Abstract

This study explores the legislative Carry Over mechanism within the Indonesian legal framework, with particular attention to its institutional design, implementation challenges, and procedural dimensions. Employing a normative juridical method complemented by a comparative legal approach, the research analyzes how the Carry Over mechanism functions in practice and its implications for legislative continuity across parliamentary terms. The findings suggest that while the Carry Over concept offers a pathway for sustaining legislative deliberation beyond a single legislative period, its application in Indonesia remains hindered by a number of structural and technical obstacles. These include persistent legal uncertainty, shifts in political direction following changes in parliamentary composition, and questions regarding the democratic legitimacy of continuing draft laws without renewed public or legislative scrutiny. In response to these concerns, the study proposes a set of policy reforms, including the establishment of clearer regulatory frameworks, enhanced procedural accountability, and stronger inter-institutional coordination—each aimed at reinforcing the effectiveness and legitimacy of the Carry Over mechanism within Indonesia’s legislative process. Abstract

This study explores the formation and challenges of Village Regulations in three regions: Tabanan, Badung, and Denpasar. It addresses two core objectives: identifying the dynamics of village-level legislation and examining the application of legal hermeneutics in interpreting such regulations. The research combines normative and empirical legal methods, employing a qualitative descriptive analysis through the Statute, Conceptual, and Analytical approaches. The findings reveal persistent issues in the drafting process, particularly inconsistencies with the Ministry of Home Affairs Regulation No. 111 of 2014. These challenges stem from both technical and interpretive shortcomings. The study further emphasizes the importance of hermeneutical interpretation in maintaining normative consistency and avoiding conflicting legal provisions. Additionally, a comparative perspective is offered through an analysis of village governance in Timor-Leste, where village regulations are governed under Law No. 9 of 2016. This research contributes to the discourse on institutional reform and democratic resilience at the village level, highlighting the need for clearer legal frameworks and interpretive consistency in local governance.

Abstract

Global developments attempt to rectify serious human rights breaches within the context of legal regulations, as well as to build human rights systems and institutions on a national and global scale. However, in Indonesia, the paradigm shift from authoritarianism to democracy leads human rights as one of most important issues faced by the Indonesia government. In the last two decades, the red record in resolving major human rights abuses has not been attained, necessitating a study to evaluate effective legal choices in settlement of the past human rights violations settlement. This paper employed a statutory method, legal concepts, legal cases, and citations. The comparison validates the direction of this paper's research on the dynamics of national legal concerns in the policy of resolving gross human rights abuses and the selection of law that may be employed in effectively resolving major human rights violations in favor of transitional justice. The obtained results and findings show that problems have emerged in policy orientation at the macro, mezzo, and micro policy strata, as well as the need for future direction in the substance of legislation and the enforcement system, both through judicial and extrajudicial channels, against serious human rights violations.

Abstract

In the face of rapid digital globalization, Indonesia must navigate the complexities of preserving national unity while embracing technological advancements. This article explores the concept of a Cyber Constitution rooted in Pancasila, Indonesia’s state ideology, to address emerging challenges in the digital realm. With the rise of misinformation, cybercrimes, privacy violations, and hate speech, the need for a legal framework that balances technological progress with the preservation of Indonesia's democratic values and unity has become increasingly urgent. Through an examination of current legislative efforts, including the ongoing development of cybersecurity and data protection laws, this paper proposes a comprehensive approach to creating a digital governance structure that fosters national harmony in the age of information technology.
