Abstract

The purposes of this paper are to identify and examine the revocation of political rights for corruptors as an extra-ordinary measure. The research showed that law enforcement through penal policies still have shortcomings such as light criminal sentence for perpetrators of criminal acts of corruption as well as lack of awareness among judges to apply the additional sentence of fixed-time revocation of rights. Penal law enforcement requires integral and sustainable policies through non-penal policies (prevention). Preventive efforts should be responsive to the demands of the community at large for officials who are clean, honest and who have integrity. Non-penal law shall be enforced through the concept of developing smart and integrity-based politics.

Abstract

The closeness of women to poverty shows that development still maintains women's subordination and places women in a marginal position. What is the analysis of the Feminist Legal Theorist (FLT) in the elimination of sexual violence? Feminist Legal Theory (FLT) as one of the streams in Philosophy of Law is one of the schools of thought that was born from the main philosophy of the paradigm of Critical Theory Feminist Legal Theory (FLT) as one of the streams in the paradigm of critical theory. It is used to analyze the complexity of the needs of victims, both women, girls, boys, and girls. The Bill on the Elimination of Sexual Violence uses the Feminist Legal Theory (FLT) as an analysis so that in every norm that is formulated this bill always considers what specific experiences of women, especially victims of sexual violence. Legal protection against the elimination of sexual violence is a form of implementation of the second principle of Pancasila, namely a just and civilized humanity.

Abstract

The research stems from Decision Number 224 PK/PID.SUS/2018 which grants the application for judicial review (hereinafter abbreviated as PK) by a suspected narcotics abuser with a novum (new evidence) in the form of previous judges' decisions. In this case, this study aims to conceptualize how the regulation of PK legal remedies in criminal cases should be. This research is a normative legal research, the approach used is a case approach, a comparative approach, and a conceptual approach, with a literature study research technique. After knowing the arguments for the admissibility of submitting a PK in the form of a District Court Decision, the author makes several comparisons with the Criminal Procedure Code (America and France), and concludes based on this comparison that the use of the basis for submitting a PK should be regulated clearly and firmly in the Criminal Procedure Code, because the two countries in its criminal procedural law it expressly states that the submission of a PK must be based on new facts and evidence which, if presented at the previous trial, has the potential to reduce or even abort the prosecution's charge

Abstract

This article aimed to analyze the problem of legal cases accumulation, especially default on credit contracts in court. It also analyzes the effectiveness of implementing a small claim court in contract default and the independence of a single judge in handling cases through the small claim court mechanism. Small claim court also to offer a breakthrough in the settlement of bad loans related to contract defaults to reduce the burden on courts in Indonesia and provide legal certainty to business actors. The sole judge also examine, resolve and decide on inheritance cases in a fast and efficient process to issue a fair decision for all parties. This normative study was carried out using statutory, case, comparative law, and analysis content approaches. The research results showed that the filing of small claim court increased 10 times from 2015 to 2020, with the plaintiffs dominated by banks in bad credit cases. A small claim court provides benefits the bank and the customer because it speeds up the settlement of the plaintiff's money in a bad credit case with a case value of not more than 500 million, especially for microloans in a maximum period of 25 days. Furthermore, the latest regulation of 2019 concerning small claim court gives judges the authority to confiscate guarantees and conduct auctions to carry out forced executions through the Court Execution Auction process.

Abstract

Konsep restorative Justice sebagai bentuk upaya penyelesaian perkara diluar pengadilan diperlukan dalam menyelesaikan permasalahan overcapacity narapidana di lembaga pemasyarakatan. Overcapacity pada Lembaga Pemasyarakatan dipengaruhi oleh beberapa faktor salah satunya tingginya presentase penggunaan pidana penjara pada peraturan yang berlaku. Penerapan konsep restorative justice dapat meminimalisir penggunaan pidana penjara sehingga permasalahan overcapacity di Lembaga Pemasyarakatan dapat diselesaikan. Metode penelitian pada penulisan hukum ini adalah penelitian yuridis empiris. Kebijakan restorative justice diatur dalam instrumen hukum internasional dan hukum nasional. Hasil penelitian bahwa Kebijakan formulasi restorative justice dalam menanggulangi overcapacity narapidana telah diatur melalui Vienna Declaration 2000, Standart Minimum Rules For the Treatment of Prisoners,Uu No. 12 Tahun 1995 tentang Pemasyarakatan, Perkapolri Nomor 6 Tahun 2019, Perjak No. 15 Tahun 2020, Kepdir Badilum MARI No. 1691/DJU/SK/PS.00/12/2020). Implementasi Konsep Restorative Justice Dalam Upaya Menanggulangi Overcapacity Di Lembaga Pemasyarakatan Kelas I Semarang dalam pelaksanaanya dilakukan oleh beberapa lembaga seperti: Polri, Kejaksaan, dan Pengadilan.

Abstract

Penelitian ini bertujuan untuk mengetahui: (1) untuk mengetahui peningkatan aktivitas belajarsiswa dengan penerapan model pembelajaran group investigation, dan (2) untuk mengetahuipeningkatan hasil belajar siswa dengan penerapan metode oembelajaran Group InvestigationPada Siswa Kelas X SMK Pancasila 1 Kutoarjo. Jenis penelitian ini adalah Penelitian Tindakan Kelas(PTK), yaitu penelitian yang berusaha meningkatkan hasil belajar dan keaktivan belajar, suaturencana pembelajaran terhadap kinerja guru serta interaksi antara siswa dengan siswa, dan siswadengan guru, adapun jumlah subyek adalah 28 siswa dengan tingkat kemampuan belajar K3 yangbervariasi. Metode pengumpulan data yang digunakan adalah metode angket dan soal yangsudah dilakukan uji validitas dan reliabilitas. Analisis data menggunakan teknik deskriptifkuantitatif.Hasil belajar siswa kelas X TKR SMK Pancasila kutoarjo menggunakan metode GroupInvestigation memperoleh nilai rata-rata pada prasiklus sebesar 63,03 termasuk kategori cukupbaik, sedangkan nilai rata-rata pada siklus I mencapai 73,75 dan termasuk dalam kategori cukupbaik. Pada siklus II, nilai rata-rata yang dicapai adalah 78,75. Peningkatan dari prasiklus ke siklus Isebesar 10,72. Peningkatan dari siklus I ke siklus II sebesar 5. Dengan demikian dapat dibuktikanada peningkatan dalam pembelajaran pada mata diklat Keselamatan dan Kesehatan Kerja (K3)menggunakan metode Group Investigation pada siswa kelas X TKR SMK Pancasila kutoarjo.Kata kunci: hasil belajar, metode group investigation.PENDAHULUANBelajar

Abstract

Criminal justice system as a tool of law enforcement, didn't work optimally in Indonesia.  It often being used by executive power because its position and function didn't independent and subordinated by executive power. Judicial power is an independent power, but  other subsistem in CJS such as investigative power,  prosecution power, and Executors  power structurally and functionally are under executive power, and as result that their roles as a power instrument to service power's interest. This research purpose to set ideal format in integrated CJS working , to manifest judicial power  in the independency and integrated  criminal law enforcement  through reconstruction and reorientation of criminal justice system construction, substantial and cultural. Main object in this research is criminal law enforcement policy, juridical normative and sociological approach, primary and secondary data as a main data to qualitative analyzing. The result of this research show that function of subsystem in criminal justice system (such as investigation, prosecution, and execution power ) have not show independent yet, cause of under the executive power. Anyway judicial power is set as independent power out of executive power, in organizationing, budgeting, staffing, and carrier system under one roof system that subordinated by Supreme Court . Here CJS is unsystemic but partially and fragmentair. This situation result subsytem rivality and in the end can be barrier in CJS performances. There is policy measures to implement integrally of independency criminal justice system by  systemic approach  to reset related policy in the law substance, the law structure and the law culture. Abstract

Law as a weergave (refiection) in a society lives and created by the society itself therefore the iaw in society becoming the refiection of socio-phiiosophic values mf society itself. Indonesian society has its characteristics of being communal, social-religious and prioritizing the harmony of society hence here the life of Indonesian Law automatically imbued by those values. Indonesian Customary Law is the law that created and desired by the Indonesian society itself based on the value of its socio-phiiosophic to regulate the life of society, nation, and state. The existence of customary law characterized as rooted, paculier and society-based, means the customary law lives and develops in accordance to the values of the society and can not be replaced since it is the spirit and the will of society. The Dutch Law shifted and turned the customary (customary criminal) law off. The characteristic differences caused the discrepancy or the value gap occured. The customary criminal law has its characteristics such a) comprehensive and unifying; b) is opened; c) differentiating the probiems; d) justice by request and e) actions in the form of reaction or correction. Substantially, the customary criminal law has several differences to the Criminal Code, they are: according to the Criminal Code there will be a certain person only that can be convicted, meanwhile on the customary criminai law not only a person but law firm and the actor's family can also be asked for taking responsibilities. According to Criminai Code a person can only be convicted if the actions the person did were having the element of accident or negligence, while in the customary criminai law, the element of error is not an absolute element; on the Criminal Code been known and distinguished between assistance, persuade and participated in a crime, for which is unknown in the customary criminal law. All who took part against the rules of customary law are required to be accounted for; in the customary criminai law doesn't recognize the trial term, as its reulated in the Criminal Code; Criminal Code based on the system ofprae-exsistence regels while the customary criminal iaw doesn t; the customary iaw doesn t differentiate between civil law and criminal law; Criminal Code has its pattern as being intellectual and rational while in the other hand the customary criminal law has its base on cosmic think and prioritizing the harmony of society. The application of customary criminal law in the process of criminal justice having its base on the Act No. 1 Year1951 concerning Temporary Actions to Organize Events Unitary Structure of Power and Civil Courts, Article 5 paragraph (3) sub b. Institutionalization of customary criminal law in the life of the Indonesian national law occurs through three tracks, namely the judicial track, legislation track, and academic track. Abstract

This study aims to explore the process of enculturation of mask art with a case study in the wooden batik (batik Kayu) enterprise of Bobung Village, Patuk, Gunung Kidul, Yogyakarta. This study method uses a netnographic approach, which in principle is the same as classical ethnography, except that netnography uses the internet as a research media. The data were sourced from informants, places & events, and documents or archives. Data from informants were collected using in-depth online interviews. Place and event data were collected using online participatory observation techniques. In addition, the source documents or archives were collected using data analysis techniques or literature studies on relevant online data. The validity of the data was tested by using informant review techniques and source triangulation. Data were analyzed using flow techniques with data reduction, display, and verification procedures. The results of the study show that the process of enculturation or culture of mask art, both classic masks and creative masks (batik Kayu), is carried out informally (family environment), non-formal (community, UKM, and studio), and formal (learning in schools). This enculturation process is carried out from generation to generation, when the mask is still a classic mask (Panji mask) until the mask develops into a superior product with economic and tourism value as it is today (Creative Mask). The art of batik and classical masks has become the identity of the people of Bobung Village, Gunung Kidul, who have undergone changes in form, function and meaning during the enculturation process from previous generations to the next.

Abstract

The purpose of this study is to study and analyze the actualization of restorative justice in the Indonesian criminal justice system. In this writing, the author uses normative juridical methods with research specifications in the form of descriptive analysis. Based on the discussion of the weaknesses of the Indonesian criminal justice system, the criminal justice system tends to be emotional in punishing perpetrators. An overly positivist understanding places the law as an absolute rule in order to achieve legal certainty and disregard the expediency and justice of the law for perpetrators and victims of a criminal justice legal system that tends to override the rights of defendants or suspects and victims. Restorative justice is a way of resolving cases through legal processes outside the courts that aim to achieve justice that emphasizes the recovery of the condition of the perpetrator and victim. Recovery is defined as recovery to the victim as well as the perpetrator. So what is restored is not just the victim. The position of restorative justice in Indonesia is strictly regulated in various laws and regulations such as the 1945 Constitution of the Republic of Indonesia; Law Number 48 of 2009 concerning Judicial Power, Law Number 14 of 1985 as amended by Law Number 5 of 2004 as last amended by Law Number 3 of 2009 concerning the Supreme Court.
