Abstract

The presence of waqf land certainly provides many benefits for the community's survival. However, in practice, most waqf land is still used individually or privately by the community. One of them happens to the waqf land located at the Amal Muslimin Mosque in Southeast Medan Village, Medan Denai District, Medan City, where this land is eventually used by local residents for personal interests, they build houses for their residences, until now, which in its utilization, it violates the basic substance of the waqf practice in accordance with Islamic teachings. Land that is waqfed can only be utilized for collective welfare, not personal. So this research aims (1) to find out the law of utilizing waqf land belonging to the Muslim Amal Mosque according to the views of Islamic Law; and (2) The law of utilizing waqf property for individual private interests. To achieve the above objectives, this research uses a normative-empirical method, using references from various books, journals, legislation, observation and interview results, as well as other supporting literacy. The results of this study reveal that using the waqf land of the Amal Muslimin Mosque for personal gain by building houses for local residents to live in is prohibited in the positive law study law and prohibited in Islamic sharia.

Abstract

This article aims to determine the waqf management at the Al-Kaffah Binjai City Waqf Foundation and the development of Islamic education at the Al-Kaffah Binjai City Waqf Foundation. This study uses qualitative methods with the type of field research. Researchers perform data collection techniques through interviews, observation, and documentation. Data analysis techniques are carried out by reducing data and presenting data and conclusions. There are two specific findings in this study, namely: 1) Waqf management conducted by Al-Kaffah Binjai City Waqf Foundation using the PIE model (planning, implementation, and evaluation). 2) development of Islamic education through waqf in Al-Kaffah Binjai City Waqf Foundation consists of a curriculum and Human Resource Development.

Abstract

The development of the sharia economy is currently an important spotlight because it is continuously progressing very rapidly both at the National and International level. The development of the sharia economy in question includes sharia based financial institutions such as sharia banking, baitul maal wat tamwil, sharia insurance, sharia pawnshops and others. Because the products available at Islamic financial institutions are different from non Islamic financial institutions, what can be a differentiating tool in in terms of determining the type of product is from the ushul fiqh framework in Islamic economic methodology. Abstract

Issues relating to the Hajj in Indonesia are still an issue that is discussed, considering that the Hajj itself is a form of worship or the fifth pillar of Islam. In the sense that Islam is perfect if you have completed the Hajj pilgrimage, however, the departure for the Hajj pilgrimage is only for the community (only capable Muslims) and is not a necessity if you do not have the ability. This type of research is empirical sociological research. The nature of the research in this research is comparative. Comparative Research is research that is comparative in nature, which is compared in the form of similarities or differences. In this research, those who will be compared are Imam Hanafi and Imam Asy-Shafi'i. The author found 2 cases in Medan Marelan District where parents had made their children Hajj (registered their children to be able to perform the Hajj) because their children had not yet reached puberty. Namely the family of Mr Suharjo Suhartono and the family of Mr Muhammad Zainal. Mr. Suharjo Suhartono has registered his 9 year old son, Farhan Agus Mumtaza, to be able to go on the Hajj later. Meanwhile, Mr. Muhammad Zainal also did the same thing, namely registering his son, Muhammad Rizqon Febriansyah, aged 12 years to go on the Hajj later. This difference is due to the propositions they use, Imam Hanafi uses general propositions, while Imam Asy-Shafi'i uses specific propositions. While their opinion regarding the condition of a child who has not reached puberty and has been registered for Hajj is that this depends on the ability of the individual (his family), Imam Hanafi is of the opinion that istitha'ah (ability) depends on health and material capabilities. Meanwhile, for Imam Asy-Syafi'i, it only depends on material capabilities. Therefore, in this case their opinions complement each other.

Abstract

This study to determine the theory of legal certainty and the theory of equality on the disparity in the determination of guardianship of fathers to biological children. This research is library research, using two approaches, documentation (document approach), in the form of status or decision from the Medan City Religious Court, namely Determination Number 109/Pdt.P/2021/PA.Mdn. and Stipulation Number 155/Pdt.P/2021/PA.Mdn. and the case approach. Data collection techniques by means of observation, interviews, and analyzing decisions. The results of the research: 1). The results of the determination of the panel of judges of the Medan City Religious Court against the guardianship of the father of the biological child in the Determination Number 109/Pdt./2021/PA.Mdn., and Number 155/Pdt./2021/PA.Mdn. There are two results of the decision, namely accepted and not accepted. 2). The perception of the judges of the Medan City Religious Court on the disparity in the determination of guardianship of the father to the biological child in Determination Number 109/Pdt./2021/PA.Mdn. and Number 155/Pdt./2021/PA.Mdn. There is no need for a decision from the Religious Courts related to the guardianship of the biological father to the biological child, even if there is a case that is accepted, it needs to be reviewed. 3). A review of certainty theory and equality theory on disparities in the determination of guardianship of fathers to biological children in Determination Number 109/Pdt./2021/PA.Mdn. and Number 155/Pdt./2021/PA.Mdn. There is the presence and disparity of decisions. The two cases assessed have the same substance.

Abstract

This research aims to describe punishments for online gambling according to islamic mass ulama. The type of research used in this research is a field research approach. The primary data in this research are the opinions of Ulama at the Islamic Community Organization Muhammadiyah and Nahdatul Ulama North Sumatra. And as secondary data, there is various literature in several books by several scholars Yusuf Al Qardhawi, Quraish Shihab, as well as other scientific works that support this research. The approach in this research also uses two approaches, namely the Statutory Approach and the Comparative Approach. The statutory approach (Statutory Approach) is carried out by analyzing and reviewing the legal regulations related to gambling sanctions, namely Law no. 7 of 1974 concerning Controlling Gambling, Article 303 bis Paragraph (1) of the Criminal Code, and Law No. 19 of 2016 concerning Amendments to Law No. 11 of 2008 concerning Information and Electronic Transactions. The results of this study are the point of view of the Muhammaduyah Ulama of North Sumatra regarding punishments for online gambling perpetrators can be concluded that there are 3 punishments, namely; prison sentence, exile sentence and strict warning sentence. Meanwhile, according to the North Sumatra Nahdhatul Ulama Ulama, there are 2 punishments, namely Prison and Fine.

Abstract

This article examines the consistency of the MUI Fatwa regarding Monosodium Glutamate (MSG) from a Maqāṣid al-Sharī’ah standpoint. The legal issue addressed in this research arises from the ongoing debate regarding the consumption of MSG. The Indonesian Ulema Council (MUI) has issued a fatwa declaring that MSG consumption is permissible (halal), provided that it is produced from halal ingredients and is processed, packaged, marketed, distributed, and served in compliance with Islamic law. However, numerous studies have highlighted the adverse effects associated with MSG consumption. This research employs a normative-empirical approach to Islamic law. The primary normative data consists of the MUI fatwa concerning flavoring products, specifically monosodium glutamate, which contains amino acids, as well as various sources discussing Maqāṣid al-Sharī’ah. The primary empirical data is derived from interviews with MUI board members regarding their perspectives on the relevant fatwa. Additionally, non-legal sources, including scientific literature on MSG, are utilized. Through this methodological approach, the research yielded several key findings. Although the MUI has declared MSG consumption as halal, individuals must still adhere to the safety guidelines established by the WHO and the Indonesian Ministry of Health. The MUI further advises against excessive or prolonged consumption of MSG due to its harmful effects on one’s well-being, including the soul, mind, reproductive system, beliefs, and property, all of which Islamic law mandates to be safeguarded. Consequently, the research concludes that the MUI fatwa, along with the explanations provided by its members, aligns closely with the principles of Maqāṣid al-Sharī’ah, as the prevention of harm takes precedence over the pursuit of benefits.

Abstract

Exploitation of street children is a crime that often occurs recently, many street children lose their freedom and do not have adequate protection from their family, region or government. With the existence of laws regarding the protection of children and women and related organizations, it is believed that the number of exploitation cases will decrease, children will receive clear legal protection and can be implemented by state authorities to increase protection for children, especially street children. This research uses a juridically valid and experimental methodology. The aim of this research is to find out efforts to handle and protect street children as victims of exploitation from Deli Serdang Regency regional regulations No.5 of 2021 and how Islam views in handling cases of exploitation of street children which are studied from siyasah dusturiyah

Abstract

Wages are a right that must be paid to workers as compensation for the work they have done. Islam provides guidelines that the payment of wages is made upon completion of a job. The aim of this research is to find out what the opinions of Hanafi fiqh and Ash-Shafi'i fiqh are regarding receiving wages for teaching the Koran and to find out which opinion is the most persistent between the opinions of Hanafi fiqh and the opinion of Ash-Shafi'i fiqh. The type of research used is normative sociological research using a descriptive and comparative approach and the raw material sources used in this research are primary and secondary material sources. The results of this research are that between Hanafi fiqh and Ash-Shafi'i fiqh there are differences of opinion regarding receiving wages for teaching the Koran. The Hanafi fiqh opinion does not allow receiving wages for teaching the Koran, while the Ash-Shafi'i fiqh opinion allows receiving wages for teaching the Koran.

Abstract

This study aims to determine the chronology of the contents of Jurisprudence Number 1/Yur/Ag/2018 which allows non-Muslim heirs to inherit by means of a mandatory will and the views of the judges of the Kisaran Religious Court and the Management of the Indonesian Ulema Council (MUI) of Asahan Regency. besides that, to describe it in the theory of Maqashid Asy-Syari'ah. This type of research is doctrinal research or juridical-normative research, using a case approach and a statute approach. The granting of obligatory wills to non-adopted children and adoptive parents has been consistently applied by the Supreme Court from 1998 to at least 2016. The views of the Religious Court judges and the Indonesian Ulema Council regarding non-Muslim heirs obtaining inheritance through the obligatory will are contradictory or mutually contradictory. each other. However, jurisprudence Number 1/Yur/Ag/2018 is a legal product that is decided for the benefit of humanity with legal justice.
