Abstract

ABSTRAK Seiring dengan disahkannya revisi UU Minerba, instrumen perizinan merupakan prinsip dasar yang mendasari pengelolaan sumber daya alam khususnya sumber daya mineral. Penelitian ini bertujuan untuk mengkaji bagaimana aspek perizinan terhadap pengelolaan sumber daya alam pasca disahkannya revisi UU Minerba, dan bagaimana fungsi perizinan dalam pengelolaan SDA pasca pengesahan revisi UU Minerba ditinjau dari perspektif hukum administrasi. Metode yang diaplikasikan dalam penelitian ini adalah penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan dan konsptual. Hasil penelitian mengetengahkan bahwa kewenangan dalam memberikan perizinan, khususnya sumber daya mineral mengarah ke arah yang lebih sentralistik. Misalnya seperti Pasal 35 ayat (1) yaitu usaha pertambangan dilaksanakan atas  kewenangan izin berusaha dari Pemerintah Pusat. Kemudian dalam UU Minerba yang baru Tahun 2020. Kemudian terdapat penyederhanaan izin, dimana sebelumnya IUP eksplorasi dan operasi-produksi dipisahkan sehingga pengusaha tambang harus mendaftar dua kali untuk kedua izin tersebut. Namun kini, cukup sekali. Oleh karena itu, dengan disahkannya revisi UU Minerba, maka iklim berusaha khususnya terkait perizinan menjadi lebih disederhanakan guna mewujudkan kepastian berinvestasi dan kemudahan berusaha di bidang pertambangan minerba. Sentralisasi usaha pertambangan menunjukkan semangat debirokratisasi atau penyederhanaan birokrasi agar usaha pertambangan berjalan lebih efektif dan efisien.Kata Kunci: Hukum Administrasi, Pengelolaan SDA, Perizinan, Revisi UU Minerba, Welfare State

Abstract

This study explores the application of the 'meaningful participation' principle in the formation of laws ratifying international agreements in Indonesia, with a focus on social, economic, and environmental sectors. The research adopts a normative legal methodology, utilizing statutory and conceptual approaches to analyze relevant legislation, court decisions, and academic literature. The findings reveal a significant imbalance in public participation in the ratification process, primarily characterized by a top-down approach with minimal substantive dialogue with affected community groups. Despite constitutional provisions allowing the President to establish agreements without ratification, meaningful public participation in legislative and ratification processes remains limited. The study emphasizes the need for open public consultations, active involvement of non-governmental organizations, and private sector engagement to achieve policies that reflect the comprehensive interests and aspirations of the populace. It highlights the importance of community involvement, transparency, economic-environmental balance, and inclusive approaches in influencing meaningful participation levels. The research calls for recommendations to the Government and Parliament to foster more qualitative and significant public participation in the ratification process, aligning Indonesia with international principles of meaningful participation in social, economic, and environmental law. This approach is crucial for Indonesia, as the world's third-largest democracy, to promote meaningful public participation in policy-making, especially in ratifying international agreements impacting the broader society. Highlights: Imbalanced Participation: Dominance of a top-down approach with minimal public dialogue in treaty ratification. NGOs and Private Sector: Essential roles in representing diverse societal interests in legislative processes. Abstract

In August 2023, news circulated in one of the local mass media that PT Sumbawa Timur Mining proposed the use of 5,300 hectares of protected forest area in Dompu Regency, NTB to the NTB Provincial Government as a place for dumping tailings from mining, which then caused pros and cons. Through this research, the author aims to examine the regulation of the conversion of protected forest areas into mining areas in Indonesia and analyze the conversion of protected forest areas in Dompu Regency into dumping areas from the perspective of the licensing function as an instrument of development engineering. The method used in this research is normative legal research with statutory, conceptual and case approaches. The results show that the Forestry Law has opened up opportunities for the use of forest areas for development purposes outside of forestry activities in production forest areas and protected forest areas. Specifically, mining activities in protected forest areas are only allowed for mining activities carried out with a closed mining pattern. Meanwhile, tailings disposal can only be carried out in waste containment dams and sea facilities with certain specifications, so that tailings disposal cannot be disposed of carelessly in protected forest areas.

Abstract

Purpose of the study: The purpose of this study is to examine the legality of the position and authority of the acting regional head, as well as to examine the dignity of democracy in the appointment of acting regional heads by the president and its construction after the Constitutional Court Decision Number 15/PUU-XX/2022. Methodology: This study applies normative legal research methods using a statutory, conceptual, and case approach. Results: The results of the study show that the appointment of acting regional heads is the operationalization of the concept of politically appointed presidential power and not the concept of election (political elected) as regional heads.  The consequence is a lack of regional legitimacy and a lack of relations with the people because it is not the people's choice.  This condition shows a portrait of the decline of democracy in the regions.  In this case, the government should prepare by making implementing regulations related to the mechanism for selecting regional heads by not degrading the democratic values as mandated by the Constitutional Court in its decision Number 15/PUU-XX/2022. Applications of this study: This article provides an analysis of how democratic principles should still be applied in the process of appointing acting regional heads.  This research is expected to be useful and can be a reference material for those who conduct research, especially with regard to the appointment of the acting regional head.  Thus, this research is expected to enrich the scientific treasures and studies related to the mechanism for appointing acting regional heads. Novelty/ Originally of this study: The research related to the appointment of acting regional heads is still very minimal.  So with the research that examines the dignity or portrait of democracy in the mechanism for appointing the acting regional head, it is considered very important as reference material in the process of implementing democracy in Indonesia.

Abstract

One the things in the Law Number 11 year of 2020 about Job Creation that cause problem is the deletion of an article concerning Environmental Permit Obligations. Environmental Permit Obligation is not strictly regulated in the Law of Job Creation. However, a petitioner must get a ruling about Environmental Eligibility to be permitted in running a business. Environmental Permission’s Nomenclature and Substance in Law of Environmental Protection and Management is changed into Environmental Agreement in the Law of Job Creation. The purpose of writing this article is to analyze environmental disputes in the Law of Job Creation, analyze environmental issue connected to Human Right, and also suggest improvement concerning environmental provision after the constitutional court’s decision number 91/PUU-XVIII/2020. The result of the research indicate that in order for a legal product that is born to be functional in the order of life of the nation and state, the legal product must accommodate what is the soul of the nation, which must be in accordance with and in harmony with the values contained in the Constitution. In addition, the right to the environment is one of the human rights regulated by the constitution, so that the revision of the Job Creation Law after the Constitutional Court’s decision related to the environment must prioritize human rights and sustainable development, especially by accommodating related environmental permit obligations in the form of Environmental Impact Assessment. Abstrak: Salah satu hal di dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (UU Cipta Kerja) yang memunculkan persoalan adalah dihapusnya pasal mengenai kewajiban izin lingkungan. Dalam UU Cipta Kerja, izin lingkungan tidak diatur secara tegas. Namun, untuk mendapatkan izin berusaha, pemohon harus mendapatkan keputusan mengenai kelayakan lingkungan. Izin Lingkungan dalam UU PPLH diubah nomenklatur dan substansinya menjadi persetujuan lingkungan dalam UU Cipta Kerja. Tujuan dari penulisan artikel ini adalah untuk mengkaji permasalahan lingkungan hidup dalam UU Cipta Kerja, mengkaji isu lingkungan hidup dalam kaitannya dengan hak asasi manusia, serta memberikan saran perbaikan mengenai ketentuan lingkungan hidup pasca Putusan MK Nomor 91/PUU-XVIII/2020. Hasil penelitian menunjukkan bahwa agar suatu produk hukum yang dilahirkan menjadi fungsional dalam tatanan kehidupan berbangsa dan bernegara, maka produk hukum tersebut harus mengakomodir apa yang menjadi jiwa bangsa, yakni harus sesuai dan selaras dengan nilai-nilai yang terkandung dalam Konstitusi. Selain itu , hak atas lingkungan hidup adalah salah satu hak asasi yang diatur oleh Konstitusi, sehingga revisi UU Cipta Kerja pasca putusan MK terkait lingkungan hidup harus mengedepankan hak asasi manusia dan pembangunan yang berkelanjutan, khususnya dengan mengakomodir terkait kewajiban izin lingkungan berupa Amdal.

Abstract

Hak asasi manusia (HAM) merupakan hak dasar yang merupakan anugerah setiap individu yang wajib dihormati, dilindungi, dipenuhi oleh negara. Maka ketika negara tidak mampu melindungi dan menghormati hak asasi, saat itu juga negara telah melakukan pelanggaran HAM. Contoh pelanggaran HAM yang telah terjadi dalam dunia sepak bola tanah air pada awal Oktober 2022 yakni tragedi di Stadion Kanjuruhan yang menewaskan ratusan korban jiwa. Peristiwa ini menjadi Sejarah kelam dalam dunia persepakbolaan tanah air bahkan mendaptkan perhatian dunia internasional. Penelitian ini menggunakan metode penelitian normatif, dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Hasil penelitian diperoleh bahwa dalam tragedi Kanjuruhan, Komnas HAM telah berperan dalam menjalankan proses pemantauan serta penyelidikan terhadap krisis kemanusiaan Kanjuruhan dan telah menyatakan bahwa memang tidak ada pelanggaran HAM berat. Kemudian Hak atas Keadilan belum dapat dikatakan tercapai bagi korban dikarenakan penjatuhan vonis hukuman yang tidak setimpal dengan banyak nya korban yang berjatuhan dan berkaitan dengan perlindungan HAM bagi supporter sejatinya dari segi regulasi sudah menjamin hak asasi setiap pihak untuk mendapatkan perlindungan dalam penyelenggaraan pertandingan sepak bola di Indonesia, namun yang kerap kali membuat perlindungan hak asasi tercederai seringkali diakibatkan dari perilaku kekerasan dan kesewenangan aparat penegak hukum.

Abstract

Social security program reflects state's responsibilities to provide social and economic protection to citizens. However, social security in Indonesia has remained to become a central issue after Presidential Regulation Number 14 of 2021. This regulation outlines administrative sanctions on delaying or terminating social security for citizens that refuse vaccines. This study examined the issue from philosophical, juridical, and sociological perspectives on the administrative sanctions for delaying or terminating the social security related to the vaccine requirements. This study used a legal research method with statutory, conceptual, and case approaches. This study indicated that the regulation regarding the postponement or termination of social security provision contradicted Article 20(1) of Law Number 40 of 2004 on the National Social Security System. Also, it violated human rights about the right to social security based on the 1945 Constitution. Instead, to succeed in vaccination, it should adopt a socio-cultural approach by combining legal instruments with elements of local culture in the community for legitimating vaccination as its part of being accepted in the society. Abstract

Forced marriages are frequent in Indonesia for several reasons, including economics and culture. In reality, practically all South Asian countries have the same problem, with poverty and tribal animosity frequently being used to force certain adolescents to marry. The purpose of this study is to examine women’s rights in the context of family law in avoiding forced marriage, as well as to examine law enforcement against forced marriage from a family law viewpoint. This research uses normative legal methods with statutory, conceptual, case, and comparative approaches. The findings reveal that respect for and implementation of women’s rights have been included in various legal instruments, both at the international and state levels. The protection of women’s rights is critical for achieving substantive justice and avoiding forced marriage. However, the combination of social, cultural, and legal concerns continues to challenge law enforcement. As a result, a family consultancy institution in partnership with the judiciary is required, similar to Australia, which has a Family Court to address instances such as forced marriage. With consultants who understand family matters and are experts in their fields, the settlement of cases of forced marriage through non-litigation is expected to be more effective, where the results of the decision can be determined by the court, as is the practice in Australia.

Abstract

Procurement of goods and services must be based on the principle of accountability to achieve procurement of goods and services that can advance public welfare and provide protection and fulfillment of human rights. It can be said that corrupt practices by government agencies and institutions at the central, regional, and other government institutions are easily carried out in the procurement of goods and services. The purpose of this study is to examine the aspects of administrative law and criminal law in the procurement of goods and services, as well as their role in realizing accountable procurement of goods and services. The method of writing this article is normative legal research with a statutory and conceptual approach. The results of the study show that in the aspect of administrative law, one of the inherent functions is the regulatory function. This regulatory function is related to the legal relationship between providers and users in the preparation process up to the process of issuing a letter of determination of providers of goods and services. This administrative law can be an instrument for building a paradigm that leads to the implementation of accountable procurement of goods and services, because, through its regulatory function, additional indicators can be created for users of goods and services in decision-making, such as the requirement for anti-bribery certification and assessment based on performance track records that have not been implemented in Indonesia. If a criminal offense is committed by the user or provider of goods or services during the procurement process, then the criminal law aspect of procurement will be applied. Therefore, it is important to have a kind of paradigm development that leads to accountable procurement of goods and services to avoid potential criminal violations.Keywords: State Administrative Law, Criminal Law, Procurement of Goods and Services AbstrakKegiatan pengadaan barang dan jasa harus dilandasi dengan prinsip akuntabilitas agar tercapai pengadaan barang dan jasa yang dapat memajukan kesejahteraan umum serta memberikan perlindungan dan pemenuhan hak asasi manusia. Karena dapat dikatakan bahwa praktik-praktik korupsi oleh badan-badan dan lembaga-lembaga pemerintah di tingkat pusat, regional, dan lembaga-lembaga pemerintah lainnya dengan mudah dilakukan dalam pengadaan barang dan jasa. Tujuan penelitian ini adalah mengkaji aspek hukum administrasi dan hukum pidana dalam pengadaan barang dan jasa, serta pernanannya dalam mewujudkan pengadaan barang dan jasa yang akuntabel. Metode penulisan artikel ini adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa dalam aspek hukum administrasi, salah satu fungsi yang melekat adalah fungsi mengatur. Fungsi mengatur ini berkaitan dengan hubungan hukum antara penyedia dan pengguna pada proses persiapan sampai dengan proses penerbitan surat penetapan penyedia barang dan jasa. Hukum administrasi ini dapat menjadi instrumen untuk membangun paradigma yang mengarah pada pelaksanaan pengadaan barang dan jasa yang akuntabel, sebab melalui fungsi mengaturnya, dapat dibuat indikator-indikator tambahan bagi pengguna barang dan jasa dalam pengambilan keputusan, seperti keharusan adanya sertifikasi anti suap dan penilaian berdasarkan track record kinerja yang selama ini belum diterapkan di Indonesia. Jika pelanggaran pidana dilakukan oleh pengguna atau penyedia barang atau jasa selama proses pengadaan, maka aspek hukum pidana dari pengadaan akan diterapkan. Oleh karena itu penting ada semacam pembangunan paradigma yang mengarah pada pengadaan barang dan jasa yang akuntabel sehingga terhindar dari potensi pelanggaran pidana.Kata Kunci: Hukum Administrasi Negara, Hukum Pidana, Pengadaan Barang dan Jasa

Abstract

In this time, the motives or concept of corruption are increasingly complex and growing, as well as the increasing number of transnational crimes, makes the world need regulations regarding Illicit Enrichment in legal products at the level of law to allow the imposition of legal sanctions for these crimes, including Indonesia. The purpose of this study is to provide an overview of the practice of Illicit Enrichment in several countries in the world and the urgency of its regulation in Indonesia, as well as an analysis of the construction of legal reforms in handling corruption by corporations through the regulation of Illicit Enrichment in the national legal system. From the results of the study, through this regulation related to Illicit Enrichment, it can prevent public officials (corporations) from committing corruption, minimizing initiatives to do business or other activities that are full of conflicts of interest (with their positions). Furthermore, the formulation of the idea of constructing Illicit Enrichment arrangements in this study is divided into three, namely: the formulation of the subject, the formulation of the offense, and the formulation of sanctions and asset confiscation. Through this Illicit Enrichment setting, asset pursuit or tracing can be further maximized. In addition, criminal provisions, especially related to Illicit Enrichment/unexplained wealth are urgently needed and considered urgent because the Anti-Corruption Law has not fully implemented/regulated the provisions of Illicit Enrichment as an independent criminal offense. Illicit Enrichment is applied to the "accused", not from the beginning of the investigation or investigation process (suspect), but only as a reinforcement of existing evidence for corruption crimes committed.
