Abstract

Land is an important resource that controls the livelihoods of many people. Land has social, economic, cultural and even spiritual value. The presence of the state based on Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945) is to regulate land allocation in a fair manner. This is also stated in the UUPA. However, since the presence of the Land Bank, it has actually triggered problems, especially in the normative order, in this case what is highlighted is the conflict of norms. Leads to two problem formulations. First, what is the essence of the Land Bank's regulation as a body that is given the authority to manage land? Second, what are the legal implications of regulating the Land Bank as a body given the authority to manage land? Using normative legal research methods, with a statutory statute approach and theoretical approach. The resulting analysis shows that the current Land Bank regulations in Law no. 6 / 2023 in conjunction with PP No. 64 / 2021, turns out to have closer economic nuances. This also shows a lack of harmony with Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia, UUPA and the objectives of agrarian reform. This regulation has legal implications, both philosophically, normatively and sociologically. Therefore, it is necessary to evaluate and reorganize Land Bank regulations in Indonesia so that they provide legal certainty and more equitable use.

Abstract

This thesis is entitled "Management Rights in Underground Spaces After the Enactment of Law Number 11 the Year 2020 concerning Job Creation and Implementing Regulations" with 2 (two) main problems, namely, (1) How is the Legal Certainty regarding the Granting of Permits and Limitations on the Use of Utilization? Basement? What is the legal status of basements after the enactment of Law Number 11 of 2020 concerning Job Creation and its Implementing Regulations? This research is a type of legal research with normative research methods. Besides, this research uses a statutory approach and a conceptual approach. The results of this thesis research indicate that the legal certainty of granting permits in terms of the use of underground spaces is based on Law no. 11 of 2020 concerning Job Creation, Article 146 Land or space formed in the upper and/or underground space and used for certain activities may be granted building use rights, use rights or management rights, in this case granting rights to the utilization of the underground space. based on the Basic Agrarian Law. Restrictions on the use of the authority of those who use it are limited by the existence of procedures that must be met in terms of the use of basements and the depth limit stipulated in the Implementing Regulation of the Employment Creation Act, Article 74, namely with a height limit according to the basic coefficient of the building and the floor of the building as well as a depth limit of 30. meters from the surface of the land that can be reached by the process of registering rights through the granting of rights that take into account/consider the holders of land rights under and/or above it. The arrangement for the acquisition of the right to use the basement is regulated in Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Flat Units, and Land Registration Article 77, namely, Upper Land or Ground Spaces may be granted Management Rights, Building Use Rights, or Right of Use after the Upper Ground or Underground Space is utilized. The granting of rights is granted by a decision on granting rights by the Minister. The regulation regarding land rights is guided by the Basic Agrarian Law.

Abstract

This research aims to study the protection of agricultural lands regarding land procurement and airport development that has taken place since the issuance of the Decree of the Governor of Yogyakarta Number 68/KEP/2015 on 31 March 2015. This has left impacts on some farmers who have lands, sharecroppers, and peasants. On the other hand, Article 36 of Law Number 2 of 2012 concerning land procurement for the development of public facilities states that compensation can be given in the form of a. money, b. substituting land; c. substituting residence; d, share ownership; or e, another form of compensation agreed by the two parties. This does not ensure that the right holders can freely choose the form of compensation needed. This research employed empirical and socio-juridical methods involving direct observation to gain data that revealed the impacts and measures of protecting agricultural lands. The data were obtained by conducting interviews with Regional Land and Spatial Planning Agency, National Land Agency, the sub-district office, and affected farmers. The data were analyzed based on descriptive qualitative methods, revealing that the measures taken to protect agricultural lands in the case of giving compensation in land procurement for public facilities are not appropriately implemented. This is obvious in the observation results, reporting that the compensation given still leaves impacts on the farming community.

Abstract

This paper aims to describe the authority of the Financial Services Authority (OJK) in conducting supervision and regulation of the financial services sector, and the juridical implications of Government Regulation Number 11 of 2014 concerning OJK Levy for capital market notaries registered with Registered Letters (STTD) who are not active in the capital market. The research method used in this paper is a normative juridical. The results of the study indicate that the OJK has the authority to levy notaries. Legal implications arising from Government Regulation Number 11 of 2014 concerning Financial Services Authority Levies for notaries who have STTD but do not engage in capital market activities becomes the state’s receivables. Payments will be made by the state receivable committee, with a forced letter that has the same legal force as the Grosse deed.

Abstract

This study aimed to analyze the obstacles to the settlement of inheritance disputes in the Kajang indigenous people and the efforts to settle inheritance disputes in a just manner in the Kajang indigenous peoples. The type of research used in this study was empirical juridical with an anthropological approach—sources of data obtained from primary and secondary legal materials. Data collection techniques were carried out through interviews. The data obtained were analyzed using descriptive methods. The results of this study indicated that the obstacles to the settlement of inheritance disputes in the Kajang indigenous people were the parties making false confessions, insisting on defending their rights and social status, tending to be emotional, and lacking firmness from the mediator. Efforts to settle inheritance disputes that were fair to the indigenous people of the Kajang tribe are carried out based on local wisdom based on pasang ri kajang through three stages, namely deliberation at the hamlet head level, mediation by the village head, and the customary justice institution.

Abstract

There is ambiguity in the regulation for granting HGB term extensions. Article 35 of the UUPA do not recognize the granting of an extension "all at once", whereas in Article 145 of Law Act No. 6 / 2023 provides provisions for granting extensions “all at once”. There are two problems focuses. First, how are the current regulations regarding granting term extensions? Second, what will be the future regulations regarding granting an extension of the term of building use rights for flats that will provide more legal certainty? The main purpose in this research is to analyses inconsistency about the regulation on HGB. Using normative legal research, with statute approach and conceptual approach. The result in this research, current regulations for granting HGB periods, it turns out that there is a lack of clarity in the regulations. Moreover, what is regulated in Article 145 Law Act No. 6 / 2023 is not in line with Article 33 paragraph (3) UUD NRI 1945. Therefore, future regulations must be developed with linear consistency with the regulatory direction of Article 33 paragraph (3) of the UUD NRI 1945, UUPA, and even the Constitutional Court jurisprudence to provide legal certainty.

Abstract

Pemanfaatan energi fosil telah berkontribusi mempercepat laju perubahan iklim global dan mengancam keselamatan manusia di masa mendatang. Untuk mengurangi dampak energi fosil perlu dilakukan transisi energi berupa pemanfaatan energi terbarukan. Namun permasalahan saat ini belum terdapat regulasi yang mengatur secara komprehensif kebijakan energi terbarukan sebagai modal transisi energi. Sesuai konsep hak menguasai negara atas sumber daya alam, harusnya negara mampu mengelola energi terbarukan guna mewujudkan transisi energi. Penelitian ini bertujuan untuk mengonstruksikan kebijakan hukum energi terbarukan sebagai modal transisi energi yang berkelanjutan berdasarkan konsep hak menguasai negara. Metode penelitian yakni yuridis normatif dengan pendekatan peraturan perundang-undangan dan konseptual. Penelitian ini menghasilkan tiga kesimpulan. Pertama, hak menguasai negara merupakan basis konstitusional dalam pemanfaatan energi terbarukan guna mewujudkan transisi energi. Kedua, pengaturan UU Nomor 30 Tahun 2007 tentang Energi masih memprioritaskan pemanfaatan energi fosil dalam memenuhi energi nasional, sehingga tidak selaras untuk mewujudkan transisi energi. Ketiga, perlu mengaktualisasikan konsep hak menguasai negara dalam bentuk pembaharuan undang-undang energi dengan mengakomodasi kebijakan pengelolaan, pengembangan, dan pemanfaatan energi terbarukan yang berorientasi pada transisi energi berkelanjutan.

Abstract

Food Resilience is a critical aspect of national sustainability programs. Indonesia has a large and diverse population necessitates prioritizing food resilience as a primary focus of government programs. Food security can be achieved by empowering the predominantly farming population of Indonesia. In this regard, the government can utilize Absentee Land to achieve food resilience goals and improve the welfare of farmers. However, the utilization of Absentee Land is hindered by regulations restricting land ownership to civil servants. These regulations pose a significant obstacle to farmers who seek to engage in or expand agricultural endeavors. The conflicts arising from these regulations constitute the most substantial barrier to farmers' efforts to realize food resilience programs in Indonesia. This research uses a normative legal research method, focusing on the Absentee Land through statutory and case approaches. The results of this research indicate that regulations regarding Absentee Land has no longer relevant given the current state of affairs, as they impede the maximization of food resilience, particularly for farmers in the agricultural sector. Abstrak Ketahanan pangan merupakan hal yang sangat penting dalam program keberlangsungan bangsa. Populasi besar dan sangat beragam yang ada di Indonesia menjadikan ketahanan pangan ini harus menjadi prioritas utama dalam program pemerintah. Ketahanan pangan ini dapat diterapkan dengan cara memberdayakan masyarakat Indonesia yang kebanyakan berprofesi sebagai petani. Dalam hal ini pemerintah bisa memanfaatkan Tanah Absentee dalam mencapai tujuan ketahanan pangan dan dapat mensejahterakan petani. Namun dalam pemanfaatan tanah Absentee ini masih terhalang oleh peraturan yang menghambat kepemilikan tanah Absentee untuk para petani. Adanya peraturan tentang kepemilikan tanah Absentee yang hanya dapat dimiliki oleh Pegawai Negeri Sipil menjadi halangan bagi petani yang akan menjalankan atau mengembangkan usaha dalam pertanian. Konflik dalam peraturan kepemilikan tanah Absentee ini adalah hambatan terbesar dalam usaha petani mewujudkan program ketahanan pangan di Indonesia. Penelitian ini akan menggunakan peneltian hukum normatif, dimana dalam studi ini akan menggali penelitian dari tanah Absentee dengan menggunakan pendekatan Perundang-undangan dan pendekatan kasus. Hasil dari penelitian ini bahwa peraturan yang mengatur tentang tanah Absentee ini sudah tidak relevan diterapkan dengan keadaan saat ini karena ketahanan pangan sektor pertanian khususnya bagi petani tidak dapat dimaksimalkan.

Abstract

This study is legal research aiming to find out the essence of Divine Principles in Indonesian Contract Law from the review of the Natural Law theory, the Sunt-Servanda theory, the Awareness and Legal Obedience Grundnorm theory, and Truth theory. This research reveals that the Divine Principle's essence is the most fundamental principle or guideline derived from God but exists in humans, aiming to find the truth and regulate the parties in making agreements. The application of the Divine Principle aims to find the truth and regulate the parties in the agreement's field.  Indonesian citizens could realize and practice the Precepts of Godhead in their agreement activities. In establishing the agreement, the parties are applying the teachings of their respective religions. This study reveals that the Divine principle needs to be incorporated into one of the upcoming National Agreement Laws principles, especially in the contract born because of the agreement. This study maintains that the divine principle can be applied comprehensively for Indonesian citizens who are parties to the agreement, not only limited to the Indonesian Muslim citizens.
