Abstract

Mudahnya penyebaran informasi elektronik di masyarakat melalui teknologi informasi membawa pengaruh besar pada peradaban masyarakat di Indonesia. Era digitalisasi yang saat ini berlangsung memungkinkan terjadinya pergeseran perilaku di masyarakat. Penyebaran Informasi di masyarakat sering diselipi dengan Hoax yang diartikan sebagai berita bohong. Masyarakat Indonesia perlu dibekali dengan literasi digital yang baik dan mumpuni terkhusus bagi masyarakat desa yang rentan terkena Hoax. Keterbukaan informasi di media sosial ini tidak diimbangi dengan kecerdasan bermedia untuk menganalisis data dan konten yang ada sehingga berakibat misinformasi. Oleh karena itu, diperlukan literasi digital di masyarakat guna mengedukasi masyarakat dalam memanfaatkan teknologi dan komunikasi dengan menggunakan teknologi digital dan alat-alat komunikasi atau jaringan untuk menemukan, mengevaluasi, menggunakan, mengelola, dan membuat informasi secara bijak dan kreatif. Tim Pengabdian akan membuat sebuah edukasi yang dinamakan DETIX “Desa Anti HOAX” untuk meningkatkan tingkat literasi digital masyarakat desa dengan sasaran masyarakat di Desa Welahan, Kecamatan Welahan, Kabupaten Jepara. Hal ini disebabkan masyarakat desa merupakan salah satu akar peradaban Indonesia sehingga penting untuk diberikan bekal literasi digital dan perwujudan DETIX “Desa Anti HOAX” sebagai salah satu bagian dalam Pembagunan Desa.

Abstract

ABSTRACTThe presence of Peer to Peer Lending Based on Financial Technology (Fintech) in Indonesia is a real manifestation of a technological advancement. The advantage of technology is its simplicity, but like two sides of a coin, technological advances in financial services also cause polemics and problems. Based on complaints received by the Financial Services Authority, there are 2 things that are often complained about by borrower, it is regarding the unwise use of private data that is used as a way of collecting debt by peer to peer providers and the way they contact borrower for collecting debt. Even though it is considered controversial, the growth of fintech service providers has accelerated to 200%. These are show the urgency that the Financial Services Authority Regulation No.77/POJK.01/2016 requires revision because it is not in suitable with the current development of Fintech. The Financial Services Authority Regulation No.77/ POJK.01/2016 requires revisions regarding the restrictions on access on borrower’s device, it must be only camera, microphone, and location only, no access to contact or gallery, then related to more detailed in regulating the operations of the fintech provider company, and related regulation for the minimum capital for the fintech provider company.Keywords: Peer to Peer; Lending; Fintech; Borrower ABSTRAKHadirnya Peer to Peer Lending Berbasis Financial Technology (Fintech) di Indonesia adalah manifestasi nyata dari sebuah kemajuan teknologi. Keunggulan dari suatu teknologi adalah kemudahannya, namun ibarat 2 sisi mata uang, kemajuan teknologi dibidang jasa keuangan ini juga menimbulkan polemik serta permasalahannya. Berdasarkan pengaduan yang diterima Otoritas Jasa Keuangan terdapat 2 hal yang sering diadukan oleh peminjam, yaitu perihal penggunaan data pribadi peminjam secara tidak bijak dan cara penagihan hutang oleh perusahaan penyedia layanan yang dinilai tidak sesuai ketentuan yang berlaku. Walaupun dinilai kontroversial, namun pertumbuhan perusahaan penyedia layanan fintek melaju sangat pesat sampai 200%. Beberapa hal ini menunjukan urgensi bahwa peraturan otoritas jasa keuangan No.77/POJK.01/2016 memerlukan revisi karena sudah tidak sesuai dengan perkembangan Fintek sekarang ini. Peraturan Otoritas Jasa Keuangan No.77/POJK.01/2016 memerlukan revisi terkait pembatasan akses perusahaan penyedia layanan terhadap gawai dari peminjam, yaitu hanya kamera, mikrofon, dan lokasi saja, tidak ada akses ke kontak maupun galeri, selanjutnya terkait pengaturan yang lebih detail terhadap operasional perusahaan penyedia layanan, dan pengaturan terkait minimum modal bagi perusahaan penyedia layanan.Kata Kunci: peer to peer; lending; fintek; pinjaman

Abstract

Kehadiran teknologi kini merambah segala bidang kehidupan, termasuk dunia investasi di Indonesia. Perkembangan Platform Investasi Digital di masyarakat saat ini menjadi perhatian banyak pihak. POJK No. 13/POJK.02/2018 sebagai Landasan hukum platform investasi digital ini mengatur tentang inovasi keuangan digital di sektor jasa keuangan. Pertumbuhan transaksi uang melalui Internet telah membawa serta perkembangan di bidang pembayaran digital. Berdasarkan POJK tersebut Inovasi Keuangan Digital di Sektor Jasa Keuangan, Inovasi Keuangan Digital (IKD) merupakan kegiatan pengembangan proses bisnis, model bisnis, dan perangkat keuangan yang membawa nilai baru bagi sektor jasa keuangan ke dalam ekosistem digital. Layanan keuangan digital merupakan aktivitas pembayaran yang tidak hanya tervatas pada keberadaan kantor fisik saja, tetapi juga layanan sistem keuangan yang dilakukan melalui penggunaan sarana teknis, termasuk layanan (agen) seluler atau berbasis web pihak ketiga, dan ditujukan kepada publik dengan sedikit atau tanpa mengakses layanan pengaturan rekening Bank. Perkembangan Teknologi berperan penting dalam mendukung layanan keuangan yang lebih cepat, murah, sederhana dan komprehensif untuk menjangkau daerah-daerah terpencil, sehingga mengurangi kesenjangan ekonomi yang lebar antar daerah. Adanya teknologi lain juga mendukung terciptanya layanan keuangan yang lebih efisien dan sesuai dengan kebutuhan masyarakat. Peran jasa keuangan dengan biaya operasional rendah dan skala kecil sangat cocok untuk melayani segmen mikro, UKM, dan menengah. Fenomena tersebut mendorong Tim Pengabdian Kepada Masyarakat mengadakan pelatihan untuk meningkatkan keterampilan mediasi digital santri di Pondok Pesantren Asshodiqiyah Kota Semarang. Santri sangat tertarik untuk menimba ilmu di bidang investasi digital karena ilmu ini sangat penting dan berguna bagi mereka di era digital sekarang ini.

Abstract

Ensuring the halal status of a product involves utilizing the services of a halal certification body, offering legal protection and confidence in halal product assurance for Muslim consumers. Indonesia is currently in the process of transitioning the certification authority from the non-governmental organization MUI to the government agency BPJPH under the Ministry of Religious Affairs. The halal certification mechanism through BPJPH closely aligns with the established process carried out by MUI. Similarly, Turkey has established the Halal Accreditation Authority (HAK) to guarantee the legal certainty of halal products, providing accreditation services for halal conformity assessment agencies. This study uses a descriptive method with a comparative approach. Focuses on positive legal nor governing the implementation of halal product between Halal Prodyct Assurance  (JPH) and Halal Accreditation Authority (HAK).  The findings reveal that in order to implement the Halal Product Assurance (JPH) system, the Indonesian government established the Halal Product Assurance Organizing Agency (BPJPH). The establishment of a globally recognized halal certification system and the removal of trade barriers in halal goods and services require the effective execution of responsibilities, as demonstrated by Turkey through the activities of the Halal Accreditation Authority (HAK). Turkey's strategy for ensuring the genuineness of halal products involves the Halal Accreditation Authority, tasked with evaluating, accrediting, and supervising the competence of halal conformity assessment bodies. This procedural framework aligns with both national regulations and international standards, incorporating additional technical regulations specified in the accreditation body's implementation documents.

Abstract

Regulation of the Minister of State Apparatus Empowerment and Bureaucratic Reform Number 25 of 2020, which underlines the 2020-2024 Bureaucratic Reform Road Map, guides the government's efforts to realize world-class government. The goal of bureaucratic reform is to achieve three main conditions: a clean and accountable bureaucracy, a capable bureaucracy, and optimal public services. The Faculty of Law at Universitas Negeri Semarang(UNNES) is one of the units committed to achieving high standards of integrity. This requires structuring good governance, optimal public services, and high integrity for all human resources at the Faculty of Law. Therefore, this study aims to examine the readiness of the Faculty of Law in building Integrity Zones, especially in achieving Free from Corruption Areas (WBK) and Clean and Serving Bureaucratic Areas (WBBM). This research uses doctrinal or normative research methods with concept and case approaches. Legal materials are collected through the study of documents and presented systematically following legal issues and research problems. Then it is analyzed qualitatively juridically. The results of the study identify strategies used by the Faculty of Law to build Integrity Zones towards WBK and WBBM. In addition, this study also identifies the strengths and weaknesses of the Faculty of Law in achieving these goals. This in-depth understanding of the readiness of the Faculty of Law in bureaucratic reform is expected to guide improving bureaucratic performance and integrity at the faculty level.

Abstract

People's lack of understanding of digital media results in misuse which has consequences for personal and social life. Social media is present as part of internet development. Its presence offers easy and new ways of interacting, communicating, and socializing with the support of interesting features. The number of social media users in Indonesia is dominated by teenagers, so the impact is felt by teenagers. Good use can improve achievement, whereas bad use can have negative consequences for children and adolescents. We need to respond to technological developments that are bringing us to the Industrial Revolution 4.0 wisely. This is what makes Digital Literacy very necessary. Self-understanding of digital technology movements requires us to learn more deeply about material related to digital literacy. To be able to use the internet well, everyone, including students, must have good digital literacy. To be able to use the internet well, it is necessary to strengthen the literacy of students. Apart from that, there needs to be protection so that the internet is used only for good, and teachers must direct students to filter negative things from the internet. After learning about Digital Literacy and Humanity, Santri will be given training on how to prepare PowerPoint as a learning medium. Improving skills in preparing learning media based on digital literacy is an important thing for students to develop.

Abstract

Penulisan artikel ini bertujuan untuk menjelaskan definisi perbuatan melawan hukum menurut Hukum Perdata dan merinci unsur-unsur yang terkandung dalam perbuatan melawan hukum, serta dampak hukum yang ditimbulkan pelaku perbuatan melawan hukum berupa kewajiban mengganti kerugian. Teknik metodologis digunakan dalam penelitian ini, termasuk menggambarkan dan menjelaskan tentang perbuatan melawan hukum menurut perspektif ilmu hukum yaitu unsur, kewajiban ganti rugi, serta dampak hukum yang ditimbulkan dengan melakukan pengumpulan data serta menggunakan peraturan perundang-udangan yang memiliki kaitannya dengan permasalahan pada penelitian ini. Artikel ini menggunakan metode pendekatan hukum normatif dengan sumber data sekunder, yaitu telaah teks hukum asli, literatur hukum sekunder, dan sumber-sumber non-hukum sehingga dapat disimpulkan, bahwa: 1. Terdapat 5 (lima) unsur atau persyaratan yang harus dilakukan individu agar dapat dikatakan perbuatannya melawan hukum. 2. Terdapat dampak hukum yang ditimbulkan berupa tuntutan ganti rugi bagi pelaku perbuatan melawan hukum. Tujuan penulisan ini berdasarkan pengalaman empiris sebagai Atase yang ditugaskan di Perwakilan RI sehingga tulisan ini diharapkan dapat memberikan konstribusi positif bagi para pembaca.

Abstract

A dispute is a problem submitted by the Customer or Customer Representative to the bank mediation organizer, after going through the complaint resolution process by the Bank. When the customer feels that the problem is not resolved through Complaint to the Bank, a dispute is born here. Disputes between the Bank and the Customer are inevitable because of the legal relationship between the two. Dispute resolution solutions are carried out through litigation or court and non-litigation channels. One of the best steps in resolving disputes between banks and customers is through Mediation which is facilitated by the Alternative Insitutions on Dispute Settlement For Financial Services Sector/Lembaga Alternatif Penyelesaian Sengketa Sektor Jasa Keuangan (LAPS SJK). The purpose of writing this article is to examine the optimization of the role of mediation for banking disputes. The settlement process at LAPS for the Financial Services Sector is confidential. The term confidential here means that the announcement is not announced. It prioritizes a win-win solution. Therefore it is more comfortable for the parties. Ultimately there will also be able to maintain consumer confidence in the financial services sector.

Abstract

The implementation of the Bilateral Investment Treaty in Indonesia with foreign investors must still pay attention to the existence of Indonesian state sovereignty. State sovereignty must be maintained by the host state to maintain the existence of the country in the international world. BIT has the main function as an international legal instrument that is useful in foreign investment activities with reciprocal relations in obtaining benefits between the guarantee of legal protection of the home state of foreign investors and the economic growth of the host state. BIT signatories are theoretically balanced and reciprocal, but they are often detrimental to host states, most of which come from developing countries. This research aims to find out the extent of Indonesia's implementation of BIT and still protect the existence of state sovereignty. The method used in this research uses normative and comparative juridical and this research has an analytical descriptive nature. Normative legal research is obtained by studying the Churchill Mining case approach and collecting data from articles, web, books, and websites and then comparing the implementation of BITs in Indonesia as a developing country and the United States as a developed country and comparing the implementation of BITs in fellow developing countries between Indonesia and Brazil. The first victory achieved by Indonesia against Churchill Mining in the resolution of the international investment dispute at the ICSID forum proved the BIT reform in Indonesia that continues to develop. This study showed that: first, The Bilateral Investment Agreement provides legal protection guarantees for foreign investors and settlement of settlement disputes through ICSID, an international investment settlement arbitration agency between the two countries that signed the BIT so that the BIT is a protection guarantee for investors. Second, Indonesia's victory against Churchill Mining proves that it has reformed the BIT that applies to Indonesia in a balanced manner to provide legal protection (host state) and the existence of state sovereignty (home state).

Abstract

The Merdeka Curriculum has diverse extracurricular learning in which content will be more optimal, giving students enough time to explore concepts and strengthen competencies. Teachers can choose various teaching tools to tailor learning to students’ needs and interests. In conducting teacher learning, of course, teachers encounter multiple characteristics of students. Disciplinary practice is carried out to achieve the learning objectives, but in the observation of the proposal team, many teachers still practice discipline that hurts students. Students feel punished for causing trauma and isolated effects, which, of course, hurts the growth of elementary school students. Teachers of Tunggul 2 Elementary School need an increased understanding of disciplinary patterns based on the Merdeka Curriculum and the school's conditions that require improved infrastructure as a better teaching tool. Positive discipline is interpreted as an act of consciousness and responsibility, as a form of respect for oneself and others around it. The method of service is to provide education through socialization and learning practices.
