Abstract

Penelitian ini bertujuan untuk mengetahui penerapan dan kendala yang dihadapi oleh petugas registrasi dan identifikasi dalam hal penghapusan registrasi kendaran bermotor di Kabupaten Mamasa. Penelitian ini menggunakan tipe penelitian hukum kualitatif, berorientasi pada data yang didapat dari narasumber, dokumen-dokumen, dan wawancara atau bahan hukum yang berkaitan.  Teknik analisis data yang digunakan adalah teknik analisis kualitatif. Hasil penelitian menunjukkan bahwa penghapusan registrasi kendaraan bermotor belum diterapkan di Kabupaten Mamasa, walaupun terdapat kendaraan yang STNK-nya lewat waktu diakibatkan karena belum adanya penekanan dan pelatihan dari satuan atas serta masih belum jelasnya pejabat registrasi dan identifikasi kendaraan bermotor yang ada dalam aturan penghapusan registrasi kendaraan bermotor. Kendala yang dihadapi adalah kendala sumber daya manusia, aturan yang belum jelas dan tegas, sarana dan prasarana yang belum memadai, partisipasi masyarakat dan luasnya medan wilayah Kabupaten Mamasa. This research aims to determine the implementation and obstacles faced by registration and identification officers in removing motor vehicle registrations in Mamasa Regency. This research uses a qualitative type of legal research, oriented to data obtained from sources, documents, and interviews or related legal materials.. The data analysis technique used is qualitative. The results showed that the elimination of motor vehicle registration has not been implemented in Mamasa Regency, although there are vehicles whose vehicle registration has expired due to the lack of emphasis and training from the upper unit and the unclear motor vehicle registration and identification officials in the regulation on the elimination of motor vehicle registration. The obstacles faced are human resource constraints, unclear and firm rules, inadequate facilities and infrastructure, community participation and the vast terrain of Mamasa Regency.

Abstract

Penelitian ini bertujuan untuk memahami penerapan asas cepat, sederhana dan biaya ringan pada system e-Court dalam perkara perdata di Pengadilan Negeri Makassar. Penelitian ini dilakukan menggunakan metode yuridis empiris. Penelitian bersifat analisis kualitatif memaparkan penerapan asas cepat, sederhana, dan biaya ringan pada sistem e-Court dalam perkara perdata di Pengadilan secara elektronik, dikaji menurut Peraturan Mahkamah Agung No. 3 Tahun 2018 tentang Administrasi Perkara di Pengadilan Secara Elektronik. Metode dan teknik pengumpulan data dilakukan dengan studi kepustakaan dan wawancara. Penelitian dilakukan kepada Hakim di Pengadilan Negeri Makassar dan Advokat dalam wilayah hukum Kota Makassar. Hasil penelitian menunjukkan bahwa penerapan asas cepat, sederhana dan biaya ringan dalam perkara perdata secara elektronik telah terlaksana melalui layanan e-Court dimana pengadilan negeri yang bersangkutan merupakan penyedia layanan dan pihak advokat serta pihak selain advokat merupakan pengguna layanan tersebut. Namun, dalam penerapannya masih terdapat beberapa hambatan, sedangkan pelaksanaannya jika ditinjau berdasarkan tahapan di dalam sistem e-Court telah efektif terlaksana pada tahap pembuatan akun, tahap pendaftaran perkara, tahap pembayaran dan tahap pemanggilan pihak, serta kurang efektif pada tahap persidangan. Salah satu faktor yang mempengaruhi penerapan dari layanan ini yaitu, perangkat e-Court Mahkamah Agung, infrastruktur teknologi, profesionalisme penyedia layanan, kemampuan advokat di bidang IT (Informasi dan Teknologi), kondisi masyarakat dan tidak memilik alamat e-mail. This study aims to understand the application of the principles of speed, simplicity and low cost in the e-Court system in civil cases at the Makassar District Court. This research was conducted using empirical juridical methods. The research is a qualitative analysis by explaining the application of the principles of fast, simple, and low cost in the e-Court system in civil cases in court electronically studied according to Supreme Court Regulation No. 3 of 2018 concerning electronic administration of cases in court. Data collection methods and techniques were carried out using literature studies and interviews. Research was conducted on judges at the Makassar District Court and advocates within the jurisdiction of Makassar City. The result of the study shows that the implementation of the principles of speed, simplicity and low cost in electronic civil cases has been implemented through the e-Court service where the relevant district court is the service provider and the advocates and parties other than advocates are the users of the service. However, in its implementation there are still some obstacles, while its implementation if reviewed based on the stages in the e-Court system has been effectively implemented at the account creation stage, case registration stage, payment stage and party summoning stage, and less effective at the trial stage. One of the factors affecting the implementation of this service is the Supreme Court's e-Court equipment, technological infrastructure, professionalism of service providers, the ability of advocates in the field of IT (Information and Technology), community conditions and not having an e-mail address.

Abstract

This study aims to analyze the use of Van Dading deed in decision 901/Pdt.G/2023/PA. Tmg. Departing from the problem that the Van Dading Deed plays an important role in the settlement of joint property disputes in Indonesia, by providing legal certainty and an efficient settlement mechanism. This research is a doctrinal study with a case approach. This approach is used to analyze court decisions on Van Dading deeds. Legal materials are obtained from court decisions and to strengthen the analysis, this research also uses several scientific articles and research results related to this research issue in order to produce a sharp analysis. This study explores the legal position of Akta Van Dading in the Indonesian legal system, particularly in the context of joint property disputes. This deed, which is produced through mediation, has the same executorial power as a court judgment, ensuring that the agreement reached will be implemented without the need for additional litigation. A case example in this study is Decision 901/Pdt.G/2023/PA.Tmg, which demonstrates the effectiveness of Akta Van Dading in achieving an amicable and binding settlement. Through mediation facilitated by a mediator, the parties to the dispute were able to reach a fair and sustainable agreement. Thus, the Deed of Van Dading not only reduces the court's workload but also encourages faster settlements and lower costs. This research confirms the importance of Akta Van Dading as an essential legal instrument in achieving justice and legal certainty in the settlement of joint property disputes in Indonesia.

Abstract

This research aims to analyze the legal legitimacy of ownership and control of culturally traditional assets in Indonesia, which drive the economicization of cultural wealth through the national tourism industry. Legal weaknesses impede recognition and support to promote the economicization of these cultural assets. The research begins with a review of regulations and policy documentation to understand the philosophical and sociological foundations of the regulation of cultural copyright ownership. The study also examines theoretical aspects of the implementation of the law.Field research is conducted through a series of in-depth interviews with experts and practitioners, both legal professionals and music industry practitioners, collecting data on public understanding through questionnaires. Field data is analyzed quantitatively, while document data and doctrinal studies are analyzed qualitatively.The results of the research indicate a low awareness of locally-based cultural intellectual wealth, as evidenced by the weak appreciation of society, including local governments, in inventorying and registering communal intellectual property assets. The subsequent effect is the weakness in optimizing the commercial value of communal intellectual property, especially in the cultural tourism sector.

Abstract

The profit-sharing agreement is one of the rights derived from customary legal practices recognized in the Basic Agrarian Law, albeit categorized as a temporary right due to its perceived elements of coercion. This research aims to assess the extent to which the Basic Agrarian Law maintains its regulations in this temporary form while acknowledging the often detrimental practices to farmers. Additionally, this study seeks to determine how much the concept of local wisdom in the implementation of a profit-sharing-based agricultural system can be considered to meet the elements of legal utility. The research method employed is normative legal research, with data analyzed normatively through the interpretation and discussion of research materials based on laws, legal norms, theories, and legal doctrines related to the core issues. The findings of this research are descriptive, utilizing both primary and secondary data. The research results indicate that, normatively, the Basic Agrarian Law has not undergone revision, thus still regulating temporary business rights, even though, in practice, the temporary basis still involves elements of coercion. Another outcome reveals that the concept of local wisdom in profit-sharing systems must fulfill elements of legal utility. However, in practice, especially concerning the three main factors required by the law, such as a written agreement, profit distribution, and duration of the agreement, it is concluded that they do not meet the principle of legal utility.

Abstract

This study aims to determine the form of providing visitor safety infrastructure at Akkarena Beach and the factors that are an obstacle for safety infrastructure providers, so that there are no cases of drowning visitors at Akkarena Beach. The type of research used is normative-empirical. The research location is at Akkarena Beach, Jalan Metro Tanjung Bunga. Data sources are primary and secondary. Data collection techniques were carried out by field observations, interviews, and field checklists. The data obtained in this study were then analyzed descriptively-qualitatively.The results show that the form of providing safety infrastructure at Akkarena Beach in general has met the security and safety requirements based on the reference to the Australian Coastal Public Safety Guidelines, and tourism facilities have met the standards to meet the needs of tourism visitors, as well as changing room and toilet facilities that meet safety standards. based on the reference to the Indonesian Toilet Association, but there are some safety facilities that are still incomplete and need to be replaced because they are no longer suitable for use. Several inhibiting factors for the provision of safety infrastructure so that there are no cases of drowning visitors at Akkarena Beach include the negligence of parents, not using safety equipment when carrying out water activities, not heeding the instructions of the coast guard, disease factors, and weather which often causes drowning accidents
