Abstract

Penelitian ini bertujuan untuk menganalisis keabsahan sertipikat hak milik atas tanah perorangan dan faktor-faktor yang menyebabkan sertipikat perorangan terbit di atas aset tanah pemerintah. Tipe penelitian yang digunakan penulis yaitu Penelitian Normatif Empiris dengan kategori Live Case Study yaitu merupakan pendekatan suatu peristiwa hukum yang prosesnya masih berlangsung atau belum berakhir. Hasil penelitian menunjukkan bahwa: Unsur-unsur keabsahan sertipikat hak milik yaitu data subjektif dan data objektif tidak terpenuhi atau tidak didukung oleh warkah pendaftaran tanah dan faktor-faktor yang menyebabkan sertipikat perorangan terbit di atas aset tanah pemerintah yaitu tidak tertibnya administrasi pertanahan dan peta pertanahan tidak lengkap. This study aims to analyze the validity of individual land ownership certificates and the factors that cause individual certificates to be issued on government land assets. The type of research used by the author is Normative Empirical Research with the Live Case Study category, which is an approach to a legal event whose process is still ongoing or has not ended. The results of the research show that: The elements of the validity of a certificate of ownership, namely subjective data and objective data, are not fulfilled or are not supported by land registration documents and the factors that cause individual certificates to be issued on government land assets are the lack of orderly land administration and incomplete land maps.

Abstract

Penelitian ini bertujuan untuk mengkaji dan menganalisis integrasi hukum perlindungan data pribadi dengan konsep hak asasi manusia dan hambatan-hambatan dalam perlindungannya. Penelitian ini menggunakan penelitian normatif empiris. Hasil penelitian menunjukkan bahwa: 1) Integrasi hukum perlindungan data pribadi dengan konsep hak asasi manusia telah berjalan secara substansial, meskipun implementasi perlindungan data pribadi belum sepenuhnya sesuai harapan. 2) Hambatan dalam pelaksanaan perlindungan data pribadi dipengaruhi oleh faktor internal dan faktor eksternal. Faktor internal meliputi kurangnya kesadaran di kalangan Subjek dan Pengendali Data Pribadi, kompleksitas dalam pemrosesan data, lemahnya sistem keamanan data di Indonesia, belum disahkannya Rancangan Peraturan Pelaksanaan Undang-Undang Pelindungan Data Pribadi, serta ketiadaan Lembaga Independen Khusus yang bertanggung jawab atas perlindungan data pribadi. Di sisi lain, faktor eksternal meliputi intersepsi atau penyadapan yang mengakibatkan kegagalan perlindungan data, terutama di instansi pemerintah dan sektor jasa keuangan. This research aims to review and analyze the legal integration of personal data protection with the concept of human rights and obstacles in its protection. This research uses empirical normative research. The results of the research show that: 1) The integration of personal data protection law with the concept of human rights has been running substantially, although the implementation of personal data protection has not been fully as expected. 2) Obstacles in the implementation of personal data protection are influenced by internal factors and external factors. Internal factors include a lack of awareness among Subjects and Controllers of Personal Data, complexity in data processing, weak data security systems in Indonesia, the absence of a Draft Implementing Regulation of the Personal Data Protection Law, and the absence of a Special Independent Institution responsible for the protection of personal data. On the other hand, external factors include interception or eavesdropping that results in data protection failures, especially in government agencies and the financial services sector.

Abstract

Penelitian ini bertujuan untuk menganalisis Surat Kuasa Membebankan Hak Tanggungan (SKMHT) jika terjadi wanprestasi dalam  Kredit Pemilikan Rumah (KPR) subsidi dan apakah SKMHT dapat digunakan untuk menjual objek jaminan jika terjadi wanprestasi dalam KPR subsidi.. Metode penelitian yang digunakan adalah  Penelitian normatif empiris yakni penelitian yang menggabungkan antara pendekatan hukum normative dengan adanya penambahan dari berbagai unsur-unsur empiris, mengkaji implementasi ketentuan hukum normatif dalam aksinya dalam setiap peristiwa hukum yang terjadi. Hasil penelitian menunjukkan bahwa: pertama  Penggunaan SKMHT pada pengikatan KPR subsidi sudah sesuai ketentuan hukum sehingga mengikat bagi para pihak. Rumah subsidi memiliki ketentuan luas bangunan dan luas tanah yakni 72 m2 (tujuh puluh dua meter persegi) dan luas bangunan 36 m2 (tiga puluh enam meter persegi), serta harga jual maksimal senilai Rp 173.000.000 (seratus tujuh puluh tiga juta rupiah), artinya tidak melebihi luas dan jumlah maksimal yang diatur dalam peraturan perundang-undangan yakni luas tanah maksimal 200 m2 (dua ratus meter persegi) dan luas bangunan 70 m2 (tujuh puluh meter persegi) sedangkan harga jual yang ditetapkan maksimal Rp. 200.000.000 (dua ratus juta rupiah), sehingga dapat disimpulkan bahwa penggunaan SKMHT dalam pengikatan jaminan KPR Subsidi memiliki kekuatan hukum yang mengikat bagi para pihak. Kedua penggunaan SKMHT tidak bisa digunakan dalam menjual objek jaminan kredit macet melalui proses lelang. Solusinya SKMHT perlu ditingkatkan menjadi Akta Pengikatan Hak Tanggungan (APHT). Adapun dalam proses pelaksanaanya tidak melibatkan debitor, karena di awal perjanjian/ akad kredit, debitor selaku pemberi Hak tanggungan telah menyerahkan kuasa kepada kreditor selaku Penerima Hak Tanggungan untuk menandatangani. Dalam kasus penjualan objek jaminan kredit macet di bawah tangan, maka SKMHT secara otomatis tidak berlaku This research aims to analyze the Power of Attorney to Charge Mortgage Rights (SKMHT) in the event of a default in a subsidized Home Ownership Credit (KPR) and whether SKMHT can be used to sell collateral objects in the event of a default in a subsidized KPR. The research method used is empirical normative research, namely research that combines a normative legal approach with the addition of various empirical elements, examining the implementation of normative legal provisions in action in every legal event that occurs. The research results show that: firstly, the use of SKMHT in binding subsidized KPR is in accordance with legal provisions so that it is binding on the parties. Subsidized houses have provisions for building area and land area, namely 72 m2 (seventy-two square meters) and building area of 36 m2 (thirty-six square meters), as well as a maximum selling price of IDR 173,000,000 (one hundred and seventy-three million rupiah), meaning it does not exceed the maximum area and quantity regulated in statutory regulations, namely a maximum land area of 200 m2 (two hundred square meters) and a building area of 70 m2 (seventy square meters) while the selling price is set at a maximum of Rp. 200,000,000 (two hundred million rupiah), so it can be concluded that the use of SKMHT in binding Subsidized KPR collateral has binding legal force for the parties. Secondly, SKMHT cannot be used to sell bad credit collateral through an auction process. The solution is that SKMHT needs to be upgraded to Deed of Binding Mortgage Rights (APHT). The implementation process does not involve the debtor, because at the beginning of the credit agreement/contract, the debtor as the giver of the mortgage right has handed over the authority to the creditor as the recipient of the mortgage right to sign. In the case of selling bad credit collateral objects under your hands, the SKMHT is automatically invalid

Abstract

Sertipikat sementara terbit tanpa surat ukur, yang saat berlakunya aturan lama fungsi dan kekuatan hukum sertipikat sementara bisa dipersamakan dengan sertipikat. Tujuan penelitian yaitu untuk mengetahui pertimbangan hukum hakim terhadap kedudukan sertipikat sementara dalam putusan No.158/Pdt.G/2020/PN.Mks, Penelitian ini dilakukan di Pengadilan Negeri Makassar. Metode yang digunakan bersifat kualitatif dengan pendekatan yuridis normatif teknik pengumpulan data melalui wawancara yang dianalisis secara kualitatif deskriptif. Hasil penelitian ini menunjukkan bahwa kedudukan sertipikat sementara memiliki kepastian hukum yang lemah dalam fungsinya sebagai alat bukti kepemilikan hak atas tanah. Sertipikat sementara merupakan sertifikat yang lemah dimata hukum yang berlaku saat ini sehingga dalam kasus ini hakim menganggap bahwa kedudukan sertipikat sementara sangat lemah karena tidak adanya surat ukur secara rinci. Temporary certificates are issued without measurement letters, which when the old regulations come into force, the function and legal force of temporary certificates can be equated with certificates. The aim of the research is to determine the judge's legal considerations regarding the position of the temporary certificate in decision No.158/Pdt.G/2020/PN.Mks. This research was conducted at the Makassar District Court. The method used is qualitative with a normative juridical approach, data collection techniques through interviews which are analyzed descriptively qualitatively. The results of this research indicate that the position of a temporary certificate has weak legal certainty in its function as proof of ownership of land rights. The temporary certificate is a weak certificate in the eyes of the current law, so in this case the judge considered that the position of the temporary certificate was very weak because there was no detailed measurement letter.

Abstract

Kekayaan intelektual berbasis kepemilikan komunitas di daerah merupakan sebuah potensi daerah yang dapat mendukung peningkatan pendapatan daerah. Dalam kenyataannya pengelolaan aset intelektual ini mengalami kendala di samping kesadaran pemerintah dan masyarakat terhadap potensi tersebut juga menyangkut ketidaktertiban pranata hukum kepemilikannya yang berakibat pada kelemahan tingkat legalitas kepemilikan itu sendiri. Penelitian menunjukkan bahwa pada tingkatan nasional kesadaran akan upaya itu sudah mulai terlihat diikuti dengan kepedulian daerah. Akan tetapi kendala terbesarnya adalah sinergitas kerja antarinstitusi belum maksimal sehingga hasil dari perlindungan kekeayaan intelektual daerah itu belum optimal.

Abstract

The purpose of this research is to find out the legal arrangements related to the redistribution of agricultural land in Indonesia and how the implementation of this agricultural land redistribution activity at Pangkajene Kepulauan Regency and to see the related obstacles in its implementation. The empirical juridical approach method is the research method used, and uses nonrandom sampling techniques, which are deliberately chosen with certain parameters. Research with primary data and secondary data that are assessed in quality by separating in the form of sentences that are in harmony with the subject matter being studied. The location of the assessment was carried out at the Pangkajene Kepulauan District Land Office and in the Biraeng Village, Minasatene District and Minasatene Village, Minasatene District. From the research results, it is known that the application of Government Regulation No. 224 of 1961 is not in line with current developments, so with the issuance of Presidential Regulation. Number 86 of 2018, could be a solution in solving cases that occur. Redistribution of Agricultural Land in Pangkajene Kepulauan Regency is well implemented. Although there are obstacles, namely the lack of good coordination between the regional government and the community and the target subject has not been designated as the recipient of agricultural land redistribution activities.

Abstract

This study aims to determine the implementation of performance rights in terms of payment of copyright royalties to creators and copyright holders at karaoke companies in the city of Makassar, to know about the implementation of Copyright royalty management by the Collective Management Institute in Makassar City, and to find out the implementation of the sanctions imposed on karaoke companies that violate the obligation to pay royalties to creators.The research method used is juridical empirical. This research was conducted at the Karya Cipta Indonesia Office in the Makassar area, the Office of the Ministry of Law and Human Rights in South Sulawesi, the Inul Vizta karaoke company and local artists or songwriters as the copyright holders. The implementation of performance rights in the payment of royalties to creators and copyright holders in Makassar City has been well implemented even though the collection mechanism is carried out by LMKN, but at the time the payment is submitted to LMK in the regions. Although it is still found that there are small-scale user businesses that have not fully entered into cooperation contracts with LMK which are still foreign to him. The implementation of performance rights is supported by the existence of the latest regulations in the Copyright Law and awareness of supporting institutions such as the Regional Office of Law and Human Rights in general socialization. The management of royalties at LMK in Makassar City is only in the form of distribution of payments, while at the stage of collection to entrepreneurs who use songs and music, it is handled directly by LKMN. The imposition of sanctions in violation of royalty payments for businesses using songs and music cannot be said to have been fully implemented because the data on violations of performance rights has not been seen in synchronization of data between the regional LMK and the LMKN between the collection and distribution of royalties.

Abstract

This study aims to determine and analyze the obstacles in the implementation of compensation payments on land acquisition for the Nipa-Nipa’s Dam in Gowa Regency and toafind out and analyze the howathe problem of compensation for land acquisition for the Nipa-Nipa Dam in Gowa can be solved. The research method used is an empirical-normative research method, which is field data as the main data source such as the results of interviews and observations. The results of the study indicate in the implementation of compensation payments on land acquisition at the Nipa-Nipa Dam in Gowa Regency, the obstacles are, the occurrence of free buying and selling of land, the existence of absentee/guntai land ownership, and not agreeing with the price offered. compensation for land acquisition for the Nipa-Nipa Dam in Gowa Regency, namely, the active role of the land acquisition committee in conducting consensus deliberation, mediation and persuasive approaches, understanding and understanding of the social function of land. The Central and Regional Governments, especially the Gowa Regency land office, should be obliged to provide an in-depth understanding of land acquisition through legal counseling, especially land law (Agrarian) both to sub-district, village/kelurahan government officials, as well as leaders and the community intensively so that better implementation in the future. People whose land is affected by the construction of the Nipa-Nipa Dam in Gowa Regency have a better understanding of the social functions of land, so that they do not ask for such high compensation so that land acquisition for the construction of the Nipa-Nipa dam can be completed.

Abstract

Auction is the sale of goods that are open to the public with a written and/or verbal price offer that is increasing or decreasing to reach the highest price, which is preceded by the announcement of the auction. This study aims to determine the legal protection measures against the winner of the land auction. The research method used is empirical legal research by collecting systematic data, recording, interpreting, and critically analyzing facts or data as well as making reports and information on symptoms studied from various aspects to find conclusions. All data that has been obtained are then analyzed and described in a qualitative descriptive manner. The results showed that the auction rules were not implemented in practice. Makassar District Court Decision No. 278/Pdt.G/2018/Pn.Mks cancel the SHM owned by the Auction Winner because the SHM is manipulative. The lack of in-depth data analysis and the application of the rules of the auction procedure on Mortgage are the factors that cause the winner of the auction to lose his rights. One of the actions that can guarantee legal protection for the winner of the auction is through the courts. Where in this case, the auction winner can make the decision of the case his basis for demanding accountability for the parties involved in the auction process for the land object. Such as KPNL and BPN carry out administrative responsibility and the seller (Bank) compensates for all costs that the winner of the auction redeems in the auction process. Abstract

This study aims to determine the elements of the crime of land grabbing as evidenced in the decision Number 315/Pid.B/2020/Pn.Mks and to determine the judge's legal considerations in passing the decision Number 315/Pid.B/2020/Pn.Mks The research method used is qualitative legal research. The types and sources of data consist of primary data in the form of laws and regulations, Circular Letters of the Supreme Court and Court Decisions and secondary legal materials consisting of books, articles and journals related to this research. The entire legal material is collected in a structured systematic manner using qualitative measures and presented in a descriptive analysis. The results of the study indicate that the elements of the crime of land grabbing have been fulfilled in Article 167 Paragraph (1) but the act is not a criminal act and the judge's consideration in passing a acquittal is based on this case not including a crime but civil law, but every the judge's decision that renders the decision must be followed by sufficient considerations, both juridical considerations and sociological considerations.
