Abstract

Abstract: This paper aims to describe the process of compensation in the procurement of land for the public interest in the expansion of Sentani Airport, the legal implication that Ondofolo is not involved in the process of providing compensation for the procurement of land for public purposes, and the correct way of putting the role or position of Ondofolo in procurement of land for the just public interest. The study used a sociological juridical approach. The process of providing compensation in the procurement of land for public purposes in the expansion of a sentani airport involves ondofolo. The legal implications if Ondofolo not involved in the process of compensation for land acquisition for public purposes is a violation of the provisions of Article 43 of Law No. 21 of 2001 on Special Autonomy for Papua which has resulted in the validity of the decision of the government in acquiring the land. The role of Ondofolo in the procurement of land for the public interest is limited to affect the behavior of people in order to work together in realizing mutually agreed objectives for the creation of justice and the guaranteed rights of indigenous peoples both customary and constitutional of the Republic of Indonesia as long as it does not violate the rules applicable Abstrak:Tulisan ini bertujuan untuk mendeskripsikan proses pemberian ganti rugi dalam pengadaan tanah untuk kepentingan umum dalam perluasan Bandar Udara Sentani, implikasi hukum jika Ondofolo tidak dilibatkan dalam proses pemberian ganti rugi atas pengadaan tanah untuk kepentingan umum,  dan cara yang benar dalam meletakkan peran atau posisi Ondofolo dalam pengadaan tanah bagi kepentingan umum yang berkeadilan. Kajian menggunakan pendekatan  yuridis sosiologis. Pproses pemberian ganti rugi dalam pengadaan tanah untuk kepentingan umum dalam perluasan bandar udara sentani melibatkan ondofolo. Implikasi hukum jika Ondofolo tidak dilibatkan dalam proses pemberian ganti rugi atas pengadaan tanah untuk kepentingan umum adalah pelanggaran terhadap ketentuan Pasal 43 UU Nomor 21 Tahun 2001 tentang Otonomi Khusus Papua yang mengakibatkan tidak sahnya keputusan pemerintah dalam pengadaan tanah tersebut.  Peran Ondofolo dalam pengadaan tanah untuk kepentingan umum adalah sebatas mempengaruhi tingkah laku orang-orang supaya dapat bekerja sama dalam mewujudkan tujuan yang disepakati bersama demi terciptanya keadilan dan terjaminnya hak-hak masyarakat adat baik secara adat maupun secara konstitusional Republik Indonesia selama tidak melanggar aturan yang berlakuDOI : http://dx.doi.org/10.17977/um019v2i12017p064

Abstract

Sengketa pertanahan merupakan suatu permasalahan yang sudah banyak terjadi di berbagai daerah. Seperti halnya sengketa pertanahan antara PT. Sumber Sari Petung dengan masyarakat Kecamatan Ngancar, dimana tanah Hak Guna Usaha yang akan diperpanjang masa jangka waktu oleh PT. Sumber Sari Petung diduduki oleh masyarakat. PT. Sumber Sari Petung yang merasa dirugikan melakukan upaya untuk mencari kepastian hukum dan perlindungan hukum yakni dengan cara menggugat ke Pengadilan Tata Usaha Negara terkait dengan dikeluarkannya Surat Keputusan Kepala Badan Pertanahan Nasional Nomor 66/HGU/BPN/2000 yang berisi bahwa tanah Hak Guna Usaha yang diajukan permohonan perpanjangan oleh PT. Sumber Sari Petung dikurangi luas obyek tanahnya seluas 250 Ha dan selanjutnya akan di redistribusi kepada masyarakat di Kecamatan Ngancar khusunya di desa Sugihwaras, desa Sempu dan desa Babadan sebagai obyek landreform. Metode penelitian dalam penelitian ini menggunakan penelitian hukum normatif dan menggunakan pendekatan kasus. Hasil dari penelitian ini dapat disimpulkan bahwa konsekuensi dari permohonan perpanjangan jangka waktu Hak Guna Usaha yakni dapat dikabulkan dan tidak dikabulkan, sehingga keputusan dari Pengadilan Tata Usaha Negara mengenai pembatalan Surat Keputusan Nomor: 66/HGU/BPN/2000 tentang Pemberian Hak Guna Usaha atas Tanah yang terletak di Kabupaten Kediri Propinsi Jawa Timur pada tanggal 18 Desember 2000 menjadi non executable dan Badan Pertanahan Nasional memiliki kewenangan untuk meredistribusikan tanah kepada masyarakat.

Abstract

This article has the intent and purpose to find out the implementation of PRONA systematic land registration for the deed of transfer of land rights that are tax payable, specifically related to Income Tax (PPh) and Land Acquisition Fees (BPHTB) which are the obligations of the parties and are registered through systematic land registration was carried out in Ternyang Village, Sumberpucung District in 2009. However, the obstacles that occurred in the field were different from the turus hamlet, the village community was more cooperative regarding physical data. Nature in Ternyang village is indeed a lot of uneven shape, so it takes more time, to determine the appropriate land boundaries. Bookkeeping of rights or storage of documents constituting evidence shall be marked with identification and kept at the Land Office as an integral part of the general register. In accordance with the provisions of Government Regulation Number 24 of 1997 concerning Land Registration, article 39 paragraph (1) point g, PPAT/PPATS may not sign the deed before the tax obligations are fulfilled and the official who gives the land rights before the tax obligations are fulfilled.How to cite item: Crisantika, Y., Koeswahyono, I., Supriyadi, S. Abstract

Resistance to neoliberal legal reforms has increased globally in recent decades due to the failure of water privatization to ensure affordable and sustainable water access in the global South. Referring to the 2004 and 2019 Water Resources Laws, this paper explores how, in the case of Indonesia, the law reproduces and normalizes neoliberal ideologies that frame water as an economic commodity. We argue that Indonesia's current legal regime governing water resources is based on populist rhetoric of fulfilling the human right to water through state management. However, the adopted water governance regime aims to facilitate the establishment of a climate conducive to private sector investment by shifting responsibility for the fulfillment of the human right to water from the state to a market-based allocation system. This paper examines the strategy adopted by the government in securing the water privatization agenda when dealing with judicial activism that requires water to be managed as a public good.

Abstract

The Sale and Purchase of the mortgage lending object is intended to pay off the loan from the debtor. Based on the background, then as for the formulation of the problem of writing is a. How does the validity of the sale and purchase of the object of guarantee of mortgage rights by the bank conducted without through the auction mechanism? b. What are the legal consequences for the sale and purchase of the mortgage guarantee object by the bank which is conducted without the auction mechanism? The research method used is normative juridical research with approach approaches statute approach, conceptual approach, case approach (Case Approach). The result of this research is the Sale and Purchase of the object of mortgage guarantee which is done under the hand and without the debtor's consent is a unlawful act where the sale and purchase of the mortgage security object is contrary to the provisions set forth in Article 6 and Article 20 of Law no. 4 Year 1996 Concerning the Rights of Consumers therefore the sale and purchase of a guarantee maternity guarantee is null and void or it is deemed that there has never been any sale. Furthermore, the Sale and Purchase of the underwriting object under the hand is contrary to Article 20 paragraph 1 (one), paragraph 2 (two), and paragraph 3 (three) of Law no. 4 of 1996 Concerning the Deposit Rights shall have legal consequences for the Creditor as the seller and PPAT as the Officer making the Sale and Purchase Certificate as well as for the Buyer who has good trade

Abstract

In the process of buying and selling land as the basis for the transition of land rights from the seller to buyers in the area of Bolaang Mongondow, especially in Lolak Village District Lolak is done in two ways, namely the process of buying and selling as in general the sale and purchase of land ownership is a unity of land and buildings and plants above it and the process of buying and selling of land is not a unity between the land and buildings and plants above it or the sale and purchase by using the principle of separation horizontal is separate sale and purchase. However, in the development of the practice of the process of buying and selling land that is considered as part of the process of buying and selling property rights on customary land or customary law, it raises legal problems, the process of buying and selling property rights on land that can not provide legal protection of the status of property in full for the buyer in the land and enjoy the benefits and functions of the land itself.

Abstract

This study entitled Legal Certainty of Electronic Certificates Based on the Implementing Regulations of Law Number 11 of 2020 concerning Job Creation with 2 (two) main problems, namely: (1) What is the strength of proof of electronic certificates in the event of a land dispute regarding dual certificates? (2) How about legal certainty. Electronic certificates in Indonesia before and after the enactment of Law Number 11 of 2020 concerning Job Creation? This research is a type of legal research with normative juridical research methods. Besides, this research uses a statutory approach and a conceptual approach. The results of this thesis research indicate that the land registration procedure to obtain an electronic certificate must refer to the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency no. 1 of 2021 concerning Electronic Certificates in accordance with the provisions of article 2 regarding the implementation of electronic land registration and also explained in article 6 for land that has not been registered and the replacement of certificates into electronic certificates for those that have been registered and clarified again in Government Regulation number 18 of 2021 concerning Management Rights , Land Rights, Flat Units and Land Registration, article 84 jo. Article 87 specifically regulates the implementation of land registration but for land that has not been registered and does not have a certificate, the registration process refers to Government Regulation number 24 of 1997 concerning Land Registration because only in the regulation it is regulated about land registration for the first time and systematic land registration until registration.

Abstract

AbstractThe essential meaning of the comparison of land management system in several countries: China, Ghana, Ethiopia and Indonesia relates to ideas in the framework of social justice land arrangement in an effort to find similarities and differences between the laws of land being compared. In addition, it provides an objective rational explanation of the causes of differences both in philosophy, conception, legal politics, regulation and equality between land laws in the three countries. With a conceptual and comparative approach, using the theory of access to obtain justice, this study aims to broaden the horizons for the study of land law that philosophy and conception of national land law (HTN) based on Customary Law with methods of adaptation and integration of the philosophy of Pancasila into Customary law and law national land is a necessity so that the goal of reforming the national land law access to reform and asset reform can realize the essence of social justice. AbstrakMakna komparasi pengaturan penataan pertanahan di beberapa negara: Cina, Ethiopia, Ghana serta Indonesia berkaitan dengan ide/gagasan dalam kerangka penataan tanah yang berkeadilan sosial sebagai upaya mencari persamaan dan perbedaan di antara hukum tanah yang diperbandingkan. Di samping itu, memberikan penjelasan secara rasional obyektif penyebab terjadinya perbedaan baik secara falsafah, konsepsi, politik hukum, pengaturan dan persamaan di antara hukum tanah pada tiga negara tersebut. Dengan pendekatan konseptual dan komparatif, menggunakan teori akses untuk memperoleh keadilan, kajian ini bertujuan untuk memperluas cakrawala pandang bagi pengkajian hukum tanah bahwa falsafah dan konsepsi hukum tanah nasional (HTN) berbasis Hukum Adat dengan metode adaptasi dan integrasi filosofi Pancasila ke dalam hukum Adat dan hukum tanah nasional merupakan sebuah keniscayaan agar tujuan pembaruan hukum tanah nasional akses reform dan asset reform mampu mewujudkan esensi keadilan sosial.

Abstract

The Law No.11 of 2020 On Job Creation is a new law that aims to facilitate investment initiated by the government of President joko widodo, in the regulation has expanded the rights to apartment units by foreign citizens. In this context, the issuance of these regulations is important to ensure legal certainty, justice and expediency. This article explores the expansion of property rights to the unit flats associated with the principle of nationality in Law No. 5 of 1960 on agrarian principles. In the expansion of property rights to units of flats by foreign nationals in the job creation law should not ignore what is the purpose of the construction of flats in Indonesia.
