Abstract

Artikel ini membahas tentang pembagian harta warisan pada masyarakat Adat Bugis Bone di Desa Aladadio Kecamatan Aere Kabupaten Kolaka Timur ditinjau dari hukum Islam. Penelitian ini adalah Penelitian kualitatif dengan sumber data, teknik pengumpulan data, observasi, wawancaradandokumentasiyang kemudian diolah dan dianalisis dengan triangulasi tehnik, triangulasi sumber dan triangulasi waktu. Berdasarkan hasil penelitian ditemukan pembagian harta warisan pada masyarakat Adat Bugis Bone di Aladadio dilakukan dengan cara memberikan wewenang langsung kepada keluarga yang dipercayakan selama anak tertua dari anggota ahli waris belum mengetahui proses pembagian harta warisan menurut tradisi Bugis Bone di Desa Aladadio khusunya dan kemudian dibagikan kepada ahli waris lainnya tanpa melalui proses musyawarah terlebih dahulu dengan ahli waris lainnya karena hal ini sudah menjadi tradisi turun temurun yang diberikan oleh tetua-tetua Bugis Bone di Aladadio. Adapun tinjauan hukum Islam terhadap pembagian harta warisan jika di lihat dari maslahatnya sesuai dengan hukum Islam karena tidak menimbulkan mudharat akan tetapi tidak sesuai dengan syariat Islam.

Abstract

This research began with local community complaints that community empowerment did not work effectively and efficiently. The most effective and faster direction for village community empowerment to achieve goals is to involve the community. However, in practice, the allocation of village funds is mostly used for infrastructure development and rarely pays attention to the community empowerment process. There are 3 problem formulations in this study, namely, first how is the form of community empowerment in managing village fund allocations, secondly how is the impact of community empowerment in managing village fund allocations in Lapoa Indah village, third how is the perspective of Islamic law on community empowerment in managing village fund allocations. The purpose of the study was to answer the formulation of the problem in this study.This type of research is qualitative, namely research on descriptive research and tends to use analysis, with an empirical normative approach with primary and secondary data sources. This study uses data collection techniques, observation, interviews, and documentation. The data analysis is an activity in research in the form of conducting a study or review of the results of data management assisted by the theories obtained previously.The results of this study illustrate that the ongoing form of community empowerment is empowering farmer groups in the form of providing nutmeg and coffee seeds, providing fertilizer and agricultural tools, namely tractors or dompeng, empowering PKK women in the form of renting catering equipment, and empowering al-qur' education parks. an for children. Meanwhile, the resulting impacts are positive and negative impacts. The positive impact of good community participation is the granting of land for the construction of farm roads, increasing agricultural yields. While the negative impacts are the lack of openness or transparency of the government and the lack of potential human resources. There are Islamic legal perspectives that are appropriate and some are not, which is in accordance with the empowerment of PKK mothers, and the empowerment of the Qur'an education park. Meanwhile, what is not appropriate is due to the lack of transparency of the village government and the lack of potential human resources.

Abstract

Penelitian ini menelaah proses pembentukan dan implementasi Peraturan Desa (Perdes) Nomor 02 Tahun 2023 tentang APBDesa di Desa Bontolanra, Kabupaten Takalar, melalui perspektif Siyasah Syar’iyyah. Tujuannya adalah untuk menganalisis tahapan pembentukan, realisasi di lapangan, serta tinjauan kesesuaiannya dengan prinsip pemerintahan Islam. Penelitian menggunakan metode kualitatif dengan pendekatan yuridis normatif dan empiris melalui wawancara mendalam dan analisis dokumen. Hasil penelitian mengungkap bahwa proses pembentukan perdes berlangsung secara musyawarah dan transparan. Implementasinya berfokus pada empat bidang utama, yaitu infrastruktur, program non-fisik, sarana prasarana, serta peningkatan kapasitas warga, yang didukung oleh kolaborasi efektif antara pemerintah desa dan BPD. Dari sudut pandang Siyasah Syar’iyyah, seluruh tahapan tersebut telah memenuhi prinsip mendasar seperti keadilan, transparansi, kemaslahatan, dan musyawarah. Implikasi penelitian ini menegaskan pentingnya model pengelolaan keuangan desa yang partisipatif dan berlandaskan nilai etika Islam sebagai kerangka untuk mewujudkan tata kelola yang akuntabel dan berkelanjutan. Temuan ini merekomendasikan penguatan kapasitas kelembagaan desa serta harmonisasi kebijakan di berbagai tingkat pemerintahan agar prinsip-prinsip serupa dapat diadopsi secara lebih luas.

Abstract

This research aims to describe the implementation of Presidential Regulation (PP) no. 72 of 2021 concerning the Acceleration of Reducing Stunting from Siyasah Dusturiyah Perspective (Study of the Wajo District Health Service). In answering this problem, the author uses a normative syar'i approach and an empirical juridical approach. The data collection methods were carried out by means of interviews, observation, documentation and literature study. The research results show that the implementation of Presidential Regulation (PP) no. 72 of 2021 concerning the Acceleration of Reducing Stunting in Wajo Regency has been going well where the Wajo district health office continues to strive to implement the program to accelerate stunting reduction. They distribute blood supplement tablets, get immunizations, get additional food, provide breast milk until the age of 24 months, get worm medicine , providing complete basic immunization to children, fulfilling nutritional needs since pregnancy, 1000 HPK, fostering exclusive breastfeeding for 0-6 months and healthy environmental sanitation. Siyasah Dusturiyah's Views on the Implementation of Presidential Regulation (PP) no. 72 of 2021 concerning the Acceleration of Stunting Reduction, in essence it does not conflict with the principles of Siyasah Dusturiyah. In essence, it is intended to enforce regulations for the benefit of its people from the regulations and policies made by its leaders. Of course, effective provisions are needed to regulate their respective duties.
