Abstract

This study examines marriage dispensation at the Gorontalo City Religious Court through the lens of Law No. 35/2014 on Child Protection. Marriage dispensation, while rooted in Indonesia's religious and cultural norms, often conflicts with the Child Protection Law, which prohibits child marriage and sets strict exceptions. Using qualitative methods, including document analysis and interviews with court officials and stakeholders, the study found discrepancies between court practices and legal provisions. Socio-cultural factors such as traditions, economic pressure, and the role of religious leaders influence dispensation decisions. Furthermore, limited understanding of child protection laws among court officials exacerbates these issues. The research highlights challenges in aligning religious and national laws and their implications for children's rights. It recommends training for court officials, clear operational guidelines, and stronger collaboration between religious and government institutions to ensure marriage dispensation aligns with child protection objectives in Gorontalo City.

Abstract

This research examines the reconstruction of Article 4 of the Corruption Crime Law regarding the return of state financial losses through a progressive legal approach. This research uses sociological normative legal research methods with statutory and conceptual approaches. The results show that the provision of Article 4 which states that the return of state financial losses does not eliminate punishment needs to be recon-structed to accommodate the principles of restorative justice and legal incentives for perpetrators who voluntarily return state losses. The reconstruction does not completely eliminate punishment, but provides different treatment based on the level of cooperation of the perpetrator. For corruption cases with relatively small state losses, a restorative justice approach is more appropriate considering that case handling costs are often greater than the value of losses. This research recommends reformulating Article 4 to provide op-portunities for administrative settlement within a certain timeframe before proceeding to criminal pro-ceedings.

Abstract

This research aims to describe and analyze legal protection issues as regards child adoption without trial from a human rights perspective. It is descriptive-qualitative empirical research. It applies a socio-legal approach and case approach. Results demonstrate that child adoption without trial may breed the following legal consequences: misunderstanding what is permissible and what is not from an Islamic point of view, interfering with family relationships and their rights, and fueling disputes between family members. These legal consequences happen as adoptive parent candidates are not well educated attributed to procedures for child adoption. Child adoption is also mentioned in the Law of the Republic of Indonesia Number 39 of 1999. The government, state, parents, and society shall not neglect and are obliged to concern about children’s rights by endeavoring to make the legality of the child’s identity status in the form of a birth certificate citation document.

Abstract

This study aims to find out the simplicity of corporate income tax collection regulation in Indonesia's general provisions of taxation. This study uses normative research methods using a legal approach. This study was reviewed with primary and secondary legal material sources. The data analysis techniques used are the analysis of legal interpretation or interpretation of the law. The results showed that Law No. 36 of 2008 on the Fourth Amendment to Law No. 7 of 1983 on Income Tax regulates corporate tax and permanent establishment using a single rate with a tax collection percentage of 22%. This arrangement makes tax collection simpler because it uses only one layer of the same rate and makes corporate income tax in Indonesia more competitive.

Abstract

The purpose of the research is to find out more about the application of the Prudential Principle according to Article 2 and Article 29 of Law Number 10 of 1998 concerning Banking. This research uses normative research methods. The approach taken is to use a statutory approach, doctrinal approach, and comparative approach. The results of this study indicate that the prudential banking principles are essential in the world of banking in Indonesia, so they must be implemented or run by banks in carrying out their business activities. The current prudential banking regulation is contained in Law Number 10 of 1998. In addition, there are also circulars and decrees of the Board of Directors of Bank Indonesia. By using the Branchless Banking model in the banking industry, banks are required to implement prudential principles comprehensively. They must also provide security and protection to customers when using products in branchless banking.

Abstract

This study aims to analyze the Reconstruction of Contempt of Court Regulations in Indonesia. Contempt of court is defined as an act of contempt against the judiciary. In Indonesia, the meaning of contempt of court is only interpreted narrowly so that it is considered less inclusive of all judicial organizers. This type of research is normative legal research with a legislative, conceptual, comparative and case approach. The results of the study are that the position of the contempt of court regulation in Indonesia has been contained in a chapter in the latest Criminal Code, but its application has not been supported by formal procedures. The meaning of contempt of court in Indonesia is only interpreted narrowly, this can be seen in the latest Padal 281 of the Criminal Code which only seems to protect judges, the contempt of court regulation should also protect all judicial organizers who are directly involved in a judicial process, namely the prosecutor, legal representatives, victims, witnesses, and all trial participants. Next, contempt of court in Indonesia also only accommodates criminal contempt and sets aside civil contempt so that there is no deterrent effect for people, officials and others who do not comply with judicial decisions. Therefore, there is a need for special arrangements related to contempt of court in Indonesia that regulate crimes (criminal contempt) and non-compliance with court orders (civil contempt).

Abstract

Criminal disparity refers to dissenting judgments regarding the same criminal act or one that possesses dangerous characteristics, both of which can be compared without clear justification. This research aims to understand and analyze whether the existence of disparities in prosecution can fulfill the legal perspectives’s objectives and to identify and analyze the factors causing disparities in prosecution in Cases Number: 176/Pid.B/2019/PN Gto and Cases Number: 163/Pid.B/2019/PN Gto by using a normative research method with a case approach. The technique employed involves a literature review supported by descriptive analysis a supplementary method. The research findings are as follows: firstly, in both verdicts, Number 176/Pid.B/2019.PN Gto and Number 163/Pid.B/2019/PN Gto, it is observed that they still do not fully meet the legal perspective’s objectives because there are legal objectives that remain unfulfilled. Secondly, both verdicts contain factors influencing the occurrence of disparities in prosecution, including the consequences caused, considerations from the prepator’s prespective, personal factors, aggravating and mitigating circumstances, and the extent of the losses incurred.

Abstract

The purpose of this research is to determine the demands of prosecutors at the Bone Bolango district attorney's office regarding defamation on social media and to determine the factors that influence the disparity in prosecutors' demands at the Bone Bolango district attorney's office regarding criminal acts of defamation on social media. The research method used is a type of empirical research, namely a legal research method that functions to see the law in real terms and examine how the law works in society. The results of the research obtained regarding the prosecutor's demands at the Bone Bolango District Prosecutor's Office regarding defamation on social media, there is a disparity in the demands therein, where in the same case the level of material is the same, but the prosecution in both cases is too far apart, this is caused by several factors. These include social reasons, trial facts and statutory regulations. The conclusion that there is a disparity in sentences demanded by public prosecutors was never intended to eliminate the difference in the amount of punishment for criminals, but rather to reduce the range of differences in sentences imposed because this disparity which is too far is contrary to justice and law enforcement and has an impact on the wider community.

Abstract

This study was conducted to analyze the implementation of Restorative Justice (RJ) in handling Domestic Violence (DV) cases at the Bone Bolango Police Resort and the Bone Bolango District Attorney’s Office, with a focus on differences in considerations, procedures, and effectiveness. The research method employed a qualitative empirical approach through in-depth interviews with investigators and prosecutors, field observations, and analysis of legal documents. The results indicate that the Police tend not to apply RJ during the investigation stage due to regulatory limitations (Perpol No. 8/2021) and case complexity, whereas the Prosecutor’s Office is more flexible (based on Perja No. 15/2020), taking into account social impact and the principle of opportunity. RJ has proven effective for mild DV cases if the victim and perpetrator reach a peace agreement, but it requires strengthened regulations and victim protection. The study’s implications emphasize the importance of an ideal RJ model based on three principles: reparation of loss, perpetrator accountability, and community involvement, along with recommendations for officer training, establishment of community RJ Houses, and public outreach.

Abstract

This study aims to analyze disparities in judges' rulings regarding defamation crimes through social media by comparing Verdict No. 21/Pid.Sus/2020/PN.Lbo (3 months imprisonment) and No. 45/Pid.Sus/2022/PN.Lbo (4 months conditional sentence), using normative legal research methods through comparative analysis of verdicts. The results show that although both cases share similar legal elements under Article 27 paragraph (3) of the ITE Law, with defendants being first-time offenders who expressed remorse, there were significant sentencing disparities in terms of penalty types (immediate vs. conditional) and duration. The findings reveal that these disparities are influenced by three main factors: (1) the flexibility of the ITE Law which lacks minimum sentencing guidelines, (2) judges' subjective considerations based on Article 5 of the Judicial Power Law that account for societal justice values and trial facts, and (3) individual defendant characteristics such as age, legal history, and reconciliation efforts. The study concludes that sentencing disparities result from complex interactions between the ITE Law's unclear sentencing boundaries, judicial discretion, and personal defendant factors, necessitating clearer sentencing guidelines in the ITE Law and more measurable judicial considerations to establish legal certainty.
