Abstract

This research aimed to provide efforts to strengthen the law if changes to regulations occur, which must be accompanied by academic and socio-political approaches. In Indonesia, there is a new form of sexual crime whether verbal, non-physical, physical, or online. The prevalence of such incidents reflects a troubling trend that needs urgent attention from both authorities and society. This research was field research, equipped with qualitative data. The data sources included observational research, interviews, and documentation as well as literature studies by reviewing documents relating to criminal sanctions for adultery, especially from the Criminal Code, outside the Criminal Code, and manuscripts of Islamic criminal law. The beneficial theory used was the Al-Būtī version, which emphasized the validity of al-‘uqūbah al-Islāmiyah. The research findings revealed that in the event of changes to criminal law in Indonesia, maslahat considerations are prioritized, particularly in cases of grave sexual crimes, the death penalty should be applied. The government must consider things such as benefits, cultural values, and societal perspectives when making criminal punishment policies. In Indonesia, several backgrounds supported the choice of the death penalty for sexual crimes. The expected benefits are community protection, preventative action, justice for victims, and the elimination of dangerous perpetrators in the future. The legal situation governing sexual crimes in Indonesia is increasingly pitiful, and a change is needed.

Abstract

This study examines the implementation of the Compilation of Islamic Law (KHI) in child care practices in Barru Regency, focusing on Article 77(3) concerning parental obligations to nurture and care for children from the perspective of maqāṣid al-sharī‘ah. Using a descriptive qualitative approach, the research draws on primary data from working parents in Barru District and secondary data from relevant studies. The analysis employs policy implementation theory and maqāṣid al-sharī‘ah. The findings reveal three predominant parenting models among dual-income families—direct, delegative, and participatory—each aligned with maqāṣid principles. The implementation of Article 77(3) is influenced by five key factors: limited understanding of KHI provisions, spousal communication and relations, time constraints and work demands, religious and local cultural values, and emotional stability within the household. Couples adopt seven main strategies to fulfill these obligations, including flexible role-sharing, spiritual guidance through daily worship, emotional communication, exemplary conduct, collaboration with third parties during work hours, adaptive parenting based on children’s needs, and open communication between spouses.

Abstract

Underage marriage remains a persistent social issue in Indonesia despite the enactment of Law Number 16 of 2019, which raised the minimum legal age of marriage for both men and women to nineteen years. Although legal reform provides stronger protection for children, its effectiveness largely depends on the active participation of educational institutions, particularly Islamic boarding schools (pesantren), in promoting awareness and preventive education. This study aims to analyze the strategies implemented by Nurul Azhar Talawe Islamic Boarding School, Sidenreng Rappang Regency, in preventing underage marriage following the legal reform of marriage age. This study employed a qualitative field research design. Data were collected through in-depth interviews, participant observation, and document analysis involving boarding school leaders, teachers, students, parents, and community leaders selected purposively according to their involvement in educational and marriage-related issues. Data were analyzed using the interactive model of data reduction, data display, and conclusion drawing, while source and method triangulation were employed to ensure credibility and trustworthiness. The findings reveal that the Islamic boarding school implements an integrated prevention strategy consisting of Islamic family education (fiqh munakahat), dissemination of marriage law reform, character education, counseling services, parental engagement, and collaboration with religious and governmental institutions. The effectiveness of these programs is supported by strong institutional commitment, parental involvement, and students' increasing awareness of educational attainment before marriage. Nevertheless, economic hardship, socio-cultural traditions, and peer influence remain major barriers to prevention efforts. The study contributes to the growing literature by demonstrating that Islamic boarding schools function not only as religious educational institutions but also as strategic social agents in child protection and underage marriage prevention through value-based education and community engagement.

Abstract

Irregularities in government project tenders remain a serious problem because they cause financial losses to the state, reduce project quality, and weaken public trust in government institutions. This study aimed to analyze the forms of irregularities occurring in government project tenders in Tolitoli Regency and to examine the relevance of Hifẓ al-Māl to procurement governance. The study employed a descriptive-analytical qualitative approach with a normative-empirical paradigm. Data were collected through interviews, observations, and documentation involving 15 informants consisting of religious leaders, government officials, contractors, and community leaders. The data were analyzed using the interactive model of Miles and Huberman and a normative-theological approach based on the principles of maqāṣid al-syarī ah. The results showed that the dominant forms of irregularities included the predetermined selection of tender winners, personal relationships between officials and contractors, manipulation of administrative documents, lack of transparency, and delays and discrepancies in project implementation. All informants considered Hifẓ al-Māl to have strong relevance as an ethical foundation for tender governance because it regards public wealth as a trust that must be managed honestly, fairly, transparently, and responsibly. Therefore, the implementation of Hifẓ al-Māl may serve as a basis for strengthening the integrity of public officials, improving transparency, and preventing corruption, collusion, and abuse of authority in government project tenders.

Abstract

This article examines the relationship between prophetic hadith and Pasang ri Kajang, the customary normative system of the Ammatoa Kajang community, through the framework of wilaayat al-amr in environmental governance. Situated at the intersection of hadith studies and Islamic constitutional thought, the study moves beyond textual interpretation to analyze how ecological hadiths function as sources of public authority in regulating collective environmental conduct. While previous scholarship has discussed Islamic environmental ethics and indigenous ecological traditions separately, their interaction as parallel normative authorities remains insufficiently explored. Using a qualitative normative-comparative method, this study analyzes selected ecological hadiths through dirāyah al-hadith, supported by maqashid al-shari‘ah and legal pluralism approaches. These findings are then compared with Pasang ri Kajang as a form of customary environmental law. The study finds that prophetic authority and Ammatoa customary leadership represent distinct yet functionally comparable forms of ecological governance. Prophetic authority operates universally, whereas Ammatoa authority functions locally as a socially autonomous institution that may also be recognized as a form of constitutional legitimacy within plural legal systems. This article argues that wilaayat al-amr should not be confined to formal state power alone, but may also include legitimate authority oriented toward public welfare (maslahah ‘ammah). By proposing the concept of authoritative ecological convergence, this study contributes to hadith studies, Islamic constitutional law, and environmental governance by offering a model through which religious norms and indigenous authority may coexist in promoting ecological sustainability. More broadly, the findings suggest that contemporary environmental policy should incorporate socially legitimate local authorities as strategic partners of the state in conservation governance. Such an approach may strengthen legal compliance, reduce jurisdictional conflict, and enhance the sustainability of environmental regulation.

Abstract

Marriage in Indonesia reflects a dynamic interaction between religious norms and living customary practices; however, studies on the Bugis To Lotang community tend to be descriptive and rarely examine its compatibility with Islamic family law. This study aims to analyze the meaning and practice of the To Lotang wedding tradition, explore its dynamic changes, and assess its conformity with Islamic legal principles. This research employs a qualitative design using ethnographic and socio-legal approaches, supported by a normative juridical perspective. Data were collected through observation, in-depth interviews with customary leaders (Uwa’), and documentation in Amparita Village, Sidenreng Rappang Regency. The findings reveal that the To Lotang wedding tradition consists of pre-wedding, wedding, and post-wedding stages that embody symbolic, social, and spiritual meanings, reflecting values such as siri’ (self-esteem), pacce (solidarity), and respect for ancestors. The tradition has undergone adaptive changes due to modernization, particularly in the simplification of stages, without altering its core values. From the perspective of Islamic family law, most practices can be categorized as ‘urf (custom) that is permissible as long as they do not contradict Sharia principles. However, the absence of explicit ijab kabul raises concerns regarding legal validity, necessitating the integration of the Islamic marriage contract. This study contributes to the development of Islamic family law by offering a contextual understanding of the interaction between customary practices and Islamic law.
