Abstract

Pembakaran hutan dan lahan dalam rangka pembukaan perkebunan, apabila terjadi kebakaran hutan yang meluas, dapat menimbulkan kerusakan lingkungan yang mengakibatkan terganggunya: kesehatan masyarakat, kegiatan pendidikan, kegiatan ekonomi dan transportasi darat dan udara, sehingga sulit untuk hidup sejahtera baik secara fisik dan spiritual. Bertempat tinggal, serta mendapatkan lingkungan hidup yang baik dan sehat merupakan hak masyarakat sebagaimana dimaksud dalam Pasal 28h ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Selain itu, pelaku pembakaran hutan diatur dalam: Undang-Undang Nomor 41 Tahun 1999 juncto Undang-Undang Nomor 19 Tahun 2004 tentang Kehutanan, Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, Undang-Undang Nomor. 39 Tahun 2014 tentang Perkebunan, KUHP dan Peraturan Mahkamah Agung Nomor 13 Tahun 2016 ternyata belum mampu menciptakan efek jera bagi pelaku kejahatan korporasi untuk membakar hutan dan lahan. Metode yang digunakan dalam penelitian ini adalah yuridis normatif, bersifat deskriptif analitis, dengan menggunakan Pendekatan Perundang-undangan. Pelaku aksi korporasi yang berulang kali membakar hutan harus mengupayakan penyelesaian hukum melalui pendekatan hukum pidana, hukum perdata berupa ganti rugi dan hukum administrasi berupa pencabutan izin pengelolaan izin usaha.

Abstract

Administrative law is a fundamental instrument in realizing a transparent, accountable, and equitable government. However, its implementation in Indonesia still faces various challenges, including jurisdictional conflicts between judicial bodies, the lack of public legal awareness, limited human resources, and suboptimal technological infrastructure. This study aims to analyze the role of public policy in strengthening the enforcement of administrative law through regulatory reform, the digitalization of the judicial system, and the enhancement of public participation. The research method used is a normative legal approach, analyzing legislation, legal doctrines, and national and international scholarly literature. The findings show that public policy plays a central role in supporting the transformation of the administrative legal system. The implementation of Law No. 30 of 2014 on Government Administration has expanded the authority of the Administrative Court (PTUN) to adjudicate on government actions that were previously outside the reach of the law. Additionally, judicial digitalization through the e-Court system has proven to expedite case handling processes and enhance public access to justice, particularly in remote areas. Strengthened public participation through Law No. 25 of 2009 and Law No. 14 of 2008 also contributes to reinforcing oversight over state administrative practices. However, the effectiveness of these policies is still limited by implementation challenges, which require further policy strategies such as regulatory harmonization, public legal education, and investment in infrastructure and human resources

Abstract

Legal development is not something that stands alone, but is integrated with development directions in other fields that require harmonization. Even though the direction of legal development is based on the outlines of ideas in the 1945 Constitution of the Republic of Indonesia, it requires alignment with the level of development of society that is envisioned to be created in the future.. This research was carried out using a normative juridical method which was carried out through a literature study which examined secondary data, namely statutory regulations, research results, scientific journals, study results and references. From the research results, it can be seen what the direction of legal development is and creating strong national resilience. There are still various legal loopholes, especially regarding laws and regulations that regulate territorial issues and state sovereignty. For this reason, law enforcement is a process that must be carried out in accordance with applicable laws and regulations without forgetting our conscience as humans. Abstract

Tujuan pengabdian ini adalah memberikan pemahaman tentang UU Perkawinan guna mencegah terjadinya perkawinan usia dini. Pengabdian ini dilaksanakan terhadap siswa SMPN 21 Sabak, Kepala Sekolah dan Para Guru SMP Negeri 21 Sabak Tanjung Jabung Timur. Pengabdian ini dilakukan dengan metode ceramah, tanya jawab dan contoh kasus. Hasil Pengabdian, para Siswa SMP Negeri 21 Sabak dapat memahami bahwa mengenai perkawinan telah diatur dalam UU No. 1 Tahun 1974 tentang perkawinan yang mengatur secara jelas tujuan, syarat-syarat perkawinan dan akibat perkawinan. UU Perkawinan juga menentukan usia yang dibolehkan oleh hukum untuk melangsungkan perkawinan apabila laki-laki dan perempuan telah berumur 19 tahun. Para siswa memahami bahwa perceraian yang terjadi dilingkungan mereka lebih disebabkan masih banyak masyarakat yang melangsung perkawinan di bawah umur atau perkawinan usia dini/anak sehingga menimbulkan praktek kekerasan dalam rumah tangga, penelantaran, kematian bagi perempuan dan perceraian. Karena kondisi daerah sehingga terdapat siswa yang tidak dapat melanjutkan pendidikan kejenjang yang lebih tinggi, jarak tempuh rumah ke sekolah yang sangat jauh, faktor keamanan, faktor ekonomi dan kebiasaan/budaya masyarakat serta kurangnya pemahaman para orang tua dan kerabat sehingga siswa/siswi demikian dipaksa untuk melangsungkan perkawinan pada usia dini/anak. Mengingat perkawinan usia dini/anak beresiko tinggi, maka perlu lebih kontinyu melakukan peningkatan pemahaman masyarakat mengenai hukum perkawinan khususnya tentang perkawinan usia dini dan akibat hukumnya.

Abstract

The source of Indonesian criminal law comes from the Criminal Code (KUHP) whose formation is carried out by political institutions based on the aspirations of the people in accordance with the fourth principle of Pancasila or in other words, the formation of criminal law is inseparable from legal politics. This research is important to study with the aim of knowing the role of legal politics in the formation of the Indonesian criminal law system based on the fourth precept of Pancasila. The research method used is normative juridical research method using statutory approach, case approach, comparative approach, conceptual approach. The results of this study show that legal politics is the basic policy of state administrators in the field of law that will, is and has been in effect, which originates from the values prevailing in society. Legal politics cannot be separated from the formation of the Indonesian criminal law system, because the formation of criminal law is carried out by the legislative body that represents the aspirations of the community. The role of legal politics in the enforcement of the criminal law system in Indonesia is to realize the objectives of the law, namely providing justice, certainty, and expediency.

Abstract

The Criminal Code is an important legal instrument in building the criminal justice system in Indonesia. In accordance with the times, the government enacted Law No. 1 of 2023 on the Criminal Code (National Criminal Code) as a replacement for the old Criminal Code (Law No. 1 of 1946). In the formation of Law No. 1 of 2023, there is a role of legal politics in order to create regulations that are in accordance with the conditions of the Indonesian nation. This study aims to determine the role of legal politics in the formation of Law No. 1 of 2023. The research method used in this research is normative juridical research method using statutory approach, case approach, comparative approach, conceptual approach. The results of this study show that legal politics plays an important role in the formation of Law No. 1 of 2023, where legal politics plays a role in determining the direction of policies regulated in the National Criminal Code relating to recodification of criminal law, democratization of criminal law, consolidation of criminal law, and adaptation/harmonization to changes in the punishment system.

Abstract

The times provide mandatory demands for laws in Indonesia to develop in accordance with the needs of today's society. However, in reality there are still many rules that intersect with each other and cause legal uncertainty. To deal with this, Indonesian law must be ready to adjust to the renewal of the legal system through omnibus law due to the accumulation of regulations. This research aims to open a new perspective in the implementation of omnibus law on land regulations that have been overlapping, resulting in the absence of legal harmonization. The research method is conducted with a normative juridical approach. The type of approach used is the statute approach. The legal materials used are primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques are carried out by means of literature studies related to research both from laws, scientific works and books. The results of this study indicate that the implementation of the omnibus law is a solution to the overlapping land regulations in Indonesia which must be accompanied by synergy and coordination from various institutions in order to create legal certainty.

Abstract

Corruption crimes have caused very large losses to the state and can have an impact on the emergence of various crises in various fields such as social life, nationhood, and statehood. Therefore, a legal enforcement method is needed through the establishment of a special body that has broad, independent, and free authority from any power in efforts to eradicate corruption crimes that are carried out maximally, intensively, effectively, professionally, and continuously. This paper uses a normative juridical research method through an approach based on basic legal materials by examining theories, concepts, legal principles, and regulations. Research using a normative juridical method is legal research conducted by examining literature or secondary data as a basis for research by tracing regulations and literature related to the issues being studied. To solve the legal problems that have been formulated and get their answers, this research uses four problem-solving approach models, namely the statutory approach, comparative approach, historical approach, and conceptual approach. The results of this study are various changes and reviews of anti-corruption laws that are legal policies applied by Indonesia as efforts towards legal reform for the better. Because corruption has harmed state finances, efforts to recover state financial losses are carried out through criminal, civil, and administrative channels.

Abstract

The intervention of political power based on the facts of law enforcement can affect responsive and conservative patterns in the formation of legal products, indicating that certain political situations can produce legal products that are in accordance with their political nature, including in the formation of the new Criminal Code which has become a public concern in Indonesia. This research aims to provide a deeper understanding of the relationship between political structure and the development of criminal law in Indonesia. The method used in collecting legal materials in this research is carried out using library research, namely by using archival review techniques or literature studies of books, journals, articles, theses or works of experts related to the research conducted. The results of this study show that in the current reform era, political configuration has a dominant influence on the structure and substance of law. Political power plays a key role in the formation of laws, where the interests of certain groups often dominate the resulting policies. Legal products are often used as a means of justifying power policies, even though they may contradict the values of public justice and are no longer in accordance with Indonesia's cultural dynamics.

Abstract

The environmental crisis caused by the escalating issue of plastic waste has garnered significant attention globally, including in Indonesia. Jambi, a region profoundly impacted, grapples with the challenge of managing plastic waste, which accounts for 50 percent of the annual waste production from 2022 to 2023. This study aims to evaluate the implementation of legal policies in addressing this environmental crisis, focusing on plastic waste management in Jambi. Additionally, it examines efforts to prevent further environmental deterioration through legal enforcement. Utilizing a qualitative approach with a case study methodology, data were gathered through interviews with various stakeholders, including governmental bodies, non-governmental organizations, and industrial sectors. Document reviews and literature surveys were also conducted to gain insights into the current state of plastic waste management in Jambi. Findings indicate that despite the existence of legal frameworks aimed at mitigating plastic waste issues, implementation remains limited, failing to significantly reduce plastic waste accumulation in Jambi. Critical factors such as inadequate inter-agency coordination, resource scarcity, and insufficient public awareness hinder effective environmental crisis management efforts. In conclusion, this research underscores the pressing need for more robust implementation of legal policies to combat the environmental crisis, particularly in plastic waste management in Jambi. Additionally, proactive measures through stringent legal enforcement are imperative to prevent further environmental degradation and safeguard the ecological integrity of Jambi's landscape.
