Abstract

This paper aims to discuss the authority of members of the House of Representatives (DPR) in the 1945 Constitution of the Republic of Indonesia (UUDNRI 1945), the legal vacuum in determining the tenure of the DPR, and the urgency of ideal regulation DPR tenure. The study uses normative juridical research with a statutory and conceptual approach. The power of the DPR in the 1945 Constitution is very broad, not only relates to legislative power but also the executive and judicial. The regulation regarding the time limit for the DPR’s period has not yet been regulated (there is a legal vacuum). There is no statutory regulation governing the time limit for a person to become a member of the DPR. The urgency of limiting the period of members of the House of Representatives is to limit the holding of power too long and provide opportunities for other citizens. Members of the Regional House of Representative (DPRD) can serve for 2 periods at the district/city level, after which they can submit at the provincial level for 2 periods, and finally can apply to become a member of the DPR RI for 2 periods.

Abstract

Penghinaan Presiden dan/atau Wakil Presiden baru-baru ini kembali dimunculkan dalam Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP) tepatnya pada pasal 218, isu kekaburan muncul karena pada penjelasan pasal 218 ayat (1) tidak memberikan batasan yang jelas mengenai perbuatan-perbuatan apa saja yang bisa membuat Presiden dan/atau Wakil Presiden merasa harkat dan martabatnya direndahkan. Metode penelitian yang digunakan adalah yuridis normative, menggunakan pendekatan perundang-undangan dan pendekatan konseptual, serta analisa bahan hukum pada penelitian ini adalah interpretаsi grаmаtikаl. Hasil yang diperoleh dari penelitian ini adalah dengan adanya kekaburan norma dari tindak pidana penghinaan Presiden dan/atau Wakil Presiden adalah yang pertama menimbulkan multitafsir, munculnya kesewenang-wenangan, dan tidak mencerminkan asas kejelasan rumusan. Abstract

This study examines how former terrorism convicts or prisoners can be integrated into society using the company's CSR funding help strategy. The author discovers a gap in regulatory standards because the Terrorism Law solely governs measures to prevent and suppress terrorism. This research aims to provide an overview of the reform of the Terrorism Law and the social reintegration model for former convicts using an empirical research model that involves interviewing sources. The findings of this study suggest that the Terrorism Law should be amended and the BNPT reimagined as an entity dedicated to preventing terrorist attacks in Indonesia.

Abstract

This article seeks to examine how the regulation of terrorism as a reprehensible act within the scope of special criminal acts in the National Criminal Code and its potential danger to Indonesia's existence as a unitary state. This research is normative juridical research, which uses conceptual and statute approaches based on primary and secondary legal materials obtained through library research. Then, the results are discussed using qualitative prescriptive analysis. The results obtained turned out to show that the regulation of terrorism as a despicable act within the scope of special crimes in the National Criminal Code intended to reinforce counterterrorism and radicalism efforts by including it as one of the special crimes by considering special characteristics.  In addition, criminal acts of terrorism also have the potential to endanger the existence and sustainability of the Indonesian state as a welfare state; for that, there is a need for synergy in the role of the government and the people in the state.

Abstract

Perkembangan anak usia dini dapat dilihat dari proses pengembangan bahasa baik bahasa lisan maupun bahasa tulis. Aspek pengembangan bahasa anak meliputi pengenalan huruf, kata serta merangkai kata menjadi kalimat sederhana untuk menambah kosakata. Indikator dalam menganalisis kesulitan membaca anak terdiri dari kemampuan anak dalam membaca huruf vocal dan huruf konsonan, serta kelancaran anak dalam menirukan bunyi huruf. Website ALPHABET menjadi media pembelajaran alternatif pengenalan huruf yang menyenangkan serta membantu sekolah paud yang memiliki keterbatasan staf pengajar dan media pembelajaran. Terjadi peningkatan kemampuan siswa setelah pelatihan tersebut namun perlu adanya kegiatan pelatihan keberlanjutan untuk meningkatkan daya ingat anak mengingat konsentrasi anak mudah terganggu oleh kondisi di lingkungannya.

Abstract

Recently, people have suffered from many serious illnesses, such as  kidney, cancer, osteoporosis, etc. One of the triggers is that the food eaten by human is not free from heavy metals. These heavy metals enter through the food chain during the crop cultivation. These heavy metals can come from artificial agrochemical inputs (such as synthesis P fertilizers and pesticides). One way to avoid the entry of heavy metals into plant is by implementing organic farming. Organic farming is an agricultural system that does not use synthetic chemical. The implication of organic farming are (1) maximizing the use local resources, (2) minimizing the use of chemical inputs, (3) ensuring biological functions, (4) maintaining a diversity of plant and animal species, (5) creating an attractive overall landscape that provides satisfaction for local communities, and (6) increasing the intensity of plants and animals in the form of polyculture, agroforestry, crop/animal systems integrated livestock etc. If organic farming principles are followed consistently then the food produced will be healthy and safe for humans and animals and save for land sustainability to support smart farming. Another benefit of organic farming is that natural resources will be sustainable and the environment will be protected from pollution and damage. To convince the Indonesian and global community, the organic products produced must be certified independently, the basis of which is SNI 6729-2016.

Abstract

This study explores the potential of fiqh (Islamic jurisprudence) in anti-corruption education as a tool to promote good governance within the context of a Halal City initiative. The research is motivated by the prevalence of corruption in Indonesia, exemplified by the high number of corruption cases in Malang City (41 out of 45 people accused in 2018). The study adopts a mixed-methods approach, employing library research, interviews, and surveys to analyze public understanding of fiqh and the Halal City concept in Malang. Quantitative data is analyzed using Structural Equation Modeling (SEM). The findings reveal a mixed public response to incorporating fiqh formulations directly into regulations (coefficient: 0.16). However, the study highlights a promising alternative: implementing fiqh principles within anti-corruption education programs shows a significant positive effect on public awareness (coefficient: 0.93). A key challenge identified is the negative evaluation of good governance within the current Halal City concept (coefficient: -0.64), despite public optimism regarding the initiative's overall goals (coefficient: 0.62). It is suggested to study these factors which can inform policymakers and bridge the gap between program execution and public expectations. Ultimately, this can lead to a more successful and well-received Halal City initiative that contributes to broader anti-corruption efforts.

Abstract

Law Number 23 of 2019 concerning National Resource Management for State Defense does not regulate conscientious objection, which refers to the right of a person to refuse to participate in a war or military service on the grounds of religion and morality. Their absence in such services is replaced by other responsibilities such as working in public health services, providing security, and being involved in other social services. Article 77 Paragraph (1) of Law Number 23 of 2019 expressly provides for sentences that should be imposed on those who refuse to serve as a military reserve, where the rule is not in accordance with the principle of conscientious objection which gives a person the right to refuse on the basis of conscience. This research discusses the legal consequences of the enactment of two rules regarding military service and the application of different conscientious objections.  This study applied normative juridical methods and approaches to examine the consistency and relevance of various statutes and government regulations that govern conscientious objection. This study also used conceptual and statutory approaches to explore why conscientious objection is considered a ground for refusal to participate in conscription according to International Human Rights Law. The findings revealed that the conception of defense and compulsory military service in Indonesia does not leave any chance to guarantee the rights of citizens to refuse to participate in military service according to the conscience and belief of every individual (conscientious objection). This is in contrast to the regulatory provisions of international human rights ratified by Indonesia under the International Covenant on Civil and Political Rights. Additionally, there is a need for clear arrangements regarding conscientious objection and the requirements that must be met by citizens who submit these principles for the rejection of military service in Indonesia.

Abstract

The imposition of sentences below the minimum penalty specifically for small-scale drug dealers has become an important debate in the context of criminal justice. This study aims to analyze the practice of judicial independence in small-scale drug trafficking cases and identify the challenges and implications for substantive justice and drug eradication policy in Indonesia. The method used in this study is comparative normative juridical, this research analyses the applicable legal rules in Indonesia and compares them with practices in several other countries. The results show that the application of sentences below the special minimum threat has a significant influence on drug eradication policies, but also raises dilemmas related to justice for offenders with a small role. Comparatively, practices in other countries show a more flexible approach, which integrates restorative justice and rehabilitation principles. This study recommends the revision of legal policies in Indonesia by adopting a more proportional approach, as well as improved training of law enforcement officers to ensure fair and consistent application. This research is expected to contribute to the formation of a more effective, humane, and equitable drug policy.

Abstract

This article aims to analyze the application of Article 36 of Law Number 31 of 1999 concerning the Original of the deed as evidence in corruption criminal cases and the legal implications if investigators fail to obtain permission from the Honorary Council of Notaries to examine the Original of the deed. This study employs a normative juridical research method, using both the statute approach and the conceptual approach. The legal materials consist of primary legal sources, which include Article 66 of Law Number 2 of 2014 amending Law Number 30 of 2004 concerning the Position of Notary and Article 36 of Law Number 31 of 1999 on the Eradication of Corruption Crimes, as well as secondary legal sources, including relevant publications related to the issues raised in this study. These legal materials are analyzed using a perspective analysis, employing grammatical and systematic interpretation methods. The research findings indicate that, based on Article 36 of Law Number 31 of 1999 on the Eradication of Corruption Crimes, which regulates investigations and prosecutions of corruption offenses, there is no legal certainty in its application due to the involvement of the Indonesian Prosecutor's Office and the Honorary Council of Notaries or sectoral ego within each institution. The legal implication of failing to grant investigators permission to examine the Original of the deed of the Honorary Council of Notaries is that it prevents the achievement of perfect proof, as the Original of the deed holds a perfect evidentiary value in proving the alleged corruption crime.
