Abstract

The establishment of an independent state institution has different names, making it unclear in its accountability, through the third amendment to the 1945 Constitution of the Republic of Indonesia it was agreed that the formation of a Judicial Commission based on Article 24B Judicial Commission is independent, this does not give meaningful meaning to its institutional status , The Judicial Commission is clearly closer to the function of judicial power, because the Judicial Commission (KY) regulation is in the 1945 Constitution of the Republic of Indonesia (UUD NRI). In addition, there are also institutions that are at the same level as the Judicial Commission, namely state institutions. independent which has the same level of function. Unlike the Judicial Commission, these three institutions are not regulated in the constitution, namely the Attorney General's Office, the Corruption Eradication Commission, and the National Human Rights Commission. However, the regulation stipulated by article 24 paragraph (3) which states "Other bodies whose functions are related to judicial power are regulated in law" So that becomes a problem. This raises a big question why only the Judicial Commission is regulated in the Constitution?This research uses a typology of normative legal research or what is also called doctrinal legal research, which deals more specifically with legal principles. In this study the authors use descriptive research characteristics, because the authors describe the Regulatory Arrangement of Independent State Institutions in the Structure of the Indonesian State Administration System.The result of the research conducted by the author is that there must be regulation arrangement in an effort to equal position by regulating these independent state institutions including the Attorney General's Office, Komnas Ham, and the Corruption Eradication Commission in the Constitution. Abstract

Rokan Hulu Regency is famous for its religious tourism with the construction of Madani Islamic Center Mosque which is visited by thousands of visitors from different regions every week. To support the characteristic of this religious tourism area, it was planned to cultivate the date palms which was inspired by the Holy Qur'an to increase the income and welfare of the community of Babussalam Village. In relation to the introduction of relatively new date fruit cultivation in Indonesia, socialization and counseling on the potential of date palms and village rules concepts in line with green constitution were necessary. This counseling aimed to provide guidance to the community of Babussalam Village Rokan Hulu District Rokan Hulu as a village that has a program of cultivation of date palms through village regulations and to improve the living standards of villagers in Babussalam as well as a pilot village of dates cultivation. Based on the five indicators (increase of participant's knowledge, the activity of the participants, the suitability of the training materials to the needs of the participants, the impact of future activity implementation and the participation rate based on the number of participants), the activity is considered successful and can improve knowledge, motivation and  of community and the apparatus of Babussalam village in implementing date palm cultivation as a trade mark for Rokan Hulu Regency as a religious tourism destination in the future.

Abstract

Proporsi perempuan sangat sedikit bila dibandingkan dengan proporsi laki-laki. Keterwakilan perempuan dalam bangku legislatif dapat dikatakan salah satu manifestasi persoalan hukum terkait diskriminasi hak asasi manusia bagi gender perempuan. Persoalan ketimpangan gender tercemin jelas dalam rendahnya keterwakilan perempuan di struktur lembaga perwakilan Indonesia, khususnya dalam Dewan Perwakilan Daerah. Rumusan masalah yang akan dibahas adalah Bagaimanakah Implikasi Putusan Mahkamah Konstitusi Nomor 30/PUU-XIV/2018 terhadap keterwakilan perempuan di dalam lembaga Dewan Perwakilan Daerah Republik Indonesia?. Penelitian ini merupakan jenis penelitian hukum normatif. Data yang digunakan dalam penelitian ini bersumber dari bahan hukum primer, bahan hukum sekunder dan dari berbagai referensi dan dokumen. Hasil penelitian yaitu Putusan Mahkamah Konstitusi 30/PUU-XIV/2018 terkait pelarangan pengurus partai politik menjadi anggota Dewan Perwakilan Daerah Republik Indonesia menjadi pemicu bagi perempuan untuk ikut andil sabagai anggota Dewan Perwakilan Daerah, dapat menyebabkan peningkatan peluang bagi perempuan untuk duduk di jabatan Dewan Perwakilan Daerah Republik Indonesia.

Abstract

Women and men have equal position in politics; women’s participation is highly needed. Such thing is due to the fact that there are many issues regarding women’s interests requiring women’s representation in legislative institutions as well as regarding the 30% quota for women in the election of legislative members in Riau Province in 2014-2019. This research focuses on the level of women’s political representation in the legislative general election in Riau Province 2014 - 2019. This was a normative legal research. The data source was from primary and secondary law materials, and result of library research from various references. The finding shows that the level of women’s representation increases as expected from the policy regarding women’s representation.

Abstract

The regions that will hold the election consist of 7 Provinces, 76 Regencies, and 18 Cities. One of them is Pekanbaru City. 5 pairs of Mayor of Pekanbaru 2017, in the implementation of campaign by all Mayor and Vice Mayor Candidates there is a violation involving parties that are prohibited by legislation to assist in campaign process.The purpose of writing this thesis are: First, law enforcement in Article 70 of Law Number 10 Year 2016 on the Election of Governors, Regents and Mayors in the election of Regional Heads and Deputy Heads of Regions simultaneously in Pekanbaru City, Second, law enforcement inhibiting factors in Article 70 of Law Number 10 Year 2016 on the Election of Governors, Regents and Mayors in the election of Regional Heads and Deputy Regional Heads simultaneously in Pekanbaru City, Third, the efforts made to overcome the obstacles of law enforcement in Article 70 of Law Number 10 Year 2016 About the election of Governors, Regents and Mayors in the implementation of the election of Regional Head and Deputy Regional Heads simultaneously in Pekanbaru City. The type of research conducted in this study the author uses the type of sociological law research, research location in this study is Pekanbaru City. Population and sample are all parties related to the problem under study. Sources of data used are: primary data, secondary data, data collection techniques using unstructured interviews.From the research results there are three main issues that can be concluded. Firstly, the enforcement of the law of Article 70 is not in accordance with the rules contained in the Law on Regional Head Election, Second, the Factor inhibiting law enforcement in Article 70 of Law Number 10 Year 2016 on the Election of Governors, Regents and Mayors in the Implementation of the Election of Regional Head and Deputy Head of Serentak Region in Pekanbaru City is: there is fear of loss of position, political interest factor, political promise given to ASN, Internal Panwaslu factor, Third, Efforts made to overcome obstacles Law Enforcement Article 70 Law Number 10 Year 2016 about the election Governor, Regent, and Mayor in the implementation of elections of Regional Head and Deputy Regional Heads simultaneously in Pekanbaru City are: Providing socialization to ASN / PNS, emphasizing to ASN / Civil Servants regarding their alignment only to the people's interest, monitoring ASN / Civil Servants so as not to eat political promises . Author suggestion, Firstly, It is expected that supervision done by law enforcers in the future is better, there should be no system of tolerance to the enforcement of election rules. Law enforcers are expected to perform their duties in accordance with the prevailing regulations, The existence of transparency of law enforcement in following up reports or findings are reported. It is expected that the revision of the legislation related to the sanctions either be criminal sanctions or administrative sanctions for candidate pair and ASN / Civil Servants and it is expected that the addition of provisions concerning membership of District / Municipal Panwaslu (human resources) amounting to only 3 people related to the provisions of Article 72 paragraph 2) point c of Law Number 15 Year 2011 regarding the Implementation of General Elections.Keywords: Law Enforcement - Election Implementation – Regional Head

Abstract

The issue of pedophiles needs more intensive and serious attention. In protecting the rights of children from rape victims, the Indonesian government through the Republic of Indonesia Law Number 17 of 2016 Application of Government Regulations in lieu of Indonesian Law on Child Protection. This means that Indonesia has legalized the castration penalty for perpetrators of sexual crimes. Castration punishment when linked to human rights (HAM), the castration penalty violates two principles that become the mandate of reform, namely the principle of human rights and democracy.This type of research can be classified into normative legal research, namely legal research conducted by examining library materials. This study examines the subject matter in accordance with the scope and identification of problems through a statute approach carried out by examining the laws and regulations relating to the legal issues examined.Conclusions that can be obtained from the results of the study are the reasons for castration being the choice of the country in the punishment of the offender it is deemed to have a deterrent effect on pedophiles. The ideal form of regulation of punishment for pedophile perpetrators in the perspective of human rights is the Government in the Pancasila mandate, 2 which says that humanity is just and civilized, so that in making a regulation regarding punishment given specifically pedophile perpetrators should be from the aspect of human rights perpetrators, not just talk about adopting existing regulations in other countries. that the ideal punishment for pedophiles is a life sentence, so that not being a predator becomes a deterrent effect for other actors who want to commit the crime.Keywords: Analysis, Castration Punishment, Child Protection, Human Rights

Abstract

Law Number 23 of 2014 concerning Regional Government is contained in Article 108 Letter I, Article 161 Letter I, which reads "what is meant by "recurring work visits" is the obligation of members of the Regency/Municipal DPRD to meet with their constituents regularly at every period. recess, the results of which meetings with constituents are reported in writing to political parties through their factions in the Regency/Municipal DPRD”. That DPRD members among others have the obligation to absorb, collect constituents' aspirations through regular working visits, accommodate and follow up on community aspirations and complaints. DPRD members and their representatives have their respective electoral districts or abbreviated as DAPIL. One example is in the constituency VI (six) of the downstream Indragiri Regency, there are 4 sub�districts that are members of the DAPIL, namely Keritang District, Reteh District, Sungai Batang District, and Kemuning District. Here the author specializes in Keritang District and Reteh District. Where the area is not translated by peopleso that there is omission in the area. Within the DAPIL there are several council members who have their respective sub-districts who are members of the DAPIL VI (six).This study uses a sociological legal research type. This research is descriptive in nature, namely research that seeks to systematically and carefully provide facts with certain population characteristics. The results of the research conducted by the authors of the implementation of the recess, especially in Keritang District, and Reteh District, Electoral District VI, Indragiri Hilir Regency have not been implemented or have not had good implications, where council members conduct recess only for formalities, recess implementation is also carried out in certain areas. Council members conduct a recess in the regions that win the most votes at the time of the general election. Abstract

Traffic and road transport in Indonesia has a very important and strategic role so that the organizers are controlled by the state, and its guidance is carried out with the aim of realizing the safe and smooth, safe, smooth and efficient traffic and road transport. In Indonesia the regulation on traffic and national road transport is regulated in Law of the Republic of Indonesia Number 22 Year 2009 on Traffic and Road Transportation. This law provides the basis and guidance on enforcement of traffic violations. The number of traffic violations in the Bengkalis District region from year to year is increasing, indicating the lack of public awareness in traffic order. The details of the number of violations obtained from the Police of the Republic of Indonesia Regional Riau Resort Traffic Unit Bengkalis Polres Year 2016 Violations 6,993, 2017 Violations 10,551.The type of research used by researchers is a type of sociological legal research, namely legal research conceptualized as a social institution that is in real terms associated with other social facts. The nature of this study is descriptive that is to provide accurate data about humans, legal factors, conditions or symptoms.From the research result Bengkalis community awareness level in the orderly traffic is still in the value of less and has not run optimally in accordance with the expected by traffic law. But the Bengkalis District Traffic Police has enforced the law against traffic violations, with repressive efforts that constitute activities covering two educative and juridical prosecutions. Educative act of repression in the form of reprimand and warning. While the jurisdiction is the action carried out by a ticket or a fine, legal awareness can be raised in several parameters, among others, in terms of the form of violation, the implementation of the law. Increased awareness of Bengkalis community law can basically be done through two ways, namely in the form of education. One of the efforts made is the direct socialization to the field, school, and directly to the village community. Abstract

Proscess dismissal is the examination of any claim by the President of the Court before the case was forwarded to a panel of judges. Dismissal procedure or the Consultative Meeting set in Article 62 of Law No. 5 of 1986 concerning the State Administrative Court. In this consultative meeting President of the Court examine whether a lawsuit lawsuit entry has met the requirements as regulated in Law No. 5 of 1986 concerning the State Administrative Court and whether the mandate of the Administrative court for trial. Therefore, it should be studied simultaneously on the First, Regulation dismissal procedures in the State Administrative Court by Regulation Legislation in Indonesia, the Second, the judges Still Continuing Examination Subject Matter of the Case are not included in the Administrative Dispute.This type of research used in writing this law is the law of sociological research. Population and sample is overall the parties relating to the issues examined in this study, the data source used, primary data, secondary data, and the data tertiary, data collection techniques in this study with interviews and literature study.The results showed that there are two main things that can be inferred. First, Regulation dismissal procedures in the State Administrative Court based on the laws and regulations in Indonesia, that the provisions of Article 62 Paragraph (1) of Law No. 5 of 1985 Jo Law Number 9 of 2004 concerning State Administrative Court governing dismissal procedures or consultative meeting is unclear, because the mechanism or procedure of checking the lawsuit is not regulated in detail, the presiding judge has the authority to carry out inspection of a lawsuit in the consultative meeting and examination preparation. Second. The judges Still Continuing Examination Subject Matter of the Case are not included in Dispute State Administration, the judges should look Evidence Section 100 Paragraph (1) of Law No. 5 of 1986 concerning the State Administrative Court, namely: a letter or writing, expert testimonies , witness statements, confessions of the parties and the knowledge of the judge. First author's suggestion, Article 62 Paragraph (1) No. 5 of 1986 which discusses theprocess of dismissal revised again in order to carry out the detailed process of dismissal referred to in Article 62 of Law No. 5 of 1986 concerning the State Administrative Court.Thus, in the process of dismissal of the lawsuit filed by the individuals and civil agencies clearly understand the functions of the dismissal process, so that individuals and civil legal entity is not harmed. Secondly, To the State Administrative Court to allow the dismissal to be effective. Abstract

Pedophilia occurs in various places, in several acts and various types ofperpetrators. Resolutions of this problem have not stop in one form. Using theconcept of Restorative Justice to achieve humanitarian justice is a concept thatwill be a progressive step in the settlement of non-criminal pedophilia. Thisresearch aims to: first, understand the current regulations for pedophiles inIndonesia, second, to find out the relevance of Restorative Justice to be applied inthe criminal prosecution of pedophilia in Indonesia.This type of research is classified as a normative study using concept ofRestorative Justice and correlation principle to approach the issues, secondarydata is used by collecting data from library research, analyzed by qualitativejuridical analysis and concluded using descriptive analytical methods.From this research we can conclude two main things. First, the currentregulations for pedophiles in Indonesia can now be found in the Criminal Code(KUHP) and Law Number 23 Year 2002 concerning Child Protection, which ischanged into Law Number 35 Year 2014 junto Act Number 23 of 2002 concerningChild Protection, which then underwent a second change with Act Number 17 of2016 concerning the Establishment of Perpu Number 1 of 2016 into Law.However, in this regulation, the punishment only focus on the detention of theperpetrators without considering other factors behind their actions, and did notprovide definitive protection for victims. Second, the relevance of restorativejustice (Restorative Justice) to be applied in Indonesia to pedophilia criminalcases in terms of several aspects such as; ethics and values of the Pancasila andIndonesia’s culture are not conflicted and can be coincide. So, the concept ofrestorative justice against pedophile perpetrators can be applied in Indonesiawith the right and appropriate arrangements.Keywords: Pedophilia, Restorative Justice, Children
