Abstract

Artikel ini memfokuskan pada eksistensi fundamentalisme dan juga radikalisme yang ditinjau dari konstruksi diskursus hukum Islam. Wacana ini muncul berdasarkan pada penyimpangan cita idealitas al-Qur’an dan al-Hadist. Oleh karenanya, artikel ini mengurai pola dan karakteristik dari fundamentalisme dan radikalisme yang poros pahamnya berbasis pada kerangka keagamaan.  Dari diskursus ini, penulis mengidentifikasi paham dan gerakan ini akan berpeluang muncul di tengah masyarakat. Artikel ini menyimpulkan bahwa para penganut fundamentalisme dan radikalisme sangat keras di dalam menyampaikan gagasannya. Bahkan mereka tidak segan-segan melakukan tindak kekerasan dalam bentuk anarkistik. Tapi, ia tetap perlu diakui sebagai bagian dari komponen masyarakat yang tidak keluar dari keIslaman. Pada dasarnya, gerakan mereka merupakan bentuk sikap menentang Barat dan modernisme yang dianggap telah melahirkan westernisasi, sekularisasi, hedonisme, pragmatisme, ketidakpastian dan kehampaan hidup.

Abstract

Solat is worship which contains some utterances and action started by recitation of laudation and ended by peace be unto you. Solat is worship demanding concentration and absorbed deeply. Humble before God in Solat can impact to concentration and health mind. If mind is health, all aspect of body will feel health. When Solat, all aspect of healthy will be synergy harmoniously. Solat is related to healthy through eacht solat actions that stimulate nerve system, such as back, armpit, shoulder, arm and leg, thigh and finger leg. If all the nerve cencors is stimulated, it will react to certain organ in the body. In perspective of maqasid al-Syariah this is preventive action to take care of soul, because the purpose of Islamic law is to give commonly useful benefit to soul as the instrument of worship to Allah SWT.

Abstract

The discursus about Islamic law about continuing to see the importance of Al-Ta'ārud occurred because of the inadedience of the mujtaid knowing the will of as-Shari' in knowing the nature of nașș. There is no indeed contradiction in nașș because it means al-ta'ārud weakness, whereas Allah almighty is an omnilime substance and far from the nature of opposition, in addition that the owner of the law is only one god almighty, so there can be no contradiction. If there is, then the opposition is not an insanity opposition. When they came across two contradictory arguments, all the scholars agreed that it was not an insanity opposition. However, if the hel occurs, then it is mandatory for the law to be discussed and sought a solution. In terms of completing al-ta'ārud al-'ām wa al-khāș the scholars of the Hanafi and Shafi'i sects offer many methods or solutions sequentially.

Abstract

The focus of this article is the existence of fundamentalism and radicalism in terms of the discourse construction of Islamic law. This discourse appears based on the possibility of deviating from the ideal ideals contained in the Qur'an and Hadith. This article tries to parse the patterns and characteristics of fundamentalism and radicalism whose axis is based on a religious understanding framework. Based on the search, it was found that, from the existing discourse, it was identified the potential and possibility of this understanding and movement, to emerge in the community. This indicates that there are people who are tough in expressing opinions related to religion, and some have even committed anarchist acts. So it can be concluded that the followers of fundamentalism and radicalism are very strict in conveying their ideas. In fact, they do not hesitate to commit acts of violence in the form of anarchism. However, even so they still have to be recognized as part of the components of society. Because basically, radicalism and fundamentalism movements are a form of attitude against the West and modernism which are considered to have given birth to westernism, secularism, hedonism, pragmatism, uncertainty and the emptiness of life

Abstract

This study aims to determine the construction of leadership in the perspective of maslahah. This is the development of Islamic legal thought, the theory used in this study is theory of maslahat and Sadd az\-z\ari>’ah. data collected by quoting, adapting and analyzing the literature that the relevance of the issues discussed, then all of them were reviewed and concluded. The results show that leadership must have the ability to direct the behavior of others, have certain skills that are not owned by everyone, so as to solve the problems that arise in the life of mankind. Between leaders and those who are led must establish synergic relations between the people and the government in carrying out their responsibilities. Between the two parties there was a synergy and mutual protection. Construction Leaders found several criteria, namely: (a) Principle of Deliberation (b) Justice, Preservation of absolute justice between fellow humans (c) Principle of Equality by treating something no more and no less. (d) The principle of humanity, namely everything worthy for humans to each other (e) Honesty, by proving between his words and deeds (f) Al-amanah, preserving the principle of being responsible both personally and institutionally (g) Al-tablig (openness), open openness to input from the people by absorbing all of his aspirations, (h) Al-fatha> nah (intelligence) intelligence, mastering conditions and insight, want to be under which the nation is. Privileges of a just leader because Fair is the noblest characteristic that determines the policies of a leader and even that raises the image and authority of a leader.

Abstract

Islam sebagai agama wahyu dapat menyelamatkan dan menyejahterakanpenganutnya di dunia dan diakhirat, hubungannya dengan alat kontrasepsi sebagai sebuah alat yang bertujuan untuk tidak terjadi kehamilan saat berhubungan intim. bentuk-bentuk kontrasepsi yakni Pil KB, Suntik KB, Spiral, Kondom, susuk, pada umumnya berfungsi untuk mengendalikan pertumbuhan jumlah penduduk juga menunjukkan jarak waktu yang diperlukan antara kelahiran seorang anak dengan kelahiran berikutnya. Islam menganjurkanpenjarangan kelahiran anak demi kepentingan kesehatan anak yang lebih baik, memulihkan kesehatan ibu agar memperoleh kembali komponen tenaga yang vital, yang telah dikuras selama mengandung dan melahirkan anak, sehingga dapat tumbuh dengan sempurna. keluarga sejahtera memiliki kriteria tertentu antara lain, Dibentuk atas dasar perkawinan yang sah, pasangan suami istri mampu memenuhi kebutuhan hidup material dan spiritual yanglayak. Keluarga berfungsi sebagai fungsi keagamaan, sosial, budaya, cinta kasih, melindungi, reproduksi, sosialisasi, pendidikan, ekonomi dan pembinaan lingkungan.Kata Kunci: Islam, kontrasepsi, keluarga sejahtera

Abstract

This article focuses on the existence of fundamentalism and radicalism in terms of Islamic law's discourse construction. This discourse emerges based on the deviation of the ideals of al-Qur'an and al-Hadith. Hence, this article represents fundamentalism and radicalism's patterns and characteristics, whose axis of understanding is based on a religious framework. From this discourse, the researcher identifies this understanding and movement will have the opportunity to emerge in the community. This article concludes that the adherents of fundamentalism and radicalism are stringent in conveying their ideas. They do not hesitate to commit acts of violence in anarchistic form. Nevertheless, they still need to be recognized as part of a societal component that does not leave Islam. Basically, their movement is a form of attitude against the West and modernism, which is considered to emerge to westernization, secularisation, hedonism, pragmatism, uncertainty, and life's emptiness.

Abstract

Motivasi dari judul adalah karena hukum Islam di Indonesia telah fluks dan refluks sedangkan hukum politik yang diterapkan oleh kekuasaan negara. Selain dari mereka semua, ia berakar dari kekuatan sosial dan budaya berinteraksi dalam pengambilan keputusan kebijakan politik. Salah satu kondisi yang harus diperlukan dalam mentransformasikan nilai syariah dan norma dalam hukum Indonesia berdasarkan Pancasila dan UUD 1945 adalah filosofi dasar / islamic hukum phisosophy hukum Islam mengandung nilai moral dan etika. Diskusi ini adalah transformasi substansi hukum Islam dalam Qanun al-Duali bentuk dan qanun al-Dustu, proses transformasi hukum Islam dalam Qanun al-Duali dan qanun al-Dusturi. Perkembangan hukum Islam di Indonesia memiliki kesempatan yang cerah dalam membangun hukum nasional, socioantropologisly dan emosional hukum Islam sangat dekat dengan masyarakat Indonesia yang sebagian besar dari mereka adalah Muslim. Hukum Islam juga bahan dalam membuat hukum nasional. Secara kuantitatif itu mempengaruhi tatanan sosial-budaya, politik dan hukum dalam masyarakat. Abstract

Gender adalah Suatu konsep kultural yang berupaya membuat pembedaan dalam hal peran, perilaku, dan karakter emosional antara laki-laki dan perempuan yang berkembang dalam masyarakat, hokum Islam tidak ada dikotomi antara laki-laki dan perempuan untuk berkipra karena masing-masing akan dimintai pertanggung jawaban. Wujud wawasan gender dalam Perundang-undangan dapat dilihat dalam kedudukan sebagai istri, Suami sebagai kepala keluarga dan istri sebagai ibu rumah tangga,masing-masing pihak berhak untuk melakukan perbuatan hukum, juga terhadap harta bersama pun istri mempunyai hak yang seimbang dengan suami, hak terhadap anak tetap ada pada suami istri, jika seandainya perkawinannya putus, dalam Proses Perceraian, begitu juga kedudukan wanita dalam hukum kewarisan diharapkan supaya dalam menggali dasar-dasar yang digunakan oleh para ulama dalam menetapkan suatu hukum yang berkaitan dengan gender supaya mengelaborasi antara hokum normative dengan hokum positif utamanya yang terkait perempuan, sehingga perempuan semakin mampu berperan secara lebih dinamis dalam kehidupan bermasyarakat.
