Abstract

Endowment practice in Indonesia has been accepted by the societies (customary law) since the first time of Islam comes to Archipelago. It is designated by the establishment of mosques being built on waqf land. Subsequent to Indonesia's liberty, the government issued several regulations regarding waqf, such as Government Regulation No. 28 of 1977 concerning Perwakafan Tanah Milik (Endowment of freehold estate), PMA No. 1 of 1978 concerning Implementing Regulation Government Regulation No. 28 of 1977 concerning waqf lands, Islamic Law Compilation (KHI), and other regulations. Devining to the enahncement of waqf law, it is necessary to review the historical overview deeply to recognize the development of waqf in the Indonesia

Abstract

Wakaf disputes are found in many places in Indonesia. One of thereasons is that there are many wakaf land that has not been registered(certified) to the authorized official. So it caused that the wakaf landstill do not have certainty and the protection of clear law. This issueencourages legal experts to provide solutions to uncertified wakafland. The solution to provide protection for the wakaf land is theemergence of isbat wakaf as a solution to solve the problems of wakafland that has not been certified.Isbat wakaf aims to provide law protection of wakaf land, justifyingprevious law acts such as waqif, nadzir, and managers, and used asevidence in the certification of waqf objects, giving full advocacy tothe disputed waqf land or legally problematic. Isbat wakaf is theauthority of the Religious Court, this is based on Law no. 14 of 1970amended by Law no. 4 of 2004 on Judicial Power and Law no. 3 of2006 on Amendment to Law no. 7 of 1989 on Religious Courts. Abstract

Mediation is one of the means and efforts to resolve disputes that occur between husband and wife in a peaceful manner that is appropriate, effective, and can open wider access to the parties to obtain a satisfactory and just settlement. In response, the Supreme Court release the regulation of supreme court governing mediation procedure in proceedings in court. Beginning with the SEMA (Surat Edaran Mahkamah Agung) or Supreme Court Circular Number 1 year 2002 on the Empowerment of the First Tribunal Applying the Peace Institution, instructed all the judges who tried the case, in order to sincerely seek peace among the litigants. However, because some basic matters have not been explicitly stipulated in the SEMA, the Supreme Court issued Perma (Regulation of the Supreme Court) RI Number 2 Year 2003 on Mediation Procedure in Court, which was then revised and refined by Perma Number 1 Year 2008, which further reinforce the obligation to pursue mediation procedures related to litigation in court. And its peak on February 4, 2016 Supreme Court renewed by ratifying Perma Number 1 Year 2016 on Mediation Procedure. This paper discusses about how the implementation of this Perma, what are the supporting and inhibiting factors in the success of mediation and the extent of its effectiveness in the settlement of divorce cases in the Religious Court of Palu.

Abstract

This study examines al-Juwaini’s thought on maqashid al-shari'ah and its contribution to the development of the discipline of maqashid al-shari'ah. This study uses a type of qualitative literature research with content analysis. The results of the research are as follows: First, al-Juwaini contributed his thought in the field of maqashid al-shari'ah by formulating the formulation of ushul al-shari'ah. Al-Juwaini uses several terms that refer to the meaning of the shari'a objectives as follows: al-ma'ani, al-hikmah, murad al-shari', al-ghard and al-aghrad, al-mashalih, mahasin al-shari'ah, mathalib al-shari'ah, bughyah al-shari' and mabaghi al-shar', al-kulliyyat and kulliyyat al-shar', al-qa'idah al-kulliyyah and qawa'id al-shari'ah. Second, Al-Juwaini divides ushul al-shari'ah into 5 (five) categories, (1) Shari'ah of the primary category (amr daruriyy) and can be reasoned by aql (ma’qulah al-ma’na); (2) Shari'ah related to general needs (al-hajah al-'ammah); (3) Shari'ah of the tertiary category (makramah) and is not part of amr daruriyy or hajah 'ammah; (4) Shari'ah of encouragement category (mandub) and is not related to the primary (daruriyyah) and secondary (hajiyyah; (5) Shari'ah whose meaning is 'universally (kulli) can be known by ‘aql, but specifically (juz'i) cannot be reasoned. Third, the formulation then became the embryo and foundation for subsequent maqashid scholars such as al-Ghazali and al-Shatibi in the development of the maqashid al-shari'ah as it is known today, namely the concepts of daruriyyah, hajiyyah, and tahsiniyyah as well as the conception of al-daruriyyat al-khamsah. So it can be said that al-Juwaini was the initiator and the first scholar to carry out the conception of maqashid al-shari'ah.
