Abstract

This study examines the application of civil law principles in resolving unfair dismissal disputes within Indonesian labor courts through a mixed-methods empirical analysis. The research investigates how Indonesian civil law frameworks, particularly those grounded in the Civil Code (Kitab Undang-Undang Hukum Perdata), interact with labor-specific legislation in addressing employment termination disputes . Using a qualitative-quantitative approach, this study analyzes 150 labor court decisions from 2020-2024 and conducts in-depth interviews with 30 legal practitioners, judges, and labor law experts . The findings reveal that civil law principles, especially those relating to contract validity under Article 1320 of the Indonesian Civil Code, play a crucial role in determining the fairness of dismissal procedures . The study identifies significant gaps in the application of civil law remedies, with only 35% of unfair dismissal cases receiving adequate compensation through civil law mechanisms . The research demonstrates that while Indonesian labor courts increasingly rely on civil law principles for dispute resolution, inconsistencies in judicial interpretation and enforcement mechanisms limit their effectiveness . This study contributes to the understanding of how civil law can be better integrated into labor dispute resolution frameworks to enhance worker protection and ensure equitable outcomes in employment termination cases.

Abstract

Kejahatan penyalahgunaan Narkotika merupakan kategori tindak kejahatan yang luar biasa (extraordinary crime), oleh karena itu perlu ditangani secara intensif melalui rehabilitasi. Strategi pemberantasan penyalahgunaan narkotika ini terdapat tiga unsur yang utama antara lain Pencegahan, penindakan dan Program rehabilitasi. Dalam Program rehabilitasi pecandu narkoba di rumah UMMI Medan dilaksanakan mengacu pada Undang- Undang No 35 tahun 2009 tentang Narkotika. Salah satu program dalam merehabilitasi para pecandu Narkoba dengan Regular Light Physical Exercise Program Guna Mendukung Proses Percepatan Penyembuhan Pecandu Narkotika Di Yayasan Rumah Ummi Medan agar stamina kunjung membaik sekaligus untuk membantu proses percepatan penyembuhan pecandu narkotika di Yayasan Rumah Ummi Medan. Program rehabilitasi pecandu narkoba ( resident) di rumah Ummi dilaksanakan melalui tahapan pembinaan dan dilaksanakan dengan fase fase dilihat seberapa parah cara berfikir dan kondisi fisik para pecandu narkoba. Dalam pembinaan terhadap residenttt dilaksanakan melalui fase -fase kepada masing masing individu dan di pantau dari waktu ke waktu melalui perilaku dan cara berfikir masing –masing individu resident sehingga dalam penanganannyapun berbeda. Dengan penerapan olah raga ringan untuk membangun potensi kemampuan cara berfikir para pecandu narkoba dengan sasaran pembinaan untuk mempercepat penyembuhan dan untuk memulihkan cara berfikir yang kacau menjadi normal dengan harapan segera kembali sembuh dan tidak tertarik lagi dengan narkoba.

Abstract

This article examines the role of the Indonesian Islamic mass organization Al Jam’iyatul Washliyah (Al Washliyah) in strengthening local wisdom–based law (kearifan lokal) in the context of rapid cultural modernization and legal centralization in Indonesia. Drawing on a qualitative sociolegal case study, the study explores how Al Washliyah’s educational, da’wa, and social welfare programs contribute to maintaining and transforming customary norms and practices so that they continue to function as living law within communities, while also engaging with the national legal framework. The analysis situates Al Washliyah’s activities within debates on legal pluralism, adat law, and the integration of local wisdom into formal legislation. The findings indicate that Al Washliyah operates as a mediating institution between state law, Islamic law, and local customary law through three main roles: internalizing local values in Islamic education, mediating community disputes and social norms, and advocating for legal recognition of local wisdom. These roles help to reconcile cultural change with normative continuity, although tensions remain regarding formalization, generational shifts, and the commodification of culture

Abstract

Rapid changes in society, the economy, and culture have resulted from the advancement of information and communication technology. Information technology is currently a two-edged sword, because, in addition to improving welfare, progress, and human civilization, it is also an effective means of committing illegal acts. The lack of human resources prepared to use information technology, both intellectually and psychologically, has made the complexity of information technology a tool that is easy to use as a criminal medium, or has influenced the birth of new things in everyday life. The approach method of reviewing the problem studied in terms of legal science and conducting an analysis of the legal norms and regulations that apply in laws and regulations based on primary, secondary, and tertiary legal materials is used in this study. to make conclusions based on the data collected during the study. The occurrence of criminal acts of threats of violence carried out through the electronic system, namely the short message service (SMS), is specifically influenced by psychological and sociological factors, and generally occurs as a result of the perpetrators' lack of legal awareness in social life. If the elements of criminal responsibility are met, criminal responsibility for the perpetrators of these crimes can be sought. The application of the law against perpetrators of criminal acts of threats of violence via short message services (SMS) was found to be in accordance with legal procedures based on trial facts in the study of the decisions examined. The defendant's actions, according to the panel of judges, settled the elements of Article 45 b Amendments to Law No. 11 of 2008 on Information and Electronic Transactions by Law No. 19 of 2016
