Abstract

Abstract: Along with the times, now the indigenous Mandailing people can be found in various regions throughout Indonesia. One of the areas where the Mandailing indigenous people can be found is in the Rokan Hulu Regency of Riau. The Mandailing indigenous people in the area live by customary values ??brought from their place of origin, including in the field of marriage. The author is interested in researching how traditional marriages are carried out in the Mandailing community, especially nasution in the current era of globalization. This research was conducted using empirical methods, using primary data, and inductively concluded. The results of the study show that in the development of people's lives, especially in the current era of globalization, some members of the community do not practice it due to economic factors that make it difficult to make honest money payments to women, there are changes in people's thinking that are influenced by modernization or also influenced by foreign cultures. Keywords: Traditional marriage; Development Marga nasution Abstrak: Seiring dengan perkembangan zaman, sekarang masyarakat adat Mandailing dapat ditemui di berbagai daerah di seluruh Indonesia. Salah satu daerah dimana dapat ditemui masyarakat adat Mandailing adalah di daerah Kabupaten Rokan Hulu Riau. Masyarakat adat mandailing di daerah tersebut hidup dengan nilai-nilai adat yang dibawa dari daerah asal, termasuk di bidang perkawinan. Penulis tertarik meneliti bagaimana pelaksanaan perkawinan adat di lingkungan masyarkat Mandailing khususnya nasution di era globalisasi saat ini. Penelitian ini dilakukan dnegan metode empiris, menggunakan data primer dan menyimpulkan secara induktif. Hasil penelitian memperlihatkan bahwasanya dalam perkembangan kehidupan masyarakat, terutama di era globalisisasi saat ini, sebahagian anggota masyarakat tidak menjalankannya dikarenakan faktor ekonomi yang sulit untuk melakukan pembayaran uang jujur kepada pihak perempuan, adanya perubahan pemikiran masyarakat yang dipengaruhi oleh modernisasi atau dipengaruhi juga oleh budaya asing. Abstract

Abstract: Researchers conducted research on the Review of the Position of Widows in the Traditional Inheritance System in the Batak Toba Society Study in Sitapongan Village, Sijama Polang District, Humbang Hasundutan Regency, North Sumatra Province. Most of the Batak people who live in Sitapongan Village still adhere to a patrilineal kinship system which does not allow widows as heirs and does not recognize the division of inheritance/inheritance. The purpose of this study was to determine the position of widows in the customary inheritance system, in the Toba Batak community, especially in Sitapongan Village, Sijama Polang District, Humbang Hasundutan Regency, North Sumatra Province. The type of research used in this research is observational research by means of a survey, meaning that a research conducted by the author directly goes down to the field to obtain information and data related to the author's research. The results of the study concluded that the position of the widow in the customary inheritance system in the Batak Toba Community due to the death of her husband has 2 options, namely the widow can remain under power and in the circle of relatives of her late husband and not remarry and the widow can return to her relatives (parboru). Settlement of disputes that occurred against widows who were abandoned in Batak custom in Sitapongan village, ended in marhata settlements or family settlements, there was no effort by the widows who were sampled to carry out settlements through the courts. Keywords: position of widow; traditional inheritance Abstrak: Peneliti melakukan penelitian tentang Tinjauan Kedudukan Janda Dalam Sistem Waris Adat Pada Masyarakat Batak Toba Studi Di Desa Sitapongan Kecamatan Sijama Polang Kabupaten Humbang Hasundutan Provinsi Sumatera Utara. Sebagian besar masyarakat Batak yang hidup di Desa Sitapongan masih menganut sistem kekerabatan patrilineal yang tidak memperbolehkan janda sebagai ahli waris dan tidak mengenal adanya pembagian harta peninggalan/ warisan. Tujuan dalam penelitian ini adalah untuk mengetahui kedudukan janda dalam sistem waris adat,pada masyarakat Batak Toba khususnya di Desa Sitapongan Kecamatan Sijama Polang Kabupaten Humbang Hasundutan Provinsi Sumatera Utara. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian observational research dengan cara survei, artinya suatu penelitian yang dilakukan penulis secara langsung turun kelapangan untuk memperoleh informasi dan data yang berkaitan dengan penelitian penulis. Hasil penelitian yang disimpulkan ialah kedudukan janda dalam sistem waris adat pada Masyarakat Batak Toba karena kematian suami memiliki 2 pilihan yaitu janda dapat tetap tinggal dibawah kuasa dan di dalam lingkaran kerabat almarhum suaminya serta tidak menikah lagi dan janda dapat Kembali ke kerabatnya (parboru). Penyelesaian sengketa yang terjadi terhadap janda yang ditinggalkan dalam adat batak di desa Sitapongan, berakhir dalam penyelesaian marhata atau penyelesesaian secara keluarga, tidak adanya upaya janda yang menjadi sampel untuk melakukan penyelesaian melalui pengadilan. Abstract

Abstract: Customary law is an unwritten law that is recognized in the 1945 Constitution. One of the indigenous peoples in Indonesia who still practice their customary law is the indigenous Malay community, especially in the city of Pekanbaru. The law of marriage for the Malay customary community must be carried out in stages and irrationally in accordance with the stages of the implementation of marriage and Malay teachings with Islamic nuances, especially in marriages between people with the title of King and people who do not have the title of King that occur among the Malay community which will also affect the children, assets, and the position of husband and wife. The main problem in this research is how the implementation of traditional Malay marriages between those with the title of King and those who do not have the title of King in Pekanbaru, and what are the legal consequences for the occurrence of marriages between those with the title of King and those who do not have the title of King for children, assets, and the position of husband and wife in the indigenous Malay community in Pekanbaru.The method used in this study when viewed from its kind is using observational research methods using survey methods. From the results of the research it is known that currently there are still many children from parents from among people with titles of Kings or nobles in Pekanbaru who carry out marriage customs, but many of these traditional marriage processions have been abandoned and keep up with the times which of course are no longer appropriate. with the authenticity of the marriage customs of the Malay community. Keywords: Marriage, Custom, Original, Titled King. Abstrak: Hukum adat merupakan hukum tidak tertulis yang diakui dalam Undang-undang Dasar 1945. Salah satu masyarakat adat di Indonesia yang masih menjalankan hukum adatnya adalah masyarakat adat Melayu terkhususnya di Kota Pekanbaru. Hukum nikah kawin bagi masyarakat adat Melayu harus dilaksanakan secara bertahap dan irasional sesuai dengan tahapan pelaksanan kawin kawin dan tunjuk ajar Melayu yang bernuansa Islam, terutama dalam perkawinan antara orang bergelar Raja dengan orang yang tidak bergelar Raja yang terjadi dikalangan masyarakat Melayu yang juga akan berpengaruh pada anak, harta, dan kedudukan suami istri.Permasalahan pokok dalam penelitian ini ialah bagaimana pelaksanaan perkawinan adat asli masyarakat Melayu antara bergelar Raja dengan tidak bergelar Raja di Pekanbaru, serta bagaimana akibat hukum terhadap terjadinya perkawinan antara yang bergelar Raja dengan tidak bergelar Raja terhadap anak, harta, dan kedudukan suami istri pada masyarakat adat asli Melayu di Pekanbaru.Metode yang digunakan dalam penelitian ini jika dilihat dari jenisnya yaitu menggunakan metode observasional researchdengan menggunakan cara survey. Dari hasil penelitian diketahui bahwa saat ini masih banyak anak dari para orangtua dari kalangan orang bergelar Raja atau bangsawan di Pekanbaru yang melangsungkan adat nikah kawin namun beberapa dari prosesi adat nikah kawin tersebut sudah banyak yang ditinggalkan dan mengkuti perkembangan zaman yang tentu saja sudah tidak sesuai lagi dengan keaslian adat nikah kawin masyarakat Melayu. Abstract

Abstract The problem of land ownership in Indonesia in general and in the Kesumbo Ampai Village area has complex problems. Among them, the government takes over land from the people, to be developed in accordance with the plans that have been set to continue economic modernization or the creation of oil palm fields for investors, both inside and outside the State. This land problem shows a conflict of interest between the government, which sees land as capital for national development, and local residents who see land as a source of income. Based on the above problems, the formulation of the problem is how is the legal review of the existence of customary land in the Sakai Tribe Village based on the UUPA. The research method uses observation research. The result of the research is that the existence of the Sakai tribe community has been based on the conditions of existence determined by law so that the Sakai tribe is still truly a customary law community, as well as the land or land on which they live is land belonging to their ancestors for generations which is still jointly owned, which in terms of management and control and use of the land still follows the rules of customary law that apply in their environment, supervised by the customary leader they have.

Abstract

Abstract Same-tribal marriages are common nowadays, because men and women love each other. However, this research focuses on the customary sanctions for same-ethnic marriages carried out by the Petalangan Malay indigenous people. Same-tribal marriage in Islam has no rules, but in customary law, same-tribal marriage will result in the consequences of customary law that applies in the Petalangan Malay indigenous people. Based on the background of the problem, the formulation of the problem raised is, what is the history of the Prohibition of Same-ethnic Marriage in the Petalangan Malay Indigenous Community in the Perbatinan Bunut Region. The research method is sociological law which is research that goes directly to the field. This research was conducted in the Balam Merah Spiritual Area, Pelalawan Regency. From this research, it is known that historically the prohibition on same-ethnic marriages for ninik mamak testifies that one person or one ethnic group is brother and sister. Therefore, if a person or group of people is prohibited from marrying, the prohibition is highly trusted and if it is carried out, bad things will happen to the couple and they are afraid of sanctions

Abstract Purpose from research this is for knowing the view of Islamic Law on Sanctions given to the Malay Customary Society Adventurers who do Marriage A tribe. Method research used is ethod research A sociologist who is plunged research directly to field. Research this done in Perbatinan Region Balam Merah District Opponent. In the Qur'an and Hadith no found about obligations or forbid marriage a tribe Customs that exist in the tribe Malay about ban married a tribe this grounded above existing confidence regularly down hereditary from generation generation. Though customs Malay Adventure forbid marriage a tribe, however marriage the said no ever canceled and fixed considered valid marriage that has been done one quarter said. This indicate marriage a tribe not including illegal category. Because if a marriage banned then marriage the said should cancelled.
