Abstract

Penanganan perkara pidana yang melibatkan anak memerlukan perlakuan khusus dalam sistem peradilan karena anak merupakan individu yang masih dalam proses pertumbuhan dan perkembangan. Salah satu tindak pidana yang sering menimbulkan perhatian hukum dan sosial adalah tindak pidana persetubuhan yang dilakukan oleh anak. Penelitian ini bertujuan untuk menganalisis kebijakan pemidanaan terhadap anak pelaku persetubuhan dalam sistem peradilan pidana anak. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa kebijakan pemidanaan terhadap anak pelaku tindak pidana harus mengedepankan prinsip perlindungan, pembinaan, serta kepentingan terbaik bagi anak sebagaimana diatur dalam sistem peradilan pidana anak. Penerapan pemidanaan tidak hanya menitikberatkan pada aspek pembalasan, tetapi juga mengutamakan pendekatan keadilan restoratif dan upaya diversi guna menjamin masa depan anak. Oleh karena itu, hakim dituntut mempertimbangkan aspek yuridis, sosiologis, dan psikologis sebelum menjatuhkan sanksi pidana kepada anak pelaku tindak pidana.

Abstract

Illegal logging causes deforestation, disrupts forest ecosystems, and threatens biodiversity, contributing to climate change by reducing carbon absorption. It also leads to soil erosion and other environmental issues. This study examines the measures taken by the Lampung Provincial Forestry Service to combat illegal logging in the Way Waya Protected Forest, Pringsewu Regency, and the challenges faced in these efforts. Using a normative and empirical legal approach, the study collects data through literature review and interviews with investigators from the Forestry Service, the Lampung Regional Police, and academics. The findings reveal that preventive actions, such as community outreach and education, alongside repressive measures like joint operations, patrols, and law enforcement, are in place. However, technical and social challenges hinder their effectiveness, requiring institutional improvements and better inter-agency collaboration. This study highlights the need for stronger partnerships between the government, communities, and relevant agencies to combat forest crimes. The recommendations aim to improve forest management policies and raise public awareness of forest preservation.

Abstract

This study aims to analyze the effectiveness of rehabilitation for narcotics users as a legal right for suspects, focusing on how regulations, implementation, and social factors influence the success of rehabilitation programs. This research uses a qualitative descriptive approach based entirely on secondary data. Sources include laws and regulations such as Law No. 35 of 2009 on Narcotics, government regulations, joint regulations on integrated assessment, court decisions, reports from the National Narcotics Agency (BNN), Ministry of Health publications, and relevant academic literature. Data were analyzed through content analysis and descriptive methods to evaluate policy implementation, program effectiveness, and challenges in rehabilitation practices. The study found that while regulations recognize rehabilitation as a right for narcotics users, implementation is not fully effective. Challenges include limited rehabilitation facilities, lack of professional staff, inconsistent application of integrated assessments, weak coordination between law enforcement and health institutions, and social stigma. These factors result in many users receiving imprisonment instead of rehabilitation, reducing overall program effectiveness. Rehabilitation is normatively guaranteed but not fully realized in practice. Effective rehabilitation requires improvements in facility availability, integrated assessment implementation, post-rehabilitation support, public education to reduce stigma, and stronger coordination between law enforcement and health institutions. This study relies solely on secondary data, limiting direct observation of rehabilitation practices and first-hand insights from stakeholders or users. The study provides insights for policymakers, law enforcement, healthcare providers, and researchers on the implementation gaps and strategies to enhance rehabilitation effectiveness. Abstract

The rapid development of information and communication technology has led to the emergence of various forms of digital-based crimes, including the dissemination of electronic information containing online gambling content through social media. This situation poses challenges for criminal law enforcement, as the parties involved are not limited to gambling operators but also include individuals who promote and facilitate access to online gambling platforms. This study aims to examine criminal liability for perpetrators who disseminate electronic information containing gambling content and to analyze judicial considerations in sentencing, referring to the Decision of the Tanjung Karang District Court Number 823/Pid.Sus/2024/PN Tjk. The method used is normative juridical research with statutory, conceptual, and case approaches. Data were collected through literature studies of relevant regulations, criminal law doctrines, and court decisions, and then analyzed using a descriptive qualitative method. The results show that the elements of criminal liability are fulfilled, including the existence of a criminal act, intent, capacity to be responsible, and the absence of grounds that eliminate criminal liability. Furthermore, the panel of judges’ considerations reflect a balanced assessment between juridical and non-juridical aspects, resulting in a decision that embodies legal certainty, justice, and utility. This study is expected to contribute to the development of criminal law, particularly in addressing online gambling crimes in the digital space.
