Abstract

One of the platforms in the blockchain is a decentralized exchange. The existence of these platforms helps exchange crypto assets instantly in the blockchain ecosystem without having to exchange them at a central exchange. The liquidity guarantors of decentralized exchanges are liquidity providers. This study aims to assess liquidity providers' legal safety on Vexanium, Indonesia's first public blockchain. The normative method employed in this analysis of the laws and regulations related to blockchain in Indonesia involves a preliminary examination of the liquidity provision process. This study found that the decentralized exchange platform on the Vexanium blockchain still needs to meet the criteria as an electronic system following the laws and regulations. In addition, the absence of clear information about the parties in the platform makes the liquidity provision contract voidable. This research can be utilized for platform developers in the Vexanium blockchain to pay more attention to legal aspects in creating their platforms..

Abstract

Bankruptcy and Arbitration are forms of mechanisms for resolving disputes among parties. The purpose of this research is to explore the use of international arbitration awards as a simple proof requirement in bankruptcy cases. The research methods employed include the statute approach and conceptual approach. The findings of this research indicate that international arbitration awards can be admissible as simple proof due to the final and binding nature of international arbitration awards when they meet certain requirements established by Indonesian positive law. Specifically, if an international arbitration award has been registered and requested for enforcement at the Central Jakarta District Court, the international arbitration award is considered valid. Meeting these criteria, international arbitration awards, as authentic evidence, fulfill the simple proof requirement. However, if an international arbitration award does not meet these requirements, it cannot be considered authentic evidence in bankruptcy proceedings under Indonesian positive law, as the authenticity of international arbitration awards is only recognized when they have been registered and requested for enforcement.

Abstract

The development of digital technology has encouraged the use of interface design in electronic business activities including the practice of dark patterns which may influence consumer decision making through unbalanced information. This practice raises legal issues because it can reduce consumer rights to correct information and freedom of choice as regulated in Law Number 8 of 1999 on Consumer Protection. This study analyzes the regulation of dark patterns within consumer protection law and examines their potential classification as criminal acts based on the Consumer Protection Law the Criminal Code Law Number 1 of 2023 and the Law on Electronic Information and Transactions. This research uses a normative legal method with a statutory approach. The results show that although not explicitly regulated dark patterns may be classified as acts of business actors that violate legal obligations and cause harm to consumers and may fulfill criminal elements under certain conditions.
