Abstract

This research discusses the practice of muhallil marriage, namely marriage which aims to make the relationship between a husband and wife who have divorced through triple talaq legal. In the case of triple talaq, the husband cannot reconcile unless the ex-wife first marries another man. Some husbands carry out formal muhallil marriages, where the ex-wife marries a third party and then separates after some time, so that she can remarry her first husband. This research uses a qualitative descriptive method through interviews and literature study. The results of the research show that muhallil marriages in Mangar Village, Tlanakan District, Pamekasan Regency are valid according to law, because they fulfill the terms and conditions of marriage without special conditions in the contract. According to Islamic law, muhallil marriages are valid based on the opinions of Imam Syafi'i and Abu Hanifah, although several other schools of thought differ.

Abstract

This study aims to analyze the resolution strategies for Non-Performing Financing (NPF) in murabahah contracts at PT BPRS Sarana Prima Mandiri Pamekasan and assess their alignment with Sharia principles. Employing a descriptive qualitative method, data were obtained through observation, semi-structured interviews, and document analysis. The findings indicate that NPF arises from both internal factors—such as moral hazard and fund misallocation—and external factors like business failure and economic shocks. To address this, the bank implements a dual-track resolution framework: non-litigation strategies grounded in Islamic ethical values (musyawarah and ta’awun), including collection efforts, rescheduling, reconditioning, restructuring, and repayment incentive programs; and litigation mechanisms, specifically through the small claims court system as a last resort. These strategies are systematically structured into a conceptual model that integrates risk sources, resolution mechanisms, and expected outcomes in accordance with maqāṣid al-sharīʿah, especially the protection of wealth (ḥifẓ al-māl), life (ḥifẓ al-nafs), and dignity (ḥifẓ al-ʿirḍ). The study contributes both theoretically—by proposing a localized, Sharia-compliant NPF resolution framework—and practically, by offering policy recommendations such as early warning systems, documentation digitalization, and capacity-building in legal and Sharia literacy. These strategies are essential for maintaining institutional resilience and the sustainability of Islamic microfinance.

Abstract

This study examines the dynamics of divorce and divorce laws in family law legislation in Indonesia and Egypt as part of legal reforms aimed at improving the status of women in the context of Islamic family law. Through a comparative normative study, this study analyzes the laws in force in both countries, where Indonesia regulates divorce through Law No. 1 of 1974 concerning Marriage and the Compilation of Islamic Law (KHI) by emphasizing court procedures and mediation, while Egypt has been reforming since 1915 through a series of laws (Law No. 25 of 1920, 1929, to Law No. 100 of 1985) that are more progressive in granting women the right to file for divorce on expanded grounds such as inability to support, infectious diseases, arbitrary treatment, and neglect. The results of the study show that although the two countries use different approaches—Indonesia focuses on multi-layered court procedures and mediation, while Egypt on expanding women's rights—both have similar goals in protecting the rights of women and children and prioritizing justice, family protection, and legal certainty through official registration.

Abstract

Abstract

Integration of science is a combination of separate sciences into a cohesion of knowledge, in this case the unification between the sciences that are religious in nature and the sciences that are general in nature. Integration of religion and general science is an effort to merge polarism between the science of religion and science which results from the mindset between religious sciences as an independent source of truth and science as an independent source. The concept of integration of religious science and general science in INSTIKA is inseparable from the basic values (qiyamusiaanyah) that are embedded in every step and educational activity carried out in it. The Islamic Institute of Annuqayah cults itself as a campus of manners, manners are an acronym for Takwa, Tafaqquh, Khidmah and rahmatan lil alamin. The three basic values of INSTICS are summarized from QS. At-Taubah verse 122. The rahmatan lil „alamin is a universal value that encompasses the three basic values which function to underlie, integrate and direct their orientation. Application of the curriculum in INSTIKA there is no separation between religious science and general science. In terms of concepts, religion and general science are taught in lecture sessions at INSTIKA, such as tasawuf, logic or mantiq lecture material, philosophy, interpretation, science and so on, all organized in curriculum units according to each study program. in INSTIKA.
