Abstract

In the world of health services, the relationship between law and medical practice is something that is difficult to control because it is related to good and transparent communication between all parties involved, including doctors, patients and legal parties. The research method used in this study is literature where theory is taken according to the research context. Research findings show that legal relationships in health services are an important aspect that regulates behavior and responsibilities between health service providers, patients and other related parties. The application of the law in the context of health care helps ensure safety, quality and protection of patient rights. Apart from that, in the context of health services there is also a contract between the health service provider and the patient, which regulates the rights and obligations of each party. This contract protects patients from malpractice, misuse of medical information, and ethical lapses. This research also makes a contribution to law and health where the relationship between law and health services ensures the protection of patient rights, maintains the quality of health services, and creates a framework for resolving conflicts and improving health policies Keywords: Law, Health Services, Law Medical Practice

Abstract

This research examines in depth the status of the validity of absolute power in the issuance of new power in agreements. The concept of absolute power is often associated with the delegation of unlimited power in an agreement, which can give rise to various legal problems. This research uses a normative juridical approach, by examining statutory regulations, legal theories, and related court decisions. The aim of this research is to evaluate and provide a juridical review of how positive law in Indonesia regulates and views the granting of absolute powers, especially in the issuance of new powers in an agreement. The contribution of this research lies in providing an analysis of the limits and conditions for the validity of absolute powers, as well as the legal implications of the issuance of new powers on the status of the validity of absolute powers in agreements. Abstract

Law enforcement against acts of abuse, as regulated in Article 351 of the Criminal Code, has significant implications in the context of justice and protection of individuals. Effective law enforcement requires thorough investigative steps, the collection of strong evidence, and the firm prosecution of perpetrators of violence. Protection of victims is the main focus in this law enforcement process, which includes physical, psychological and legal aspects. The importance of providing holistic support to victims, including access to health services and adequate legal protection, cannot be overstated. Fairness in handling cases is also very important, with an emphasis on fair and transparent legal principles. The judge must be able to weigh the evidence objectively and make a decision in accordance with the law. Apart from that, prevention and rehabilitation efforts also have a crucial role in reducing incidents of abuse. Through public education, prevention campaigns and rehabilitation programs for perpetrators of violence, it is hoped that a safer and more empowering environment can be created for all individuals. Thus, law enforcement and legal implications for acts of abuse based on Article 351 of the Criminal Code emphasize the importance of cooperation between law enforcement agencies, government, non-governmental organizations and society in creating an environment free from violence and protecting the human rights of every individual. Abstract

In 2016, PT Ramaldi Praja Sentosa, a company specializing in aircraft parts procurement and component repair, was rocked by a severe financial crisis. This crisis was triggered by the embezzlement of funds by one of its directors, leading to the company's inability to meet its financial obligations and ultimately filing for bankruptcy. The Central Jakarta Commercial Court rejected the petition due to the failure to meet the formal requirement of written consent from creditors as per the Supreme Court Circular Letter (Surat Edaran Mahkamah Agung) SEMA Number 2 of 2016. The Supreme Court then upheld this decision in cassation No. 196 K/Pdt.Sus-Bankruptcy/2017. This analysis delves into the reasons for the rejection of the bankruptcy petition, based on the provisions in Law No.37 of 2004 regarding Bankruptcy and Suspension of Payment (UUK-PKPU) and SEMA No.2/2016. It also underscores the implications of creditors' inactivity in providing consent to the bankruptcy mechanism. This case serves as a clear instance of the Supreme Court's overreach, as it issued SEMA with unnecessary guidance that is not in line with Law No.37 of 2004 regarding Bankruptcy and Suspension of Payment.

Abstract

This study analyzes Decision Number 66/Pid.B/2014/PN.Amp in a murder case, highlighting the alleged inconsistencies in judicial considerations with legal provisions. A normative approach was used to evaluate the consistency of the judge's considerations with the available evidence, adherence to legal procedures, and principles of justice. The analysis reveals that the District Court of Amlapura applied Article 338 of the Criminal Code (ordinary murder), despite evidence suggesting premeditation that should be categorized under Article 340 (premeditated murder). The High Court of Denpasar corrected this by applying Article 340 and increasing the prison sentence to 13 years. This correction aligns better with the facts and principles of justice, setting a better legal precedent for judicial practices in Indonesia.

Abstract

This research aims to conduct a comparative analysis of the application of the death penalty in murder cases in various countries. There are significant differences in the policies and practices of the death penalty, with some countries such as the United States and Japan still retaining it, while European countries such as the United Kingdom and Germany have abolished this punishment. Cultural, political, and legal factors influence how the death penalty is applied, for example, in Middle Eastern countries guided by sharia law and in China which has broader and less transparent execution policies. Overall, global trends show a trend toward reducing and abolishing the death penalty, reflecting shifts in social norms and human rights advocacy. This research highlights the importance of considering local context in death penalty policy and supports the need for international dialogue to encourage a more humane and effective implementation of justice

Abstract

This kind of approach focuses on rehabilitation and taking responsibility for one’s action rather than severe punishment. Pretrial interventions also allow the offender to participate in rehabilitative programs aimed at skills training and preventing future offenses without the stressful effect of the traditional criminal scion. More training and resources for police are crucial in the management of petty theft cases without the loss of public trust in the system of justice. Wanting community education efforts are also important in the elimination of petty theft. The study in this research uses the literature research method. Literature research method, also known as literature study, is an approach in research that relies on secondary data through the collection, analysis, and interpretation of published materials relevant to the research topic. The rationale for alternative legal solutions for petty theft cases cases demonstrates an advancement of criminal justice systems going beyond punitive measures. With the help of the restorative methods of justice, the two parties- the offender and the victim – become participants in the process of redress, which makes it possible for the offender to accept responsibility for his/her behaviour and for the victim to be reinstated with a sense of justice.

Abstract

The rapid spread of hoaxes in the digital era poses a significant threat to social, political, and economic stability worldwide. Artificial Intelligence (AI) has emerged as a promising solution for detecting and mitigating hoaxes through advanced techniques such as natural language processing, machine learning, and deep learning. This study employs a literature review method to examine the role of AI in identifying, verifying, and limiting the dissemination of false information across digital platforms. Data were synthesized from relevant academic articles, reports, and previous studies to provide a comprehensive understanding of current approaches and challenges. The findings reveal that AI technologies enhance the efficiency and accuracy of automatic hoax detection, enabling real-time analysis of large-scale digital content. However, challenges persist, particularly related to data scarcity, algorithmic bias, and the complexity of understanding cross-linguistic and cross-cultural contexts. To address these limitations, collaborative efforts involving governments, technology developers, academic researchers, and society are required. Strengthened regulatory frameworks, cross-sector partnerships, and improved digital literacy are essential to ensure the sustainable and ethical application of AI in combating hoaxes. This study contributes to the growing body of knowledge by highlighting the dual role of AI as both a technical and socio-ethical tool in countering misinformation. It provides practical insights for policymakers, educators, and technology practitioners on integrating AI-based detection systems with broader strategies for digital literacy and regulatory governance. By presenting a comprehensive framework, the study underscores how AI can be leveraged responsibly to safeguard information integrity in the digital age.

Abstract

The COVID-19 pandemic has not only brought challenges in the health sector, but also given rise to the phenomenon of disinformation that has had a significant impact on public health. This study aims to identify patterns of dissemination and the impact of COVID-19-related disinformation, as well as to formulate effective mitigation strategies through a literature review of various scientific literature and research reports. The results of the analysis indicate that misinformation spreads massively through social media, instant messaging apps, and mass media, with patterns that exploit public emotional sentiment and uncertainty. The impact of misinformation includes a decline in compliance with health protocols, scepticism about vaccination, and a decline in public trust in health institutions and the government. The recommended mitigation strategies include improving digital and health literacy, strengthening regulations, promoting cross-sector collaboration, and optimising data-driven public communication and transparency. These findings underscore the importance of synergies among various parties in building public information resilience to face similar crises in the future
