Abstract

Indonesian laws determines different age limit for the children. The Law of Republic of Indonesia Number 1 Year 1974 concerning Marriage holds the age limit for the children until 16 years old for the women and 19 years old for the men. Meanwhile, on the Law of Republic of Indonesia Number 23 Year 2002 concerning Child Protection, the age limitation both for women and men is 18 years old. This Child Protection Act has adopted norm as stipulated in the Convention of the Rights of Children, as ratified through Presidential Decree Number 36 Year 1990. Some violations of the human right of children in Indonesia were more or less related to the unclear limitation of the age of children. A few years ago, this situation was brought into legal concern as a constitutional review was lodged before the Constitutional Court of Republic of Indonesia. This court has finally issued a Judgment Number 30-74/PUU-XII/2014 that addressing the issue in concern. Once should be noted that not all Justices had a similar opinion on the Judgment as one Justice expressed a different opinion. The main purpose of this paper is to analyze the legal consideration contained in this Judgment. In addition, it also intends to criticize the Justice’s Dissenting Opinion that was addressed against this Judgment. This paper is set as a Normative Legal Research that uses case study approach and statutory approach. Key Words : Constitutional Court, Indonesia, Children Rights, Age Limit.

Abstract

Collective Labor Agreement (CLA) is one of the main pillars that can be used in resolving disputes that occur in the company, However, there are problems concerning the implementation of CLA. The purpose of this research is to find and identify factors that can trigger disputes in the implementation of CLA, the probability of amendment of the CLA, identify the position of CLA in resolving Industrial Relation Disputes and find a mechanism of settlement in the implementation of the CLA. The research was carried out using empirical legal methods and analyzed using qualitative methods. The results are presented in a descriptive analysis report. The results of this research showed differences in interpretation, when unclear validity arrangements and adjustments of the new legislation happen were triggering disputes in the implementation of the CLA. Based on goodwill from the CLA parties, amendments could be made through negotiations in accordance with the mechanism stipulated in the Laws and Regulations. The position of CLA is an autonomous law that applies to the company and is an important element in preventing and resolving Industrial Relation Disputes. Finally, the settlement through bipartite, tripartite and Industrial Relation Court are the mechanism that can be taken for interest disputes.

Abstract

After the enactment of the Law of Government Administration implied the regulation concerning the execution of the Administrative Court Judgment. Some pro-cons academic and practice discourses, arguing that the enactment of the Law of Government Administration is the culminating point from the limited role of the Administrative Court on enforcing the administrative law and the argument that the regulation of the Law of Government Administration contains various ambiguities norms in concern with implementation in the Administrative Procedural Law System. This study aims to analyze and discuss concerning the regulation of the provisions of the Administrative Court Ruling execution, constrains in judgment execution and the legal certainty for the justice seekers in the provisions of the Administrative Court Ruling execution after the enactment of the Law of Government Administration. This paper is using a normative and empirical method. The data that using consisted of primary and secondary data, were analyzed using qualitative methods. This study result is presented in a descriptive analysis paper.

Abstract

ABSTRACT This paper specifically examines the concept of law in a sociological study to find out how the law develops and how the law implemented or enforced as a unity in the legal system. This paper-based on the normative juridical method, using legal materials collected and analyzed using qualitative methods. The results show that the sociological of law studies as part of the activities of drafting legal products and the preparation of legal products is not just a juridical process. The processes of transformation from social desires into laws and regulations both in political and sociological contexts do not only occur during the formation of a regulation, continue and continually correct the legal products that produced. Law enforcement related to the sociology of law that observes the reality of how the law is working on different social structures, this scientific approach is expected to not only provide advice related to the development of legal science alone, but also must be applied, but unfortunately in the development of this science itself is not able to develop dynamically because observations that are not equally displayed in providing input to the development of legal protection in Indonesia.

Abstract

Perubahan UUD NRI 1945 mendorong lahirnya Mahkamah Konstitusi sebagai pelindung konstitusi dan penjamin hak konstitusional warga negara Indonesia. Putusannya bersifat final dan mengikat, namun terdapat problematika berkaitan dengan kekuatan mengikat, makna filosofis dan akibat hukum implementasi Putusan Nomor 128/PUU-XII/2015 perihal pengujian atas Pasal 33 ayat (1) huruf g. dan Pasal 50 ayat (1) huruf c. UU Nomor 6 Tahun 2014 tentang Desa terkait syarat bagi calon kepala desa atau perangkat desa. Tulisan ini menggunakan metode penelitian dan penulisan hukum normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Putusan MK No. 128/PUU-XIII/2015 bermakna sebagai pengendalian sosial, merevitalisasi hak pilih warga Negara yang tadinya dianulir sebagai calon kepala desa atau perangkat desa, dan warga Negara yang berpendidikan paling rendah sekolah menengah umum atau sederajat dapat menggunakan hak konstitusionalnya dalam pengisian jabatan kepala desa atau perangkat desa. Putusan MK No. 128/PUU-XIII/2015 termasuk putusan yang membatalkan suatu norma hukum, pelaksanaannya secara langsung sesuai dengan substansi, tanpa memerlukan perubahan terlebih dahulu atas UU No. 6 Tahun 2014. Hasil penelitian itu diharapkan dapat mendukung penguatan implementasi Putusan Mahkamah Konstitusi Nomor 128/PUU-XII/2015 dari aspek kekuatan mengikat, makna filosofis, dan akibat hukum implementasinya.Amendments to the 1945 Constitution of the Republic of Indonesia encouraged the birth of the Constitutional Court as a protector of the constitution and a guarantor of the constitutional rights of Indonesian citizens. The decision is final and binding, but there are problems related to binding force, philosophical meaning and the legal consequences of the implementation of Decision Number 128/PUU-XII/2015 regarding the examination of Article 33 paragraph (1) letter g. and Article 50 paragraph (1) letter c. Law Number 6 of 2014 concerning Villages relates to requirements for prospective village heads or village officials. This paper uses research methods and normative law writing with a statute approach, conceptual approach and case approach. Constitutional Court Decision No. 128/PUU-XIII/2015 means as social control, revitalizing the voting rights of citizens who were previously disqualified as candidates for village head or village officers, and citizens with the lowest education of public high school or equivalent can use their constitutional rights in filling the position of village head or village officials.  Constitutional Court Decision No. 128/PUU-XIII/2015 including decisions that cancel a legal norm, its implementation is directly in accordance with the substance, without requiring prior changes to Law No. 6 of 2014. The results of the study are expected to support the strength of the implementation of the Constitutional Court Ruling Number 128/PUU-XII/2015 in terms of binding force, philosophical meaning, and the legal consequences of its implementation.

Abstract

Konsep Green Constitution yang telah diadopsi dalam beberapa konstitusi di dunia seperti Konstitusi Ekuador 2008 dan Konstitusi Perancis 2005, selaras dengan UUD NRI Tahun 1945 pasca amandemen yang memuat konsep Green Constitution sebagaimana dirumuskan pada Pasal 28H Ayat (1) UUD NRI Tahun 1945 yang mencerminkan generasi hak asasi manusia ketiga yakni hak kolektif dan hak pembangunan, berupa hak atas lingkungan hidup, serta Pasal 33 ayat (4) UUD NRI Tahun 1945 yang mencerminkan pembangunan lingkungan hidup yang berkelanjutan di Indonesia secara konstitusional. Tujuan penelitian ini ialah untuk menganalisis konsep Green Constitution di dalam Konstitusi Indonesia (UUD NRI Tahun 1945). Di sisi lain, juga secara intensif mengkritisi implementasi dari konsep Green Constitution yang berkaitan dengan pembangunan lingkungan hidup yang berkelanjutan. Tulisan ini berfokus pada dua permasalahan hukum yakni : bagaimanakah konsep Green Constitution dalam konteks UUD NRI Tahun 1945 dan pengaturannya di Indonesia serta bagaimanakah implementasi konsep Green Constitution dalam UUD NRI Tahun 1945 dalam konteks menjamin hak asasi manusia atas lingkungan hidup berkelanjutan. Adapun tulisan ini dibuat dengan menggunakan metode penulisan socio-legal dengan pendekatan studi konseptual dan pendekatan perundang-undangan. Melalui tulisan ini diharapkan dapat menegaskan bahwa konsep Green Constitution di Indonesia dimaknai sebagai konstitutionalisasi norma hukum lingkungan sebagaimana diatur dan terimplementasi dalam ketentuan Pasal 28H ayat (1) dan Pasal 33 ayat (4) UUD NRI Tahun 1945 serta konsiderans menimbang huruf a, b, f, Pasal 1 angka (2), Pasal 44, Penjelasan Bagian I. Umum angka (1) dan (5) Undang-Undang Nomor 32 Tahun 2009. Namun demikian, Green Constitution belum tercermin secara holistik, terbatas pada indikator masyarakat, namun belum didukung indikator hukum dan indikator pelaksana praktik hukum.Green Constitution concept which has been adopted by several constitution in the world such as The Constitution of Ecuador 2008 and The Constitution of France 2005, inline with 1945 Indonesian Constitution after Amendment that contains Green Constitution concept in the Article 28H paragraph (1) 1945 Indonesian Constitution which shows the third human rights generation such as collective rights and development rights especially the rights of environmental, and in Article 33 paragraph (4) 1945 Indonesian Constitution that contains sustainable environmental development in Indonesia constitutionally. The main purpose of this journal is to analyze the concept of Green Constitution in the 1945 Indonesian Constitution. Besides, it also intends to criticize the implementation of the Green Constitution concept that relates to sustainable environmental development. This paper focuses on two law problems: how the concept of green constitution in 1945 Indonesian Constitution with other regulations is and how the implementation of green constitution concept in the 1945 Indonesian Constitution in the context guarantee human right for sustainable environmental development is. This paper is set as a socio-legal Research with conceptual study and statutory approach. This paper is expected to affirm that the Green Constitution in Indonesia is valued as environmental norm constitution as arranged and implemented in Article 28H paragraph (1) and Article 33 paragraph (4) 1945 Indonesian Constitution and Considering part a, b, f, Article 1 Sub-article (2), Article 44, Elucidation I. General part (1) and (5) The Law of the Republic of Indonesia Number 32 Year 2009 about Protection and Management of Environment. However, the Green Constitution has not been reflected holistically. It is still limited on society indicators and has not been supported by legal indicators and indicators of legal practice.

Abstract

The enactment of the Law Number 30 Year 2014 regarding Government Administration with the expansion of Administrative Court competence stimulate confusion and obstacles in norms and theoretical also practical obstacles for the justice enforcers especially Administrative Court Judges. On the other hand, this law is contrary and potentially conflict with Government Administration Law. To resolve this legal problem, Indonesia Supreme Court issuing several Supreme Court Regulation and Circular Letter of Supreme Court for each expansion of Administrative Court competence otherwise the confusion and obstacle in theoretical and practical spheres still conducted the problem for the justice enforcers. This study has aims to analyze and discuss concerning confusion and obstacles faced by enforcers especially Administrative Court Judges and the attitude or solution towards those obstacles. This study is using normative and empirical method with qualitative types as a descriptive analysis article.

Abstract

The objections of this article are to describe, analyze, combine, and maintain concurrent relationships between regulations, implementation of Direct Cash Fund regulations at the regional level, and determined or measured factors on Direct Cash Fund by regional governments. This study combined normative and empirical legal research, analyzed legal instruments, and conducted interviews with various apparatus and parties involved in the Direct Cash Fund. This research results demonstrate that Direct Cash Fund was an effective government instrument, both in terms of its regulation and implementation by central and regional governments, in assisting village governments in mitigating the COVID-19 pandemic effect, particularly on the poorest people, and sustaining village development agendas through the new Village Fund scheme within Direct Cash Fund allocation.

Abstract

The 1945 Constitution amendment led into Indonesia state order transition that related also towards state fundamental aspects, including citizenship issue. Discourse has been raises on material and formal context on citizenship arrangement, and develops consideration according to Constitutional Court consent into several Constitutional Court Decisions. This article intention related on dynamics and problematic over citizenship arrangement after Indonesi reform, and Constitutional Court Decision consideration on citizenship issues to evaluate needs to reformulate citizenship arrangement. This article was arranged based on legal research with thesis on arrangement dynamics and Constitutional Court Decision relevance on citizenship supported with statutory laws, conceptual, legal facts, and legal cases approaches. The results reflected citizenship arrangement dynamics related material, formal, legal needs, era and human rights development comprehensively. The Constitutional Court Decision considers Indonesia citizenship into nationalities, maximum protection, full constitutional rights, and comitment to defending single citizenship stelsel into current statutory laws.

Abstract

This article focused on the dynamics following the enactment of the Law on Job Creation. Pros and cons were raised publicly, with proponents arguing that the Omnibus Legislation method could be used to propose leaps and further forward steps for national economic acceleration with more effective and efficient investment and the creation of new job fields in Indonesia. However, the opposition argued that this law, enacted using the Omnibus Legislation method, was not prepared and did not involve workers or worker unions in the lawmaking process prior to its enactment. Furthermore, this law has crucial and controversial provisions that weaken workers’ rights fulfillment compared to the previous arrangement. This condition is the primary issue that created a chasm between workers with their rights and their employers, and it is the basis for further analysis of legal norms in the entirety of the Law on Manpower and the Law on Job Creation. With the use of a normative legal research method supported by a statutory law approach and a legal conceptual approach, as well as a legal material searching method and argumentative analysis, legal research is conducted. This article discovers and proposes fundamental principles, concept formulation, and concept proof comprehensively regarding Employment Law policy dynamics in Indonesia and pursues basic rights of workers protection after enactment of the Omnibus Law on Job Creation to ensure the realization of worker rights protection including industrial relations problem, and certainty guarantee that Employer must fulfill.
