Abstract

This thesis discusses "Implications of Waqf on Community Welfare at Modern Islamic Boarding School Ittihadul Ummah Gontor 11 Poso, Central Sulawesi, Maslahah Mursalah Perspective". With this research, it can provide a clearer understanding of the implications of waqf in the welfare of the people in Pondok Modern Ittihadul Ummah Gontor 11 Poso. This research was conducted by descriptive qualitative field research. Descriptive Qualitative Research Field. With a syar'i approach and an empirical juridical approach. The sources of data in this study, namely: Primary data, secondary data and searches of various literatures or references. Data collection methods used are observation, interviews, and documentation. Data processing and analysis techniques are carried out through three stages, namely: data identification, data reduction, and data editing. The results of this study indicate that the impact of the benefit of waqf from business units whose profits can later be useful for the development of the sectors in the cottage both from the operational side of the cottage, the needs of the cottage that are monthly operational can be in the cafer with the benefits of the waqf unit - business units in the cottage, so that the sustainability of life in the cottage does not depend on monthly payments from the students but from existing business units. 2. The forms of benefit of waqf on the welfare of the community are certainly very influential on the survival of the cottage, one of which is the workers in the cottage from outside communities such as construction workers, kitchen workers, and so on, all of which are based on waqf-waqf funding. This business unit is not only for the students but can also be enjoyed by the community, so that the community feels helped by the existence of these Pondok business units. The implications of this research are: With the implications of waqf on the welfare of the community at Pondok Modern Ittihadul Ummah Gontor 11 Poso in the perspective of maslahah mursalah we can find out the impact and forms of benefit of waqf, especially in business units in Pondok Modern Ittihadul Ummah Gontor 11 Poso This research is expected to have an impact on increasing the cottage community and the community outside the cottage with the existence of business units. Abstract

Artikel ini mengkaji tentang jual beli online menggunakan sistem dropshipping dalam perspektif hukum Islam dan undang-undang informasi dan transaksi elektronik. Jenis penelitian yang digunakan penulis dalam penelitian ini adalah studi kepustakaan yang berisi uraian tentang teori, temuan dan bahan penelitian yang diperoleh dari bahan acuan untuk dijadikan landasan kegiatan penelitian. Hasil penelitian ini menunjukkan adanya perbedaan pendapat antara hukum Islam dan undang-undang informasi dan transaksi elektronik mengenai jual beli online menggunakan sistem dropshipping. Berdasarkan dari pandangan hukum Islam memiliki perbedaan pendapat tentang hal ini. sedangkan ndang-undang informasi dan transaksi elektronik mengenai jual beli online menggunakan sistem dropshipping tidak ada larangan untuk menggunakan transaksai online dengan menggunakan sistem dropshipping, yang terpenting adalah seorang pelaku usaha yang menawarkan suatu produk melalui sistem elektronik harus menyediakan informasi yang jelas dan benar terkait informasi barang yang diperjualbelikan.

Abstract

Pokok masalah penilitian ini adalah bagaimana perbandingan hukum islam dan hukum adat terhadap tradisi tolak bala mappande sasi yang ada di Lingkungan Tamo Kec. Banggae Timur Kab. Majene. Jenis penilitian tergolong kualitatif dengan pendekatan prime dan sekunder. Hasil penelitian ini menunjukkan bahwa: 1) Tradisi mappande sasi digelar setiah tahunnya dimana masyarakat nelayan tamo pulang dari perantauan setelah berbulan-bulan. Dalam Prosesnya, Prosesi acara mappande sasi diawali dengan pembacaan doa yang dipimpin oleh Imam untuk meminta keselamatan dan rezeki yang berlimpah. Pelaksanaan ritual pertama, yaitu mempersiapkan sesajen dan di bawah kelaut menggunakan perahu yg di persembahkan bagi mahluk goib; 2) Adapun beberapa pandangan dari masyarakat tamo memili pandangan yang berbeda beda dimana masyarakat berpendapat bahwa tradisi tersebut bertentangan dengan syariat islam namun, masih ada sebagian masyarakat mempercayai bahwa mereka tidak bisa meninggalkan kebiasan-kebiasaan yang ada sejak dari nenek moyang mereka; 3) Berdasarkan perbandingan hukum islam dan hukum adat bahwa tradisi tersebut sangat erat kaitannya dengan nenek moyang mereka.sedangkan dalalam hukum islam sebagai bentuk rasa syukur atas reski yang telah di berikan. Implikasi dari hasil penelitian ini adalah: 1. Agar masyarakat lingkungan Tamo Kecamatan Banggae Timur Kabupaten Majene yang masih menjaga nilai leluhur dan kesakralan dari tradisi mappande sasi agar kemudian dipertahankan atau dilestarikan yang positif dan berangsur-angsur mengganti yang negatif yang tidak menyimpang dari ajaran Islam 2. Tradisi Mappande Sasi yang dilaksanakan masyarakat daerah Tamo tidak patut dinilai musyrik karena sebagian besar masyarakat setempat berangsur-angsur telah mengubah tujuan dari tradisi tersebut sebagai bentuk rasa syukur atas rezeki yang telah diberikan oleh Allah Swt.

Abstract

This research discusses how the perception of students in religious moderation and its relevance to the concept of wasatha (Case Study of Comparative Schools and Law Students at UIN Alauddin Makassar). This type of research is classified as qualitative with a social approach. The data sources for this research are primary and secondary data. The results of this study indicate that: 1) Religious moderation is a bridge for people to respect each other in a life that is colored by differences. Religious moderation is not a way to create a new understanding for the most correct, the presence of religious moderation in the midst of diversity is a way that needs to be implemented at the campus world level. 2) Students of Comparative School and Law slowly accept differences in the campus environment for the sake of mutual harmony. With this, slowly the aspiration of the Chancellor of UIN Alauddin Makassar is realized, although a small portion still does not act wasatha but this is not seen in the campus environment, what is seen is the majority of students who act wasatha and understand the meaning of religious moderation. 3) The implementation of student attitudes tends to implement the values of religious moderation through behavior and attitudes by respecting each other and impartially so that there is no impartial treatment. The attitude of students is also silent with a sign of respect for people to look for sources of understanding so that they do not immediately follow and indirectly justify that the understanding is correct and must be followed. PTKIN has a duty to instill the value of moderation in its students in order to form a tolerant character.

Abstract

The purpose of this study is to find out the views of the al-Shafi'i school and the Hanafi school about the phenomenon of fasakh nikah on the grounds that the husband is poor in the contemporary era. This research uses a qualitative type of research, with data collection using library research methods, the approach method used is normative by examining the Qur'an and Hadith as the basis of Islamic law, primary data sources in the form of the Qur'an and Hadith while secondary data sources in the form of books, journals, and other scientific papers. The results showed that marriage on the grounds of the husband in the contemporary era according to the views of the al-Shafi'i school and the Hanafi school is first according to the al-Shafi'i school saying that if the husband is in a state of incapacity or in a poor state that cannot provide for his wife in the form of food, clothing, and shelter then the wife can and is allowed to file for divorce through a judge (fasakh). Secondly, according to Hanafi, when a husband is unable to provide a living, the wife is not allowed to use the right of fasakh to sue her husband for divorce. A husband who is unable to provide for his wife may be due to two things, first: because he is reluctant or unwilling to take responsibility as a husband even though he is able, second: the condition of the husband is indeed in a poor state so that the husband has not been able to provide for his wife. Imam Hanafi reasoned that the wife was not allowed to claim her rights (fasakh) because the husband's obligation was only to provide according to his ability, the husband was still given the opportunity to earn a living so that he could return to meet his wife's bread.

Abstract

Kuli bangunan seringkali tetap bekerja meskipun pada bulan ramadan, namun yang menjadi masalah adalah apakah kuli bangunan mendapatkan dispensasi puasa (Rukhsah) pada bulan ramadan. Adapun yang menjadi masalah dalam penelitian ini adalah bagaimana hukum menjalankan puasa bagi kuli bangunan yang bekerja selama puasa Ramadan namun mendapatkan kesulitan selama menjalankan keduanya dalam Perpektif Ulama Madzhab. Jenis penelitian yang digunakan adalah library research atau kajian pustaka. Penelitian ini menggunakan metode penelitian kualitatif yang bersifat deskriptif, menggunakan dua sumber data yakni data primer dan data sekunder dimana data primer diambil dari kitab suci Al-Qur'an dan hadis. Dari hasil penelitian ini menunjukkan bahwa kuli bangunan yang dimaksud dalam penelitian ini harus tetap menajalankan ibada puasa Ramadan. Mengenai hukum rukhsah ibadah puasa Ramadan bagi kuli bangunan ada dua. Pertama, kuli bangunan tidak boleh (haram) mengambil rukhsah apabila tidak mendapatkan kesulitan selama melaksanakan pekerjaannya apabila tidak dirasakan masyaqqah (kesulitan). Kedua, para kuli bangunan dapat mengambil (mubah) rukhsah yang diberikan apabila ternyata selama melaksanakan pekerjaannya tiba pada waktu siang hari pekerja bangunan tidak dapat menahan lagi haus dan lapar yang bahkan saat itu sudah dikhawatirkan dapat mengancam jiwa dan kesehatannya apabila tidak membatalkan puasanya. Pelaksanaan rukhsah ini hanya dapat dilakukan jika memang telah sampai pada dikhawatirkannya jiwa dan keselamatan pekerja apabila masih melanjutkan puasa dalam bekerja bahkan hukumnya akan menjadi wajib dalam keadaan tertentu.

Abstract

The Mansai tradition is the custom of collecting material assistance before the wedding to lighten the burden on the prospective groom. This procession becomes a problem whether it is in harmony with the Prophet's orders. This study is qualitative research using the approach of living traditions and anthropology of Islamic law. Living sunnah is used to analyze the concept of hadith that lives in the Banggai community, while the anthropology of Islamic law analyzes the practice of mansai which is a tradition in marriage. Data was collected by gathering information through in-depth interviews and literature studies. The field findings were then analyzed using the perspective of living sunnah and integrated with the customs of the people of the Banggai Tribe, Central Sulawesi. The selected hadiths are those that have been validated for the quality of their sanad and matan. This study found that the mansai tradition means that the prospective groom invites his family and community to bear the funds or assets as wedding expenses which will be handed over to the woman (mangantokon sai). Mansai as a custom has become a habit in accordance with Islamic law and has become a living sunnah. The main message in the Mansai tradition is to help each other and ease the burden on Muslim brothers and sisters in the process of marriage (banikah) in the Banggai Tribe community. Anthropologically, mansai as a tradition that has been accepted by the Banggai people for a long time, functions as a unifying medium, maintains the practice of deliberation and overcomes social problems.

Abstract

The insignificance of modern reality to the Prophet Muhammad [pbuh]’s statements and policies determines hadith misperception. This research examines the Prophet Muhammad [pbuh]’s assurance that Madinah was sterile from the ṭā‘ūn as a pandemic, even though Madinah was also infected with Covid-19. This study used a qualitative design utilizing library data based on al-Kutub al-Tis‘ah.  The takhrij al-ḥadīṡ technique was used to track down the data that analyzed using an integrative technique developed by Ma‘ānī al-Ḥadīṡ and Maqāṣid al-Syarī‘ah. The findings revealed that the Prophet’s declaration about Madinah’s sterility due to the disease was part of his strategy for preserving the socio-political stability of Muslims who were pioneering a new civilization. Ḥifẓ al-daulah is a notion in Maqāṣid al-Syarī‘ah, it must be taken into consideration when attempting to determine the maqāṣid of each message and the Prophet. It can dispel the perception that the Prophet Muhammad’s hadith is irrelevant to the reality of modern life.ملخصإن عدم أهمية الواقع الحديث لأقوال الرسول صلى الله عليه وسلم وسياساته يحفز على سوء فهم الحديث. يفحص هذا البحث تأكيد النبي أن المدينة المنورة كانت عقيمة منذ ظهورها على أنها جائحة، على الرغم من إصابة المدينة المنورة أيضًا بـ Covid-19. استخدمت هذه الدراسة تصميمًا نوعيًا باستخدام بيانات المكتبة بناءً على الكتب التسعة. تستخدم تقنية تخريج الحديث لتعقب البيانات ثم تحليلها بتكاملية طورها علم معاني الحديث ومقاصد الشريعة. وكشفت النتائج أن إعلان الرسول صلى الله عليه وسلم عن عقم المدينة المنورة بسبب المرض هو جزء من استراتيجيته للحفاظ على الاستقرار الاجتماعي والسياسي للمسلمين الذين يقودون حضارة جديدة. حفظ الدولة كمقاصد الشريعة الذي يجب أن يؤخذ في الاعتبار عند محاولة تحديد مقاصد كل رسالة النبي. يمكن أن تبدد الفكرة القائلة بأن أحاديث النبي لا علاقة له بواقع الحياة الحديثة.

Abstract

Muhammad Nāṣir al-Dīn al-Albānī is one of the most controversial contemporary hadith scholars of this century. He has attracted many researchers to explore his life and works. This study aims to examine more deeply the methodology in determining the level of the dhaif of hadith (Study of the book of Irwā' al-Galīl fī Takhrīj Aḥādīṡ Manār al-Sabīl). Classifying the assessment of the quality of al-Albānī hadith in the book of Irwā al-Galīl fī Manār al-Sabīl. This research is qualitative in the form of literature (library research). Second, as for the classification of hadith in Irwā' al-Galīl fī Takhrīj Aḥādīṡ Manār al-Sabīl there are 5 types of groups including 1) types of validity; 2) type of Hasan; 3) type of dhaif; 4) type of maudhu'; 5) the type of hadith that has no status or certainty. As for the types of hadith validity, there are 26 kinds of assessments where the total number of hadiths is 1726. There are 6 types of hasan assessment with 205 the number of hadith as many as 174 hadith. There are 26 types of ta'afan assessments with a total of 501 hadiths. Maudhu' types are 3 types of assessment terms with a total of 14 hadiths, while the types of hadiths that do not have certainty or status are 163 hadiths. الملخص يعتبر محمد ناصر الدين الألباني من أكثر علماء الحديث المعاصرين إثارة للجدل في هذا القرن. لقد استقطب العديد من الباحثين لاستكشاف حياته وأعماله. تهدف هذه الدراسة إلى التعمق في المنهجية في تحديد مستوى ضيف الحديث (دراسة كتاب إرواء الغليل في تخريج آحاديث منار السبيل). - تصنيف تقييم صفة حديث الألباني في كتاب إرواء الغليل في منار السبل. هذا البحث نوعي في شكل مؤلفات (بحث مكتبة). ثانياً: بالنسبة لتصنيف الحديث في إرواء الغليل في تخريج آحاديث منار السبل ، هناك 5 أنواع من المجموعات ، منها 1) أنواع صدق. 2) نوع الحسن. 3) نوع الضيف. 4) نوع المودة. 5) نوع الحديث الذي ليس له صفة أو يقين. أما بالنسبة لأنواع الأحاديث النبوية ، فهناك 26 نوعًا من التقويمات حيث يبلغ إجمالي عدد الأحاديث 1726. وهناك 6 أنواع من الأحاديث النبوية ، وعددها 205 أحاديث يصل عددها إلى 174 حديثًا. يوجد 26 نوعًا من تقييمات التعافين بإجمالي 501 حديثًا. أنواع المودة هي ثلاثة أنواع من مصطلحات التقييم بإجمالي 14 حديثًا ، في حين أن أنواع الأحاديث التي ليس لها يقين أو حالة هي 163 حديثًا.

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui bagaimana pandangan syariat terkait dengan praktek outsourcing dan bagaimana prinsip-prinsip ijarah diterapkan dalam praktek outsourcing. Dengan menggunakan metode library research  dan metode takhrij al hadits ditemukan bahwa praktek outsourcing tidak melanggar syariat sepanjang terpenuhi manfaat dan kebaikan bagi semua pihak yaitu tenaga kerja outsourcing, perusahaan outsourcing, dan perusahaan pengguna. Berdasarkan hasil pelacakan hadits ditemukan bahwa prinsip kesepakatan, keadilan, manfaat, tanggung jawab, keseimbangan, dan amanah menjadi dasar yang positif dalam menjalankan muamalah outsourcing untuk menciptakan keharmonisan dalam kondisi perbedaan kepentingan.
