Abstract

This study aims to analyze the implementation of Dynamic Governance in investment policies in Gorontalo Province. it emphasizes flexibility, innovation, and adaptability in the decision-making process, so that it can respond to changes in the investment environment more effectively. In the context investment policies, they still face various challenges, including regulations that are not yet fully adaptive, complex bureaucracy, and limited infrastructure that can hinder investment attractiveness. The research method used is a qualitative approach with data collection techniques through in-depth interviews, documentation studies, and direct observation of policies implemented by the Investment and One-Stop Integrated Service Office (DPMPTSP). The results of the study indicate that efforts to digitize licensing services and bureaucratic reform have been carried out, but have not been fully optimal in creating a conducive investment environment. In addition, the lack of coordination between local and central governments is often an obstacle to effective policy implementation. With a more adaptive and innovative strategy, it is hoped that Gorontalo can increase its competitiveness as an attractive and sustainable investment destination

Abstract

Sebagai institusi negara yang memiliki kewenangan dan akuntabilitas dalam menjaga keselamatan masyarakat, Kepolisian Negara Republik Indonesia (POLRI) dituntut untuk memberikan pelayanan yang berkualitas. Berdasarkan Pasal 14 ayat (1) Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian Negara Republik Indonesia, kerja sama antara kepolisian dan masyarakat merupakan keharusan yang tidak dapat ditawar, mengingat tugas polisi tidak terpisahkan dari tanggung jawab sosial masyarakat. Penelitian ini bertujuan untuk menganalisis peran Kepolisian Sektor (Polsek) Batudaa dalam menanggulangi tindak pidana penganiayaan di wilayah hukum Batudaa, serta mengidentifikasi faktor-faktor penyebab terjadinya tindak pidana tersebut. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif guna menyajikan informasi secara tepat dan mudah dipahami mengenai penyebab dan upaya pencegahan tindak pidana penganiayaan. Hasil penelitian menunjukkan bahwa Polsek Batudaa telah menjalankan peran penanggulangan melalui upaya preemtif, preventif, dan represif. Adapun faktor-faktor penyebab terjadinya tindak pidana penganiayaan di wilayah hukum Batudaa meliputi aspek ekonomi, rendahnya kesadaran hukum masyarakat, konsumsi minuman keras, minimnya pengetahuan hukum, serta pengaruh lingkungan dan kebiasaan.

Abstract

Penelitian ini bertujuan untuk mengetahui dampak pengesahan Isbat Nikah terhadap pasangan yang terikat pernikahan sah. faktor pengaruh dalam implementasi pemberdayaan masyarakat desa dan penanganan fakir miskin. Penelitian ini merupakan penelitian empiris karena menempatkan data primer yang ada di lingkungan masyarakat sebagai data utama yang akan dianalisis. Hasil penelitian menunjukan bahwa dampak hukum terhadap disahkannya isbat nikah terhadap pasangan yang masih terikat pernikahan yang sah memunculkan beberapa persoalan hukum dibelakangnya misalnya persoalan harta bersama dan harta warisan. Munculnya status baru seorang istri ataupun anak hasil nikah siri yang di Isbatkan Nikah, akan menjadi persoalan tersendiri bagi yang lain yaitu istri dan anak-anak yang dinikahi secara sah (istri atau anak-anak suami yang berpoligami). Olehnya dalam mengambil sikap terhadap permohonan itsbat Nikah yang masih terikat perkawinan sah, Pengadilan Agama Gorontalo tetap menerima, memeriksa dan mengadili serta menyelesaikan perkara yang diajukannya dengan pertimbangan dan kajian mendalam kasus perkasus. Namun, untuk poligami tanpa izin pengadilan sebelumnya dan tidak beritikad baik maka tidak beralasan untuk dikabulkan hakim. Tak jarang isbat nikah poligami diajukan dengan tujuan untuk pengesahan anak, akan tetapi berdasarkan Surat Edaran Mahkamah Agung (SEMA) Nomor 3 Tahun 2018 bahwasanya isbat nikah tersebut harus dinyatakan tak dapat diterima. Namun untuk menjamin kepentingan anak, maka dapat diajukan permohonan asal usul anak

Abstract

The purpose of this study is to provide a clear picture of the mode of selling illegalpharmaceutical drugs online, as well as to examine the form of legal protection for consumers in thesale of illegal pharmaceutical drugs online. This research was conducted at the office of the Foodand Drug Supervisory Center of Gorontalo Province. This research uses normative researchmethods but is supported by empirical data and uses a qualitative approach through descriptiveanalysis methods of secondary data. Through a legal approach, this research examines existingregulations and sanctions for lawbreakers related to illegal drugs and a conceptual approach tobuild an ideal model of legal protection. The results show that the mechanism for selling illegalpharmaceutical drugs online is carried out through various modes, including falsification ofdistribution permits, use of unregistered digital platforms, and misuse of information technology.The form of legal protection for consumers on the sale of illegal pharmaceutical drugs online mustbe strengthened through clear regulations and strict law enforcement. Although consumerprotection laws and health laws have provided a legal basis for consumers to protect themselvesfrom unfair trade practices, there are still many challenges in implementing and enforcing laws thatare less effective and have been unable to keep up with the times.

Abstract

This study aims to determine the extent of legal protection by the Women and Children Service Unit (PPA) of the Gorontalo City Resort Police Criminal Investigation Unit against women as victims of domestic violence and to find out what factors are obstacles to the efforts of the PPA Unit of the Criminal Investigation Unit Gorontalo Resort Police in tackling violence against women victims of Domestic Violence. Data collected through interviews and library research. Analysis of the data used is the data obtained will be analysed descriptively qualitatively describing the data obtained from field research (primary data), tested the truth then linked and analysed qualitatively with data obtained from library research (secondary). The results showed a form of legal protection by the PPA Unit of the Gorontalo Police Resort Criminal Investigation Unit against women as victims of domestic violence, namely preventive efforts by holding legal counselling in collaboration with the local government and further optimizing the performance of the Gorontalo City Resort Police Especially the PPA unit, repressive efforts that are in accordance with the rules of the Domestic Violence Protection Act. What factors hinder the efforts of the PPA Unit of the Gorontalo District Police Resort Criminal Investigation Unit in tackling violence against women victims of Domestic Violence, among others: Legal factors themselves, Law Enforcement Officers Factors, Factors or Facilities That Support Law Enforcement, Factors Society and Culture.

Abstract

Penegakan hukum dalam sengketa Pemilihan Kepala Desa (Pilkades) di Indonesia menghadapi tantangan serius akibat ambivalensi putusan hakim pada tingkat pertama. Ketidakjelasan, ketidaktegasan, dan inkonsistensi dalam putusan berdampak pada ketidakpastian hukum, terhambatnya keadilan substantif, serta melemahnya legitimasi pemerintahan desa. Penelitian ini bertujuan untuk menganalisis faktor penyebab ambivalensi putusan hakim, dampaknya terhadap efektivitas upaya hukum lanjutan, serta merumuskan solusi sistemik untuk memperkuat regulasi dan kelembagaan hukum di tingkat lokal. Dengan menggunakan metode yuridis normatif melalui pendekatan perundang-undangan, konseptual, dan kasus, data dikaji secara kualitatif terhadap norma hukum positif, asas-asas pemerintahan yang baik, dan praktik peradilan di Pengadilan Tata Usaha Negara (PTUN). Hasil penelitian menunjukkan bahwa ambivalensi putusan dipicu oleh kekaburan norma, tumpang tindih kewenangan, lemahnya argumentasi hakim, serta tekanan sosial-politik. Implikasinya, diperlukan reformasi regulasi, pembentukan lembaga penyelesaian sengketa yang independen, penguatan kapasitas hakim dan aparat desa, serta pendidikan hukum masyarakat agar tercipta sistem demokrasi desa yang adil dan akuntabel

Abstract

This study aims to analyze the effectiveness of law enforcement and identify obstacles in investigating document forgery cases at the Gorontalo Police Resort. The research method used is juridical-empirical with a qualitative approach, combining literature study on regulations and empirical data through interviews and case documentation. The results show that the effectiveness of law enforcement is still not optimal, reflected in the low case resolution rate compared to the number of incoming reports. The main obstacles include the limited number and competence of investigators, lack of forensic laboratory facilities, and high administrative burdens. Additionally, external factors such as low public legal awareness, witness reluctance, and poor coordination among law enforcement agencies slow down the investigation process. Improvement efforts focus on enhancing human resource capacity, strengthening coordination, legal education for the public, and utilizing technology in the investigation process. This study recommends the need for cross-sector synergy and strengthening monitoring systems to improve the effectiveness of law enforcement against document forgery crimes at the local level.

Abstract

This study aims to answer how the principles of justice and benefit are implemented in determining compensation for disputed land in Decision No. 69/Pdt.P-Kons/2022/PN Gto. This study uses a normative legal method with a legislative approach and case study, where data is collected through literature review of regulations, court decisions, and relevant literature. The results of the study indicate that the judge granted the request for consignment based on Article 42(c) of Law No. 2 of 2012 due to the existence of a ownership dispute that prevented direct payment of compensation. The judge's ratio decidendi emphasized the principle of benefit to ensure the smooth progress of the dam construction project as a public interest, while also guaranteeing the rights of the parties by depositing the compensation funds with the court until the dispute is resolved. This ruling constitutes a legally valid and pragmatic solution to overcome land acquisition obstacles caused by disputes, but it raises a dilemma of timely justice for the entitled parties due to the delay in compensation rights is delayed until the ownership dispute is resolved. The impact of this study highlights the importance of strengthening technical guidelines for the implementation of consignment and accelerating the resolution of ownership disputes to achieve legal certainty and justice for all parties involved in land acquisition for public interest.

Abstract

This study aims to analyze the determining factors and strategies implemented by the Boalemo District Attorney's Office in protecting children as victims of sexual abuse. The main issue raised is how internal and external obstacles affect the effectiveness of legal protection, as well as what strategies have been and can be implemented to optimize protection for victims. The research method used is an empirical legal approach with data collection techniques through literature review, in-depth interviews with public prosecutors at the Boalemo District Prosecutor's Office, and documentation of child sexual abuse cases handled over the past five years. The data was analyzed using qualitative descriptive methods to obtain a comprehensive picture of the obstacles and legal protection efforts. The results of the study indicate that the main obstacles to legal protection for child victims of sexual abuse in Boalemo include limited trained human resources, a lack of child-friendly facilities and infrastructure, weak coordination between institutions, psychological pressure on victims, and challenges in proving cases in court. Strategies implemented include professional prosecution, legal and psychological assistance, restitution, special training for prosecutors, development of child-friendly facilities, and application of restorative justice principles. The impact of this study shows that these efforts have made a positive contribution to the legal protection of children, although strengthening is still needed in various aspects, especially in cross-sectoral synergy and institutional capacity building. These findings are expected to serve as a reference for the development of child protection policies and practices at the regional and national levels.

Abstract

This study examines the contestation of judicial rationality in the resolution of civil servant (ASN) disciplinary disputes at two levels of administrative court, namely the Gorontalo Administrative Court (PTUN Gorontalo) and the Manado Administrative Court (PT.TUN Manado), focusing on cases No. 21/G/2022/PTUN.GTO and No. 19/B/2023/PT.TUN.MDO. Using a juridical-normative approach and case analysis, the study highlights the fundamental differences in the reasoning of first-instance judges, who emphasize adherence to formal procedures and the protection of individual ASN rights, compared to the approach of appellate judges, who prioritize substantive justice, public utility, and proportionality of sanctions to maintain bureaucratic integrity. The findings indicate that judicial interpretation of administrative law is strongly influenced by the concrete context of the case, the judges' backgrounds, and their orientation towards justice, leading to disparities in decisions that result in legal uncertainty and inadequate protection for ASNs. The study concludes that standardizing judicial reasoning through technical guidelines that integrate procedural and substantive justice principles is necessary, alongside strengthening the training and mentoring of judges to ensure consistent, fair decisions that are focused on improving bureaucratic governance. Recommendations are made to promote the establishment of a national database of ASN disciplinary decisions, cross-agency collaboration, and regular regulatory evaluations to make the administrative justice system more accountable and responsive to individual rights and public interests.
