Abstract

This study examines the integration of the Huyula tradition, a local wisdom of the Gorontalo community, in contemporary waqf governance based on the principles of good governance and Islamic law reform. Huyula, which contains the values of togetherness, mutual cooperation, deliberation, and collective responsibility, has the potential to strengthen productive, transparent, and participatory waqf management, especially in the digital era with the use of technology such as e-waqf and blockchain. Through a pentahelix collaborative model involving government, society, academia, business, and the media, this tradition can become an institutional foundation responsive to modern socio-economic and technological challenges. This research uses mixed methods (Normative and Empirical), uses a qualitative approach and conducts interviews with 8 resource persons related to normative aspects and waqf management practices. The results of the study show that the revitalization of Huyula values can increase waqf literacy, nazhir capacity, and community participation in the planning, supervision, and evaluation of waqf, in line with the sustainable development goals (SDGs). Adaptive policies that accommodate local values in the national legal system and digital governance are recommended so that waqf management becomes more effective, equitable, and sustainable.

Abstract

Divorce cases, particularly cerai talak (husband-initiated divorce), have increased significantly at the Gorontalo Religious Court over the past three years, raising serious concerns regarding the fulfillment of the economic rights of women and children following marital dissolution. This article analyzes the judicial efforts undertaken to protect and fulfill the economic rights of women and children in cerai talak cases at the Gorontalo Religious Court. The purpose of this article is to examine both preventive and repressive measures employed by judges in ensuring that rights such as mutah, iddah maintenance, child support, and division of marital assets are adequately addressed within court rulings. A normative-juridical method was employed through a case approach and statute approach. The findings prove that while judges have made considerable efforts through active fact-finding, mediation, and ex officio authority, the effectiveness of these rulings remains substantially hindered by low legal literacy among women, weak post-judgment execution mechanisms, and limited access to legal aid. It is therefore recommended that institutional strengthening, inter-agency synergy, and the consistent optimization of judges' ex officio authority are essential to ensuring that legal protection for women and children extends beyond formal court decisions into substantive justice

Abstract

Public administration reform aims to create a professional, efficient, and service-oriented bureaucracy. However, in its implementation, bureaucratic modernization often ignores local cultural values that have long been guidelines for work ethics, including for Civil Servants (PNS). This study examines the revitalization of cultural values in public administration reform, focusing on PNS in Gorontalo. This study uses a qualitative approach with a descriptive method, where data are collected through interviews, observations, and document analysis. The results of the study indicate that local cultural values of mutual cooperation, honesty, and the principle of harmony between customs, social norms, and religion still influence the work ethic of PNS in Gorontalo. However, the implementation of these values faces challenges in a bureaucratic system that increasingly prioritizes administrative procedures and compliance with formal regulations. Several factors that hinder cultural revitalization in public administration include rigid bureaucratic structures, lack of culture-based training, and low integration of cultural values in institutional policies. This study recommends a strategy for revitalizing cultural values in public administration reform, including through strengthening local wisdom-based training, developing culture-oriented leadership, and aligning regulations with the social values of society. With this approach, it is hoped that a bureaucracy can be formed that is not only modern and efficient, but also more inclusive, humanistic, and rooted in local cultural values.

Abstract

The main problem addressed in this study is the unilateral appropriation of a father’s premarital property by his second wife and their child, which ignores the inheritance rights of the children from the first marriage and thereby raises issues of justice and legal certainty within the family inheritance context. This study aims to analyze the implementation of inheritance distribution of the father’s premarital assets to the children from the first marriage from the perspectives of Islamic law and positive law, as well as to examine the legal consequences arising from such unilateral control. The research employs a normative–empirical legal approach that combines a doctrinal analysis of legal literature with an examination of concrete cases in the field through a statutory and qualitative approach. Data were obtained through observation and in-depth interviews with a judge of the Religious Court of Gorontalo City, an official of the North Gorontalo Land Agency (BPN), and the relevant heirs, and were analyzed descriptively and qualitatively using Islamic law and civil law theories. The findings show that, based on the Kompilasi Hukum Islam (KHI) and the Kitab Undang-Undang Hukum Perdata (KUHPerdata), children from the first marriage are legitimate heirs who possess equal rights to their father’s premarital property, without any distinction in birth order. The unilateral appropriation of assets by the second wife is classified as an unlawful act because it contravenes Article 176 of the KHI and Article 852 of the KUHPerdata. The study concludes that such actions render the legitimacy of unilateral control null and void and give rise to an obligation to restore the property to all rightful heirs. The implications of this research underscore the importance of strengthening public legal awareness and optimizing the role of judicial institutions in ensuring the just distribution of inheritance in order to prevent and minimize prolonged family conflicts.

Abstract

This study examines the legal and implementation challenges of using trademark rights as fiduciary guarantees to accelerate bank financing in Indonesia. Employing normative legal research with statutory and conceptual approaches, the analysis covers the Civil Code, Fiduciary Guarantee Law, Trademark Law, Copyright Law, Patent Law, and Creative Economy Law. The findings reveal that trademark rights, classified as intangible movable assets under the Civil Code, possess a sound juridical foundation for fiduciary security. However, there is normative disharmony: the Trademark Law remains silent on fiduciary transfers, while copyright and patent laws explicitly authorize them. The Creative Economy Law resolves this ambiguity by expressly permitting trademarks as fiduciary collateral. Despite this normative progress, implementation in Indonesian banking practice remains unrealized due to fundamental obstacles, including complex valuation, the absence of specialized institutions and standardized methodologies, prudential concerns, and a lack of uniform operational protocols. Addressing these challenges requires coordinated efforts among the government, financial authorities, and banks to develop valuation infrastructure, regulatory guidance, and internal banking capacity.
