93 mg/L, MAPE = 18.2%, dan Bias = 1.43.  Estimasi konsentrasi MPT lapangan memiliki rerata sebesar 39.19 mg/L, sementara hasil prediksi dengan algorithma Ajiperwata (37.88  mg/L), Wirasatriya (48.98 mg/L), Maslukah (11.54 mg/L), Laili (13.42 mg/L), dan algorithma baru memiliki nilai rerata 39.90 mg/L. Penelitian ini masih memiliki keterbatasan, karena algorithma dikembangkan berdasarkan satu kali pengambilan, yang mewakili musim peralihan, sehingga masih diperlukan pengujian atau validasi terhadap data MPT di waktu lainnya. Meskipun demikian algorithma yang dihasilkan dapat membantu dalam monitoring jangka panjang di musim yang sama.

Abstract

Penelitian ini dilakukan untuk menganalisis karakteristik MHW di WPPNRI 711 meliputi Selat Karimata, Laut Natuna, dan Laut Natuna Utara yang mana merupakan wilayah yang memiliki potensi perikanan ikan pelagis kecil dan pelagis besar. Tujuan penelitian ini adalah untuk mengidentifikasi metriks MHW yang terjadi selama 42 tahun. Data yang digunakan dalam penelitian ini adalah data remote sensing suhu permukaan laut yang berasal dari Copernicus Marine Environtment Monitoring Service (CMEMS). Metode pendekatan yang digunakan yaitu dengan statistika deskriptif. Hasil yang ditemukan yaitu rata – rata karakteristik MHW di WPPNRI 711 yaitu frekuensi 2 – 4 kali per tahun; Rerata durasi 8 – 18 hari; dengan rerata intensitas 1oC – 1.6 oC. Tren frekuensi MHW mengalami peningkatan positif 0 – 0,2 kejadian per tahun; Tren durasi dengan rentang nilai -0,5 – 0,5 hari/tahun; Tren intensitas yaitu -0,08 oC – 0,08oC per tahun. Kejadian MHW tertinggi berdasarkan kondisi intensitas selama 42 tahun terjadi pada tahun 2016, 1998, dan 2023.

Abstract

This paper explores the legal framework and law enforcement mechanisms regarding illegal mining in Indonesia, focusing on the implications for environmental protection and criminal accountability. The study employs a normative juridical analysis to examine the existing laws, including the Mining Law No. 4 of 2009, Environmental Law No. 32 of 2009, and the Indonesian Criminal Code (KUHP). The paper highlights the gaps in the legal system, such as weak enforcement, inadequate penalties, and the challenges posed by corruption within local authorities. It also assesses the social and environmental consequences of illegal mining, including deforestation, pollution, and the exploitation of local communities. The findings suggest that while Indonesia has a comprehensive legal framework, the effectiveness of its enforcement mechanisms remains insufficient. Based on the analysis, the paper proposes recommendations to strengthen law enforcement, improve penalties, combat corruption, and support alternative livelihoods for communities affected by illegal mining.

Abstract

MI Luthful Ulum's Transformational Leadership Management in Achieving Excellent Madrasa in Pati Regency. MI Luthful Ulum's Transformational Leadership Management in Achieving Superior Madrasas in Pati Regency is as follows: 1) the principal's transformational leadership can be interpreted as the form or style applied by the principal in influencing his subordinates (teachers, administrative staff, and all employees) to achieve performance and desired educational goals. 2) The main principle of transformational leaders is that they have high competence and vision to realize success, leaders can inspire subordinates to respond with great enthusiasm and commitment to achieving goals. 3) Transformational leadership will have a positive influence on the relationship between superiors and subordinates in Islamic education. With the concept of transformational leadership, subordinates will feel trust, admiration, pride, loyalty and respect for their superiors and will be motivated to do work with results that exceed the targets that have been determined together.  These positive changes such as setting an example, such as leaders showing professional behavior in the teaching and learning process, honesty, discipline (on time), ability to collaborate and relationships between students and teachers will influence teachers at Islamic Education Institutions. 4) Implementation of MI Luthful Ulum's transformational leadership management in achieving superior madrasas in the District. Pati in the picture above there are 4 descriptions of transformational leadership, such as leaders who pay attention to the needs of subordinates, leaders who raise issues of need to a higher level, leaders who listen to subordinates' problems at work, and leaders who build subordinates' self-confidence.

Abstract

Laut Flores merupakan salah satu perairan strategis di kawasan timur Indonesia yang memiliki potensi produktivitas laut tinggi. Fenomena upwelling yang terjadi di wilayah ini berperan penting dalam membawa massa air laut dari lapisan bawah yang kaya akan nutrien ke permukaan. Proses ini berkaitan erat dengan dinamika angin muson dan kondisi oseanografis setempat. Dalam penelitian ini, digunakan data satelit angin, suhu permukaan laut (SPL), dan klorofil-a untuk mengkaji variabilitas klimatologis upwelling secara spasial dan temporal selama periode 2008 hingga 2022. Perhitungan indeks upwelling dilakukan menggunakan pendekatan Ekman transport dan Ekman pumping guna melihat kontribusi gaya angin terhadap dinamika vertikal air laut. Wilayah studi dibagi menjadi dua transek berdasarkan sebaran geografis, dan masing-masing dianalisis menggunakan pemrograman Python serta divisualisasikan secara spasial. Hasil analisis menunjukkan bahwa fenomena upwelling dominan terjadi pada musim timur, khususnya bulan Juni hingga Agustus, yang ditandai dengan peningkatan kecepatan angin, penurunan SPL, dan lonjakan konsentrasi klorofil-a. Nilai indeks upwelling tertinggi tercatat di Transek A, sedangkan pada Transek B Ekman pumping bukan merupakan faktor dominan dalam memicu terjadinya upwelling pada wilayah tersebut.
