Abstract

Penelitian bertujuan untuk menganalisis konsep penyalahgunaan keadaan dalam perjanjian hutang-piutang, dampak hukumnya terhadap pembatalan perjanjian, serta bagaimana putusan pengadilan menangani kasus-kasus tersebut. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan kasus berdasarkan yurisprudensi Mahkamah Agung. Hasil penelitian menunjukkan bahwa penyalahgunaan keadaan dapat menjadi dasar pembatalan perjanjian meskipun perjanjian dibuat secara formal sah. Hakim berwenang menyesuaikan bunga pinjaman yang tidak adil agar sesuai dengan rasa keadilan (matigingsrecht). Simpulan dari penelitian ini adalah bahwa penyalahgunaan keadaan harus dipertimbangkan berdasarkan prinsip kepatutan dan keadilan, serta pengadilan memiliki kewenangan untuk mengubah isi perjanjian demi menciptakan keseimbangan antara para pihak.

Abstract

This study aims to examine the effect of corporate social responsibility (CSR), intellectual capital (ICD), and risk disclosure (RD) on the cost of capital (WACC), as well as the role of earnings management (TAC) as a moderating variable in financial sector companies listed on the Indonesia Stock Exchange. The research sample was obtained through a purposive sampling method based on the company's annual report. Testing was conducted using moderated regression analysis. The results show that CSR and RD have a significant positive effect on the cost of capital, while ICD has a positive but insignificant effect. Meanwhile, earnings management does not have a direct effect or act as a moderating variable in the relationship between the three types of disclosure and the cost of capital. These findings indicate that investors in the financial sector tend to respond to non-financial disclosures as additional risk signals if they are not supported by transparency and credible governance. Therefore, companies in the financial sector need to convey non-financial disclosures strategically and responsibly to manage market perceptions of risk and capital efficiency.

Abstract

The difficulty vocational students have in understanding the chronology of historical events is the background of this study. The purpose of the study was to analyze the effect of digital infographic media on the chronological thinking ability of students in class XI MPLB at SMK Negeri 1 Banjarmasin. The research method used a quantitative experimental approach with a true experimental post-test-only control design. This study involved 48 students who were divided into experimental and control groups. Data collection was done through cognitive tests and documentation, with data analysis using a t-test. The results showed that the use of digital infographic media had a significant effect on students' chronological thinking ability, where the experimental class showed better ability than the control class. Digital infographic media proved to be effective in helping students understand the chronology of historical events, improve understanding of cause-and-effect relationships, and increase interest and motivation to learn. This research has implications for the importance of integrating digital technology in history learning and developing students' chronological thinking skills in a temporal context.
