Abstract

Tidal lowland productivity in type C is still low. Most of them have only been able to cultivate rice twice a year. The third cultivation of corn often fails due to a lack of water. The research objective is to determine an operational model for water management in the field for maize cultivation at several planting times. Model area is conducted at a tertiary block of reclaimed tidal lowland, Telang Jaya Village Primer 8 Delta Telang I, of  Banyuasin District. There are three planting times treatments: the fourth week of April, the second week of June, and the first week of July, 2021. A water management model was applied to control the drainage system, in which the water level in the tertiary channel is maintained at a depth of 50 cm. When groundwater drops below 70 cm, and there is no rain, pump irrigation is provided. Results of the field experiment showed that the maize crop showed similar growth quality at each phase. Land with a planting period of June and July still requires water addition using pump irrigation. It was applied on 14th and 18th August. Moreover, the maize cultivated at the end of April did not require pump irrigation. All treatments have generally similar production with an average magnitude of 8.0 Mg ha-1. The highest production is 8.73 Mg ha-1, which is planted in the first week of July.

Abstract

Abstract : This study examines the increasing trend of e-cigarette use among students in Indonesia compared to Thailand and Brunei Darussalam. This study aims to analyse the advantages and disadvantages of e-cigarette regulation in Indonesia as a new form of addictive substance, and to compare it with regulatory frameworks in other countries in the region. Using normative juridical methods, this study explores laws and policies from Indonesia, Thailand, and Brunei Darussalam. Findings show that although Indonesia imposes relatively high excise taxes on e-cigarettes, its regulations are less comprehensive compared to other countries. Regulatory gaps in terms of advertising, age restrictions, and waste management of e-cigarettes are still evident. The journal suggests strengthening Indonesia's regulatory framework by adopting best practices from other Southeast Asian countries such as Thailand and Brunei Darussalam to ensure public health protection and environmental safety.Abstrak : Penelitian ini mengkaji tren peningkatan penggunaan rokok elektrik di kalangan pelajar di Indonesia dibandingkan dengan Thailand dan Brunei Darussalam. Penelitian ini bertujuan untuk menganalisis kelebihan dan kekurangan regulasi rokok elektrik di Indonesia sebagai bentuk baru dari zat adiktif, dan untuk membandingkannya dengan kerangka regulasi di negara-negara lain di kawasan ini. Dengan menggunakan metode yuridis normatif, penelitian ini mengeksplorasi undang-undang dan kebijakan dari Indonesia, Thailand, dan Brunei Darussalam. Temuan menunjukkan bahwa meskipun Indonesia memberlakukan cukai yang relatif tinggi terhadap rokok elektrik, namun peraturannya kurang komprehensif dibandingkan dengan negara lain. Kesenjangan regulasi dalam hal periklanan, pembatasan usia, dan pengelolaan limbah rokok elektrik masih terlihat jelas. Jurnal ini menyarankan untuk memperkuat kerangka regulasi Indonesia dengan mengadopsi praktik-praktik terbaik dari negara-negara Asia Tenggara lainnya seperti Thailand dan Brunei Darussalam untuk memastikan perlindungan kesehatan masyarakat dan keamanan lingkungan.

Abstract

This research analyzes the juridical implications of Articles 38 and 39 of Law Number 1 of 2023 (Criminal Code) on the construction of criminal liability for persons with disabilities in Indonesia's criminal justice system. Through a juridical-normative approach, the research identifies a paradigmatic transformation from a paternalistic model toward a rights-based approach, albeit with implementation challenges encompassing conceptual ambiguities, procedural limitations, and structural barriers. The findings demonstrate the urgency of reorienting criminal liability construction through developing a "Differential Criminal Responsibility" model that integrates principles of proportionality, individualization, and adaptive support aligned with international standards. Recommendations include legislative harmonization, assessment protocol development, institutional capacity enhancement, and diversification of rehabilitation-based legal consequences to optimize legal protection for persons with disabilities within an inclusive and equitable criminal justice system. Abstract

Proving a criminal act is the most crucial aspect of criminal law enforcement. Reflecting on the case of the premeditated murder of Brigadier Nofriansyah Yosua Hutabarat, which the main perpetrator and other perpetrators tried to cover up, one of the perpetrators, Richard Eliezer, took the courage to volunteer to become a Justice Collaborator. The problem arose when the legal protection given to a justice collaborator was not also given to his family. Based on this issue, this study aims to discuss the issue of legal protection for justice collaborators and their families with a case study of Richard Eliezer and to examine the reformulation of legal protection for justice collaborators and their families in Indonesia. This study uses a normative juridical method. The results of the study show that, reflecting on the reality of legal protection for Richard Eliezer as a justice collaborator in case No. 798/Pid.B/2022/PN JKT.SEL, normatively, legal protection for the families of justice collaborators has not been clearly regulated, because the LPSK is passive in protecting the families of justice collaborators. The conclusion of this study is that the reformulation policy on protection for witnesses who cooperate (justice collaborators) in Indonesia, primarily consists of specific technical rules regarding the protection of justice collaborators and their families

Abstract

This study aims to analyze the application of analogy interpretation by judges in the case of possession of new psychoactive substances, especially in Decision Number 1352/Pid.Sus/2024/PN Mdn on behalf of the Defendant Lindawati. The background of this research departs from the delay of the Indonesian legal system in responding to social changes, especially related to the phenomenon of the spread of new psychoactive substances that have not been explicitly regulated in laws and regulations. This study uses a normative juridical method with a legislative approach, a case approach, and a conceptual approach. Analysis was carried out on primary, secondary, and tertiary legal materials using anticipatory and teleological interpretation methods. The results of the study showed that the Panel of Judges used Article 62 of the Psychotropic Law to punish the Defendant, even though the substance ketamine was not listed in the official psychotropic appendix. This action reflects the findings of the law through analogy, which is doctrinally contrary to the principle of legality in criminal law. Nevertheless, from a progressive legal perspective, the application reflects a response to rapidly changing social realities as well as the need for adaptive legal protection. This study concludes that although analogies in criminal law are prohibited, their application in the context of a legal vacuum for psychoactive substances can only be understood as an effort to realize substantive justice and public protection through a progressive approach in criminal law enforcement.
