Abstract

Syarat mengenai ambang batas pencalonan kepala daerah sering menjadi perdebatan dalam dunia politik karena dianggap menghambat demokrasi yang inklusif. Penelitian ini bertujuan untuk menganalisis aspek yuridis Putusan Mahkamah Konstitusi No. 60/PUU-XXII/2024 terhadap demokrasi dalam pelaksanaan Pilkada Serentak 2024. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan analitis, serta pengumpulan data melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi memberikan pertimbangan hukum yang kuat dalam menyatakan pasal 40 ayat (3) UU No. 10 Tahun 2016 bertentangan dengan UUD 1945. Putusan tersebut menurunkan ambang batas pencalonan dari 20-25% menjadi 6,5-10%, memberikan ruang lebih besar bagi partai politik kecil dan meningkatkan partisipasi publik. Dengan demikian, putusan ini berdampak positif pada kualitas demokrasi di Indonesia.

Abstract

Perkembangan teknologi digital yang pesat telah mendorong pertumbuhan platform e-commerce, termasuk TikTok Shop sebagai salah satu media sosial yang merambah sektor perdagangan daring. Fenomena ini menimbulkan dinamika baru dalam hubungan antara pelaku usaha dan konsumen yang bertransaksi secara daring. Dalam konteks ini, muncul pertanyaan mengenai sejauh mana negara bertanggung jawab dalam menjamin perlindungan hukum bagi konsumen terhadap potensi kerugian yang timbul dalam transaksi melalui platform tersebut. Penelitian ini bertujuan untuk menganalisis tanggung jawab negara dalam menjamin perlindungan hukum konsumen TikTok Shop berdasarkan perspektif Hukum Tata Negara, khususnya prinsip negara hukum (rechtsstaat) dan kewajiban negara dalam melindungi warga negaranya. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual, Undang-Undang Informasi dan Transaksi Elektronik, serta prinsip-prinsip konstitusional dalam UUD NRI 1945. Kesimpulan dari penelitian ini adalah bahwa perlindungan hukum konsumen TikTok Shop tidak hanya menjadi tanggung jawab pelaku usaha dan platform digital, tetapi juga menjadi bagian dari tanggung jawab negara dalam menjamin kepastian hukum dan perlindungan hak-hak warga negara dalam ekosistem digital yang semakin berkembang

Abstract

Purpose: This research describes how much the selection of acting regional heads by the central government does not run as per the constitutional principles, local democracy and national resilience which are through the Asta Gatra framework but more politically captured by offering a model of governance that is more accountable and participatory. Study Design/Methodology/Approach: Normative legal method with narrative review and comparative analyses of legislation, Constitutional Court decisions, and national and international academic literature to map the correlation between legal legitimacy, institutional design and regional government stability the research applies a normative legal method combined with a narrative review and comparative analyses of legislation, Constitutional Court decisions, and national and international academic literature in order to map the correlation between legal legitimacy, institutional design, and regional government stability. Findings: The findings reveal that the higher-level leadership appointment system has substantial regulatory vacancies, especially in terms of authority restriction, legislative supervision, selection transparency and performance responsibility. These contradictions are affecting the political, governance and social aspects of Asta Gatra so that it can drain the drain the power of regional legitimacy and institutional resilience. Country illustrations, like in Germany, India, and South Africa, show that support for interim leadership is normally subject to legislative endorsement and public scrutiny, with terms of office limited to democratic insurance coverage. Originality/Value: This conceptual contribution is presented to the development of an institutional design for regional leadership transitions that is more democratic and adaptive to national resilience needs. Recommendations focus on regulatory reform, involvement of the Regional People's Representative Council (DPRD), and strengthening public evaluation to ensure the appointment of Acting Regional Heads aligns with substantive democratic principles and strengthens regional autonomy.

Abstract

The constitution in Indonesia has undergone several changes since Indonesia's independence. In this dynamic, Indonesia is in the phase of finding its identity and the right government system in accordance with the conditions of the Indonesian nation. Changes to the constitution repeatedly, namely in the Post-Independence period, the 1945 KRIS, the 1950 Constitution, the New Order, the Old Order, and the Reformation. Article 7 of the 1945 Constitution of the Republic of Indonesia states that the President governs for a term of five years and can be re-elected in the election of the head of state. However, until the New Order era, the presidential term limit was not determined. Resulting in abuse of power and political chaos. The post-amendment reform era changed Article 7 by limiting the president's power to only two terms. The amendment to Article 7 is referred to as the embodiment of reform and is in accordance with the opinion of the Indonesian people so that power regeneration can occur. The discourse on the third amendment in Article 7 is pro and contra because it is planned that there will be a change in the limitation of the presidential term of office to three periods. This discourse is not in accordance with the spirit of Article 7 of the 1945 Constitution of the Republic of Indonesia and the controversy among the Indonesian people. The Indonesian people hope that the abuse of power will not repeat itself as in the pre-reform era and stick to the mandate of Article 7 of the 1945 Constitution of the Republic of Indonesia that the president is limited to two terms.

Abstract

Humans as social beings grow and develop through interactions with others, requiring norms and ethics in communal life. Ethics and health law are important foundations in maintaining the well-being of individuals and society. This study used a qualitative method with a literature review to collect and analyze information related to the principles of ethics and health law. Ethics, originating from Latin and Greek words, refer to norms of behavior related to human values and customs. Law regulates human behavior in society with the aim of maintaining order and justice, including in the context of health services. Ethics and health law complement each other, where the law tends to be rigid while ethics provide morally responsive guidance to changes. Conflicts between ethics and health law, such as in cases of abortion, emphasize the need for clear policies and a strong moral understanding from medical professionals. The application of ethics and health law in health services, especially in hospitals, influences patient experiences, reflecting practices that are professional and respect patient privacy.

Abstract

AbstractPlastic waste has become one of the most serious environmental problems in Indonesia, particularly in rural areas that face limitations in waste management systems. Uncontrolled plastic waste management has caused adverse impacts on the environment, public health, and ecosystem sustainability. Low levels of public awareness and legal understanding of environmental regulations further exacerbate this condition. Therefore, strengthening community participation and local governance structures has become an urgent necessity. This Community Service Program (PkM) was conducted by lecturers of the Faculty of Law, Universitas Esa Unggul, in Tugu Jaya Village, Cigombong District, Bogor Regency, West Java, on 6–7 December 2025. The program aimed to establish an Environmentally Aware Village through the socialization of plastic waste management regulations and the strengthening of the role of neighborhood and community associations (RT/RW) as the frontline actors in environmental management. The methods employed included lectures and regulatory socialization, discussions and question-and-answer sessions, as well as educational games and the distribution of incentives, with reference to Law Number 18 of 2008 on Waste Management, Government Regulation Number 81 of 2012, and Law Number 32 of 2009 on Environmental Protection and Management. The results of the program indicate an increase in public legal awareness regarding rights and obligations in plastic waste management. The strengthening of the role of RT/RW proved effective in encouraging collective community participation and compliance with environmental regulations. Accordingly, community-based legal education serves as a strategic instrument in realizing sustainable environmental governance at the village level. Keywords: plastic waste, environmental law, community service, RT/RW, sustainable village. ABSTRAKSampah plastik telah menjadi salah satu persoalan lingkungan paling serius di Indonesia, khususnya di wilayah pedesaan yang memiliki keterbatasan sistem pengelolaan sampah. Pengelolaan sampah plastik yang tidak terkendali menimbulkan dampak negatif terhadap lingkungan hidup, kesehatan masyarakat, dan keberlanjutan ekosistem. Rendahnya kesadaran dan pemahaman hukum masyarakat terhadap regulasi lingkungan memperburuk kondisi tersebut. Oleh karena itu, penguatan peran masyarakat dan struktur pemerintahan lokal menjadi kebutuhan mendesak. Kegiatan Pengabdian kepada Masyarakat (PkM) ini dilaksanakan oleh Dosen Fakultas Hukum Universitas Esa Unggul di Desa Tugu Jaya, Kecamatan Cigombong, Kabupaten Bogor, Jawa Barat, pada tanggal 6–7 Desember 2025. Tujuan kegiatan adalah membentuk Desa Sadar Lingkungan melalui sosialisasi regulasi pengelolaan sampah plastik dan penguatan peran RT/RW sebagai garda terdepan pengelolaan lingkungan. Metode yang digunakan meliputi paparan berikut sosialisasi, diskusi dan tanya jawab serta permainan edukatif dan pemberian hadiah yang mengacu pada Undang-Undang Nomor 18 Tahun 2008 tentang Pengelolaan Sampah, Peraturan Pemerintah Nomor 81 Tahun 2012, dan Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Hasil kegiatan menunjukkan adanya peningkatan kesadaran hukum masyarakat terkait hak dan kewajiban dalam pengelolaan sampah plastik. Penguatan peran RT/RW terbukti efektif dalam mendorong partisipasi kolektif masyarakat dan kepatuhan terhadap regulasi lingkungan. Dengan demikian, pendidikan hukum berbasis komunitas menjadi instrumen strategis dalam mewujudkan tata kelola lingkungan yang berkelanjutan di tingkat desa. Kata kunci: sampah plastik, hukum lingkungan, pengabdian masyarakat, RT/RW, desa berkelanjutan.

Abstract

This research aims to analyze the effectiveness of the Online Single Submission (OSS) system as an instrument of bureaucratic reform in realizing transparency and accountability of licensing services in the digital era. The scope of the study includes the normative provisions underlying OSS and its implementation in practice, focusing on the gap between regulatory design and bureaucratic reality. The research method uses a normative juridical approach, with an analysis of laws and regulations, academic literature, and relevant secondary data. The results of the study show that OSS is able to simplify licensing procedures and improve access to information, but still faces obstacles in the form of weak central-regional data integration, limited apparatus capacity, and lack of substantive transparency in decision-making. The conclusion of the study confirms that OSS has great potential as a legal instrument to support the principle of good governance, but its effectiveness is not optimal. It is necessary to strengthen derivative regulations, improve the competence of the apparatus, and have a more comprehensive supervision mechanism so that OSS can truly become a means of bureaucratic reform that ensures legal certainty, transparency, and accountability of public services.

Abstract

The concept of the rule of law as the foundation of modern statecraft affirms the supremacy of law in governing national life. Encompassing both formal and substantive dimensions, the rule of law emphasizes the protection of human rights, limitations on government power, and guarantees of justice. This multidisciplinary study incorporates philosophical, sociological, political, and juridical perspectives that continue to evolve alongside global socio-political transformations.This research uses a Systematic Literature Review (SLR) to systematically, structured, and transparently identify, evaluate, and synthesize scholarly findings. This method examines scholarly articles on the evolution of the concept of the rule of law within the rechtsstaat and rule of law traditions and their implementation in the modern constitutional system, producing evidence-based conclusions while minimizing researcher bias.The research aims to analyze the development of the concept of the rule of law through an integration of theoretical and practical dimensions. It aims to identify structural challenges to implementation, explore the role of jurisprudence and judicial activism, evaluate legislative responsibility in producing just legal products, and deepen understanding of the philosophical foundations of the rule of law concept to address the complexities of contemporary legal realities.The findings indicate that the implementation of the rule of law in Indonesia faces legislative inconsistencies and political intervention that hinder effective law enforcement. Jurisprudence plays a crucial role in interpreting constitutional principles, but judicial activism requires balance to prevent judicial supremacy. Legislative power must produce laws that are formally valid and substantively just. The effectiveness of a state based on the rule of law requires reform of the legislative system, strengthening of public institutions, and developing a legal culture in society.The conclusion emphasizes the need for comprehensive reform of the legislative system, strengthening the capacity of public institutions, and developing a legal culture to address the gap between constitutional norms and the reality of implementation. A balance between judicial independence and accountability is necessary to prevent the overreach of judicial authority. The legislature is responsible for producing laws that protect citizens' rights in a contextualized manner. The concept of a state based on the rule of law requires in-depth philosophical understanding and ongoing theoretical reformulation to address the complexities of contemporary law.

Abstract

The Indonesian constitutional system underwent a fundamental transformation following the amendments to the 1945 Constitution, particularly in the distribution of authority within state institutions. Studying the dynamics of authority is crucial for understanding the checks and balances mechanism in democratic and constitutional governance.This research analyzes the institutional transformation of the People's Consultative Assembly (MPR), examines the patterns of relationships between state institutions, evaluates the role of the Constitutional Court as an interpreter of the constitution, and analyzes the redistribution of legislative authority through the strengthening of the House of Representatives (DPR) and the establishment of a bicameral system with the Regional Representatives Council (DPD) to foster a democratic legislative process.The research methodology employed a Systematic Literature Review (SLR) conducted in a systematic, planned, and transparent manner to identify, evaluate, and synthesize various relevant scholarly articles to obtain a comprehensive overview of the development of research concepts.The results show that the MPR has transformed from a supreme institution to an equal institution. Relations between state institutions are built on the pillars of constitutional supremacy and the separation of powers. The Constitutional Court serves as a guardian of the constitution, resolving disputes over authority. The establishment of a bicameral system strengthens the checks and balances mechanism in the national legislative process.The conclusion of the study confirms that the amendment to the 1945 Constitution has succeeded in creating a more democratic state architecture with the transformation of the authority of the MPR, strengthening of constitutional supremacy through the Constitutional Court, and redistribution of legislative authority which has resulted in a more accountable, participatory, and representative government system towards national and regional interests within the framework of a democratic state based on the rule of law.

Abstract

The principle of checks and balances is an essential foundation of modern constitutionalism, preventing the concentration of power and ensuring accountability, transparency, and fairness in democratic governance, rooted in Montesquieu's idea of ??the separation of powers.This study analyzes the principle of checks and balances in the Indonesian constitutional system through four dimensions: the theoretical-constitutional foundation following the amendments to the 1945 Constitution, the role of the judiciary as a counterweight, the effectiveness of constitutional accountability mechanisms, and the identification of structural weaknesses to formulate an institutional strengthening agenda.The research methodology employed a Systematic Literature Review (SLR), conducted systematically, structured, and transparently to identify, evaluate, and synthesize relevant scholarly articles to gain a comprehensive understanding while minimizing bias.The results show that the amendments to the 1945 Constitution have transformed the architecture of checks and balances from executive dominance to proportional inter-branch equality. The Constitutional Court plays a vital role as a constitutional watchdog, but faces tensions between accountability and judicial independence. The impeachment mechanism and the protection of independent institutions such as the Corruption Eradication Commission (KPK) are crucial instruments, although their implementation faces the threat of political intervention that undermines the effectiveness of oversight.The research's conclusions emphasize the need for Pancasila-based reconstruction to strengthen the philosophical foundation of the balance of power system. A comprehensive institutional strengthening agenda is needed, encompassing strengthening the authority of the Regional Representative Council (DPD), protecting independent institutions, regulating proportional judicial accountability, and internalizing Pancasila values ??to optimize the effectiveness of checks and balances in preventing abuse of power and realizing a democratic, just, and sustainable Indonesian state system.
