Abstract

Waqf, as an important form of financial worship, has significant economic potential and has evolved from traditional forms such as land and buildings to innovations like cash waqf, which is more flexible for developing productive enterprises. Although the potential for cash waqf in Indonesia is very high, reaching Rp180 trillion per year according to the Indonesian Waqf Board, its management is not yet optimal. The aim of this research is to analyze and compare the development of Sharia stock benefit waqf as a form of productive waqf modernization in Indonesia and Malaysia, and to identify its development potential to increase the effectiveness and benefits of waqf in the context of modern Islamic economics. This research uses normative legal research methods with statutory and conceptual approaches, focusing on analyzing regulations and legal concepts related to Sharia stock benefit waqf in Indonesia and Malaysia. Legal sources include primary, secondary, and tertiary materials, with data collection techniques through literature study and data analysis using a comparative qualitative approach. The research results show that stock waqf has been implemented in Indonesia and Malaysia in accordance with applicable regulations, with differences in the institutional structure of its management. In Indonesia, stock waqf is regulated by the Ministry of Religion, the Indonesian Waqf Board, and the National Sharia Council, while in Malaysia it is managed by the State Islamic Religious Council in each state. Indonesia focuses on Sharia stock waqf or its profits, while Malaysia raises funds through share offerings to finance specific programs. Nevertheless, the potential for stock-based waqf in both countries has not been optimally maximized. Factors influencing development in Indonesia include stock waqf literacy, nazir capacity, and inefficient digitalization, while in Malaysia it is constrained by regulatory inconsistencies between states, lack of a transparent and accountable regulatory framework, and limited regulations on mechanisms for collecting and distributing cash waqf including shares.

Abstract

This This paper analyzes the legal provisions relating to land acquisition for the public interest by using the perspective of the concept of justice according to Thomas Aquinas. This normative juridical method study illustrates that the nomenclature of land acquisition for the public interest contained in Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest and has been revised in part in Law Number 6 of 2023 concerning Job Creation has not embodied the concept of justice echoed by Thomas Aquinas in the fulfillment of one's rights. This study concludes that the nomenclature of land acquisition for the public interest has a critical note regarding commutative justice (Justitia commutative), namely the legal provisions regarding the assumption that the community agrees to the use of their land contained in the nomenclature of land acquisition for the public interest, even though the person concerned was not present in the public consultation session. This is not in accordance with Thomas Aquinas' concept of justice, which emphasizes the equality of a person as a holder of land rights that must be fulfilled.

Abstract

This paper aims to analyze how the harmonization of land bank law and land law provisions in agrarian reform. This study is a normative legal research that examines the harmonization of land bank law and land law provisions in Indonesia. This research uses a statute approach to find the harmonization of land bank legal rules through Law Number 13 of 2022 concerning the Formation of Legislation. This research uses data from Law No. 63 of 2023 on Job Creation, Government Regulation No. 64 of 2021 on the Land Bank Agency, Law No. 5 of 1960 on Basic Agrarian Principles, and MPR Decree No. IX of 2001 on Agrarian Reform. The data is processed by analyzing the harmonization of the legal rules of the land bank and the provisions of land law in agrarian reform through Law Number 13 of 2022 concerning the Formation of Legislation. The results of this study show that the land bank regulated in the provisions of Law No. 63 of 2023 on Job Creation and Government Regulation No. 64 of 2021 on the Land Bank Agency is disharmonious with the 1945 Constitution, Law No. 5 of 1960 on Basic Agrarian Principles, and MPR Decree No. IX of 2001 on Agrarian Reform.

Abstract

Balanced nutrition refers to daily dietary composition containing appropriate types and amounts of nutrients required by the body. A balanced dietary pattern establishes healthy eating habits through adequate intake of carbohydrates, proteins, fats, vitamins, and minerals. Children frequently experience nutritional deficiencies and possess limited knowledge about healthy food sources. A social project was implemented through educational outreach and interactive games to address stunting issues among children at Yarhima 4 Orphanage, Bondowoso. The activity was conducted over four days using various methods including nutrition education sessions, film reviews, and fun games. Materials covered balanced nutrition concepts and the "Isi Piringku" guideline, delivered through PowerPoint presentations and hands-on activities. Participants demonstrated high enthusiasm throughout the program. Pre-test scores averaged 30%, while post-test results showed significant improvement to 85%. These evaluation results demonstrate that participants successfully absorbed the educational materials and developed better understanding of balanced nutrition principles. The children can now identify healthy food sources and recognize the importance of nutritious meals in their daily lives. This program effectively enhanced nutritional literacy among orphanage residents
