Abstract

Penelitian ini membahas implementasi perlindungan hukum terhadap pekerja anak di bawah umur dalam praktik ketenagakerjaan di Indonesia. Meskipun berbagai regulasi, seperti Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Undang-Undang Perlindungan Anak, telah mengatur batas usia minimum bekerja serta kewajiban perlindungan khusus bagi anak, fakta di lapangan menunjukkan masih adanya pelanggaran. Penelitian ini bertujuan untuk mengkaji bagaimana aturan tersebut diterapkan, hambatan yang muncul dalam pelaksanaannya, serta sejauh mana mekanisme pengawasan dan penegakan hukum berjalan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan didukung data empiris dari berbagai laporan dan temuan lapangan. Hasil penelitian menunjukkan bahwa implementasi perlindungan hukum belum optimal akibat lemahnya pengawasan, faktor ekonomi keluarga, serta tingginya aktivitas pekerjaan informal yang tidak terpantau negara. Penelitian ini merekomendasikan penguatan regulasi turunan, peningkatan kapasitas pengawas ketenagakerjaan, serta perluasan program sosial bagi keluarga rentan.

Abstract

This community service activity aims to increase the understanding and capacity of workers, especially Micro, Small, and Medium Enterprises (MSMEs) related to credit and banking guarantee practices from a normative and economic perspective, as well as their relevance to increasing workers' income in North Sumatra. The problems faced by partners include low legal and economic literacy in banking, limited understanding of credit guarantee mechanisms, and lack of optimal use of productive financing. The service methods used include educational and socialization activities through material presentations, interactive discussions, and evaluation of participants' understanding using pre-test and post-test. The material provided includes banking credit regulations, types of credit guarantees such as dependents and fiduciary guarantees, as well as strategies for the use of productive credit to increase income. The results of the activity showed an increase in participants' understanding of the normative aspects of credit and banking guarantees, as well as increased awareness in choosing and managing credit in a more productive and sustainable manner. This activity makes a practical contribution in the form of strengthening financial literacy and banking laws which is expected to encourage an increase in workers' income in an inclusive manner in North Sumatra.

Abstract

This study focuses on how the law protects contract workers based on the provisions of Law No. 13 of 2003 concerning Manpower. Using a normative approach based on legislation and conceptual methods, this study draws on secondary data such as Law No. 13 of 2003, Government Regulation No. 35 of 2021, legal references, and scientific works. The findings indicate that labor regulations in Indonesia provide fairly comprehensive protection for PKWT workers, including BPJS membership, the right to fair wages, occupational health and safety, and freedom of association. However, there is a clear discrepancy between the legal norm (das sollen) and its implementation (das sein). The main challenges that arise include diverse interpretations of the term “de jure” so that changes in employment status do not proceed as they should, unclear responsibilities in the outsourcing system, weak labor supervision due to limited resources and low compliance among business actors, and low legal understanding and access to justice for workers. Although the available regulations are quite comprehensive, the effectiveness of protection for PKWT workers is still not optimal, requiring significant improvements both normatively and institutionally, particularly regarding the consistency of law enforcement, increasing the capacity of supervisors, improving mechanisms for handling violations, and strengthening legal education for workers.

Abstract

Penelitian ini membahas pentingnya kepatuhan bank syariah terhadap regulasi hukum ketenagakerjaan sebagai bagian dari penerapan prinsip keadilan dan nilai-nilai syariah dalam pengelolaan sumber daya manusia. Bank syariah tidak hanya berfungsi sebagai lembaga intermediasi keuangan, tetapi juga sebagai institusi yang membawa tanggung jawab moral dan sosial. Oleh karena itu, kepatuhan terhadap regulasi ketenagakerjaan dipandang sebagai fondasi untuk menjaga keseimbangan antara kepentingan organisasi dan perlindungan hak tenaga kerja. Penelitian ini meninjau kerangka regulasi yang berlaku di Indonesia, termasuk keterkaitannya dengan prinsip maqashid syariah, serta menganalisis tantangan implementasi yang muncul dalam praktik operasional. Fokus kajian juga mencakup peran manajemen, unit kepatuhan, dan mekanisme pengawasan internal dalam memastikan penerapan regulasi secara konsisten. Selain itu, penelitian ini mengevaluasi tingkat kepatuhan, mengidentifikasi dampak ketidakpatuhan terhadap stabilitas organisasi, serta merumuskan strategi peningkatan kepatuhan sebagai langkah preventif dan korektif. Ketidakpatuhan berpotensi menimbulkan konflik industrial, menurunkan kepercayaan karyawan, serta merusak legitimasi sosial bank syariah. Sebaliknya, kepatuhan yang kuat mendorong terciptanya budaya kerja yang adil, transparan, dan berkelanjutan. Hasil penelitian menunjukkan bahwa kepatuhan terhadap regulasi ketenagakerjaan bukan hanya kewajiban administratif, melainkan bagian integral dari praktik etis yang memperkuat kepercayaan publik, loyalitas karyawan, dan citra bank syariah sebagai lembaga keuangan berbasis prinsip keadilan dan kemaslahatan. Dengan demikian, penguatan sistem pengawasan dan komitmen manajerial menjadi kunci keberlanjutan industri perbankan syariah.

Abstract

This study aims to analyze the synchronization of the national legal framework in the field of labor by examining the alignment between the Manpower Act, the Job Creation Act, and their implementing regulations. The introduction of the omnibus law brought substantial changes to labor governance, particularly regarding employment relationships, wage systems, contract flexibility, and worker protection. However, these reforms have not been fully accompanied by adequate harmonization at the level of implementing rules, resulting in inconsistencies and potential legal uncertainty. This research employs a normative legal method with statutory and comparative approaches to identify points of divergence, normative conflicts, and their implications for regulatory implementation. The findings indicate that although the Job Creation Act aims to improve regulatory efficiency and the investment climate, significant gapsremain between the primary legislation and its derivative regulations, especially in terms of worker protection and policy coherence. These results highlight the need for strengthened harmonization through regulatory evaluation, refinement of implementing rules, and alignment of legal norms to ensure a balanced relationship between economic flexibility and labor protection. The study contributes theoretically by mapping regulatory disharmony and offering analytical foundations for policymakers in shaping future labor law reforms in Indonesia.

Abstract

Occupational Safety and Health (OSH) constitutes a fundamental workers’ right that must be guaranteed by theState as part of its human rights obligations. Within the employment relationship, the State bears a constitutional duty to ensure safe, healthy, and dignified working conditions. This article examines State responsibility for OSH protection under Indonesian labour law. It aims to identify the normative basis and forms of State responsibility, evaluate the effectiveness of the regulatory framework, and assess the implementation of OSH standards across employment sectors. The research adopts a normative juridical method, employing statutory and conceptual approaches, with data derived from legislation and scholarly literature published within the last decade. The study finds that although Indonesia has established OSH obligations through various legislative instruments, enforcement remains suboptimal, particularly in the informal sector, small and medium enterprises, and regions with limited supervisory capacity. Insufficient labour inspection mechanisms and the limited number of labour inspectors contribute to recurrent non-compliance with statutory OSH standards. The article concludes that State responsibility in ensuring effective OSH protection requires regulatory reinforcement, strengthened supervisory institutions, and enhanced inter-agency coordination to secure comprehensive labour protection.
