Abstract

Tindakan kekerasan dalam rumah tangga (KDRT) merupakan permasalahan serius yang sangat berdampak luas terhadap korban, khususnya perempuan. Minimnya pemahaman hukum di masyarakat menjadi salah satu faktor yang memperburuk kondisi korban KDRT. Kegiatan pengabdian ini bertujuan untuk meningkatkan pemahaman hukum kader PKK sebagai ujung tombak pencegahan KDRT di tingkat komunitas melalui sosialisasi Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga. Kegiatan dilaksanakan di Desa Pulau Busuk, Kabupaten Kuantan Singingi dengan melibatkan 20 kader PKK. Metode pelaksanaan menggunakan pendekatan partisipatif dan edukatif yang terdiri dari observasi awal, penyuluhan hukum, diskusi kelompok, serta evaluasi akhir. Hasil menunjukkan adanya peningkatan signifikan pemahaman peserta terhadap hak-hak korban dan prosedur pelaporan kekerasan dalam rumah tangga (KDRT), serta munculnya inisiatif pembentukan posko sahabat perempuan di desa. Pengabdian ini menegaskan bahwa dengan dukungan dan edukasi yang memadai, kader perempuan dapat berperan strategis dalam pencegahan kekerasan dalam rumah tangga (KDRT) di tingkat lokal.

Abstract

Permasalahan dalam pengelolaan pasar rakyat dan Pedagang Kaki Lima (PKL) di Kota Pekanbaru, khususnya di kawasan Pasar Kodim. Kota Pekanbaru sebagai salah satu sentra ekonomi di Sumatera menghadapi tantangan besar dalam mengatur pertumbuhan ekonomi, urbanisasi, dan kegiatan Peraturan Daerahgangan, termasuk penataan Pedagang Kaki Lima yang sering kali menimbulkan gangguan ketertiban, kemacetan, dan permasalahan kebersihan. Pemerintah Kota Pekanbaru telah mengatur pengelolaan pasar melalui Peraturan Daerah Nomor 09 Tahun 2014 tentang Pengelolaan Pasar Rakyat, Pusat Perbelanjaan, dan Toko Swalayan. Peraturan Daerah ini bertujuan untuk menata pasar secara menyeluruh, memberikan kepastian hukum bagi pedagang, dan mendukung pemberdayaan ekonomi lokal. Dalam konteks otonomi daerah, kajian terhadap Politik Hukum di balik pembentukan dan pelaksanaan Peraturan Daerah ini menjadi penting untuk memastikan kebijakan tersebut mampu mencapai keseimbangan antara kepentingan pemerintah daerah, masyarakat, dan hak-hak Pedagang Kaki Lima. Penelitian ini diharapkan dapat memberikan solusi komprehensif dan adil dalam pengelolaan pasar rakyat di Kota Pekanbaru. Penelitian ini termasuk kedalam penelitian Hukum Empiris, karena hendak mengetahui Politik Hukum pemberlakuan Peraturan Daerah Kota Pekanbaru Nomor 09 Tahun 2014 Tentang Pengelolaan Pasar Rakyat, Pusat Perbelanjaan Dan Toko Swalayan Pada Pedagang Kaki Lima di Pasar Kodim pekanbaru. Penelitian ini menganalisis peran Politik Hukum dalam kebijakan penataan Pedagang Kaki Lima (PKL) di Kota Pekanbaru, dengan fokus pada implementasi Peraturan Daerah (Peraturan Daerah) Kota Pekanbaru Nomor 09 Tahun 2014. Hasil penelitian menunjukkan bahwa Politik Hukum memegang peranan penting dalam menyeimbangkan kepentingan umum dan hak-hak Pedagang Kaki Lima sebagai bagian dari ekonomi informal. Regulasi ini bertujuan untuk menjaga ketertiban, kebersihan, dan tata ruang kota, namun pelaksanaannya menghadapi tantangan akibat tekanan sosial-ekonomi, seperti meningkatnya jumlah Pedagang Kaki Lima. Penelitian juga menemukan bahwa pelaksanaan Peraturan Daerah ini melibatkan berbagai instansi, seperti Dinas Perindustrian dan Perdagangan, Satpol PP, DLHK, dan Dinas Perhubungan Kota Pekanbaru. Namun, pengelolaan Pasar Kodim saat ini sebagian besar dialihkan kepada pihak swasta melalui konsep Bangun Guna Serah (BGS), dengan peran pemerintah lebih bersifat konsultatif dan pengawasan. Tantangan utama meliputi konflik kewenangan antara pemerintah dan swasta, penegakan hukum yang belum optimal, serta keterbatasan infrastruktur. Selain itu, aspek sosial-ekonomi pedagang turut memengaruhi keberhasilan penataan, karena area Pasar Kodim menjadi sumber penghidupan utama bagi banyak Pedagang Kaki Lima. Oleh karena itu, diperlukan pendekatan kebijakan yang responsif, dengan mempertimbangkan keseimbangan antara penegakan aturan dan pemberdayaan Pedagang Kaki Lima, untuk mendukung pembangunan ekonomi lokal dan menciptakan tata ruang kota yang lebih teratur.

Abstract

Everyone has human rights, one of which is legal protection. Victimprotection revealed that in principle it has been regulated in Law Section Number12 of 2022 concerning Crimes of Sexual Violence in articles 42 to article 47concerning Victim Protection. In accordance with the provisions of Article 4 ofthe Witness and Victim Protection Law, witness and victim protection aims toprovide a sense of security to witnesses and/or victims in providing informationduring any criminal detention process. Therefore, the aim of this thesis researchis firstly to explain the legal protection for female victims of sexual disclosurefrom the perspective of Indonesian criminal law, secondly to describe theweaknesses contained in the PSK Law regarding the legal protection of femalevictims of sexual disclosure.This research is normative legal research, referring to positive legalnorms that apply in Indonesia to answer issues that exist on the surface. This isbased on library research which takes quotations from book readings, orscientific research as support that is related to the problem to be researched. Thisresearch uses secondary data sources consisting of primary, secondary andtertiary legal materials. This research also uses qualitative data analysis andproduces descriptive data.From the results of the discussion it was concluded that, firstly, legalprotection for women who are sexually victims is discussed in the Criminal Lawin Indonesia regarding the restoration of victims' rights, while technicalprotection is mandated by the Witness and Victim Protection Law. The secondobstacle in legal protection for victims of sexual disclosure is that the realizationof the LPSK's duties and authority in the PSK Law is not specifically regulated ina separate provision or chapter, the victim is actually re-criminalized by theperpetrator through the ITE Law in the article on defamation, a culture ofblaming the victim, legal sanctions are required. For perpetrators of restitutiveviolence, many forms are open but the laws used are still the same, resulting inlegal violations. The author's suggestion is that regulations are needed thataccommodate a sense of justice for victims of sexual harassment. Abstract

In article 137 of Law no. 22 of 2009 concerning Road Traffic andTransportation (UU LLAJ), it is regulated that goods cars are prohibited fromtransporting people. This refers to the definitions of goods cars and passengercars which are clearly different. So, drivers must be aware and careful not tocarry passengers. Every person who drives a goods car to transport people exceptfor the reasons as intended in Article 137 paragraph (4) letters a, b and c will bepunished with imprisonment for a maximum of 1 (one) month or a fine of amaximum of IDR 250,000.00 (two hundred fifty thousand rupiah)This type of research is empirical legal research, namely research usingfield data as the main data source, such as the results of interviews andobservations. Empirical research is used to analyze law which is seen aspatterned social behavior in people's lives which always interact and relate insocial aspects.From the results of the research and discussions carried out, several conclusionswere obtained, namely: First, Regional Regulation Number 2 of 2009 Article 4Paragraph (2) Concerning Road Traffic and Transportation in Pekanbaru Cityregarding the prohibition on goods cars carrying passengers in Pekanbaru hasbeen implemented since the regulation This issue has been published, but has notbeen implemented optimally by the traffic police because there are stilldiscretionary actions in the field. Abstract

Highlighting the performance of the executive, legislative and judicialgovernments, which often deviate from the rules and have violated the constitution,causing losses to the state. These deviant acts are rampant acts of corruption that havenever disappeared from the government from the past until now. In fact, the legitimacy ofprevious institutions tends to be questioned, due to the widespread practices ofcorruption, collusion and nepotism that occur in these institutions. This is thebackground that requires an institution that has a special task to eradicate corruptionwithin the Indonesian government, so a new institution was formed in the reform era inIndonesia, namely the Corruption Eradication Commission (KPK). This is because thecriminal act of corruption is defined as an action carried out by individuals in thelegislative, judicial and private institutions whose aim is to benefit themselves and others.increasing the level of public trust in the KPK, it turns out that the state issued a newregulation to the KPK, namely Law of the Republic of Indonesia Number 19 of 2019concerning the Second Amendment to Law Number 30 of 2002 concerning theCorruption Eradication Commission which has become controversial for the publicbecause of several articles that contained in this Law has weakened the position of theCorruption Eradication Commission in carrying out its duties and authority. This is whatunderlies the need for this research.This research is normative legal research. This is based on library researchwhich takes quotations from reading books, or supporting books that are related to theproblem to be researched. Data sources Primary, secondary and tertiary data sourcesare characteristic of this research. This research also uses qualitative data analysis andproduces descriptive data. Abstract

The existence of legal fiction actually assumes that everyone knows the law(presumtioiures de iure). However, many people really don't know about the existence of agood rule because of a lack of socialization from the government, not awareness of thepeople concerned. Van Apeldoorn introduced the principle of Legal Fiction and it has beennormalized in article 81 of Law Number 12 of 2011. In Latin there is also the adageignorantia jurist non excusat, ignorance of the law cannot be forgiven. There is also astatement with the same principle, namely the principle of ignorantia juris neminemexcusat ,that is, ignorance of the law is not a reason for forgiveness for someone. As for the sound ofArticle 81 of Law Number 12 of 2011 in terms of promulgation, it is so that everyone knowsit, and in its explanation it states that everyone is considered to know the law. The aim of thisresearch is to find out the reasons for ignorance of legal fiction by finding out what theurgency is and whether legal fiction is in accordance with legal objectives.This research method uses a type of normative legal research using qualitativeanalysis by outlining, explaining and describing the principles of legal fiction and legalobjectives. By using primary legal materials such as the 1945 Constitution, Law Number 12of 2011 concerning the Formation of Legislative Regulations replacing Law Number 10 of2004, Law Number 14 of 2008 concerning Openness of Public Information, also with aconceptual approach , and cases. Also other supporting legal materials.Fictional research results that appear to be intended more to encourage confidencethat a given legal outcome is just and appropriate are known as emotive fictions, and are anapology for the necessity in which the law finds itself in linking the actions of the parties tolegal consequences that they could not have anticipated. as apologetic fiction. However,looking at the situation in Indonesia where there are still people who do not know the law,both in terms of education, awareness of the law, knowledge and the reach of access toinformation is not optimal. Abstract

The zoning system is a policy for accepting new students (PPDB) which iscarried out by determining the zone radius between the school and the placewhere the relevant student lives. One of the objectives of the zoning system itself ismapping students during school registration, besides aiming to equalize thequality of education, eliminate the title of favorite school, improve the quality ofteachers, and reduce the level of traffic congestion.This research was conducted using a qualitative approach, the authorwent into the field to conduct observations and direct interviews with researchinformants. The unequal quality of education equivalent to State High Schools hasbeen a problem that has been occurring for some time. Efforts made to overcomethis problem are the implementation of a zoning system for Admission of NewStudents (PPDB).The PPDB zoning system aims to: a) Ensure that the admission of newstudents is carried out in an objective, transparent, accountable, nondiscriminatory and fair manner in order to encourage increased access toeducational services, b) Ensure the availability and readiness of educational units(state schools, in particular) to be able to provide quality education services, c)Ensure equal access and fair quality of education in each zone/region determinedto be close to where students live, d) Ensure the provision of competent teachingand education staff supported by adequate infrastructure and facilities that can beprovided and used jointly by every educational unit in the designated area/zone.However, in reality, the zoning system has not been implemented wel, due to theineffective use of Family Cards. This is proven by the methods used by thecommunity to continue attending the school which has been labeled as a favoriteamong the community, including the people of Pekanbaru.The conclusion fromthe research is that equal distribution of education using the zoning system hasnot been completely successful, there are several factors causing this to happen.Suggestions from this research is to have an approach to the communityregarding the purpose of implementing a zoning system, so that the communityunderstands and complies with the regulations issued by the government.Keywords: Zoning System, Acceptance of New Students (PPDB)

Abstract

The constitutionality in Indonesia is measured based on its alignment with the 1945Constitution. The examination of the role and appointment of the Chief of Authority in theSpecial Capital Region of the National Capital is essential to comprehend its governancemechanism. The Chief of Authority of the Indonesian Capital City is directly appointed by thePresident and serves a five-year term, which, however, does not conform to the general electionmechanism stipulated in Article 18 Clause 4 of the 1945 Constitution used by other regionalleaders.The type of research utilized in this study is normative legal research. In collecting data fornormative research, a literature review method (library research) was employed. This researchalso employs qualitative data analysis and generates descriptive data.From the research findings and discussions conducted, several conclusions are derived:firstly, the appointment of the Chief of Authority of the Indonesian Capital City by the Presidentpotentially violates the principle of regional autonomy regarding the direct appointment andplacement of the Chief of Authority by the President. This violation threatens the autonomy andauthority of regions, which contradicts the principle of decentralization mandated by Article 18Clause 4 of the 1945 Constitution. Secondly, the ideal concept of appointing the Chief ofAuthority of the Indonesian Capital City by the President aims to balance power between thecentral government and regional governments by maintaining the concept of checks andbalances and regional autonomy. The concepts of checks and balances and regional autonomyare considered crucial to prevent power abuse.The recommendations include proposing a judicial review of Article 4 Clause 1 letter b,Article 5 Clause 4, Article 9, Article 10, Article 13 Clauses (1) and (2) of the Law on theIndonesian Capital City, as well as on the division of authority between the central governmentand regions in the context of the Indonesian Capital City Authority in Article 10 of PresidentialRegulation Number 62 regarding the Indonesian Capital City Authority to ensure alignment withthe principles of regional autonomy stipulated in Article 18 Clause 4 of the 1945 Constitution.Additionally, the restoration of the role of the Regional People's Representative Council (DPRD)in the governance structure of the Indonesian Capital City Authority as the representation of thepeople in accordance with the provisions of Article 18 Clause 3 of the 1945 Constitution isrecommended. Furthermore, inclusive dialogue and active participation from all stakeholders,including the central government, regional governments, civil society, and other democraticinstitutions, in formulating policies related to the appointment of the Chief of Authority.Keywords: Chief of Authority, Indonesian Capital City, Regional Autonomy
