Abstract

The regulation of transfusion, stem cells, and organ transplantation from a public health perspective in Indonesia has been supported by applicable laws and regulations. Meanwhile, problems related to the implementation of blood transfusions, stem cells, and organ transplants from the legal aspect of health in Indonesia, among others, during the Covid-19 pandemic, the availability of blood bag stocks was running low due to the PSBB factor in terms of Social Distancing so that blood donors who came did not meet their needs, including the provision of blood donations. convalescent plasma for Covid-19 patients with severe stages whose system is currently being drafted by the government.

Abstract

Health is a fundamental right for every human being. The right to live healthy is a human right for every citizen. In various international conventions, the protection of human rights is discussed, one of which is in the health sector. Indonesia generally regulates human rights in the health sector in laws and regulations as the legal basis for implementing health services. In health services, there are rights and obligations of the parties, namely health service providers (medical personnel, health workers) and health service recipients (patients) arising from therapeutic transactions. Each party must understand its rights and implement its obligations. In practice, the lack of communication between the parties involved in the implementation of health services, lack of understanding, or lack of information disclosure results in problems with patient rights. The purpose of making the theme of this paper is to find out the relationship between biomedical conventions and patient rights from a human rights perspective, as well as patient rights from a juridical perspective and their application in Indonesia. The results of this paper are the need for information disclosure, strengthening socialization related to rights and obligations as well as sanctions in case of violations in the application in the biomedical field and awareness of the parties concerned in understanding the rights and implementing their respective obligations in the implementation of health services.

Abstract

Health is an element of well-being. Public health plays an important role in the formation of human resources, increasing the nation's resilience and competitiveness, as well as national development. In Indonesia, HIV infection is one of the main health problems and one of the infectious diseases that can affect maternal and child mortality. Everyone has the right to have a healthy life so that they can live productively both socially and economically, one of which is reproductive health. In principle, the state prohibits abortion, but on indications of a medical emergency and worsening mental condition due to pregnancy, cases of rape are exceptions to the provisions. The increase in cases of HIV and AIDS in the community is a potential threat to public health that can have a broad and negative impact on the resilience of the nation. In addition, the act of abortion also raises pros and cons because reproductive health is one of the scopes of public health. The purpose of making the theme of this paper is to find out the perspective of public health law on HIV and AIDS, reproductive health, and abortion. The results of this paper are the need for information disclosure, strengthening socialization, awareness and supervision of related parties in HIV and AIDS prevention, reproductive health management, and supervision of abortion.

Abstract

With the existence of the Asean Economic Community (MEA) in 2015 where the free trade of ASEAN countries begins to be implemented, the demands for the quality of processed products will also increase. If the quality of local products is not able to compete with imported products, then Indonesia will not be able to survive in free trade. The application of food safety in Indonesia is still considered not guaranteed. One way to ensure food safety is the implementation of the HACCP (Hazard Analysis and Critical Control Point) program on products, which is a hazard analysis and control of critical points of the production process. With the implementation of HACCP on local products, it is hoped that it will increase confidence in the safety of processed foods so that it will indirectly promote trade and the stability of the national food business and increase the competitiveness of the national food sector in the face of free trade.

Abstract

The consumer rights mentioned above show that the issue of consumer comfort, security, and safety is the most important thing in consumer protection issues. Legal responsibility in the event of consumer losses due to expired drugs is the obligation of consumers to read or follow information instructions and procedures for using or utilizing drugs for safety and security, it is important to get regulation. The importance of this obligation is because often business actors have conveyed a clear warning on the label of a product/drug, but consumers do not read the warning that has been delivered. The regulation of this obligation gives the consequence that the business actor is not responsible if the consumer in question suffers a loss due to neglecting the obligation. This research was made using normative research methods, because this research is supported by data obtained from the literature by collecting secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. The primary legal materials for this thesis are the 1945 Constitution of the Republic of Indonesia, which was amended IV and Law Number 8 of 1999 concerning Consumer Protection. After the data is collected, the data is processed by verifying and validating the validity of the data. Data analysis was carried out by applying the syllogistic way of thinking and deductive methods in order to find conclusions or answers from the formulation of the problem.

Abstract

Terms that are often found in society, such as e-commerce, e-business, and e-contract, essentially have differences from one another but are closely related. E-commerce is one way of running an e-business that is secured by an e-contract for the parties to one another. Meanwhile, e-business also has various models to run, each of which has a different way of doing it and different levels of preference from consumers. The issue of e-commerce has also become a concern for the international community with the demonstration of a general assembly resolution from the United Nations which regulates a little about e-commerce.

Abstract

Domains are very helpful because the chances of fraud happening are very small. This can be seen in the registration method which can be said to be quite strict. To register a domain, general requirements are needed, which include not violating patent rights and being required to report a clear identity legally.

Abstract

In Indonesia, the development of "informed consent" in a formal juridical manner, was marked by the emergence of a statement from the Indonesian Doctors Association (IDI) regarding "informed consent" through SK PB-IDI No. 319/PB/A.4/88 in 1988. Then it was reaffirmed by PerMenKes No. 585 of 1989 concerning "Informed Consent". As well as emphasized by Law No. 29 of 2004. Informed Consent obtained in an improper manner cannot be considered as the inventor of the patient's autonomy right, so that such action is a violation of the law. -Values in the local culture are very varied.
