Abstract

Tujuan dari penelitian ini untuk menganalisis tanggung jawab hukum pemerintah di bidang kesehatan terkait belanja wajib. Metode penelitian menggunakan penelitian normatif dengan pendekatan konseptual dan pendekatan undang-undang yang berkaitan dengan materi yang dipelajari. Hasil penelitian ini bahwasanya Penghapusan Mandatory Spending sangat berpengaruh terhadap pelaksanaan kewajiban negara di dalam UUD 1945 yang berakibat pada ketiadaan kewajiban pemerintah dalam bertanggung jawab melaksanakan pemenuhan hak konstitusional warga negara seperti meningkatnya kasus dalam program unggulan, menurunnya kasus AHH, dan mislokasi anggaran dana ke daerah-daerah. Kemudian, terkait dengan tanggung jawab hukum pemerintah dalam pemenuhan hak konstitusional warga negara terdapat dalam UU Kesehatan yang lama yaitu adanya kegiatan mandatory spending. Penghapusan kegiatan mandatory spending mempengaruhi tanggung jawab pemerintah. Tak terlaksananya kewajiban tersebut berhubungan dengan hukum administrasi negara yang apabila kewajiban tersebut tidak dilaksanakan dengan baik, hal tersebut termasuk dalam kategori perbuatan melawan hukum oleh penguasa (PMHP). PMHP dapat diadili di dalam pengadilan tata usaha negara. The aim of this research is to analyze the government's legal responsibilities in the health sector regarding mandatory spending. The research method uses normative research with a conceptual approach and a legal approach related to the material studied. The results of this research are that the abolition of mandatory spending has had a significant impact on the implementation of state obligations in the 1945 Constitution, which has resulted in the absence of the government's responsibility to implement the constitutional rights of citizens, such as increasing cases in superior programs, decreasing cases of AHH, and misallocating budget funds to regions. area. Then, related to the government's legal responsibility in providing citizens' constitutional rights contained in the old Health Law, namely the existence of a mandatory spending program. Elimination of mandatory spending activities that affect government responsibilities. Failure to carry out these obligations is related to state administrative law, which if these obligations are not carried out properly, this falls into the category of unlawful acts by the authorities (PMHP). PMHP can be tried in state administrative courts.

Abstract

In every action of a military doctor in a hospital, there are certainly interesting potential problems related to criminal acts in general or the military as well as in the field of health law. The aims of study were to analyze the form of regulations and legal issues for military doctors who practice in non-government hospitals; analyze authorities and justice mechanisms that prosecute malpractice acts of military doctors in non-government hospitals. The type of research was normative juridical. The approach study used a statute approach and conceptual approach. Legal materials obtained from research, literature study, statutory regulations and legal articles. The results of the research explain that a military doctor is a soldier with strata officer status or rank who can practice both in private practice and in non-government hospitals based on regulations, in accordance with the condition that a doctor must have a doctor's registration letters and a practice license. The military judiciary has authority over every T soldier who commits a crime, be it a military crime or a general crime, including military doctors who are definitely officers, if they commit a crime or malpractice at a place of practice in a non-government hospital.

Abstract

Notary is a profession with a very noble position (nobile officium). because of why a notary is burdened with obligations and prohibitions to obey. sometimes notaries are often negligent in their actions, this is triggered, by the increasing number of new notary graduates, giving rise to unhealthy competition however. This competition sometimes takes the form of ethical violations committed by a notary, such as using the services of other parties (brokers) to get clients. so this needs to be examined further regarding "the responsibility of a notary who uses the services of a third party (broker) to get a client" The rules or norms in positive law. The problem approach uses statutory approaches and approaches, with legal materials consisting of primary, secondary and non-legal materials. In the responsibility of a notary who uses the services of a broker to get a client, it is of course against the principle of decency contained in the laws and regulations for the position of a notary and is not justified and not allowed in the provisions of the notary's code of ethics, there are at least three aspects that can be accounted for by a notary. Moral responsibility, professional technical responsibility,legal responsibility. then in legal consequences for notaries who use brokerage services in finding clients can be charged with imposing sanctions by the honorary council as stated in article 6 of the notary's code of ethics, these sanctions are in the form of, reprimand, warning, scoring (temporary dismissal) from the association association, Onzetting (dismissal) from to members of the association, dishonorable discharge from the association.Keywords: Notary Responsibilities, Using Broker Services, Clients

Abstract

Teachers will spend most of their time at work, namely at school by doing the same tasks every day. Therefore, the condition of the school's physical environment must meet the requirements that aim not to cause teachers to experience work stress. Work stress is a state of tension that causes physical and psychological imbalances, which have an impact on emotions, thought processes, and employee conditions. Job stress in teachers can occur not only from one causal factor, but from a variety of causal factors, both internal and external. This study aims to determine "The Relationship between Individual Characteristics, Working Conditions and Work Environment with Job Stress in Teachers at SDN Meruya Utara 13, Kembangan, West Jakarta in 2023". This study discusses individual characteristics, work conditions, and the physical and social work environment. This study used analytic research with a cross sectional approach. The subjects of this study were teachers at SDN Meruya Utara 13, Kembangan, West Jakarta with a sample size of 24 teachers. Analysis of the data obtained in this study was carried out using the chi square statistical test. The results of univariate analysis showed that 12 teachers (50%) experienced moderate work stress and 12 teachers (50%) experienced severe work stress. Based on the results of bivariate analysis, it is found that the variables associated with work stress in teachers are individual characteristics (age), work conditions (workload and work routine), physical work environment (lighting), and social work environment (interpersonal relationships).

Abstract

There are still cases of hospital accreditation manipulation, highlighting the importance of the existence of independent institutions as assessors of government hospital accreditation. Therefore, two research questions arise: the regulation of independent institutions as assessors of government hospital accreditation and the administrative legal accountability of independent institutions as assessors of government hospital accreditation. This study is a normative legal research employing several approaches, including legislative approach, conceptual approach, and comparative approach. The results show that the authorization given to independent institutions in accrediting hospitals is regulated by Law Number 17 of 2023 concerning Health, aiming to create consistency, harmony, systematicity, and synchronicity in efforts to improve the quality of health services. These provisions are reinforced by regulations such as the Hospital Law, Minister of Health Regulation Number 12 of 2020, and Minister of Health Decree Number HK.01.07/MENKES/406/2020 jo. Minister of Health Decree Number HK.01.07/MENKES/6604/2021, and Minister of Health Decree Number HK.01.07/MENKES/1128/2022, demonstrating the accountability, consistency, and systematic nature of the legal basis needed. The administrative legal accountability of independent institutions as assessors of government hospital accreditation has administrative legal consequences, namely the revocation of the Minister of Health's decree that approves their status as hospital accreditation providers.

Abstract

Wilayah Mediterania Timur kini menjadi kawasan paling strategis bagi kemajuan pertahanan udara Rusia. Setelah intervensinya di teater Suriah, Rusia terlihat dapat mempertahankan jejak militernya dengan menyebarkan sistem pengawasan terintegrasi yang berhasil mengundang perhatian dunia terhadap pembangunan kapabilitas A2/AD (anti access/area denial). Rusia tampaknya telah memastikan peningkatan teknologi perang dengan keterlibatannya di perang Suriah. Dengan menjadi bos wilayah udara Suriah, Rusia pun mengambil kesempatan tersebut untuk melakukan beberapa pelatihan militer dalam pengalaman tempur yang sebenarnya. Dengan demikian, artikel ini kemudian menemukan bahwa dari sudut pandang peningkatan dan penyempurnaan militer, kehadiran militer Rusia berada pada posisi yang paling diuntungkan terkait dengan peluang untuk menggunakan lingkungan permisif Suriah. Secara keseluruhan, artikel ini meyakini bahwa kemunculan dan kelanjutan aksi militer Rusia di kancah global akan selalu berakar pada persepsi ancamannya terhadap suku Barat.

Abstract

Citizens' rights to Social Security are realized by the Government through the National Health Insurance Program (JKN Program) with the principles of Social Insurance. The JKN Program is an initiation to achieve Universal Health Coverage (UHC), which is one of the objectives of the Sustainable Development Goals (SDGs). The government has the authority and responsibility for administering the JKN Program, particularly in terms of participation and financing. This research aims to analyze the Government's authority and responsibility within the JKN Program to achieve UHC. The research is Normative Juridical, using a Juridical approach based on statutory regulations. It concludes that the Government's authority in the JKN Program is legally attributed to the National Social Security Council and the Social Security Administering Body. Concerning the Government's responsibility in the JKN to achieve UHC, the Government must prioritize participation and financing to ensure effective implementation as a part of its obligation to its citizens. BPJS, as a Legal Entity organizing the JKN Program, has Sole Authority and must involve Independent Government Institutions for aspects like service, promotion, and supervision.

Abstract

Stres kerja merupakan masalah global yang memengaruhi berbagai profesi di negara maju dan berkembang. Berdasarkan Data Persatuan Perawat Nasional Indonesia (PPNI) tahun 2006 menyatakan sebanyak 50,9% perawat di Indonesia yang bekerja mengalami stres di tempat kerja. Perawat jiwa menghadapi tantangan unik berbeda dengan perawat umum yang dimana perawat jiwa harus menangani pasien dengan gangguan mental yang sering kali menunjukkan perilaku tidak terduga dan berpotensi berbahaya selain itu beban kerja yang tinggi akibat interaksi sehari-hari dengan pasien merupakan faktor penyebab stres kerja. Penelitian ini merupakan studi deskriptif dengan desain Cross-Sectional berjudul "Faktor-faktor yang Berhubungan dengan Stres Kerja pada Perawat di Ruang Rawat Inap Jiwa RSKD Duren Sawit Kota Jakarta Timur Tahun 2024." Populasi penelitian ini adalah 59 perawat dengan sampel berjumlah 38 responden pada shift pagi dan sore. Penelitian ini mencakup observasi dan wawancara dengan responden. Hasil penelitian untuk melihat hubungan antara beban kerja dengan stres kerja didapatkan nilai beban kerja (p = 0,002) sehingga di katakan ada hubungan signifikan. Sedangkan antara karakteristik, hubungan interpesonal, dan prevalensi perilaku agresif pasien dengan stres kerja didapat nilai usia (p = 0,653), jenis kelamin (p = 0,233), pendidikan (p = 1,000), masa kerja (p = 0,478), hubungan interpersonal (p = 0,395), dan prevalensi perilaku agresif pasien (p = 0,667) tidak ada hubungan dengan stres kerja pada perawat di ruang rawat inap jiwa RSKD Duren Sawit Tahun 2024. Kesimpulanya, stres kerja pada perawat di ruang rawat inap jiwa RSKD Duren Sawit Tahun 2024 dapat di pengaruhi oleh beban kerja.

Abstract

The right to live with an adequate standard for the health and well-being of oneself and one's family is a human right recognized by all countries worldwide. Therefore, the state has a responsibility to provide proper healthcare to improve public health and the well-being of its citizens, where the implementation of social security is a prerequisite for a welfare state. Based on these circumstances, the following issues are formulated: 1) The regulation of the national health insurance system in Indonesia and the Republic of China; 2) The responsibilities of both countries in providing health protection through national health insurance. Objective to analyze the regulation of each national health insurance system in the Republic of China and Indonesia and analyze the legal efforts made by each country to protect its citizens to obtain welfare in terms of health insurance. This study is normative juridical research with a legislative approach, a conceptual approach, and a comparative approach. We employ a documentary study as a data collection method, involving primary, secondary, and tertiary sources related to the topic. Legal material analysis is conducted using a qualitative approach to address the research problems. This method produces descriptive-analytical data in the form of written, verbal, or actual behavior. The secondary data obtained through the documentary study will be analyzed concerning the applicable laws in both countries and compared accordingly. The findings of this thesis indicate that there are similarities and differences in the regulation of national health insurance in the two countries, particularly in terms of history, insurance providers, participation, covered services, and financing. Indonesia has fulfilled its constitutional obligation as stipulated in the 1945 Constitution and Law No. 40 of 2004 on the National Social Security System, which mandates the implementation of the Indonesian National Health Insurance to provide healthcare services for every citizen. Meanwhile, in the Republic of China (Taiwan), the National Health Insurance fulfills the constitutional obligations set forth in the Constitution of the Republic of China. The national health insurance systems in Taiwan and Indonesia have different approaches. Taiwan implements a centralized National Health Insurance, managed by the NHIA, with funding from individual contributions, employers, and government subsidies. In Indonesia, the National Health Insurance is managed by the Health Social Security Agency (Badan Penyelenggara Jaminan Sosial Kesehatan) under the Social Security Agency Act, despite facing accessibility and efficiency challenges. Both countries protect the health rights of their citizens through their respective legal bases. Taiwan relies on the Constitution of the Republic of China and National Health Insurance regulations, while Indonesia uses the 1945 Constitution and related regulations. To improve transparency, funding, and service quality, Indonesia can study Taiwan's National Health Insurance system and strengthen policy evaluation and public education.

Abstract

Kebijakan luar negeri India terhadap Taiwan sebenarnya tidak terlalu menguntungkan bagi Negara India, akan tetapi sebagai negara besar berusaha untuk menjaga konstelasi pengaruh di kawasa Asia Timur. Tujuan penelitian ini adalah untuk  menganalisis kebijakan luar negeri India tetap mempertahankan kerjasama dengan Taiwan melalui kebijakan “Act East”.  Metodologi penelitian ini menggunakan kualitatif dengan pendekatan deskriptif terkait dengan analisis kebijakan luar negeri. Dalam analisis politik luar negeri “Act East” India terhadap Taiwan mencerminkan beberapa elemen konstruktivisme yang mencakup kebijakan yang mempengaruhi preferensi, dan kepentingan negara. Yang pertama, “Act East” India adalah ide untuk menghidupkan kembali hubungan strategis dan historis dengan Taiwan. Kedua, hubungan bilateral  India-Taiwan yang positif membentuk pemahaman bersama berdasarkan nilai-nilai kebebasan, demokrasi, hak asasi manusia, dan norma. Ketiga, sinergitas sebagai emerging power menempatkan India untuk hidup berdampingan secara damai dengan Taiwan dan menjaga keamanan serta stabilitas di kawasan.Kata Kunci: Konstruktivisme, Kebijakan Luar Negeri, Act East, India , Taiwan
