Abstract

Penelitian ini memfokuskan pada bagaimana proses pendampingan rehabilitasi korban perkosaan dan pemenuhan hak-hak korban dalam mewujudkan keadilan restoratif di pusat pelayanan terpadu pemberdayaan perempuan dan anak (P2TP2A). Penelitian dikatagorikan sebagai jenis penelitian lapangan (field research) dengan menggunakan pendekatan kualitatif deskriptif. Hasil penelitian ini bahwa proses pendampingan rehabilitasi di P2TP2A, pertama penerimaan atau pengajuan laporan kekerasan seksual; kedua, Identifikasi dan Registrasi; ketiga, Assesmen (pemeriksaan); keempat, Pelayanan Rehabilitasi; dan kelima, Advokasi dan Pembelaan Hukum. Selanjutnya juga dilakukan Pembinaan Mental dan Spiritual, Pembinaan Sosial dan Psikologis, dan Pembinaan Keterampilan/kreatifitas terhadap korban perkosaan. Dalam mewujudkan keadilan restoratif, P2TP2A tidak hanya mangandalkan pendampingan hukum positif sebagai kemaslahatan pada korbaan perkosaan, akan tetapi secara khusus menitik beratkan pada pemulihan hak-hak korban perkosaan yang hilang dalam beberapa aspek. Pertama aspek pencegahan atau preventif; kedua aspek Litigasi; ketiga aspek terapi; dan keempat aspek rehabilitasi, sebagai usaha untuk memperoleh fungsi dan penyesuaian diri secara maksimal dalam kehidupannya dimasa mendatang. Kata Kunci: Keadilan Restoratif; Rehabilitasi; Tindak Kejahatan Perkosaan.

Abstract

Since 2017-2021, case of electronic-based sexual violence (EBSV) reported to service institution continues to increase, and a majority of the victims are women. This research aims to describe the EBSV case data, explain legal protection efforts given to the victims, then analyze it using the legal system theory. The type of research used is juridical-empirical with locus research at Women Crisis Centre (WCC) Dian Mutiara. The research results show that on month January 2020 - September 2022, there were 42 cases handled by WCC Dian Mutiara. Then the legal protection for victims is carried out through preventive and repressive efforts. In terms of legal structure, the facilities and infrastructure for handling KSBE cases at WCC Dian Mutiara and the police are not yet fully available. At WCC Dian Mutiara, this can be seen from the lack of human resources (assistants) and the unstable finances of the institution. Meanwhile, in the police, it can be seen from the victim's complaint at the time of confiscation of evidence in the form of a handphone which is usually used for daily activities by the victim. Then the analysis of the legal substance shows that the rules regarding EBSV already exist in the Law on Electronic Transactions (UU ITE) and the Pornography Law, but more comprehensive rules are contained in the Law on Crimes against Sexual Violence (RUU TPKS). Finally, an analysis of legal culture shows that public oversight of the performance of law enforcers, especially the police, is increasing. However, some­times the community's understanding of a case is still partial, making it easy to intervene. Meanwhile, the legal culture of law enforcement officials can be seen from the lack of optimal cases in the process of resolving cases, coupled with the occasional attitude of the police, not on the side of the victims.

Abstract

Dalam kasus cerai gugat dalam putusan perkara nomor 73/Pdt.G/2022/PA. Ksn. Hakim menetapkan putusan perkara bahwa hak asuh anak milik bersama (joint custody/ shared parenting). Padahal dalam kasus tersebut anak masih berusia dibawah 12 tahun. Fokus permasalahan dalam penelitian ini yaitu untuk mengetahui pandangan Hakim di Pengadilan Agama Kasongan terkait pengasuhan anak (joint custody) pasca cerai gugat. Dan pengasuhan anak (joint custody) ditinjau UU Nomor 35 Tahun 2014 Tentang Perlindungan Anak. Jenis penelitian ini termasuk dalam jenis penelitian yuridis empiris dengan pendekatan kualitatif. Sumber data primer yang digunakan yaitu wawancara, dan sumber data sekunder menggunakan studi pustaka seperti buku, jurnal dan skripsi. Proses pengumpulan data menggunakan wawancara dan dokumentasi berupa surat keterangan telah melakukan penelitian. Adapun tahapan pengolahan data yang digunakan dalam penelitian ini terdiri dari proses pemeriksaan, klasifikasi, verifikasi, analisis, dan kesimpulan. Hasil penelitian menunjukan bahwa Hakim Pengadilan Agama Kasongan setuju dengan pengasuhan anak (joint custody). Sebab, hal tersebut memberikan anak kebebasan untuk memilih tinggal dengan orang tua manapun tanpa adanya paksaan. Pengasuhan anak (joint custody) ditinjau UU Nomor 35 Tahun 2014 sangat relevan. Sebab konsep pengasuhan bersama sangat berkaitan erat dengan asas kepentingan terbaik bagi anak. Sebagaimana dalam Pasal 2 Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak.

Abstract

The high rate of child marriage in Indonesia following the marriage dispensation procedure demands an application to help judges decide the proposals accurately and effectively. This 4D development model research aims to create a standard reference in making decisions regarding the dispensation of marriage proposals using an application. The first stage is defining variables used at the application as measurement, the second stage is designing, namely the process of preparing a conceptual framework in the form of technological innovation, the third stage is developing technological innovation and the fourth stage is disseminating, namely the use of an application. At the defining stage, the variables to measure the level of urgency in granting the marriage dispensation include Social, Partnership Role, Financial, Spiritual, and Reproductive or Sexual Readiness. At the designing stage, the Dispen-Ku application is created using Kodular, a website that provides tools for creating Android applications using block programming. In the disseminating stage, the Dispen-ku application which has been uploaded to the Playstore page is distributed to research subjects, namely two judges in Religious Courts.

Abstract

The Sakinah Workshop Program is an innovation program from the Banyuwangi Regency TP-PKK which is a corner service for the community by providing motivation, understanding, and prevention. The main purpose of the establishment of the Sakinah Workshop program is to reduce the divorce rate in Banyuwangi Regency. This research uses an empirical-normative type of research and uses a qualitative approach. The results showed that the Sakinah Workshop in Banyuwangi Regency has not achieved the main goal, namely to reduce the divorce rate in Banyuwangi Regency, and the divorce rate in Banyuwangi Regency cannot be a benchmark for the success of Sakinah Workshop because the scope of Sakinah Workshop is not only to prevent problems for couples who are about to divorce, but more broadly, namely regarding health, safety, and also assistance to the duafa community. The efforts made by Sakinah Workshop to reduce the divorce rate are by opening a space to vent to families who are experiencing problems such as the economy, infidelity, and domestic violence.

Abstract

Penelitian ini bertujuan untuk menjelaskan tentang landasan hakim dalam mengabulkan permohonan dispensasi nikah pasca pemberlakuan Undang-Undang No. 16 Tahun 2019 yang kemudian dianalisis menggunakan teori sistem hukum Lawrence M. Friedman. Penelitian ini merupakan penelitian hukum empiris (field research), Metode yang digunakan dalam yaitu yuridis empiris, dengan cara turun langsung ke Pengadilan Agama Malang dan kepada pihak pemohon dispensasi nikah. Penelitian ini menyimpulkan bahwa pertama, landasan hakim mengabulkan semua permohonan dispensasi nikah karena mengutamakan kepentingan terbaik bagi anak dan khawatir jika ditolak keburukan yang timbul akan lebih besar. Kedua, hukum belum bisa berjalan dengan efektif karena ketiga sub sistem dalam sistem hukum masih saling bertabrakan, struktur dan substansi hukum dalam Undang-Undang No. 16 Tahun 2019 masih ada kalimatnya yang multitafsir “alasan sangat mendesak”, dan juga dari segi budaya hukum yang masih belum seimbang yakni tingkat kesadaran hukum masyakarat yang masih rendah, serta budaya hukum hakim masih memiliki pola penetapan dispensasi nikah yang tidak berubah dalam menangani perkara dispensasi nikah, yaitu cenderung cepat dan tidak banyak pertimbangan.

Abstract

Childfree is a life choice not to have children after or before marriage, whether biological children, stepchildren, or adopted children. This article discusses how childfree is influenced by the digital era and what the perspective of Islamic law is according to the views of ulama and gender activists in Malang, East Java. This empirical legal study used legal sociology and maqāṣid al-sharī’ah approaches. Data were collected by means of in-depth interviews and a literature review. Findings showed that child-free development in Indonesia has been influenced by the digital era through online media, which quickly spread and made it easier for people from various countries to interact and share information. One of the objectives of Islamic law (maqāṣid al-sharī'ah) is to maintain offspring (hifz al-nasl) through marriage. According to the ulama, being childfree is contrary to Islamic law and the nature of humanity. According to the Nahdlatul Ulama, Muhammadiyah, and gender activists, the laws on childfree can be summed up in two ways: haram and mubah. Childfree is haram (unlawful) because it is contrary to maqāṣid al-sharī’ah, i.e., preserving offspring, as it is also the goal of marriage. Childfree is mubah (allowed) if there are reasons that are condoned by the sharia, e.g., health problems, physical limitations, and psychological conditions that prevent the wife from having children. Sociologically, the government and all related parties need to provide education to the public so that the meaning of childfree can be understood properly and correctly.

Abstract

This article endeavors to conduct a comparative and gender-equality-focused analysis of legal policies safeguarding women facing domestic violence in Indonesia and Malaysia. Employing a normative juridical research approach, the study utilizes legal comparison as its methodological framework. Primary, secondary, and other relevant literature data are employed for a descriptive and analytical analysis. The study reveals that Indonesia addresses gender equality in protecting women through Law Number 23 of 2004, while Malaysia relies on the 1994 Domestic Violence Act (Act 521). These legal frameworks not only prescribe criminal sanctions for domestic violence perpetrators but also encompass provisions for victims' psychological, physical, and social recovery. Despite the existence of legal safeguards in both countries, instances of domestic violence persist. Women, often the primary victims, face barriers in reporting or seeking protection due to ingrained social structures, educational factors, economic disparities, and a prevailing patriarchal culture. This phenomenon underscores persistent gender inequality in society. The article contributes by shedding light on the societal reality of ongoing gender inequality, perpetuating domestic violence against women in Indonesia and Malaysia. It advocates for the revision of legal policies pertaining to the protection of women facing domestic violence, grounded in gender equality, to ensure comprehensive safeguarding within the realms of social structure, education, economics, and socio-cultural factors

Abstract

Gender often becomes an issue in assuming roles in family resilience. Some people believe that maintaining household stability is a responsibility solely entrusted to the husband. However, one of the factors contributing to divorce is the imbalance in household stability resulting from the lack of roles among family members in maintaining family resilience and well-being. This study aims to explore how family resilience education operates in Kemantren Village, Malang Regency. Simultaneously, this article also seeks to examine the implications of gender perspectives on the community in Kemantren Village. The research method used is qualitative, with a sociological approach. This study involves 27 individuals as informants who will fill out questionnaires and also serve as interview subjects to understand the state of family resilience education in Kemantren Village. The study findings indicate that women's roles in the family not only influence overall family dynamics but can also be crucial factors in facing challenges and strengthening family resilience. The insights from family resilience education in Kemantren Village have had a positive impact on the sustainability of their households. Considering women's roles in the context of family resilience is one essential step in addressing the divorce trend in Indonesia

Abstract

The The partial settlement provision is a new provision in Supreme Court Regulation (PERMA) No 1 of 2016 which has not been regulated in previous regulations, which is an interesting discussion that must be examined from a progressive legal perspective. The aim of this research is to test progressive legal theory regarding the renewal of partial settlement provisions in Supreme Court Regulation (PERMA) Number 1 of 2016. The research method in this research is normative juridical research with a conceptual approach using library data collection techniques or library research. The results of this research show that the update to Perma Number 1 of 2016 concerning partial settlement provisions has fulfilled the basic ideas of progressive law. Partial Settlement Provisions for a portion of the entire object of a case or lawsuit can create ideal law. The parties can resolve the legal consequences that arise peacefully, after the main lawsuit and will reach a happy ending. Partial settlement provisions will realize the function of mediation, namely as a peaceful settlement and provide ample space for the parties to reach a wise and fair settlement.
