Abstract

Conditions in Indonesia show that cases of violence, crime, and sexual harassment are increasing. Sexual violence not only occurs against adults but also against children. Children are vulnerable to becoming victims of sexual violence, this is because they are in a weaker position and cannot protect themselves. This study aims to determine the role and service mechanisms of the UPTD PPA Jember Regency in providing legal protection to child victims of sexual violence, and to determine the inhibiting and supporting factors of the UPTD PPA Jember Regency in implementing protection for child victims of sexual violence. The empirical legal research method uses two approaches, namely the Legal Approach and the Sociology of Law. The location of this research is the Regional Technical Implementation Unit for the Protection of Women and Children of Jember Regency, the research subjects are UPTD PPA companion officers, parents/guardians of victims, and child victims. Primary data sources were obtained through interviews, observation, and documentation, while secondary data are divided into two forms, namely primary legal materials and secondary legal materials. Data collection was carried out through data reduction, data presentation, and drawing and verifying conclusions. The researcher used descriptive analytical techniques for primary and secondary data.

Abstract

Corruption in Indonesia has been classified as an extraordinary crime; however, the absence of an illicit enrichment offense has resulted in law enforcement primarily targeting the symptoms of corruption rather than its root cause, namely the accumulation of disproportionate and unexplained wealth. This condition creates an urgent need to examine the potential criminalization of illicit enrichment while ensuring the protection of human rights. This study aims to analyze the construction of legal policy in Indonesia and Poland and to assess the extent to which criminal law policies concerning illicit enrichment in both jurisdictions integrate fundamental principles of criminal law and human rights within their normative design. The research employs a normative legal method, applying both comparative and conceptual approaches. The findings indicate that Indonesia remains in a transitional phase between the orientations of state efficiency and defendant’s rights, whereas Poland places greater emphasis on rights protection through the mechanism of extended confiscation. The criminalization of illicit enrichment can only be justified if it is formulated with precision and proportionality in order to maintain a fair balance between the effectiveness of anti-corruption enforcement and the protection of fundamental human rights.

Abstract

Ketentuan amnesti merupakan salah satu dari 4 (empat) bentuk pengampunan yang merupakan hak prerogatif Presiden berdasarkan Pasal 14 UUD NRI 1945. Selain tersurat dalam Pasal 14 ayat (2) UUD NRI 1945 dan Pasal 1 dan Pasal 4 UU Darurat RI Nomor 11 Tahun 1954 tentang Amnesti dan Abolisi, sebagai kebaharuan hukum pidana, amnesti merupakan salah satu aspek yang membuat gugurnya kewenangan penuntutan sebagaimana tersurat dalam Pasal 132 ayat (1) huruf h UU 1/2023 tentang KUHP dan Pasal 71 ayat (2) huruf h UU 20/2025 tentang KUHAP serta Pasal 132 ayat (1) huruf h UU 1/2026 tentang Penyesuaian Pidana. Amnesti juga merupakan salah satu aspek yang membuat gugurnya kewenangan pelaksanaan pidana sebagaimana tersurat dalam Pasal 140 huruf c UU 1/2023 tentang KUHP. Tujuan penelitian ini untuk mengetahui kedudukan amnesti dalam sistem peradilan pidana demi terwujudnya supremasi hukum yang berkepastian dan berkeadilan.

Abstract

Detention under the Indonesian Criminal Procedure Code (KUHAP) is intended to function as a temporary, non-punitive procedural instrument to ensure the proper administration of criminal proceedings. However, the application of detention to individuals with psychotic mental disorders reveals a structural inconsistency between substantive criminal law and criminal procedure, causing detention practices to shift into a form of disguised punishment. This article adopts a normative-analytical approach to assess conceptual gaps within KUHAP, examine the implications of procedural incapacity, and evaluate the urgency of implementing medically rehabilitative detention grounded in international human rights principles. The study analyzes legal literature, national regulations, and forensic perspectives to trace the consequences of conventional detention practices for individuals with psychotic mental disorders. The findings indicate that standard detention not only fails to protect their rights but also heightens psychosocial risks, exacerbates mental conditions, and produces substantive injustice. This research underscores the need to reformulate KUHAP by recognizing procedural incapacity, implementing non-punitive detention based on medical rehabilitation, and integrating the principles of legal utility, substantive justice, and human rights protection. Such an approach is expected to bridge the gap between substantive criminal law and criminal procedure while affirming that the protection of the rights of individuals with psychotic mental disorders is not merely a domestic obligation but also a commitment to international human rights standards.

Abstract

Teachers may impose sanctions or Corporal Punishment on students for educational purposes. In several cases, the Corporal Punishment action taken by the teacher resulted in the imposition of criminal sanctions on the teacher. This paper describes the perspective of criminal law settlement in Corporal Punishment cases. This paper uses the normative juridical research method, which examines the application of positive legal norms. Hence, this paper interprets the corresponding law in the means of textually. Furthermore, researchers use a conceptual framework to illustrate a teacher's professional duties and Corporal Punishment. Finally, this research uses qualitative descriptive analysis supported by a case approach. This research found that applying life skill-based and contextual learning methods may prevent the aftermath of teachers' Corporal Punishment. Teachers, carrying out their professional duties, may avoid criminal charges for Corporal Punishment if these actions do not exceed reasonable limits, which result in student losses, both physically and psychologically. The functionalization of criminal law may be prevented using ultimum remedium in resolving Corporal Punishment cases. This may occur in settlement through restorative justice, which involves various parties in the educational process. Alternatively, criminal law settlement may be used in Corporal Punishment cases. Judges may apply the concept of individualized punishment in imposing sanctions on teachers who are proven guilty of Corporal Punishment. Finally, this paper recommends a psychological intervention to assess educators' mental capacity. This may take form through periodic assessments to determine the competence of teachers as educators.
