Abstract

Sappa Barakka (Tabarruk) Merupakan sebuah tradisi yang yang biasa dijalankan oleh masyarakat bugis makassar ke benda peninggalan dan makam para wali dan ulama sebagai perantara untuk mendapatkan berkah dari Allah SWT, seperti halnya dengan makam Anregurutta Ambo Dalle yang terletak di samping masjid DDI AD Mangkoso jalan poros Barru Pare-pare yang sering diziarahi oleh santri, masyarakat, dan musafir untuk menjadikan makam anregurutta sebagai perantara mendapatkan berkah dari Allah SWT,  namun tentunya praktek tersebut masih menjadi perdebatan dikalangan ulama khususnya dari ulama ibnu taimiyah dan pengikutnya oleh karena itu dalam tulisan ini penulis  akan menganalisis mengenai praktek tradisi sappa barakka yang dilakukan masyarakat setempat di makam anregurutta ambo dalle dan korelasinya dengan nilai-nilai ajaran Islam dalam tinjauaan hukum Islam dan diharapkan dengan tulisan yang sederhana ini mampu untuk memberikan informasi kepada pembaca tentang Tradisi Sappa Barakka (Tabarruk) khususnya di makam anregurutta ambo dalle.Kata Kunci: Tradisi, Sappa Barakka, Tabarruk dan Sosiologi Hukum Islam

Abstract

This article discusses non-Muslim leaders in the region choosing Muslims from the views of Nahdlatul Ulama and Muhammadiyah. The formulation of the problem to be answered in this study is What is the leadership succession procedure in Islam? (2) What is the fiqh view of non-Muslim leadership? (3) What is the view of the Islamic community organizations Nahdlatul Ulama and Muhammadiyah on the law of choosing non-Muslim leaders in Muslim-majority areas?The type of research used by the author is library research which is guided by data processing and is also obtained from various literature related to the title of this article which is sourced from primary data and secondary data. The research approach used is a political approach. The results of this study indicate that the leadership succession procedure in Islam there is no standard and standard procedure set by the Al-Qur'an and Hadith, but the jumhur of ulama agrees that leaders in Islam are chosen in two ways, namely appointed by ahlul halli wal aq in the election committee and appointed by the previous leader. The majority of fiqh scholars view that non-Muslim leadership in Muslim-majority areas is not allowed because their leadership is not valid according to Islamic sharia, unless these non-Muslim leaders lead and control in non-Muslim-majority areas. Meanwhile, in the view of Nahdlatul Ulama and Muhammadiyah regarding the law of choosing non-Muslim leaders, there is already a fatwa stipulation from the two organizations that it is haram to choose non-Muslim leaders but Nahdlatul Ulama provides a little leeway by exempting in an emergency.Keywords: Non-Muslim Leaders, Succession, Nahdlatul Ulama, Muhammadiyah

Abstract

Pencantuman labelisasi halal pada produk dapat memberikan kepercayaan yang meningkat pada konsumen. Sikap ragu-ragu tidak akan menyelimuti konsumen ketika ingin membeli sebuah produk. Pendekatan yang digunakan sosial-empirik. Hasil penelitian menemukan bahwa proses labelisasi halal suatu produk di Kota Makassar sama dengan proses labelisasi halal di daerah manapun di Indonesia, proses sertifikasi halal untuk mendapatkan labeli halal memerlukan waktu 21 hari kerja muali dari pendaftaran dokumen ke Badan Penyelenggara Jaminan Produk Halal sampai dengan keluarnya sertifikat halal. Perspektif maslahah mursalah terkait dengan labelisasi halal suatu produk merupakan kemaslahatan yang tidak hanya mementingkan satu pihak melainkan untuk pelaku usaha itu sendiri dan konsumen atau masyarakat, karena pada dasarnya maslahah mursalah adalah kemaslahatan yang menyangkut kepentingan orang banyak. Kemaslahatan ini tidak berarti untuk kepentingan semua orang, tetapi bisa berbentuk kepentingan mayoritas umat atau kebanyakan umat. Walaupun, tidak ada nas atau dalil al-quran yang mengatur dengan jelas. kepercayaan konsumen terhadapa labelisasi halal di Kota Makassar sekarang ini sangat baik dikarenakan dengan adanya label halal di kemasan suatu produk memberikan jaminan keamanan dari segi kehalalan yang membuat konsumen tidak lagi dirundung keragu-raguan saat akan membeli dan mengonsumsi suatu produk.

Abstract

The major objective of this research was to investigate the concept of Zakat’s haul during the pandemic based on the opinions of four big Imams of Islam. In addition, this research also aimed to know the law of expediting the zakat before its haul. The methodological approach taken in this research was qualitative approach by using the library research method. The scientific approaches employed by the researcher were language and normative juridical approaches. This study indicated two major findings. Firstly, in general, it was apparent that no requirements are needed for Zakat’s haul on agricultural and fruit according to the majority of four scholars. While Hanafiyyah argued that one-year haul is a requirement for zakat including on agricultural products and fruits, Mālikiyyah and Syafi'iyyah contrastingly suggested that the completion of one year (haul) is a mandatory condition for zakat only on goods such as gold and silver, produces, and livestock and not for the materials such as minings, inventions, and agricultural products. In the similar vein, Hanabilah suggested that one-year haul requirement is only given on gold, silver, livestock and produces. Other types such as fruits, agricultural products, mining goods, ancient relics are not required to complete one-year haul. Secondly, it is worth noticing that despite the differences, the opinions of the four Imams regarding the importance of expediting the zakat payments are the same. It should be paid based on the condition of its Haul. Several implications were drawn from this research. Firstly, theoretically, there are no disputes among the opinions of four Imams regarding the law of immediacy on zakat payments. However, the difference in the understanding of their followers and certain Muslim communities that may causes various contradictions in understanding the issue. Secondlt, practically, it is expected for all the related parties such as BAZNAS (Zakat Management Body) to educate people related to the wrong paradigm occurring among muslims in Indonesia.

Abstract

This research aims to discuss the problems of repeated Hajj and Umrah according to Ali Mustafa Yaqub from the perspective of Islamic jurisprudence. This research includes library research with a normative and methodological approach. The existing data was collected then processed and analyzed using content analysis and comparative analysis methods. The results of the research show that Ali Mustafa Yaqub's opinion in forbidding or disallowing Hajj and Umrah is repeatedly different from what is understood by fiqh scholars. The Prophet's deeds. who only performs Hajj once and performs Umrah four times not because he hates this act, but because of several other reasons behind it. The argument that social worship is more important than the Sunnah Hajj and Umrah is also inappropriate because it is only based on a textual understanding of the propositions. Every Muslim may perform the Hajj or Umrah whenever he is able to do it while taking into account the advantages and disadvantages that may occur during the journey, such as when he does not have the physical strength or funds, the atmosphere is not conducive, or for other reasons that cause someone not to be able to go at that time.

Abstract

This article aims to describe and Analyze dissent from Maliki and Hanbali on the practice of istibdāl endowments and endowment empowerment adopted by Act No. 41 of 2004. Type this research is the library which is based on data management obtained from several kinds of literature. This research approach uses a normative approacpp. This study indicates that there are differences in the views of the Maliki School and the Hambali School related to the practice of istibdal waqf. In this paper, the opinion of the Maliki School distinguishes two categories in the practice of istibdal waqf, namely movable waqf property and immovable waqf property. Movable waqf property is allowed to practice istibdal waqf because the movable waqf property can no longer be used. At the same time, the waqf property that does not move is not allowed to practice istibdal except with emergencies such as the expansion of masjid, cemeteries, and public roads, unlike the case with the Hambali School, which does not distinguish movable waqf property or immovable waqf property. This school prioritizes the benefits of the waqf. If the community can no longer use it, it is permissible to practice istibdal following its terms and conditions. Moreover, the ability to practice istibdal waqf in the Hambali School is quite relevant to conditions in Indonesia, following Law Number 41 of 2004 concerning waqf, which both aim to optimize the benefits of waqf and empowering waqf assets

Abstract

AbstrakTulisan ini membahas tentang status hukum rumah potong ayam yang ada di pasar sentral rakyat Sungguminasa Kabupeten Gowa. Masalah ini kemudian disusun ke dalam submasalah atau pernyataan penelitian, yaitu 1). Apa standarisasi  LPPOM MUI dalam sembelihan ayam potong?, 2) Bagaimana status hukum ayam potong yang dijual di pasar?. Tulisan ini menggunakan penelitian lapangan (field research), yang di mana penulis langsung terjun ke lapangan dengan diperkuat dengan hasil wawancara dan dokumentasi. Hasil penelitian ini menunjukkan bahwa pemotongan ayam yang halal mengacu pada standarisasi LPPOM MUI (Majelis Ulama Indonesia) adapun standar yang ditentukan yaitu ada 8 dan penyembelihan ayam potong di pasar sentral rakyat Sungguminasa kabupaten Gowa halal hanya saja belum memiliki labelisasi halal dari Majelis Ulama Indonesia.Kata kunci: Penyembelihan; Ayam potong; Standarisasi LPPOM MUI.  AbstractThis paper discusses the legal status of chicken slaughterhouses in the Sungguminasa people's market, Gowa Regency. This problem is then organized into subproblems or research statements, namely 1). What is the standard of LPPOM MUI in slaughtering of broilers ?, 2) What is the legal status of broilers sold in the market ?. This paper uses field research, in which the writer jumps into the field with the results of interviews and documentation. The results of this study indicate that halal chicken slaughtering refers to the standardization of LPPOM MUI (Indonesian Ulema Council) as for the specified standards, namely 8 and slaughtering of slaughtered chickens in the central market of the people of Sungguminasa, halal Gowa regency, however, it does not yet have halal labeling from the Indonesian Ulema Council.Keywords: Beef chicken, LPPOM MUI Standardization, Sungguminasa people's market, Gowa district.

Abstract

Abstrak artikel ini membahas tentang proses Pelepasan Nazar pada pemakaman aggalarrang tanginunga jene’ Kabupaten Jeneponto Provinsi Sulawesi Selatan, kemudian terdapat Rumusan Masalah yakni Bagaimana Menurut Hukum Islam tentang pelepasan Nazar, Bagaimana Tata Cara pelepasan Nazar di pemakaman di Desa Balang Lompoa Kabupaten Jeneponto, Bagaimana Menurut Mazhab Syafi’I dan Mazhab Maliki tentang Nazar. Penelitian ini menggunakan metode kualitatif (filed research) atau penelitian lapangan yakni mencari secara langsung, sedangkan pendekatan yang digunakan dalam penelitian ini adalah pendekatan Syar’I, dan sosiologis. Adapun penggumpulan data yang digunakan dengan caa wawancara yaitu, Juru kunci serta penjaga makam, perziarah makam. Sedangkan metode penggelolaan data melalui beberapa tahap sehingga menghasilkan data yang lebih akurat, yakni identifikasi data, reduksi data dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa proses pelepasan Nazar  di makam gallarang tangginunga jene’  sebab Masyarakat yang datang untuk bernazar di makam gallarang tangginunga jene’ berkeyakinan bahwa jika bernazar dimakam doa dan harapan yang dipanjatkan akan cepat dikabulkan karena makam merupakan salah satu karaeng yang ada di Kabupaten Jeneponto . serta perziarah beranggapan bahwa jika bernazar dapat membantu menyelesa ikan suatu maslaah bagi kehidupanya.Kata Kunci :Fikih; Nazar; Mazhab Syafi’i dan Maliki.Abstrack This article discusses the process of releasing Nazar in the funeral aggalarrang tanginunga jene 'in Jeneponto Regency, South Sulawesi Province, then there is a Problem Formulation namely How According to Islamic Law about the release of Nazar, How is the Procedure for releasing Nazar in a funeral in Balang Lompoa Village, Jeneponto Regency, How According to the Syafi School of Law 'I and the Maliki School of Nazarism. This study uses a qualitative method (filed research) or field research that is looking directly, while the approach used in this study is the Syar'I approach, and sociological. As for the collection of data used by caa interviews, namely, key keeper and guardian of the tomb, pilgrimage tomb. While data management methods go through several stages so as to produce more accurate data, namely dataidentification, data reduction and conclusion drawing. The results of this study indicate that the process of releasing Nazar in the tomb of gallarang Tangginunga Jenene 'because the people who come to vow at the tomb of gallarang Tangginunga Jenene' believe that if the vow is buried in prayer and the hope that is offered will be quickly granted because the tomb is one of the karaeng in the district of Jeneponto .and pilgrims assume that if vows can help resolve fish a problem for their lives.Keywords : Fiqh;  Nazar; Syafi'I School and Maliki School.

Abstract

Artikel ini mengkaji tentang harta warisan yang dijadikan jaminan dalam transaksi utang piutang (Studi Komparasi Fiqh dan Hukum Positif). Jenis penelitian yang digunakan dalam penelitian ini adalah deskriptif kualitatif. Deskriptif kualitatif adalah penyelidikan yang menafsirkan peristiwa atau fenomena, deskriptif kualitatif digunakan untuk mencari makna bagi suatu fenomena dengan menggunakan teknik analisis mendalam yang meneliti masalah, yaitu dengan meneliti harta warisan yang dijadikan jaminan transaksi utang-piutang (studi komparasi fiqh dan hukum positif). Hasil dari penelitian ini yaitu baik dalam perspektif fiqh maupun hukum positif sama-sama melarang melakukan transaksi utang piutang dengan jaminan harta warisan yang masih dikuasai pewaris, karena syarat atau kriteria dari kedua dasar hukum tersebut adalah jaminan harus merupakan hak milik yang dikuasai oleh peminjam. Hanya saja perbedaan antara kedua dasar hukum tersebut adalah terdapat pengecualian dalam hukum positif ketika melakukan transaksi utang piutang dengan jaminan harta warisan.
