Abstract

This study examines and analyzes the subjective and normative aspects of the distribution of joint property after divorce in Decision Number 1290/Pdt.G/2021/PA.Pdg. The research aims to analyze the legal process and judicial considerations applied in determining the distribution of joint property between the plaintiff and the defendant. The study employs a qualitative approach combining normative juridical analysis and field research. Primary data are obtained through interviews with ex-husband (plaintiff), ex-wife (defendant), the Chief Judge of the Padang Religious Court, and an Islamic family law scholar. Secondary data consist of judicial decisions, statutory regulations, and relevant academic literature. Data are analyzed using Miles and Huberman’s techniques, including data reduction, descriptive narrative presentation, and iterative conclusion drawing. The findings show that the dispute over joint property arises from different interpretations of ownership between the plaintiff and the defendant regarding a house acquired during marriage. Although Article 35 of Law Number 1 of 1974 and Article 97 of the Kompilasi Hukum Islam (KHI) generally recognize equal division of joint property, the court considers the financial contribution of a third party, namely the defendant’s mother. The judge applies the principles of good faith, distributive justice, and recognition of third-party contributions in determining a proportional distribution of the property. From the perspective of maqāṣid al-sharī‘ah, particularly the principle of ḥifẓ al-māl (protection of property), the decision reflects an effort to safeguard legitimate ownership and prevent unjust enrichment while maintaining fairness in family economic relations. These findings imply that integrating statutory law and maqāṣid principles can strengthen substantive justice in resolving joint property disputes in Islamic family law.

Abstract

Islamic boarding schools are Islamic educational institutions in the form of dormitories where students' activities are carried out under the guidance and supervision of mentors who are supposed to play an important role in instilling religious values so that students can comply with the legal norms that apply to them. However, behind the image of Islamic boarding schools as places of spiritual development, reports of sexual violence have raised public concern because they are committed by people who have the authority to educate and protect students. This occurs because the perpetrators wield power, making it easy for them to intimidate their victims. Sexual violence in religious educational environments is often hidden and goes unreported because it is committed by people with strong power structures. This issue is important and very complex because it can lead to violations of Islamic legal norms. Using a qualitative approach, this study analyzes the experiences of victims and the response of institutions to violations that have occurred. The results of the study show that unchecked power can create an environment that encourages sexual violence. This is evidenced by the fact that the perpetrators were immoral teachers and dormitory supervisors who held positions of power at the Islamic boarding school, making it impossible for the victims to avoid or even reject them. This study is expected to provide insights into the need for policy reform and increased awareness to protect victims, as well as the enforcement of existing legal norms

The findings revealed 12 couples in the area engaging in unregistered marriages, predominantly due to pregnancy out of wedlock, with two cases involving arranged marriages. Understanding Islamic law underscores the significance of registering marriages at the Office of Religious Affairs (KUA) to safeguard the legal rights of partners and children, particularly in instances of pregnancy out of wedlock. Knowledge of Islamic marriage procedures underscores the imperative of complete registration at the KUA, especially in cases of pregnancy out of wedlock. Awareness of the legal consequences emphasizes the curtailment of rights for children and wives from unregistered marriages, particularly in situations of out-of-wedlock pregnancy. Attitudes towards Islamic legal education stress its role in diminishing the incidence of unregistered marriages and underscore the importance of marriage registration, particularly in cases of out-of-wedlock pregnancy. The experience of addressing unregistered marriage cases underscores the significant legal issues faced by such couples, particularly concerning children born out of wedlock without registration. Overall, this research underscores the criticality of marriage registration and Islamic legal education in safeguarding the legal rights of spouses and children.

Abstract

Penelitian ini diarahkan untuk mengkaji serta menganalisis secara mendalam urgensi perlindungan hukum bagi anak yang menjadi korban perundungan, sekaligus mengeksplorasi model perlindungan hukum yang relevan dalam perspektif viktimologi. Metode yang digunakan adalah penelitian yuridis normatif, yang memandang hukum sebagai suatu sistem norma yang tersusun secara sistematis dan hierarkis. Pendekatan yang diterapkan meliputi pendekatan peraturan perundang-undangan (statutory approach), pendekatan analitis, serta pendekatan konseptual guna memperoleh pemahaman yang komprehensif. Dalam konteks Indonesia, perlindungan hukum terhadap anak penyandang disabilitas yang menjadi korban perundungan telah memiliki dasar normatif melalui berbagai regulasi yang berlaku. Berdasarkan perspektif viktimologi, kelompok anak penyandang disabilitas yang mengalami perundungan dapat diklasifikasikan dalam tipologi biologically weak victim, yaitu kelompok individu yang secara biologis memiliki tingkat kerentanan yang lebih tinggi terhadap risiko viktimisasi.

Abstract

Artikel ini bertujuan mengkaji Hubunan agama dan negara dalam hukum Islam di Indonesia. Metode penelitian menggunakan penelitian kualitatif deskriptif dengan studi pustaka yang bertujuan untuk mengkaji data primer yaitu undang-undang, peraturan sejenis, jurnal, buku, dan sumber lain yang berkaitan dengan masalah penelitian. Pendekatan penelitian yang digunakan adalah penelitian hukum. Teknik pengumpulan data dengan studi literatur dengan analisis data dengan metode deskriptif kualitatif. Hasil kajian menunjukkan bahwa Indonesia bukanlah negara agama tetapi agama merupakan salah satu unsur yang sangat penting, sehingga hubungan antara agama dan negara berimplikasi pada positivisasi hukum Islam ke dalam hukum nasional sebagai bentuk manifestasi negara sebagai satu kesatuan yang tidak dapat dipisahkan dari kehidupan beragama yang bersifat simbiosis-integralistik, dengan melahirkan suatu produk hukum Islam sebagai hukum nasional hingga tetap berlaku. sehingga memberikan kerukunan, kedamaian, dalam kehidupan beragama, berbangsa dan bernegara tercapai dan tetap lestari.
