Abstract

This study aims to analyze the implementation of the Indonesian Ulema Council (MUI) Fatwa Number 83 of 2023 concerning the boycott of Israeli products, with a focus on its impact in North Sumatra Province from economic, social, and political aspects. The research method used in this study is qualitative using a legal sociology approach. The data sources used are primary data and secondary data with data collection methods, namely literature review and interviews. The results of the study obtained indicate that the MUI fatwa Number 83 of 2023 concerning the boycott of Israeli products, viewed from an economic aspect, has the potential to reduce the income of Israeli companies that rely on exports to international markets, including Indonesia. From a social aspect, this boycott is a manifestation of concern for the suffering of others and support for their struggle. From a political aspect, this fatwa has several implications, specifically support for Palestine. This study is expected to contribute to the understanding of the interaction between ulama fatwas, public policy, and public response in the context of sensitive international issues.

Abstract

Violations of moral norms often have significant social impacts, one of which is marriage which is carried out as a form of resolving moral conflicts in society. This article aims to analyze marriage due to violations of moral norms in Pematang Siantar City based on the perspective of Islamic law and positive law in Indonesia. In Islamic law, marriage is often considered a solution to normalize social relations after the occurrence of a violation, although there are requirements and principles that must be met. Meanwhile, positive law in Indonesia emphasizes the formal legality aspect and does not explicitly regulate the obligation to marry in such situations. This study also discusses various social implications that arise as a result of this phenomenon, such as social pressure on the individuals involved, as well as its impact on household stability. Using a normative-juridical approach, this article reviews how the two legal systems view this phenomenon, as well as providing an overview of the integration efforts between religious, legal, and cultural values in resolving this problem. The results of the analysis show that a comprehensive approach is needed to handle marriage cases due to violations of moral norms, in order to ensure justice for all parties involved.

Abstract

Transparency and accountability are needed to build and maintain public trust in waqf management. High trust will encourage people to be more active in waqf. One of the obstacles in waqf management is the lack of adequate supervision and transparent reporting. By regulating transparency and accountability, BWI Sumut can improve the supervision system and improve the quality of financial reports and activity reports. The most important Shari'ah maqashid in waqf is the protection of wealth (hifzul mal). Safeguarding wealth is one of the maqasid shariah categorized as maqasid al-dharuriyyah and also includes maqasid ammah, which is Allah's general purpose in making law (shariah). So, in the context of maqashid waqf actually appears as an Islamic instrument in social activities to maintain the role of wealth. So, waqf is in a position to protect property in its interest for a moment, for longer or continuously intended for public waqf.

Abstract

The temettok tradition in the context of law is basically permissible, but in its journey, this shift in tradition has undergone significant changes, especially in the essence of this tradition itself, which is a tradition built on the principles of ta'awun and mutual cooperation, but shifts to economic values ​​that are demanded its citizens to bear expenses which in principle were like debt. This research aimed to find out how the Temettok tradition at walimatul ursy according to Aceh Ulama Traditional Assembly (MAA). The approach used in this research was to use a qualitative approach. The results of this research indicated that first, The tradition of recording Temettok money when the walimatul ursy in Aceh Singkil Regency had two percentages, the first is the Cinendang river, which was estimated to have existed since 1985. The two Sungkhaya rivers were thought to have existed since 1956. So, this Temettok tradition held at the time of the walimah to be precise on the last day. Second, The Temettok tradition, in the view of Aceh Ulama and Traditional Assembly (MAA), allowed this tradition by reason of the principle of fiqh “a custom can be made into law”, besides that the Temettok tradition was also in the form of a grant, not a debt, because if a debt was owed, the law was haram, because tradition might not conflict with Islamic law. Thret, After analyzing more deeply based on the verses of the Qur'an and the hadith of the Prophet Muhammad SAW, that the Temettok tradition was classified as ‘urf Sahih, because, this urf applied in general, it did not contradict Islamic law, the gift was in the form of a grant. So apart from that, if it was seen from the social side, the Temettok tradition at the time the walimah put forward help, strengthened ties, strengthened ukhuwah and the Temettok tradition was well known in the community.

Abstract

The Supreme Court, through Decision Number 485 K/Ag/2013, issued a decision regarding determining the inheritance rights of non-Muslim heirs through the 'aṣabah sababiyah route. The legal basis regarding 'aṣabah sababiyah is not contained in the marriage law or the compilation of Islamic law. In its decision, the Supreme Court referred to the 'aṣabah sababiyah theory of Egyptian inheritance law. This decision is a legal effort based on the decision of the Medan Religious Court Number 751/Pdt.G/2011/PA.MDN, which stated that, in inheritance law, the number of ulama agreed to require that heirs and heirs must have the same religion, namely Islam. This problem is interesting to study in more depth through the views of the Medan Religious Court judges and analyze based on a progressive legal perspective. This research is empirical legal research with a qualitative approach, and data collection in this research uses observation, interview techniques, and then analysis. This research found that 'aṣabah sababiyah is an asabah in the class of heirs, which occurs because of freeing both male and female slaves. The views of the Medan Religious Court judges regarding Supreme Court decision Number 485 K/AG/2013 concerning the Determination of the Heirs of 'Ashabah Sababiyah are in two groups, namely accepting the decision and rejecting the decision. If the disparity in the decisions of the Supreme Court and the Medan Religious Court in determining heirs of different religions is viewed based on progressive law, then Supreme Court Decision Number 485 K/AG/2013 is closer to the value of legal progressivity because one form of application of progressive law by judges is to realize social justice through the method of legal discovery by placing social justice in society above statutory regulations.

Abstract

The traditional Nias wedding procession of Gunungsitoli City studied relates to famasao marafule, which is divided into fanema marafule, baru safusi and kofo. Problem formulation: 1). How is the procession of the traditional wedding feast carried out by the Nias Muslim community in Gunungsitoli City? 2). How is the procession of the traditional wedding feast carried out by the Nias Muslim community of Gunungsitoli City from the perspective of positive law? 3). How is the procession of traditional marriage feasts carried out by the Muslim community of Nias Gunungsitoli City from the perspective of maqāṣid ash-sharī`ah? Analysing these problems using positive law and maqāṣid ash-sharī`ah approaches. Perspective of Positive Law, contrary to Article 106 of the Civil Code, contrary to Article 3 of KHI because it does not realise sakīnah, mawaddah and raḥmah. The traditional marriage procession of Nias Muslims in Gunungsitoli City is contrary to Article 34 paragraph (1) and paragraph (2) of Law Number 1 of 1974 concerning Marriage, the marriage procession of famasao marafule (fanema marafule, baru safusi), the husband and wife cannot carry out their obligations, the husband does not want to provide maintenance because his wife does not live with him, while the wife cannot take care of her household because she still lives with her parents. The procession of the traditional Nias marriage ceremony in Gunungsitoli City with the condition that the husband and wife live together implemented by the Nias Muslim community in Gunungsitoli City from the perspective of Maqāṣid ash-Sharī`ah violates ḥiẓhud dīn and ḥifẓul `aql in Maqāṣid ash-Sharī`ah.

Abstract

The community has not fully paid attention to the regulations in the implementation of waqf, especially for those who do or give waqf. This causes uncertainty about the status of the waqf itself both juridically and administratively. The use of waqf land, like any other function, is for the benefit of the people, in accordance with Law No. 41/2004 on waqf, that is, the allocation of waqf land depends on the waqf pledge made. However, it is still found that the use of waqf land is different from the purpose of waqf, as is the case with MIS Al-Ikhlas and BKM Masjid Al-Ikhlas. This research aims to find out the problems of waqf disputes in the management of MIS Al-Ikhlas and Al- Ikhlas Mosque, as well as to analyse the law of management and status of waqf land without an authentic deed (reviewed from the Waqf Law No. 41 of 2004). The research method used is empirical legal research (Empiric Law Research) which includes a statute approach, case approach, and combines legal materials (juridical empirical) and uses in-depth interviews to enrich primary data. The results show that based on Law No. 41 of 2004, the legal position of Nazirs who are not registered with the Ministry of Religious Affairs and the Indonesian Waqf Board results in legal uncertainty of waqf land. The validity status of MIS Al-Ikhlas waqf land is declared invalid due to the absence of authentic deeds and appropriate registration. Waqf land is considered valid if it fulfils the pillars according to Law Number 41 of 2004 and the absence of an authentic deed triggers waqf disputes. Keywords: Waqf, Validity, Authentic Deed, Management Masyarakat belum sepenuhnya memberikan perhatian terhadap peraturanperaturan dalam pelaksanaan wakaf terutama bagi mereka yang melakukan ataumemberikan wakaf. Hal ini menyebabkan ketidakjelasan dari status wakaf itu sendiri baik secara yuridis maupun administratif. Kegunaan tanah wakaf sebagaimana fungsi pada umumnya yakni bertujuan untuk kemaslahatan umat, sesuai UU Nomor 41 Tahun 2004 tentang wakaf, yaitu peruntukan tanah wakaf adalah tergantung pada ikrar wakaf yang dibuat. Namun, masih ditemukan pemanfaatan tanah wakaf yang berbeda dengan tujuan wakaf sebagaimana halnya yang terjadi pada MIS Al-Ikhlas dan BKM Masjid Al-Ikhlas. Penelitian ini bertujuan untuk mengetahui permasalahan sengketa wakaf dalam pengelolaan MIS Al-Ikhlas dan Masjid Al- Ikhlas, serta menganalisis hukum pengelolaan dan status tanah wakaf tanpa akta otentik (ditinjau dari UU Wakaf No 41 Tahun 2004). Adapun metode penelitian yang digunakan adalah penelitian hukum empiris (Empiric Law Research) yang meliputi pendekatan undang-undang (statute approach), pendekatan kasus (case approach), dan memadukan bahan-bahan hukum (yuridisempiris) serta menggunakan wawancara mendalam untuk memperkaya data primer. Hasil penelitian menunjukkan bahwa berdasarkan UU No. 41 Tahun 2004, kedudukan hukum Nazhir yang tidak terdaftar di Kementerian Agama dan Badan Wakaf Indonesia mengakibatkan ketidakpastian hukum tanah wakaf. Status keabsahan tanah wakaf MIS Al-Ikhlas dinyatakan tidak sah karena tidak adanya akta otentik dan pendaftaran yang sesuai. Tanah wakaf dianggap sah jika memenuhi rukun sesuai Undang-Undang Nomor 41 Tahun 2004 dan ketidakadaan akta otentik memicu sengketa wakaf. Kata kunci: Wakaf, Keabsahan, Akta Otentik, Pengelolaan

Abstract

This paper raises the issue of legal protection for uncertified waqf land assets in Batu Bara Regency. Uncertified waqf land has the potential to cause disputes and misuse due to the lack of formal legal force. Waqf land assets are objects that have high economic value for someone who is given by a certain person to another. Waqf land assets have a value that can provide for a person's life when given, but become problematic when they have not been legally legalized through a certificate. These uncertified waqf land assets are still common among the community, especially in Batu Bara Regency. In Batu Bara Regency, there are several uncertified waqf land assets. Based on data obtained from the Ministry of Religious Affairs of North Sumatra Province in 2025 in Batu Bara Regency, it is known that there are a total of 594 waqf land assets. Of this total, there are 327 certified waqf land assets and 267 uncertified waqf land assets. Thus, there are still problems regarding uncertified waqf land assets. Therefore, this study aims to analyze the objective conditions of waqf land asset protection in Batu Bara Regency, how is the protection of uncertified waqf land assets according to the perspective of Law Number 41 of 2004 concerning Waqf in Batu Bara Regency and the factors causing uncertified waqf land assets in Batu Bara Regency. The research method used by the researcher in this journal article is a qualitative research method with an analytical descriptive approach. Data collection in this study uses primary data and secondary data. The primary data used by the researcher is by going directly to the field through observation and interviews, while the secondary data carried out by the researcher is by using books, journal articles and supporting documents. The data analysis techniques used are data reduction, data presentation, and drawing conclusions. The results of this study indicate that the protection of uncertified waqf land assets in Batu Bara Regency based on the perspective of Law Number 41 of 2004 concerning waqf is The objective condition of waqf land assets in Batu Bara Regency can be seen through its management. Waqf land assets are used for the benefit of humanity such as the construction of prayer rooms, mosques, cemeteries, schools and others. Waqf land that does not yet have a certificate in Batu Bara can be proven by the Waqf Pledge Deed (AIW) and the Waqf Pledge Deed Replacement Deed (APAIW) issued by the Waqf Pledge Deed Making Official (PPAIW). The factors causing uncertified waqf land assets in Batu Bara Regency are the low public understanding of the urgency of waqf land certification, complex administrative procedures, and high costs that must be incurred.

Abstract

This study aims to explores the effectiveness of the implementation of Medan City Regional Regulation Number 10 of 2021 concerning Public Order and Tranquility, particularly regarding the prohibition of transporting dusty and foul-smelling materials using open vehicles. A socio-legal approach was employed, combined with empirical fieldwork through interviews, direct observation, and analysis of both classical and contemporary literature, including principles of fiqh siyasah. The findings reveal that the enforcement of the regulation remains suboptimal. This is evidenced by the low compliance rate among transport vehicles, weak monitoring systems, and administrative sanctions that fail to produce a deterrent effect. Implementation barriers stem from structural issues such as the lack of personnel and infrastructure as well as cultural constraints, notably the low level of legal awareness among the community. From the perspective of fiqh siyasah, this situation reflects the state's failure to safeguard public welfare and a lack of actualization of the principles of hisbah, sadd al-dzari’ah, and siyasah dusturiyah. Addressing this issue requires a multi-sectoral strategy involving government entities, civil society, and religious institutions. Institutional reform, regulatory strengthening, and enhanced public education are essential components for optimizing public policy implementation grounded in Islamic values.   Keywords: Local Policy, Open Transport, Fiqih Siyasah, Legal Effectiveness   Abstrak Kajian ini bertujuan untuk mengeksplorasi efektivitas implementasi Peraturan Daerah Kota Medan Nomor 10 Tahun 2021 tentang Ketertiban dan Ketentraman Umum, terutama dalam larangan pengangkutan bahan berdebu dan berbau busuk menggunakan kendaraan terbuka. Pendekatan yuridis sosiologis ipadukan dengan metode lapangan (empiris) melalui wawancara, observasi langsung, serta telaah terhadap literatur klasik dan kontemporer yang relevan, termasuk prinsip-prinsip fiqh siyasah. Hasil penelitian menunjukkan bahwa pelaksanaan regulasi masih belum optimal. Hal ini ditandai dengan rendahnya tingkat kepatuhan teknis kendaraan pengangkut, lemahnya sistem pengawasan, serta sanksi administratif yang tidak menimbulkan efek jera. Hambatan implementatif bersumber dari persoalan struktural seperti minimnya petugas dan infrastruktur serta kendala kultural berupa rendahnya kesadaran hukum masyarakat. Dalam kerangka fiqih siyasah, lemahnya pelaksanaan ini mencerminkan kegagalan negara dalam menjaga kemaslahatan publik dan belum terwujudnya nilai hisbah, sadd al-dzari’ah, serta siyasah dusturiyah. Untuk memperbaiki kondisi tersebut, diperlukan strategi lintas sektor dengan melibatkan elemen pemerintah, masyarakat, dan institusi keagamaan. Reformasi kelembagaan, penguatan regulasi, serta peningkatan edukasi publik menjadi komponen utama dalam mengoptimalkan kebijakan publik berbasis nilai-nilai keislaman.   Kata Kunci: Kebijakan Daerah, Kendaraan Terbuka, Fiqih Siyasah, Efektivitas Hukum

Abstract

Penelitian ini bertujuan untuk menganalisis implementasi Peraturan Daerah Nomor 9 Tahun 2016 tentang Penyelenggaraan Lalu Lintas dan Angkutan Jalan terhadap Hak Pejalan Kaki di Kota Medan dalam perspektif Siyasah Dusturiyah. Pasal 88 perda ini secara eksplisit menetapkan kewajiban pemerintah dalam menyediakan dan memelihara fasilitas pejalan kaki, termasuk trotoar. Namun, pelaksanaan di lapangan belum berjalan efektif. Metode penelitian ini menggunakan pendekatan yuridis sosiologis dengan studi kasus, teknik pengumpulan data berupa wawancara mendalam, observasi, dan studi dokumentasi. Hasil menunjukkan ketidaksesuaian antara norma dan praktik, terlihat dari maraknya pelanggaran fungsi trotoar, lemahnya pengawasan, serta rendahnya kesadaran hukum masyarakat. Dalam perspektif Siyasah Dusturiyah, hal ini mencerminkan kegagalan negara dalam menjamin kemaslahatan publik dan menegakkan prinsip keadilan. Rekomendasi diberikan agar pemerintah memperkuat pengawasan, melibatkan partisipasi publik, serta menerapkan prinsip maslahah dan hisbah dalam pengelolaan ruang publik.
