Abstract

This study analyzed the Reformulation of the Legal Status of the Indonesian Dentist Association Professional Organization with the Enactment of Law Number 17 of 2023 concerning Health. The existence of Law Number 17 of 2023 concerning Health has significant implications for the legal status of professional organizations, including the Indonesian Dentist Association (PDGI). Before the enactment of this law, PDGI as a professional organization had a strong position in regulating and supervising dental practices in Indonesia. However, with the enactment of the new Health Law, there has been a change in the governance of the medical profession which has a direct impact on the legal status of PDGI. With the enactment of Law Number 17 of 2023 concerning Health, the absence of various roles and functions of professional organizations that were previously contained in laws and regulations. In the future, the various roles of these health professional organizations will be carried out by the government, or institutions under the authority of the government. Therefore, this study is juridical-normative research using statute, conceptual and comparative approaches.

Abstract

This study aims to determine the extent to which the most strategic area as Russian air defense. The Eastern Mediterranean region is now the most strategic area for the advancement of Russian air defense. After its intervention in the Syrian theater, Russia seems to be able to maintain its military footprint by deploying an integrated surveillance system that has succeeded in inviting world attention to the development of A2/AD (anti access/area denial) capabilities. Russia seems to have ensured the improvement of war technology with its involvement in the Syrian war. By becoming the boss of the Syrian airspace, Russia also took the opportunity to conduct some military training in actual combat experience. Thus, this article then finds that from the perspective of military improvement and refinement, the Russian military presence is in the most advantageous position in relation to the opportunity to use the permissive environment of Syria. Overall, this article believes that the emergence and continuation of Russian military action in the global arena will always be rooted in its threat perception towards the Western tribe.

Abstract

The Russian-Ukrainian conflict is a prolonged conflict that began during the Cold War between the Western bloc, in this case NATO led by the United States, and the Eastern bloc, namely the Warsaw Pact led by the Soviet Union. In 1999, during the reign of President Gorbachev in the Soviet Union, a political revolution called Glasnots and Peretroika occurred which resulted in the division of the Soviet Union into the Russian State and several small countries that separated themselves. Ukraine as a free country to cooperate in security with the Western bloc, to protect its country from Russian influence. In addition, there are minority groups in Luhansk and Donest who are ethnic Russians who want to join Russia. This prompted Russia to launch a special operation which was followed by a full-scale operation in Ukraine. The purpose of this study is to analyze Indonesia's soft power diplomacy in the Russia-Ukraine conflict. This study uses a qualitative research method with a descriptive approach, according to Sugiyono (2022), the descriptive qualitative research method is a study based on the philosophy of postpositivism used to examine the conditions of natural objects where researchers are key instruments. The results of the study show that the conflict between Russia and Ukraine is a conflict of interest between large countries that want to expand their influence to other countries. Indonesia's diplomatic efforts in the Russia-Ukraine conflict began with President Joko Widodo communicating directly with Ukrainian President Zelensky and Russian President Putin to resolve the conflict between the two countries and inviting them to attend the G20 meeting. Indonesia's role as the holder of the presidency and host of the G20 Summit in 2022. In organizing the G20 in 2022, geopolitical conditions and the global security crisis are among the issues discussed. Therefore, the conflict between Russia and Ukraine automatically becomes a topic of discussion.

Abstract

This research discusses the current determination of Archipelagic Sea Lanes determined by the Indonesian government which is able to provide legal certainty for foreign-flagged ships crossing Indonesian waters. The problem that arises with the determination is whether they do not create vulnerabilities that have the potential to harm the national interests of the Indonesian people. This research is normative legal research with a conceptual and statutory approach. The research results show that the Indonesian government has established archipelagic sea lanes so that it can provide legal certainty for foreign ships crossing Indonesian waters. This determination is a mandate from the ratification of the 1982 international maritime law convention. However, this determination still creates vulnerabilities that have the potential to harm the national interests of the Indonesian people. The cause of this vulnerability is because the norms contained in the regulations regarding archipelagic sea lanes does not contain sanctions norms so that legal violations often occur in the archipelagic sea lanes area. The need for more significant sanctions is due to the fact that archipelagic sea lanes have specificities compared to other maritime zones.

Abstract

Salah tangkap adalah kesalahan yang dilakukan oleh aparat penegak hukum terhadap seseorang yang sebenarnya tidak bersalah dalam hal ini adalah salah tangkap yang dilakukan oleh pihak Kepolisian. Kekeliruan dalam penangkapan terjadi ketika aparat penegak hukum melakukan tindakan penangkapan terhadap seseorang yang sebenarnya tidak bersalah atau bukan merupakan orang yang seharusnya ditangkap. Tujuan dari penelitian ini adalah untuk mengetahui tanggung jawab kepolisian menurut hukum positif di Indonesia dalam kasus salah tangkap dan penetapan tersangka. Hasilnya bahwa Anggota Polisi yang melakukan salah tangkap dapat dikenakan sanksi yaitu berupa berupa peringatan, penurunan pangkat, mutasi, atau bahkan pemberhentian sementara. Kesimpulannya bahwa anggota Polisi yang melakukan salah tangkap karena mereka melanggar due procces law dan melanggar asas praduga tidak bersalah yang harus dipedomani dan dipatuhi oleh anggota Polisi yang melakukan penyelidikan.

Abstract

Penegakan hukum terhadap tindak pidana korupsi menjadi elemen krusial dalam mewujudkan keadilan dan akuntabilitas publik. Dalam sistem hukum Indonesia yang menganut tradisi civil law, hakim memiliki kewenangan luas dalam menjatuhkan vonis berdasarkan ancaman pidana yang ditentukan dalam undang-undang. Penelitian ini bertujuan untuk menganalisis kewenangan yudisial dalam menjatuhkan vonis terhadap terdakwa kasus korupsi berdasarkan Putusan Perkara Nomor: 1/PID.SUS-TPK/2025/PT DKI jo Nomor: 70/Pid.Sus-TPK/2024/PN.Jkt.Pst., serta mengidentifikasi potensi penyalahgunaan kewenangan hakim dan mekanisme pengawasan yang tersedia. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan teknik analisis kualitatif terhadap putusan pengadilan, peraturan perundang-undangan, dan teori kewenangan hakim. Hasil penelitian menunjukkan bahwa hakim dalam perkara ini telah menggunakan kewenangannya secara mandiri dengan memperhatikan unsur formil dan materil, namun terdapat celah penilaian subjektif yang berpotensi menimbulkan ketimpangan dalam penerapan hukum. Di sisi lain, mekanisme pengawasan melalui Komisi Yudisial, Mahkamah Agung, dan kontrol publik masih bersifat reaktif dan belum sepenuhnya efektif dalam mencegah penyalahgunaan wewenang yudisial. Oleh karena itu, diperlukan reformasi sistem pengawasan dan penyusunan pedoman pemidanaan yang terstruktur guna menjamin konsistensi, proporsionalitas, dan integritas dalam putusan hakim atas perkara korupsi.

Abstract

In carrying out duties in disaster areas, various factors affect the rescue actions of military medical personnel assisting victims. The government and relevant agencies must ensure legal protection for these personnel in performing their professional duties. This study examines the form of legal protection for military medical and health personnel assigned to disaster areas under the enactment of Law Number 17 of 2023 on Health, focusing on both criminal and civil law. Using a normative juridical approach, the analysis explores the application of relevant laws and the conceptual understanding of legal principles related to military medical practice. The findings show that military medical personnel must possess STR and SIP and are entitled to legal protection, as medical risks may arise even when procedures comply with established SOPs. If disputes occur in criminal or civil matters, patients may file complaints with the MDP. Subsequent proceedings include an examination, a public hearing, and recommendations by the MDP to the concerned personnel. Should any personnel be found at fault, they remain entitled to redress through both military and general judiciary channels, provided their actions adhered to professional service standards and that initial resolution efforts are pursued through alternative dispute mechanisms outside the court.

Abstract

North Natuna Sea's abundance of natural resources provides a tremendous pull for diverse parties, who, for the sake of profit maximization, are willing to commit any crime. A further report found that the claims of South East Asean countries and China on Indonesia's Exclusive Economic Zone (EEZ) waters in North Natuna Sea are completely divorced from the attractiveness of the natural resources. Considering the strategies to resolve any differences and the disputes between South East Asean countries and China in a peaceful manner through dialogue, affirming commitment to the goals and principles of UNCLOS, 1982, this paper provides a systematic review of the strategies as a the treaty of amity and cooperation in the South East Asian model for Indonesia’s stability which promotes agency and reflective practice. Comparing the current practice of the current waters’ cases in North Natuna Sea to the international stabilities reported in the literature, this review suggests that North Natuna Sea needs adopt two strategies that are concurrently executed and mutually supportive. The first is a diplomatic strategy consisting of two simultaneous steps, the first of which involves efforts to expedite the implementation of negotiations and the conclusion of a territorial boundary agreement between Indonesia and the Philippines, India, Malaysia, Palau, Singapore, Thailand, Timor-Leste, and Vietnam. sea. The second strategy is a defense diplomacy approach to China, by leveraging Indonesia-China bilateral defense cooperation and multilateral defense cooperation venues such as ARF and ADMM Plus where China is a discussion partner. Abstract

Papuan Armed Criminal Group has carried out various attacks on TNI-POLRI , Papuan civilians, and migrant civilians in recent years. Every act of terrorism that occurs disturbs the Papuan people who live or work there. There are many victims of the KKB attack in Papua, ranging from military personnel, teaching staff, medical personnel, then students who are studying in their school. The type of research that the author uses in writing this thesis is normative juridical research. This type of research is research that seeks solutions to legal issues that arise to provide prescriptions regarding what should be the issues raised. And using the Conceptual Approach, Statute Approach, and Comparative Approach. The Papuan armed criminal group does not match the characteristics and definition of terrorists, in which terrorists do not aim to establish their own country and seek their sovereignty through militia and diplomacy. The Papuan Armed Criminal Group aims to get international attention, hoping that the land of Papua can become a sovereign country. The Indonesian government's steps should be Belligerent preventive not limited to tackling terrorists. Resolving disputes with Papuan armed criminal groups by not committing acts that are categorized as international crimes is through the mechanism of Military Operations Other than War, Regional Expansion, and Infrastructure Development in the land of Papua. However, if the Armed Criminal Group is included in the Belligerent category, the Indonesian government can carry out Military Operations for War but must comply with the Laws of War or Mediation, Conciliation, and International Arbitration.

Abstract

In 2019, President Joko Widodo announced the plan to relocate Indonesia's capital to East Kalimantan. This project aims to improve regional governance and reflect the nation's identity and unity. With a budget of Rp466 trillion, the project involves various funding schemes. The Nusantara Capital Authority (OIKN) was established to manage the preparation, construction, and relocation of the new capital, as well as to administer the special regional government. This study aims to analyze the legal status of OIKN and the legal implications of its regulations in managing the capital city. Using normative and descriptive legal methods, the study evaluates OIKN's special authority within Indonesia's state administration system and its legal implications. The research reveals that OIKN, established under Law No. 21 of 2023 and Presidential Decree No. 62 of 2022, functions as a special regional government institution under Article 18B of the 1945 Constitution. Although the head of the authority is appointed directly by the president and not elected by the Regional People's Representative Council (DPRD), OIKN has broad powers, including in investment licensing, spatial planning, and development. While this system is expected to expedite development and provide legal certainty, the potential conflicts with regional governments and criticism of relocating the capital from Jakarta to IKN highlight the challenges and complexities of implementing the project, including concerns about budget and legal certainty for investors.
