Abstract

This article aims to determine the waqf management at the Al-Kaffah Binjai City Waqf Foundation and the development of Islamic education at the Al-Kaffah Binjai City Waqf Foundation. This study uses qualitative methods with the type of field research. Researchers perform data collection techniques through interviews, observation, and documentation. Data analysis techniques are carried out by reducing data and presenting data and conclusions. There are two specific findings in this study, namely: 1) Waqf management conducted by Al-Kaffah Binjai City Waqf Foundation using the PIE model (planning, implementation, and evaluation). 2) development of Islamic education through waqf in Al-Kaffah Binjai City Waqf Foundation consists of a curriculum and Human Resource Development.

Abstract

Undang-Undang Perkawinan telah menentukan orang tua sebagai pihak yang memiliki legal standing untuk mengajukan permohonan dispensasi kawin bagi anaknya, sedangkan anak di bawah umur tidak memiliki legal standing. Pada perkara Nomor 20/Pdt.P/2020/PA.Kbj. Pemohon adalah seorang anak di bawah umur, tetapi Hakim tidak menilainya cacat formil, justru menerima dan mengabulkan permohonannya. Penelitian ini bertujuan untuk mengkaji pertimbangan hukum Hakim dalam memutus perkara tersebut. Penelitian yuridis-empiris dilakukan dengan menggali data melalui wawancara secara mendalam kepada informan penelitian dan sumber data lainnya, kemudian disajikan secara dekriptif dengan analisis kualitatif. Hasil penelitian menunjukkan bahwa Hakim telah berpaling dari ketentuan hukum formil dispensasi kawin dengan pertimbangan telah terjadi kekosongan hukum, penegakan asas personalitas keislaman, dan fleksibilitas aturan usia matang untuk perkawinan, sehingga berdasarkan kemaslahatan anak, Hakim memberikan legal standing kepada anak di bawah umur. Penulis mengemukakan beberapa argumen bahwa masih terdapat alternatif lain yang dapat dilakukan oleh Hakim daripada harus mengesampingkan aturan hukum formil.

Abstract

Marriage is a method developed by Allah as a strategy to preserve the life of the people of the prophet Muhammad, one of the main pillars of marriage is a bride's guardian. This research is analyzed with the legal research method of empiricism, it’s empirical analysis of the ijtihad method of the Chief of Religious Affairs  of Kabanjahe District and  Berastagi District, Karo Regency, addressing the case of the appointment of a guardian in the marriage of a female Muslim convert , with a sociological and anthropological approach and Gustav Radbruch's theory of law enforcement, namely legal certainty, justice and expediency.  The method of the Head of Religious Affairs of Kabanjahe Subdistrict in determining the marriage guardian of a muallaf is First; paying attention to the religion of the father of the bride, if he is Muslim then he has the right to become a guardian regardless of his previous religious background, Second; if he is not Muslim, then a search for his descendants who are Muslim because the head of the Kabanjahe sub-district religious affairs prioritizes the guardian of the lineage. Third; if a search has been made from the side of relatives and there are none, then the judge's guardian acts as a guardian in the marriage, However, according to the Head of the Kabanjahe Religious Affairs Office, the third point rarely occurs in Kabanjahe, because the Kabanjahe community is majority Karo, identical  with Rakut Si Telu culture, which is very moderate in religion. As for the Berastagi religious affairs office, the determination of the marriage guardian is carried out by paying attention to three stages of analysis, namely; First; by paying attention to the context, namely the muallaf whether he is a muallaf from parents who have long been muallaf' or only he is a new muallaf and his parents are still non-Muslim. Secondly, by taking into account the marriage system of the parents, whether the marriage of the parents was carried out in a Christian marriage, Islam or just a customary marriage, then if it was not previously Islamic, then, Thirdly, the legal and entitled guardian of the judge.

Abstract

Penelitian ini bertujuan untuk memahami dan menganalisis ihwal praktik penggunaan alat penangkapan ikan jaring tarik dan jaring hela di Kecamatan Medang Deras Kabupaten Batubara, yang ditinjau berdasarkan perspektif hifz al-bi’ah. Penelitian ini merupakan penelitian hukum empiris. Data primer dalam penelitian adalah kata-kata dan tindakan masyarakat nelayan Kecamatan Medang Deras. Sedangkan data sekunder, penulis menggunakan berbagai literatur yang membahas tentang maqashid al-syariah. Hasil penelitian menjelaskan, bahwa menggunakan jaring tarik dan jaring hela yang merusak ekosistem laut, dengan alasan apapun, hukumnya adalah haram. Selagi laut masih tercemar, maka semua manusia akan terus berdosa. Adapun dosa yang paling besar ditanggung oleh pelaku perusakan lingkungan hidup, kemudian pemerintah yang mempunyai kekuasaaan dan kewenangan hukum, serta yang terakhir adalah masyarakat yang berkewajiban mencegah, mengingatkan, memelihara dan memberikan keteladanan yang baik dalam pelestarian lingkungan (hifz al-bi’ah). Pasalnya, berdasarkan perspektif maqashid al-syariah, melestarikan lingkungan laut adalah salah satu aspek al-daruriah yang mesti dijaga dan dilestarikan dalam kehidupan manusia.

Abstract

Analysis of the Concept of Joint Assets in the Compilation of Islamic Law reviewed Based on Corrective Justice Values is an Islamic law study that discusses legal issues regarding joint assets. Based on the reality and legal developments that occur in Indonesian society, which is very dynamic, and from several court decisions, it was found that, in general, the panel of judges at the Religious Courts, in deciding cases for claims for the distribution of joint assets, did not depart from these laws and regulations, namely by dividing joint property equally (half share) between husband and wife. This rule causes many problems that occur when practicing the rulings of the religious courts, because not a few people consider that the distribution of joint assets does not fulfill a sense of justice. For this reason, it is necessary to understand in detail the distribution of joint assets based on the inculcation of Islamic values through education. This research model (mode of inquiry) is qualitative. While the approach used is philosophical legal research, In conclusion, this study shows that the distribution of joint assets between ex-husband and ex-wife, based on the value of corrective justice, should be divided according to the amount of effort between the two in obtaining assets during marriage, dividing equally (50:50, Article 97 KHI). is considered that there are times when not fulfilling a sense of justice is necessary when one party has committed an act that is detrimental to the other party (husband or wife) because it does not carry out what has become its obligation in the long term.

Abstract

Fokus penelitian adalah bagaimana kedudukan anak zina dalam kewarisan sebelum dan sesudah Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010, dan paradigma hakim Pengadilan Agama di Sumatera Utara terhadap Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010. Model penelitian (mode of inquiry) penelitian ini adalah kualitatif. Pada akhirnya penelitian ini menunjukkan bahwa paradigma hakim Pengadilan Agama di Sumatera Utara terhadap Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010, jika dimaknai dari sudut perlindungan anak bagi golongan anak sebagai putusan yang progresif sesuai dengan tuntutan rasa keadilan setiap anak, untuk mendapatkan pemenuhan hak keperdataannya jika orang tuanya tidak melakukan pengakuan atau pengesahan terhadapnya. Sedangkan jika dimaknai dari sudut hukum waris, maka Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 dimaksudkan terhadap anak yang dilahirkan dari orang tuanya telah dilangsungkan perkawinan menurut hukum agama dan kepercayaannya, bukan anak yang dilahirkan dari orang tuanya yang belum/tidak pernah terikat perkawinan sama sekali. Sehingga kepada anak zina yang sama sekali tidak memiliki hubungan pernikahan diantara kedua orang tuanya, dan menjadikan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 sebagai dasar agar anak zina tersebut mendapat waris dari ayah biologisnya tidak begitu serta dapat diterima, karena di dalam hukum Islam telah diatur dengan tegas tentang status dan hak dari seorang anak hasil zina, sehingga dengan memberlakukan kewarisan kepada anak zina akan menimbulkan penolakan umat Islam di Indonesia.

Abstract

Mixue Ice Cream & Tea is a Chinese franchise that has been around since June 16th, 1997. Mixue has been in Indonesia since 2020, first in the city of Bandung, and now has more than a thousand locations throughout the country, with the majority in the city of Medan. Since Medan City is home to a sizable Muslim population, it offers several possibilities for economic expansion. The purpose of this analysis is to examine the function of the MUI in relation to halal certification based on the JPH Law (No. 33 of 2014). This research relies on qualitative research techniques. Taking a normative legal approach to the pressing problem of research by analyzing the steps used to obtain halal certification of Mixue drinks. The findings of this study led to a request from the Indonesian Ministry of Religion BPJH that Mixue refrain from using the halal symbol on its packaging before the halal certificate is issued. Mixue Ice Cream & Tea has been declared Halal by the MUI. After a hearing regarding halal products was conducted by the Fatwa Commission on 15th February 2023, the MUI issued a Halal Decree. The head of the Halal Inspection Agency, the Food, Drug, and Cosmetic Review Institute, presented an audit report on halal certification to the MUI, and after careful deliberation, the organization issued a Halal Decree. Abstract

Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal, telah diubah dengan Undang-undang Nomor 11 Tahun 2020 tentang Cipta Kerja, dimana dalam Pasal-Pasal yang diubah ada menyisipkan Pasal yang mewajibkan pelaku usaha mikro dan kecil untuk memiliki sertifikat halal bagi produk olahannya. Tujuan dalam penelitian in adalah untuk mengetahui 132 pengaturan produk halal dalam undang-undang nomor 11 tahun 2020 tentang cipta kerja dan mengetahui 133 pengaturan produk halal dalam undang-undang nomor 11 tahun 2020 tentang cipta kerja ditinjau dari Perspektif 134 fiqh siyasah. Metode penelitian yang akan digunakan dalam penelitian ini adalah penelitian hukum normatif. Pendekatan penelitian yang akan digunakan dalam ini menggunakan pendekatan undang-undang (statute approach). Sumber bahan hukum yang akan digunakan dalam penelitian ini meliputi bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja pada klaster jaminan produk halal, dijalankan dengan tujuan memberikan kenyamanan, keamanan, keselamatan, dan kepastian ketersediaan produk halal bagi masyarakat dalam mengkonsumsi dan menggunakan produk, serta meningkatkan nilai tambah bagi pelaku usaha untuk memproduksi dan menjual produknya. Hal ini sejalan dengan hukum Islam yang memerintahkan umat muslim mengkonsumsi setiap produk yang terjamin kehalalannya. Meskipun pemberian sertifikasi dipermudah dan waktu proses sertifikasi yang dipersingkat.

Abstract

Tujuan dalam penulisan ini adalah untuk menguraikan konsep dan rumusan aturan hukum  diambilnya pajak pendapatan untuk pengusaha trucking pandangan siyasah maliyah.Hal ini disebabkan karena belum adanya peraturan pasti tentang ditetapkannya pajak untuk pengusaha trucking yang berdampak ketidak adilan pada diambilmnya pajak itu.Ketidak pastian itu menimbulkan maksud dari hukum sulit digapai pada sebuah bangsa. Penelitian ini menggunan metode penelitian deskritif. Penelitian deskriptif berupa jenis penelitian yang menghubungkan antara menomena social atau hubungan antara fenomena yang di uji dengan pendekatan dalam penelitian ini menggunakan Undang-undang juga konseptual.  Jenis penelitian yang digunakan dalam penelitian ini yaitu data primer, data sekunder, data tersier. Hasilnya memaparkan pentingnya guna dibuat hukum terkhusus bagi pengusaha trucking kemudian hilang ketidak adilan pada sebuah bangsa. Kosongnya norma pada diambilnya pajak pengusaha trucking mempersulit guna pemungutannya untuk pengusaha trucking. Perlunya norma sebagai landasan guna ditetapkannya wajib pengusaha truckinguntuk membayarkan pajaknya. Ditetapkannya hukum guna pengusaha trucking menimbulkan rasa adil juga manfaat. Diluar hal tersebut, terdapatnya kejelasan hukum dapat mempermudah pengusaha trucking guna dibayarkan pajaknya menurut pendapatannya.
