Abstract

Suara yang lantang melawan ketidakadilan menjelaskan kondisi yang menuntut keadilan. Dalam mencapai kesejahteraan sosial, perlu ada teori-teori yang berbicara tentang keadilan. Teori-teori yang dapat menggambarkan seperti apa keadilan itu, dan bagaimana mengaplikasikannya dalam kehidupan dengan segala permasalahannya yang semakin kompleks. Artikel ini berusaha untuk membahas penggalan-penggalan teori tentang keadilan. Penelitian ini menggunakan pendekatan interdisipliner dalam ilmu hukum atau biasa disebut dengan penelitian sosio-legal. Prinsip keadilan utilitarianisme memberikan pemahaman bahwa keadilan dapat diukur, setidaknya mampu memberikan atau paling tidak secara teoritis memberikan metode konkret dalam pengambilan keputusan yang sulit. Kemudian, prinsip keadilan kelompok liberalisme egalitarian mengedepankan prinsip keadilan yang disebut dengan justice as fairness atau keadilan sebagai persamaan. Sementara itu, prinsip keadilan historis pada hakikatnya adalah tindakan mengambil sesuatu yang tidak boleh merugikan orang lain, harus dilakukan secara sukarela kepada orang lain yang didasarkan pada pengalihan kepemilikan atas suatu keadaan atau tindakan di masa lampau yang dapat menciptakan hak atas sesuatu.

Abstract

This research aims to find out the legal arrangements related to the unlicensed drug trade, which is reviewed from Law Number 36 of 2009 concerning Health or called the Health Law. In addition, this research also finds out about law enforcement related to the criminal act of unlicensed drug distribution in case verdict Nomor: 1/Pid.Sus/2023/Pn.Pre. The type of research used is normative research combined with empirical research. This research uses a statutory approach related to legal norms or substance, legal principles, legal theories, legal arguments combined with research that directly observes events that occur in the field. The results showed that legal arrangements related to the unlicensed drug trade are regulated in Articles 196, 197 and 198 of the Health Law. The form of law enforcement carried out regarding the distribution of unlicensed drugs in the case of the decision is repressive, which finds the application of sanctions for violators. These sanctions also provide a deterrent effect so that similar violations do not occur again in the future and ensure that justice is upheld.

Abstract

Investment is the allocation of capital or resources with the aim of gaining profits in the future. Foreign investment is often considered the primary driver of economic development as it can increase the amount of capital available for development, create jobs, and introduce new technologies and management skills. In Indonesia, investment activities are regulated under Law Number 25 of 2007 concerning Investment and Law Number 6 of 2023 concerning Job Creation, widely known as the Omnibus Law, which also regulates investment. Despite having various regulations, the protection mechanisms are often debated, especially when conflicts arise between foreign investors and the government or local parties. Therefore, it is important to study how legal protection and dispute resolution related to foreign investment in Indonesia are addressed. The research method used in this study is normative with a comparative, legislative, and analytical approach. The types of data used in this research are primary and secondary data, where primary data consist of legislation, while secondary data consist of published documents that are not in official form, including legal textbooks, legal journals, legal papers, and so forth. The data analysis technique is qualitative and presented descriptively by explaining, describing, and illustrating issues closely related to the topic, then drawing conclusions based on analysis using deductive logic in line with prescriptive discipline. The results of the study show that both Law Number 6 of 2023 and Law Number 25 of 2007 provide legal protection to foreign investors, although the focus and approach used to provide such protection differ.

Abstract

Tindakan aborsi merupakan salah satu tindak pidana yang diatur dalam berbagai peraturanperundang-undangan di Indonesia. Indonesia, salah satunya adalah Undang-Undang Nomor 36 Tahun 2009tentang Kesehatan, atau disingkat UU Kesehatan. Selain UU Kesehatan, pengaturan mengenai aborsi jugaterdapat dalam Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana atauyang dikenal dengan sebutan KUHP. KUHP Nasional. Penelitian ini bertujuan untuk mengetahui perbedaanpengaturan terkait aborsi terhadap korban perkosaan menurut UU Kesehatan dan KUHP Nasional. KitabUndang-Undang Hukum Pidana Nasional. Jenis penelitian yang digunakan dalam penelitian ini adalahpenelitian hukum normatif. hukum normatif. Perbuatan aborsi dalam Undang-Undang Kesehatan diatur dalamPasal 75, 76, 77 dan 194 dengan ancaman pidana penjara paling lama 10 tahun dan denda paling banyakRp. 1.000.000.000,- (satu milyar rupiah), sedangkan aborsi dalam Kitab Undang-Undang Hukum Pidanadiatur dalam pasal 463, 464 dan 465 dengan ancaman pidana penjara paling lama 4 (empat) tahun.

Abstract

Constitutional Court Decision Number 70/PUU-XXII/2024 is the result of a judicial review of Law Number 10/2016 on the Second Amendment to Law Number 1/2015 regulating the minimum age limit for regional head candidates. The regulation is discriminatory because it limits the political participation of younger individuals. This article seeks to critically answer how human rights studies view the age limit in Constitutional Court Decision Number 70/PUU-XXII/2024. The method used in this research is a normative legal research method with an analytical-critical approach and case studies that prioritize human rights aspects. The Constitutional Court explained that although age restrictions can be justified, this policy must be evaluated periodically to ensure its relevance and suitability with the evolving social and political dynamics. The Constitutional Court also emphasized the importance of flexibility in this arrangement, in order to avoid age discrimination that could harm certain groups, especially the potential younger generation. Public policies must be responsive to demographic and social changes, including in terms of political participation. This policy should be aligned with the principles of equality and human rights, and should take into account the ability and integrity of candidates without being hampered by rigid age limits. Abstract

Food security investments have brought conflict between local indigenous communities and the government in South Papua. The research aims to encourage protection and recognition efforts from the state towards indigenous peoples' entities. This research uses socio-legal studies. The research found sixteen plants that function as medicine. Inventory in the form of "recording" communal intellectual property is the first step to protecting all communal intellectual property that has never been recorded before. The Yei Indigenous People or the local government should work together to register with the Ministry to obtain rights to communal intellectual property, which will impact state action in protecting and defending communal intellectual property rights.

Abstract

This research examines the enactment of Law Number 6 of 2023, which formalizes Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation. The law reflects the Indonesian government's efforts to create and expand employment opportunities. However, it is crucial to investigate whether these efforts align with the broader interests of the community or merely serve the ruling elite's agendas. This study assesses whether the law, with its various mechanisms, effectively addresses social conditions in line with the government's objectives—such as reducing unemployment, accommodating new workers, and fostering the growth of cooperatives and MSMEs—or whether it diverges from these goals. A socio-legal approach is employed to analyze whether the government's interests genuinely reflect the community's needs.

Abstract

This recognition requires further regulation through a Government Regulation and serves as a procedural requirement for being acknowledged as indigenous peoples. The purpose of this article is to provide us an overview of how the recognition requirements for indigenous peoples as outlined in legislation, both before and after the enactment of the Criminal Code. Additionally, it examines the struggles of indigenous peoples in Ecuador, who have organized themselves into indigenous groups to fight for the rights that have been taken away from them. This research employs a statutory approach, a comparative approach, and an interdisciplinary approach in law commonly referred to as socio-legal research. As a result of this, indigenous peoples often find themselves in a weak position relative to the dominant authority of the state. The government needs to provide political recognition affirming that indigenous peoples are equal legal subjects with the state and possess the capacity to act legally to represent their interests as indigenous groups. With the enactment of the National Criminal Code set for 2026, this recognition may pave the way for indigenous peoples to become equal parties when engaging with the state in matters of customary criminal law. Additionally, the indigenous movement in Ecuador serves as a significant point of reflection. Their ability to unite indigenous peoples and nations under a national framework has profoundly influenced the political and legal landscape.

Abstract

Article 13(2) of the ICESCR contains the provision of the right to education and freely access educational affairs, including reading materials. But can we establish the right to reading materials as the citizens’ rights? Does it apply to a certain group or all people without exception? And, under what conditions is the applicability of the right attached? Previous research articles by Andina (2011), Rahajaan (2012), Affandi (2017), Purwanda & Syahril (2021), Jacobs (2013), Hartsfield & Kimmel (2021) have not specifically reviewed the status of the right to reading materials, highlighting whether the provision of reading materials by the state has significance to the protection and recognition of rights and whether the right applies only to a group of people or all people without exception, as well as how the enforceability of the right is attached to citizens. The sophistication of this this sociolegal research uses an interdisciplinary approach in law, lies in the provision of reading materials by the state is a right that cannot be separated from the human right and the need for the state to provide reading materials as a form of protection and recognition of the citizen’s rights. The state is obliged to provide and protect the right to reading materials for its citizens as a form of protection and recognition of citizens' rights. Legal protection of citizens' rights to reading materials requires legal fulfilment by the state as part of the right to enjoy or obtain education (right to education).

Abstract

This study demonstrates the impacts of monism and pluralism on the legal development of a nation. First of all, this study discusses how isms or sects or ideologies begin, related to supernatural thoughts by humans. Subsequently, these thoughts develop into a concept that nature is the center of this universe. Nature sign is not due to supernatural power or in other words rain falls not because the Rainy Goddess is crying but nature itself moves its power. Nature supreme grows well in human knowledge, through natural studies, which is called naturalism. Naturalism continuously forms materialism, something that presents/exists, and then it is what is called the truth. Next, these thoughts develop to mechanistic and vitality thoughts. These give impacts to culture, social even legal system in a nation.
