Abstract

ABSTRAKTransek geologi Padalarang-Purwakarta sesuai SNI 1726:2019 dan SNI 2833:2016, menunjukan Padalarang dan sekitarnya terletak pada PGA=0,3-0,4g, PSA Ss 0,2 dt=0,6-0,7g dan PSA S1 1 dt=0,3-0,4g dan Purwakarta dan sekitarnya terletak pada PGA=0,25-0,3g, PSA Ss 0,2 dt =0,5-0,6g dan PSA S1 1 dt =0,25-0,3g, pada situs SB, dengan probabilitas 7% dala 75 tahun. Hasil penilaian  potensi bencana gempabumi lajur transek ini, menunjukan Padalarang dan Purwakarta pada kelas situs SC dan SD merupakan bagian dari  zona gempabumi D (SD1> 0,50g). Gaya Gempabumi Horizontal Statis (EQ)  pada kelas situs SC dan SD pada periode T=0,1 detik di Padalarang adalah 0,64 Wt dan 0,70 Wt dan di Purwakarta 0,68 Wt dan 0,70 Wt. Gaya Gempabumi Horizontal Statis (EQ) pada kelas situs SC dan SD untuk periode lebih besar atau sama dengan T0, dan lebih kecil atau sama dengan TS di Padalarang adalah 0,77 Wt dan 0,84 Wt dan di Purwakarta 0,84 Wt dan 0,84 Wt. Gaya Gempabumi Horizontal Statis (EQ) pada kelas situs SC dan SD untuk periode lebih besar dari TS untuk 2 detik di Padalarang adalah 0,28 Wt dan 0,32 Wt dan di Purwakarta 0,27 Wt dan 0,32 Wt.Indek potensi bencana gempabumi di lajur transek geologi Padalarang-Purwakarta ini, diharapkan dapat dijadikan data dasar penilaian potensi bencana dan risiko gempabumi untuk pembangunan infrastruktur jembatan KA dan Tol. Kata Kunci: Potensi Geologi, Bencana  dan Risiko Gempabumi ABSTRACTThe geological transect of Padalarang-Purwakarta according to SNI 1726:2019 and SNI 2833:2016, shows Padalarang and its surroundings are located at PGA=0.3-0.4g, PSA Ss 0.2 second=0.6-0.7g and PSA S1 1 second=0.3-0.4g and Purwakarta and its surroundings are located at PGA=0.25-0.3g, PSA Ss 0.2 second =0.5-0.6g and PSA S1 1 second =0.25-0.3g, at the SB site class, with a 7% probability at 75 years. The results of the the potential earthquake disasters assessment on this transect  show that Padalarang and Purwakarta in the SC and SD site classes are part of the D earthquake zone (SD1> 0.50g). Horizontal Static Earthquake Forces (EQ) on site class SC and SD at period T=0.1 second in Padalarang are 0.64 Wt and 0.70 Wt and 0.68 Wt and 0.70 Wt in Purwakarta. Horizontal Static Earthquake Forces (EQ) on site classes SC and SD for periods greater than or equal to T0, and less than or equal to TS in Padalarang are 0.77 Wt and 0.84 Wt and in Purwakarta 0.84 Wt and 0 ,84 Wt. Horizontal Static Earthquake Forces (EQ) on site class SC and SD for periods greater than TS for 2 seconds in Padalarang are 0.28 Wt and 0.32 Wt and in Purwakarta 0.27 Wt and 0.32 Wt.The index of the potential for earthquake disasters in the Padalarang-Purwakarta geological transect  is expected to be used as the basic data for assessing the potential for earthquake disasters risks for the construction of railway and toll bridge infrastructure. Keywords: Geological Potential,  Earthquake Disaster and Risk

Abstract

Since Religious Court Law was amended by Law No. 3 of 2006, every sharia economic case is stipulated as the competency of the Religious Court. Conversely, Bankruptcy Law No. 37 of 2004 has never been synchronized with the amended Religious Courts Law. Therefore, the competent court does not handle sharia economic bankruptcy (al-taflis) cases. This study aims to ensure that al-taflis can be examined based on sharia economic principles by the most appropriate judicial forum. It is normative legal research using primary and secondary legal materials such as court decisions, statutory, books, journals, reports, and internet sources, then analyzing and synchronizing to get an ideal formula regarding how al-taflis cases are settled in court. The result shows that al-taflis is appropriately stipulated as the absolute competence of Religious Courts. Case studies of al-taflis court decisions settled by the Commercial Court so far, also indicate that sharia principles are not sufficiently considered in the decisions, even ignored. Therefore, it is urgent to make synchronization efforts by amending the Bankruptcy Law until it can accommodate the settlement of al-taflis case through Religious Courts. Otherwise, it will be only a utopian sharia economic bankruptcy law

Abstract

This study aims to analyze how the state regulates the administration of unregistered marriages (nikah sirri) in Muslim minority communities in Jayapura City, with a focus on the practice of mass weddings organized to facilitate the registration of marriages. Unregistered marriages, which are not recorded by the state, are still found among Muslim minorities in Jayapura. Factors influencing the practice of unregistered marriages include economic limitations, lack of awareness about administrative procedures, and difficulty in accessing official marriage registration services. To address these issues, the Jayapura City government, through the Religious Affairs Office (KUA), the Religious Court (PA), and the Directorate General of Population and Civil Registration (DUKCAPIL), has initiated a mass wedding program aimed at simplifying the legalization process for couples who have not yet registered their marriages. This research uses a qualitative approach with interviews and observations of couples participating in the mass wedding program. The findings indicate that this program is effective in raising public awareness about the importance of marriage registration. However, challenges remain in terms of legal understanding and the readiness of couples to comply with the applicable administrative procedures. The study suggests the need for increased education about the importance of marriage administration and strengthening access to marriage registration services to reduce the practice of unregistered marriages. With the mass wedding program, it is hoped that all marriages in Jayapura City can be legally registered according to state law, providing optimal legal protection for married couples

Abstract

Article 28 of the Indonesian Constitution is formulated to guarantee the freedom of associations and assembly, including the formation of community organizations (ormas). Ormas holding legal entity status are accommodated under associations, while non-legal entity ormas can still register but do not have the same status. The distinction between ormas and associations lies in their legal recognition. Associations possess legal entity status, while ormas are considered non-legal entities. According to Article 20 of Law No. 17 of 2013, ormas have the right to cooperate with other entities to develop and sustain their organizations. However, such cooperation may give rise to conflict, which cannot always be avoided. This raises important questions, such as "Do ormas administrators possess full authority to undertake all legal actions?" and "What avenues are available for ormas to resolve disputes through litigation?" To address these questions, doctrinal research is conducted using both legislative and conceptual methods. The results shows that the authority of ormas administrators is strictly limited by legal provisions. Since ormas lacks  the legal standing required of legal entity, they  are are unable to resolve conflicts through litigation. In light of such challenges, it is recommended that ormas registration system include a comprehensive list of members authorized to act on behalf of the organizations in civil actions with third parties. This measure would enable ormas to explore non-litigation channels for resolving civil disputes, offering a practical alternative to formal court proceedings.

Abstract

Many academicians regret the removal of seven words in the Jakarta Charter and consider this a political defeat for Muslims. If the words had not been removed, Islamic law would be simple in its implementation in Indonesia. There was a new hope when the Presidential Decree of July 5th, 1959, stated to return to the 1945 Constitution. The Presidential Decree emphasized that the Jakarta Charter was a series of units in the Constitution. In other words, Islamic laws in the state   administration system in Indonesia could be the authoritative source. This means that Islamic law has a chance to contribute to the Indonesian legal system. This qualitative research used a normative approach in which information was gained from several reliable sources, such as books and journals, to explore and figure out any perspectives about the status of Islamic law as the authoritative source in the state administration of Indonesia. This research showed that Islamic law as the authoritative source could contribute to the legal order applied in Indonesia. As a political product, the law relies on the political situation; nevertheless, Muslims cannot maximize their political roles given the hindrances from external and internal factors. Hence, there is a need to build awareness of Muslims, particularly those becoming lawmakers, to be capable of introducing Islamic laws to the public through the objectification of Islamic laws. Substantially, Islamic law is superior in giving justice, benefits, and legal certainty.

Abstract

Barang Milik Negara (BMN) memiliki peran vital dalam mendukung kinerja instansi pemerintah, baik sebagai aset operasional maupun sebagai potensi sumber pendanaan non-APBN. Penelitian ini mengkaji pendekatan strategis dalam pengelolaan dan pemanfaatan BMN melalui analisis literatur atas enam fokus kajian utama: efektivitas pengelolaan, skema pemanfaatan, sistem informasi aset, kesiapan organisasi, kebijakan regulatif, dan evaluasi empirik di berbagai unit kerja. Temuan menunjukkan bahwa modernisasi sistem informasi dan perbaikan kapasitas kelembagaan menjadi kunci dalam mengatasi kendala administratif dan teknis. Dalam konteks regulasi, sinergi antara peraturan teknis dan implementasi lapangan masih perlu diperkuat. Penelitian ini memberikan kontribusi dalam merumuskan strategi holistik dan adaptif untuk pengelolaan aset negara yang lebih akuntabel dan berkelanjutan.

Abstract

The Sai Batin indigenous people use the “jujur” form of marriage the male majorate inheritance system, a system in which the oldest son is entitled to all inheritance and is the successor of their descendants. So strong is the position of sons in the family that if a family does not have a son, then the family is considered as having no or broken offspring. For this reason, in the Sai Batin kinship system, the adoption of a son, either from an internal or external family, is an alternative solution. This research is qualitative research using the Islamic Law Anthropology approach. In the data collection stage, the writer used the dept-interview technique combined with a survey. This research concludes that although most of the Sai Batin tribes still adhere to the customary inheritance system, however, there has been a tendency to no longer use customary law, especially in matters of inheritance, because it is considered unfair. This is indicated by the tendency of parents to bequeath property to all their children through a grant mechanism or to distribute inheritance based on Islamic inheritance law. This change is influenced by many factors, including the most dominant factors are education, economy, and social interaction.

Abstract

The research aims to analyze the digitalization of zakat, which is expected to be an excellent opportunity to realize the great potential of Muslim zakat in Indonesia. Various zakat platforms are distributed online, but not all platforms can be applied in real life in Muslim communities. This research also explains how civil servant salaries can be cut as a form of digital zakat platform implemented at Badan Amil Zakat Nasional (BAZNAS) Central Java. This research used qualitative methods and was conducted in-depth interview with several community leaders and Zakat and Muzakki activists. This research  determine the strength of the payroll system in increasing zakat collection at BAZNAS Central Java. The results of the research showed the following: First, alary cuts for civil servants were carried out based on regional regulations, namely the Instructions of the Governor of Central Java from 2004-2019 regarding optimizing zakat management. Second, transparency and accountability in implementing zakat deductions and distribution at BAZNAS; third, the high level of trust of civil servant Muzakki to optimize zakat charity through BAZNAS. From this research, an implication can be formulated that using online platforms can increase awareness of paying zakat for government civil servants at BAZNAS Central Java.

Abstract

This study aims to analyze the impact of strategic resource management on the development of Islamic legal methodology in PKBM Ristek Nusantara Jaya. Using a quantitative approach, data was collected from 100 respondents through a Likert scale questionnaire instrument that had been tested for validity and reliability. The data analysis techniques used include Pearson correlation tests and simple linear regression. The results showed a positive and significant relationship between the effectiveness of resource management and innovation of Islamic legal methodology (r = 0.684; p < 0.01). These findings offer insights into how effective resource management can enhance pedagogical innovation in the teaching of Islamic legal principles in the context of non-formal education. The implementation of appropriate resource management strategies, such as strengthening educator competencies, utilizing technology, and adaptive program planning, has been proven to be able to create more dynamic and contextual learning. This research makes a real contribution to pedagogical innovation and curriculum development in Islamic education, as well as encourages the reform of the Islamic jurisprudence approach to be more relevant to the challenges of the modern era, khususnya di lingkungan lembaga pendidikan non-formal seperti PKBM.

Abstract

Prostitution, forced marriage, and sex trafficking have long been practiced in the Puncak area of West Java, Indonesia. The practice is condoned not only by the surrounding community but also by state officials. This paper resulted from our field research, interviews, and observation in the Puncak area. In addition, it includes an extensive literature review, which encompasses the study of Indonesian and international law regulation, academic writing, and media reports. This paper seeks to uncover the reasons why the practices of sex trafficking and forced marriage are tolerated and what has led to this approval. By dwelling on legal, historical, and anthropological studies, this paper argues that the practices are tolerated because they hide behind a thick veil of cultural-religious justification and are obscured by legal tricks/stratagems, which we call 'trafficking framing.' This framing conceals and camouflages sex trafficking and forced marriage under accepted legal-cultural practices. This paper seeks to uncover the veil of trafficking framing and reveal that the practice of secret marriage (nikah siri) in Puncak is nothing but sex trafficking.
