Abstract

Indonesia is a country abundant in natural resources and human resources, aiming to provide prosperity for its people. The need for credit and the provision of credit facilities require collateral. The government has established a credit guarantee institution capable of providing legal certainty and legal protection. One of these institutions is the Mortgage Rights institution regulated by Law Number 4 of 1996 concerning Mortgage Rights on Land and Related Objects (UUHT). In the city of Balikpapan, East Kalimantan, there is a legal product in the field of land management based on regional autonomy, adhering to the principle of decentralization that grants authority through the enactment of Regional Regulation Number 1 of 2014 concerning State Land Opening Permits, known as "Izin Membuka Tanah Negara" (IMTN). IMTN is a permit granted by the Mayor or designated official to individuals or legal entities to open and/or utilize state-owned land directly controlled by the government. In this Regional Regulation, it is explicitly stated that IMTN cannot be used as collateral for debt transactions. However, in Balikpapan, there are still cooperatives or financing institutions that accept IMTN as collateral, binding it with a credit guarantee that is subsequently accompanied by an additional agreement known as "Surat Kuasa Membebankan Hak Tanggungan" (SKMHT). The existence of collateral with IMTN as the object is not permitted, as IMTN serves as administrative evidence for the initial proof of land rights ownership in Balikpapan. IMTN can later be processed to become land rights (Ownership Rights, Building Utilization Rights, Right to Use), which has led Notaries and Banks to accept IMTN as collateral.

Abstract

Villages hold a strategic position in harnessing tourism potential as part of regional autonomy at the regency and city levels. Such development efforts can yield substantial economic gains and enhance the welfare of local communities. Despite this, the existing legal framework confines the authority to carry out land acquisition for tourism area development solely to four entities: the central government, regional administrations, state-owned enterprises (“BUMN”), and regionally owned enterprises (“BUMD”). As a result, village governments and village-owned enterprises face limitations in developing village tourism areas. This study employs a normative juridical approach, integrating conceptual and statutory methods. The findings indicate that strengthening decentralization and focusing on rural development present opportunities to empower village governments and village-owned enterprises with the authority to acquire land. The restriction of land acquisition for tourism areas to the central government, regional governments, SOEs, and ROEs is becoming increasingly irrelevant. Village tourism areas possess more significant economic potential when managed directly by village governments and village-owned enterprises, with active involvement from local communities. Therefore, a legal reconstruction is necessary to expand the entities authorized to acquire land for village tourism development. This can be achieved by harmonizing relevant legislation, particularly Law No. 2 of 2012, in conjunction with Law No. 6 of 2023 and Government Regulation No. 11 of 2021. Such harmonization will support village governments and village-owned enterprises in realizing effective, sustainable, and inclusive village tourism development.

Abstract

This study examines the agrarian conflict in Tanea Village, South Konawe Regency, Southeast Sulawesi, which originated from an overlap between community ownership certificates and claims to protected forest areas based on the Decree of the Minister of Agriculture No. 639/Kpts/Um/9/1982 (TGHK). The designation of forest areas without community involvement has created legal uncertainty, restricted access, and the potential for criminalization of farmers. This study uses a socio-legal method with a sociological juridical approach through a normative review of regulations (UUPA, Forestry Law, PP 23/2021, PP 43/2021, Permen LHK 7/2021, MK Decision No. 34/PUU-IX/2011) as well as an empirical study of rights holders, BPN officials, BPKH, and agrarian-forestry experts. The results show that the conflict was triggered by regulatory disharmony, data asymmetry between agencies, dualism of authority, weak evidence of ownership, and the absence of community participation in determining area boundaries. Legal protection efforts can be pursued preventively through negotiation, mediation, and regulatory boundary change mechanisms, or repressively through lawsuits to the State Administrative Court (PTUN). This research emphasizes the importance of community participation in forest boundary inventory, optimizing the One Map Policy, and synchronizing digital data between agencies to achieve fair and balanced legal certainty for both the community and the state.

Abstract

Indonesia possesses the world’s largest nickel reserves, positioning the commodity as a key strategic natural resource—often classified as a critical mineral. Based on Article 33 of the 1945 Constitution, the governance of natural resources, including nickel, must be carried out fairly and sustainably to benefit the people's welfare. The policy of nickel downstreaming, particularly through the development of smelter industries, represents one expression of state sovereignty over natural wealth. Nonetheless, the execution of this policy presents several challenges, including environmental degradation, unequal distribution of economic gains, and reliance on non-renewable, polluting energy sources like coal. This study adopts an economic analysis of law framework to evaluate the efficiency and effectiveness of Indonesia’s nickel downstreaming regulations. Using a normative juridical method with statutory and conceptual approaches, the research finds that although current regulations formally demonstrate state sovereignty, they fall short in upholding the constitutional principles of sustainability and social justice. The policy has, in practice, led to environmental harm and socio-economic disparities among impacted communities. From an economic analysis of law perspective, the downstreaming strategy has yet to achieve optimal economic efficiency, fair benefit distribution, and proper handling of negative externalities. As such, regulatory reform is essential to ensure legal certainty, promote environmental preservation, and reinforce social welfare through mining downstream policies, including those related to nickel.

Abstract

The regulation of land area for plantation cultivation rights (Hak Guna Usaha/HGU) has changed from 1960 to 2023. Paradigm theory is one of the theories that examines why and what reasons lie behind written regulations. When legal changes occur, a paradigm shift also takes place. This article addresses the issue of what paradigm is used to determine the land area for plantation cultivation rights in several laws and whether a paradigm shift has occurred. A normative research method is chosen to examine the provisions regarding the land area of cultivation rights in four laws. The analysis uses a systematic, conceptual, and historical approach. This study shows a shift in paradigm in the granting of cultivation rights, particularly from 1960, which emphasized social justice, to 2023, which prioritizes economic interests.

Abstract

The Sovereignty Principle in the Plantations Law legalizes dynamics that disproportionately empower plantation companies while disenfranchising indigenous peoples. Under this principle, plantation permits are granted to companies, not indigenous communities, limiting the latter's involvement in mandatory deliberations set by the law. Consequently, indigenous peoples are coerced into relinquishing their lands in exchange for compensation, leading to the erosion of their collective land rights. This practice is at odds with the protections intended under Article 28D Paragraph (1) and Article 28H Paragraph (2) of the 1945 Constitution of Indonesia, which safeguard collective rights to property. The lack of political will to recognize and protect these rights suggests a troubling disregard for the existence and sovereignty of indigenous peoples.

Abstract

This article aims to determine legal consequences and remedies not filling the provisions of article 74 paragraph 1 of law number 20 year 2011 jo article 54 paragraph 1 of government regulation number 4 of 1988 concerning the association of the occupants unit of flats, using normative legal research methods, through approach to legislation, conceptual and comparison in order to obtain the views an doctrines as a basis legal arguments on legal issues studied. Based on the survey result revealed that, with no formation of associations of occupant flats units, then the resident will lose the right to enjoy a sense of comfort, easy, safe, orderly and organized the principles in the flats. According to article 107 flats legislation may be subject to adminisrative sanctions contained in article 108 of the law enactment flats in stages, ranging from a written warning to revocation of business license. Remedies that can be given the resident can do prosecution by first reporting to the local authorities for further prosecution to the developer. According article 75 paragraph 1 law flats: ”development actors are required to facilitate the formation of associations occupant apartment units at the latest before the transitional period ends. In article 59 paragraph 2”. The transitional period a maximum of one year since the first delivery of flats units to the owner.

Abstract

The legal position of the Minutes of Boundary Documents contains many legal instruments against the state's right to control over forest areas, but this is often misunderstood, causing legal uncertainty, especially the legal position in the trial of proving ownership, for this Minutes of Boundary Demarcations need to be studied further, especially regarding certainty and classification. evidence in civil procedural law. This research is a normative juridical research, using a statutory approach. The conclusions that can be drawn from this research are, firstly, the existence of Minutes of Boundary Demarcation is not merely authentic evidence but an instrumental constitutional authority for the state to control forest areas, and contains three aspects, juridical, historical and sociological.

Abstract

Pertanian organik di Malang Raya menghadapi berbagai tantangan struktural dan regulatif, mulai dari keterbatasan lahan, minimnya pemahaman hukum, hingga kendala dalam sertifikasi dan pengakuan legalitas usaha yang membatasi akses pasar serta keberlanjutan usaha petani. Padahal, kawasan ini memiliki potensi besar dalam pengembangan pertanian organik sebagai strategi utama untuk mewujudkan ketahanan pangan berkelanjutan. Kurangnya pengetahuan petani terhadap aspek hukum, kelembagaan, dan perlindungan usaha kerap menyebabkan kesulitan dalam memperoleh dukungan regulatif, kemitraan bisnis, maupun perlindungan hak hukum. Menanggapi persoalan tersebut, kegiatan pengabdian kepada masyarakat ini dilaksanakan untuk memperkuat legalitas dan kapasitas hukum petani organik di Malang Raya. Kegiatan ini bermitra dengan Lembaga Pengembangan Pertanian Nahdlatul Ulama (LPPNU) Kota Malang sebagai pendamping lapangan dan fasilitator komunitas petani, serta Lembaga Penyuluhan dan Bantuan Hukum Nahdlatul Ulama (LPBHNU) Kota Malang sebagai mitra penyelenggara penyuluhan dan advokasi hukum bagi petani. Pendekatan yang digunakan bersifat partisipatoris dengan 2 (dua) metode utama: Focus Group Discussion (FGD) untuk mengidentifikasi hambatan struktural dan regulatif, serta workshop sebagai sarana sosialisasi hukum dan penguatan kapasitas usaha. Workshop menghadirkan 6 (enam) narasumber lintas bidang yang membawakan materi tentang sertifikasi dan legalitas usaha, pengembangan bisnis, pembentukan badan hukum, kontrak dan perlindungan HKI, manajemen keuangan sederhana, serta pendampingan izin dan sertifikasi halal. Hasil kegiatan menunjukkan terdapat peningkatan terhadap kesadaran hukum dan pemahaman peserta. Mayoritas petani menilai materi yang disampaikan berada pada kategori baik hingga sangat baik, menandakan relevansi kegiatan dengan kebutuhan riil di lapangan. Program ini diharapkan dapat berkontribusi nyata dalam memperkuat fondasi hukum, ekonomi, dan kelembagaan petani organik di Malang Raya, serta menjadi praktik kolaboratif antara perguruan tinggi, LPBHNU, dan LPPNU Kota Malang dalam mendorong terwujudnya sistem pertanian organik yang berdaya saing, berkeadilan, dan berkelanjutan sebagai pilar ketahanan pangan lokal.
