Abstract

The advancement of digital technology has transformed patterns of human communication, including interactions within the household. Social media, originally intended for social connection and entertainment, has increasingly become a source of marital tension. Online infidelity, emotionally intimate digital communication, jealousy arising from virtual interactions, and violations of digital privacy often develop into prolonged conflicts that threaten marital stability. This study examines the contribution of social media to divorce cases at the Sengkang Religious Court, analyzes judicial legal reasoning in such cases, and interprets the phenomenon through the perspective of Islamic jurisprudence. A qualitative case-study approach was employed, involving document analysis, courtroom observation, and in-depth interviews with judges, clerks, and litigants. Data from 2024 show that out of 1,011 divorce cases, approximately 20 percent explicitly involved conflicts related to social media use, indicating a significant impact of digital behavior on marital dissolution. Judicial considerations are primarily based on Article 19(f) of Government Regulation No. 9/1975 and Article 116(f) of the Kompilasi Hukum Islam, which recognize continuous disputes (syiqaq) as lawful grounds for divorce. Judges evaluate not only formal digital evidence, such as screenshots and message records, but also the psychological and emotional harm caused by digital misconduct. Mandatory mediation under Supreme Court Regulation No. 1/2016 is used to assess the possibility of reconciliation. From the perspective of Islamic law, harmful social media practices are assessed through the maxim dar’ al-mafāsid muqaddam ‘alā jalb al-maṣāliḥ, affirming that divorce is permissible when digital harm outweighs marital benefit.

Abstract

This study aims to analyze the role and urgency of sharia fatwas in legitimizing and operationalizing zakat as a financing instrument for renewable energy projects, viewed through Islamic political thought in the context of the global climate crisis. Employing a qualitative approach, the research utilizes document analysis of fatwas (e.g., MUI Fatwa No. 15/2017 and Malaysian zakat fatwas), interviews with representatives from zakat institutions (Baznas and State Zakat Centers), and case studies of renewable energy projects in Indonesia and Malaysia. The findings reveal that sharia fatwas provide robust legal legitimacy for channeling zakat into green projects like solar power plants (PLTS) and biomass initiatives, aligning with maqasid sharia’s hifzhul bi’ah (environmental preservation) and supporting global climate goals, such as the 2050 net-zero emissions target. Despite challenges like low sharia literacy and limited fund scales, zakat demonstrates significant potential to support Sustainable Development Goals (SDGs) 7 and 13, fostering socio-economic benefits for mustahik through clean energy access and green job creation. The study concludes that sharia fatwas and green zakat serve as innovative tools to bridge Islamic values with global environmental policies, enhancing sustainability. Academically, it contributes by developing the concept of green zakat, filling a literature gap in integrating zakat with renewable energy financing, and offering a framework for aligning sharia-based finance with sustainable development.

Abstract

This study aims to examine the effectiveness of the al-shulhu approach in resolving Islamic economic disputes, particularly in cases of breach of murabahah contracts in Indonesia. Employing a qualitative approach with a library research design, this study collects data from academic journals, books, and regulations such as DSN-MUI fatwas through qualitative content analysis. Source selection was based on criteria of relevance to the topic, recency of publication (focusing on the 2020–2025 range). The findings indicate that al-shulhu, rooted in the principle of sulh in the Qur’an (Surah An-Nisa: 128), is an effective dispute resolution mechanism as it emphasizes justice (al-‘adl), honesty (as-sidq), and mutual consent (ridhā). This approach enables solutions such as financing restructuring or penalty reductions without violating sharia principles, while maintaining social harmony between Islamic banks and clients. However, the application of al-shulhu faces challenges, including the lack of a clear legal framework, inconsistent implementation across institutions, and a shortage of competent mediators with expertise in Islamic law. This study contributes to academic discourse by bridging classical Islamic legal theory with modern dispute resolution practices and provides practical recommendations for Islamic financial institutions and regulators, such as OJK and DSN-MUI, to integrate al-shulhu into the national legal system through clear regulations and mediator training. The study recommends further empirical research to enhance understanding of al-shulhu’s application in religious courts and Islamic financial institutions.

Abstract

One form of action that gets criminal abolition is an action taken by someone in order to defend themselves from an emergency threat, but the act of self-defense sometimes exceeds the proper limit. This study aims to find out how the comparison between Islamic criminal law and positive law towards actions that exceed the limits (noodweer exces) in self-defense. This research is a qualitative research study using library research. According to the results of this study, it was found that the defense carried out beyond the limit (Noodweer exces), in positive law as stipulated in KUHP 49 paragraph 2, when self-defense that exceeds the limit carried out under conditions of "shaking of the soul", then this can be used as a justification or forgiveness that can eliminate the crime. In contrast to Islamic criminal law, a person must be held responsible for acts of defense that go beyond limits under any circumstances.Keywords: Self-Defense; Noodweer Exces; Positive Law.

Abstract

The enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes (UU TPKS) marks a transformative momentum in Indonesia's victim-oriented criminal law. However, within a religious society, doubts often arise regarding the alignment of these regulations with Islamic values. This study aims to analytically compare the construction of sexual violence sanctions in the TPKS Law and Islamic Criminal Law (Jarimah Ta'zir) and the extent to which both provide justice for victims. The research method employed is normative legal research with statutory, conceptual, and comparative approaches. Primary, secondary, and tertiary legal materials were used as data sources, analyzed through descriptive qualitative content analysis. The results indicate a substantial convergence between the two legal systems, where the restitution mechanism in the TPKS Law shares functional similarities with the concept of Diyat Ta'zir, aimed at recovery (jawabir). Furthermore, the treatment and rehabilitation sanctions in the TPKS Law are found to be consistent with the principles of ta'dib and ishlah in Islamic law. Additionally, financial sanctions in the form of fines under UU TPKS correspond to the concept of ta'zir bi al-mal in Islamic jurisprudence, while supplementary sanctions such as publication of the perpetrator's identity reflect the Islamic concept of tashhir. The study concludes that the 2022 TPKS Law is a modern manifestation of the objectives of public interest (Maqashid al-Syari'ah), providing holistic protection for human dignity through both outward and inward dimensions recognized by Sharia. It is recommended that law enforcers optimize the application of UU TPKS sanctions without hesitation, as they substantively meet Islamic standards of justice, and that future empirical research be conducted to evaluate the actual effectiveness of sanction enforcement in the field.

Abstract

This study aims to analyze the influence of Halal Lifestyle, Halal Awareness, and Halal Branding on cosmetic product purchasing decisions among university students in Parepare City. Using a quantitative method with an associative approach, this study explores how these three factors influence the purchasing decision-making process. Data were collected from 96 university students and analyzed using SPSS software, with validity, reliability, and classical assumption tests to ensure the integrity of the results. The research findings indicate that these three factors have a positive and significant influence on university students' purchasing decisions. Halal Lifestyle, which reflects a lifestyle in accordance with Islamic principles, directly influences the preference for Halal-certified cosmetic products. Halal Awareness, which reflects consumers' knowledge and awareness of a product's Halal status, also significantly influences purchasing decisions. Furthermore, Halal Branding, which focuses on promoting Halal attributes in products, strengthens consumer trust and loyalty. This study emphasizes the importance of integrating Halal values into marketing strategies for companies targeting Muslim consumers, particularly in the growing cosmetics industry.

Abstract

This study aims to analyze the practice of selling broiler chicken at Lakessi Market in Parepare City, map the halal product assurance system at the trader level and consumer perceptions, and assess the urgency of halal certification. This study used a qualitative method with a descriptive case study approach. Primary data were collected through observations and interviews with 20 informants consisting of 8 broiler chicken sellers, 10 consumers, and 2 government agency representatives, with data analysis conducted inductively. The results show that sales practices generally follow two patterns: supply from slaughterhouses considered trustworthy or independent slaughtering with efforts to follow Islamic slaughter procedures, basic hygiene aspects (cleanliness of equipment, covering meat with plastic, use of ice) are also considered. However, halal assurance in the field is still predominantly based on trust and visual verification by consumers, so that halal assurance cannot be fully assured without certification. The urgency of halal certification is highly assessed to strengthen regulatory certainty, consumer protection, and market confidence, but compliance is hampered by limited understanding of procedures and concerns about costs, so government assistance is a key need.

Abstract

The objective of this study is to ascertain the comparative analysis of religious blasphemy legislation in Egypt and Indonesia. This study also elucidates the implementation of religious blasphemy legislation in Egypt and Indonesia. This study involves comparative legal research. Comparative research was conducted to gather additional insights on the blasphemy laws in Egypt and Indonesia. This study employs library research methodology to gather both primary and secondary data. The findings of this study indicate that the legislation governing religious blasphemy in Indonesia is law number. 1/ PNPS/1965, but in Egypt it is article 98 of the Egyptian Penal Code. Additionally, this study discovered parallels in the implementation of religious blasphemy legislation in Egypt and Indonesia. The implementation of anti-blasphemy legislation in both nations frequently subjects defendants to a succession of grave human rights infringements perpetrated by both private individuals and government agents

Abstract

This study aims to analyze the implementation of Islamic economic values in the intervention policy of Perum Bulog on rice grain prices in Duampanua District, Pinrang Regency. Price fluctuations and the dominance of middlemen as the main buyers often force farmers to sell their harvest below the Government Purchasing Price (HPP). This condition indicates that Bulog’s role as a price-stabilizing institution has not been fully optimal in maintaining price stability and protecting farmers’ welfare. This research employs a descriptive qualitative method with a case study approach and field research design. Data were obtained through in-depth interviews with farmers, middlemen, and Bulog officials, supported by secondary data from policy documents and relevant literature. The results show that Bulog’s interventions through HPP policies, grain procurement, and market operations have contributed to price stabilization; however, implementation remains uneven due to limited access, bureaucratic obstacles, and lack of socialization. From the perspective of Islamic economics, the values of Siddiq (honesty) and Amanah (trustworthiness) are reflected in price determination and farmer protection but have not been fully and consistently applied in practice. The value of Fathonah (wisdom and intelligence) appears in procurement and infrastructure policies but has not effectively reached remote production areas. Meanwhile, Tabligh (transparency and dissemination of information) remains weak, resulting in the incomplete realization of Maṣlaḥah (public welfare) for farmers.

Abstract

This study aimed to formulate a tripartite reconciliation model that synchronizes the Bugis customary value of Siri' with the principles of Islamic criminal law (Jinayah) and the positive law of Indonesia within the framework of Law No. 1 of 2023 on the Criminal Code. This research employed a normative legal research method using a statute approach and a conceptual approach, with data collected through structured library research involving primary, secondary, and tertiary legal materials. The validity of legal materials was tested through textual criticism and theoretical triangulation techniques. The findings revealed that the Siri' value in Bugis culture shared a strong philosophical convergence with the principle of Hifz al-Irdh in Islamic law, as both placed human dignity as a legally protected object. The study also confirmed that the Diyat and Afw mechanisms in Jinayah were functionally equivalent to restitution and restorative justice under the new Criminal Code, while the Tudang Sipulung deliberation tradition was structurally parallel to the Sulh mediation in Islam and restorative justice procedures under Prosecutor Regulation No. 15 of 2020. These findings established that no principled contradiction existed among the three legal systems in resolving honor-based disputes, and that their integration into a tripartite model offered the most effective and humanistic solution for criminal law enforcement in South Sulawesi.   Penelitian ini bertujuan untuk merumuskan model rekonsiliasi tripartit yang mensinkronkan nilai Siri' dalam budaya Bugis dengan prinsip hukum pidana Islam (Jinayah) dan hukum positif Indonesia dalam kerangka UU No. 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana. Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual, serta pengumpulan data melalui penelusuran pustaka terstruktur yang meliputi bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa nilai Siri' memiliki titik temu filosofis yang kuat dengan prinsip Hifz al-Irdh dalam hukum Islam, di mana keduanya menempatkan kehormatan manusia sebagai objek hukum yang wajib dilindungi. Mekanisme Diyat dan Afw dalam jinayah terbukti setara secara fungsional dengan restitusi dan keadilan restoratif dalam KUHP Baru, sementara tradisi musyawarah Tudang Sipulung secara struktural identik dengan mediasi Sulh dalam Islam dan prosedur keadilan restoratif berdasarkan Peraturan Kejaksaan No. 15 Tahun 2020. Ketiga sistem hukum tersebut tidak memiliki pertentangan prinsipil dalam penyelesaian delik kehormatan, sehingga integrasinya dalam model tripartit merupakan solusi yang paling efektif dan berkeadilan bagi penegakan hukum pidana di Sulawesi Selatan.
