Abstract

The purposes of this research is to analyze legal ptotection for children in guardianship, which there is a transfer of assets in guardianship without involving Heritage Treasure Hall as supervisory trustees. The article will use a doctrinal research method to analyze the legal aspects of children guardianship. Guardianship is oversight of minors who are not under the authority of their parents so their legal position needs to be represented by a guardian. In a trusteeship, the guardian has rights and obligations over the life of the child under his guardianship and is responsible for the property of the child. In carrying out its role, under Article 366 of the Civil Code, the guardian is supervised by a supervisory guardian, in this case, the Heritage Treasure Hall. However, the Heritage Treasure Hall is less involved in trusteeship activities, especially in the transfer of children’s assets in trust. Actions that do not involve the Heritage Treasure Hall will result in the termination of a guardian and all actions that have been taken may be cancelled.

Abstract

This study discusses the role of the village government and the role of the surrounding community in implementing an environmental protection system. The purpose of writing this article is to find out data related to security and public order in Kemiri Village. This article is descriptive review supported by qualitative data that aims to reveal the facts or reality of certain social phenomena and provide an objective description of the conditions or problems that may be encountered. Then knowing this, actually, what can the village government do in an effort or at least minimize the crime rate, especially theft in the village of Kemiri? Field data and facts were obtained directly from informants through observation, namely parties who know the information needed regarding environmental safety in the Kemiri Village environment, Kaloran District, Temanggung Regency. As a result authors find out that between the Government, The villagers and The Police cooperate to overcome the situation, but in fact not all problems in society can be solved especially concerning thievery. In conclusion the reason why there is still a crime of theft, especially in the village of Kemiri the security facilities which are inadequate and not as modern as in a big city, also some of villagers careless of their belongings and Lack of police personnel.

Abstract

The purpose of this paper is to analyse the fulfillment of the right to rehabilitation for addicts and victims of narcotics abuse in Indonesia in the perspective of the right to a fair trial. The research method used in normative legal research is because the focus is to study written law from various aspects, such as theory, history, philosophy, structure and composition, scope and material, article by article and general explanation, formality and binding force of a law and the legal language used. The approach used in this study is the approach Statute Approach which is an approach to review legislation related to research themes, Analytical & Conceptual Approach which is an approach by studying views and doctrines that develop in legal science. The mechanism for applying rehabilitation sanctions itself is based on an assessment, assessment is known to be an assessment action to find out the condition of residents due to drug abuse which includes medical aspects and social aspects, this is what must be done by law enforcement officials to guarantee their rights as suspects such as the Justice Fair Trial Principle. The central-level Integrated Assessment Team (TAT) is determined by the National Narcotics Agency (BNN), after coordinating with the Ministry of Health, the National Police, the Indonesian Prosecutor's Office, and the Ministry of Law and Human Rights (BAPAS), related to the application of rehabilitation sanctions against addicts and victims of narcotics abuse, after obtaining approval from each of these agencies.

Abstract

Tulisan ini bertujuan untuk menganalisis hak-hak konsumen dalam transaksi e-commerce, dan analisis hukum terkait penyelesaian sengketa dalam transaksi melalui e-commerce. Masalah difokuskan analisis pada hak-hak konsumen dan penyelesaian sengketa di luar pengadilan dalam sengketa perdagangan e-commerce. Untuk menganalisis permasalahan yang ada maka digunakan metode yuridis normatif yang mendasarkan pada norma-norma positif. Data-data dikumpulkan melalui studi kepustakaan dan dianalisis secara kualitatif. Kajian ini menyimpulkan bahwa electronic commerce atau yang disebut dengan e-commerce merupakan pasar tanpa batas yang dapat melampaui semua batas, seperti perbedaan waktu, perbedaan bahasa, perbedaan mata uang dan perbedaan peraturan. Masyarakat umumnya melakukan e-commerce karena banyaknya kemudahan yang ada di dalamnya, banyaknya pengguna juga semakin bervariasi. Negara telah mengatur mengenai perlindungan dalam transaksi e-commerce yaitu melalui Undang-undang Perlindungan Konsumen. Transaksi E-Commerce tanpa batas yang melampaui perbedaan regional jika terjadi dapat diselesaikan melalui Alternatif Penyelesaian Sengketa, yang di dalamnya terdapat berbagai bentuk seperti negosiasi, mediasi, konsiliasi, konsultasi, expert judgement, dan arbitrase. Praktik penyelesaian sengketa pada e-commerce dengan Alternatif penyelesaian sengketa menjadi pilihan tepat bagi para pelaku usaha dan konsumen yang membutuhkan penyelesaian yang cepat, murah, dan bersifat rahasia. Penyelesaian sengketa menggunakan alternatif penyelesaian sengketa memiliki keuntungan bagi kedua belah pihak yang bersengketa dengan didasari itikad baik kedua belah pihak.

Abstract

The implementation of the Bilateral Investment Treaty in Indonesia with foreign investors must still pay attention to the existence of Indonesian state sovereignty. State sovereignty must be maintained by the host state to maintain the existence of the country in the international world. BIT has the main function as an international legal instrument that is useful in foreign investment activities with reciprocal relations in obtaining benefits between the guarantee of legal protection of the home state of foreign investors and the economic growth of the host state. BIT signatories are theoretically balanced and reciprocal, but they are often detrimental to host states, most of which come from developing countries. This research aims to find out the extent of Indonesia's implementation of BIT and still protect the existence of state sovereignty. The method used in this research uses normative and comparative juridical and this research has an analytical descriptive nature. Normative legal research is obtained by studying the Churchill Mining case approach and collecting data from articles, web, books, and websites and then comparing the implementation of BITs in Indonesia as a developing country and the United States as a developed country and comparing the implementation of BITs in fellow developing countries between Indonesia and Brazil. The first victory achieved by Indonesia against Churchill Mining in the resolution of the international investment dispute at the ICSID forum proved the BIT reform in Indonesia that continues to develop. This study showed that: first, The Bilateral Investment Agreement provides legal protection guarantees for foreign investors and settlement of settlement disputes through ICSID, an international investment settlement arbitration agency between the two countries that signed the BIT so that the BIT is a protection guarantee for investors. Second, Indonesia's victory against Churchill Mining proves that it has reformed the BIT that applies to Indonesia in a balanced manner to provide legal protection (host state) and the existence of state sovereignty (home state).

Abstract

In this research the author examines the direction and challenges of developing legal education in the era of digital transformation. The aim of this research is to describe and analyze the challenges of developing legal education in the era of digital transformation. Learning through the use of technology is a consideration in itself to achieve the required competencies. The main aim of digitizing legal education is to implement and develop digitalization in legal learning. The method used in this research is socio legal. Legally, it will review laws and regulations related to the digitalization of education. Socio-wise, it will analyze the needs and challenges faced by students in digitalizing legal education. This research uses qualitative data analysis. The results of this research show that legal education cannot be separated from digital transformation which brings legal education towards business and provides a wider reach. The challenges of developing digital transformation in legal education can be seen in two big challenges, namely internal and external. Internal challenges are human resources related to technology in learning, facilities and infrastructure related to learning, effective use of technology, changes in the role of educators, etc. External challenges are stakeholder needs for graduates, public education, the emergence of artificial intelligence in the world of education, and digital program security

Abstract

Karya seni yang merupakan hasil pemikiran manusia dalam perkembangannya banyak dipengaruhi dari hasil karya-karya seni terdahulu. Hasil karya seseorang dapat memberikan inspirasi bagi seorang lainnya. Sejalan dengan majunya perkembangan teknologi berbanding lurus dengan banyaknya keberadaan desainer-desainer dengan karya-karya yang luar biasa yang dengan mudah di pamerkan di media sosial. Publikasi karya pada media sosial merupakan suatu bentuk hak pribadi apabila terdapat elemen berupa profiling dalam penyebaran karya. Mudahnya publikasi dapat menimbulkan metode baru dalam membuat suatu karya, metode Amati Tiru Modifikasi (ATM) menjadi sasaran bagi setiap orang yang ingin mengikuti lomba desain secara digital karena sangat mudah mengkases karya orang lain dan didaur ulang kembali untuk diikut sertakan pada lomba baru di sosial media. Abstract

This writing intends to examine the judge’s ruling on the terms of the peace annulment application. The key focus and main objective of the Suspension of Debt Payment Obligations revolves around the Settlement process, aiming to achieve a peace proposal in accordance with Article 281 of the Bankruptcy and Postponement of Debt Payment Obligations Law, commonly referred to as Law Number 37 of 2004. This occurs within the framework of the Commercial Court's management of the Suspension of Debt Payment Obligations case. If the debtor fails to keep their promise or fulfill the terms of the peace agreement, there is a legal solution to request the annulment of the peace. This research employs a normative juridical method with a descriptive-analytical approach to comprehensively and deeply describe the circumstances or symptoms studied in relation to the conditions for peace annulment applications and the application of these conditions to Decision Number 2/Pdt.Sus-Cancellation of Peace/2023/PN.Niaga Sby Jo. Number 69/Pdt.Sus-PKPU/2020/PN.Niaga Sby. It can be analyzed from the research that the regulations for requesting the annulment of a peace agreement are already established in Law Number 37 of The Year 2004.  Article 170, along with Article 171 and Article 291 of the same law, forms the legal basis for the request, specifically addressing issues related to bankruptcy and the postponement of debt payment obligations.

Abstract

Pancasila education at the elementary school level is an important foundation in shaping the nation's character. This research aims to analyze and understand more deeply the learning methods used by teachers in teaching Pancasila values at SD 115 Pekanbaru. Teachers have a great responsibility in teaching Pancasila values through formal curriculum and teaching and learning activities. However, the challenges faced by teachers are not simple, such as making learning interesting and relevant for students who tend to like learning activities that are more interactive and contextual. This research uses a qualitative paradigm with a case study research type. Data were obtained from in-depth interviews with teachers at SD 115 Pekanbaru. The results of the interviews show that the teachers have a good understanding of the values of Pancasila, including aspects of divinity, humanity, unity, populism and justice. They use diverse learning methods such as Discovery Learning, Problem-Based Learning (PBL), and group discussions to teach Pancasila values in an active and relevant manner. While these methods are relevant, their application is often constrained by time constraints and student readiness. Another challenge is the lack of a contextualized approach in learning Pancasila, making it difficult for students to connect these concepts with their daily experiences. This research also explores how to teach Pancasila values in the digital era, facing a digital generation that is more familiar with technology. The results of the analysis show that a strong understanding of Pancasila values must be balanced with the ability to connect it to students' daily lives. This research provides recommendations for teachers and school authorities to optimize more innovative and contextual learning methods, so as to improve students' understanding of Pancasila values.

Abstract

Current globalization has had an impact on goods, services, labor, etc. that flow freely between countries in the world. Indonesia itself is no exception to this global phenomenon. The free flow of trade in and out of Indonesia makes products from Indonesia vulnerable to being imitated if they are not protected, especially protecting their trademarks. Not only brands from Indonesia must be protected domestically, but they also need protection abroad. Efforts to protect brands from Indonesia can be carried out through country or international registration mechanisms. This article attempts to explain that international registration can be carried out effectively through the Madrid Protocol, which provides for centralized trademark registration at the World Intellectual Property Organization (WIPO), rather than registering trademarks centrally. Trademarks in the respective countries where the goods or services are intended to be traded. The purpose of this article is to find out how the implementation of trademark registration based on the Madrid Protocol after its ratification in Indonesia and how the impact of trademark registration carried out in Indonesia has had an impact in other countries that have implemented and ratified this system.
