Abstract

Tujuan penelitian menganalisis kedudukan hak waris anak luar kawin yang memiliki akta kelahiran dalam prespektif KUH Perdata dan Komplikasi Hukum Islam. Tipe penelitian ini adalah normatif. Hasil Penelitian penulis mendapatkan bahwa: 1). Kedudukan hak waris anak luar kawin yang memiliki akta kelahiran dalam prespektif KUHPerdata dan Komplikasi Hukum Islam, terdapat perbedaan utama yaitu terletak pada pengakuan nasab anak luar kawin, di mana KUHPerdata memberikan peluang hubungan hukum dengan ayah melalui pengakuan yang dapat memperkuat hak waris, sedangkan dalam KHI hak waris hanya diakui jika pernikahan sah. 2). Implikasi hak waris anak luar kawin yang memiliki akta kelahiran dalam prespektif KUHPerdata dan Komplikasi Hukum Islam dimana KUHPerdata, anak luar kawin dapat diakui dan mendapatkan hak waris dari ayah biologisnya melalui pengakuan, sedangkan dalam KHI, anak luar kawin dapat memperoleh hak warisnya dengan wasiat wajibah dengan memberikan sebagian harta kepada anaknya. The research objective is to analyze the position of inheritance rights of illegitimate children who have birth certificates from the perspective of the Civil Code and Islamic Law Complications. This type of research is normative. The author's research results found that: 1). The position of inheritance rights of illegitimate children who have birth certificates from the perspective of the Civil Code and Islamic Law Complications, there is a main difference, namely in the recognition of the lineage of illegitimate children, where the Civil Code provides opportunities for legal relations with the father through recognition that can strengthen inheritance rights, whereas in the KHI Inheritance rights are only recognized if the marriage is valid. 2). The implications of the inheritance rights of illegitimate children who have birth certificates from the perspective of the Civil Code and the Complications of Islamic Law where in the Civil Code, illegitimate children can be recognized and obtain inheritance rights from their biological father through recognition. In contrast, in the KHI, illegitimate children can obtain their inheritance rights using a compulsory will to give some of the property to their children.

Abstract

Tujuan penelitian menganalisis Peran Kementerian Badan Pertanahan Kota Makassar, serta untuk mengetahui faktor yang mempengaruhi keefektivitasan penyelesaian sengketa tanah melalui mediasi. Metode yang digunakan dalam penelitian ini adalah yuridis empiris. Hasil penelitian menunjukkan bahwa Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional (ATR/BPN) di Kota Makassar berperan efektif dalam menyelesaikan sengketa pertanahan melalui mediasi. Proses ini tidak hanya mempercepat penyelesaian sengketa dan meredakan konflik, tetapi juga mendorong dialog konstruktif dan menciptakan iklim investasi yang lebih baik. Kementerian ATR/BPN berperan krusial Untuk meningkatkan efektivitasnya, disarankan agar kementerian memperluas sosialisasi layanan mediasi, mengadakan pelatihan rutin bagi mediator, dan menyusun SOP yang jelas untuk proses mediasi agar terstruktur.. The research objective is to analyze the role of the Makassar City Land Agency Ministry, as well as to determine the factors that influence the effectiveness of resolving land disputes through mediation. The method used in this research is empirical juridical. The research results show that the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) in Makassar City plays an effective role in resolving land disputes through mediation. This process accelerates dispute resolution, defuses conflict, encourages constructive dialogue and creates a better investment climate. The Ministry of ATR/BPN plays a crucial role. To increase its effectiveness, it is recommended that the ministry expand the socialization of mediation services, hold regular training for mediators, and develop clear SOPs for the mediation process so that it is structured.

Abstract

Tujuan penelitian menganalisis perlindungan hukum yang menjadi hak bagi pihak pembeli dalam perjanjian jual beli tanah dan bagaimana kedudukan hukum pihak pembeli yang beritikad baik terhadap pihak penjual yang menjual kembali Objeknya (Tanah) Kepembeli lain Secara sepihak. Penelitian ini menggunakan tipe penelitian hukum empiris dengan melakukan pendekatan pada kenyataan yang terjadi di lapangan melalui wawancara dan quisioner secara langsung kepada pihak yang terkait dalam penelitian. Hasil dari penelitian ini terkait (1) Pihak pembeli mendapatkan perlindungan hukum. Perlindungan hukum dibagi menjadi dua macam , sebagai berikut : (a). Sarana Perlindungan Hukum Preventif Perlindungan yang diberikan pemerintah dengan tujuan untuk mencegah sebelum terjadinya pelanggaran. Hal ini terdapat dalam peraturan perundangundangan dengan maksud untuk mencegah suatu pelanggaran serta memberikan rambu-rambu atau batasan-batasan dalam melakukan suatu kewajiban. (b) Perlindungan hukum represif merupakan perlindungan akhir berupa sanksi seperti denda, penjara, dan hukuman tambahan yang diberikan apabila sudah terjadi sengketa atau telah dilakukan suatu pelanggaran. The research objective is to analyze the legal protection that is the right of the buyer in a land sale and purchase agreement and what is the legal position of the buyer who has good intentions towards the seller who resells the object (land) to another buyer unilaterally. This research uses an empirical type of legal research by approaching the reality that occurs in the field through interviews and questionnaires directly with parties involved in the research. The results of this research are related to (1) The buyer gets legal protection. Legal protection is divided into two types, as follows: (a). Means of Preventive Legal Protection Protection is provided by the government to prevent violations before they occur. This is contained in statutory regulations to prevent violations and provide signs or limitations in carrying out an obligation. (b) Repressive legal protection is final protection in the form of sanctions such as fines, imprisonment and additional penalties given if a dispute has occurred or a violation has been committed.

Abstract

Tujuan penelitian menganalisis kedudukan Surat Pernyataan Penguasaan Fisik Tanah (Sporadik) dan untuk mengetahui dan menganalisis akibat hukum apabila Surat Pernyataan Penguasaan fisik bidang tanah (Sporadik) dipakai sebagai dasar pendaftaran tanah. Penelitian ini menggunakan pendekatan yuridis normatif. Hasil penelitian menunjukkan bahwa Kedudukan Surat Pernyataan Penguasaan Fisik Bidang Tanah (Sporadik) jika merujuk pada undang-undang pokok agraria (UUPA), Sporadik merupakan sebuah proses awal atau alas hak untuk mendapatkan pengakuan atau sertifikat hak atas suatu bidang tanah. Surat sporadik termasuk dalam kategori belum terdaftar, hanya sebagai syarat untuk melakukan pendaftaran tanah dan Akibat hukum Surat pernyataan fisik bidang tanah atau sporadik dalam melakukan pendaftaran tanah akan membawa akibat diberikannya surat tanda bukti hak atas tanah yang umum disebut dengan Sertipikat tanah kepada pihak yang bersangkutan dan berlaku sebagai alat pembuktian yang kuat terhadap Hak Atas Tanah yang dipegangnya itu. The research objective is to analyze the position of the Statement of Physical Land Control (Sporadic) and determine and analyze the legal consequences if the Statement of Physical Land Control (Sporadic) is used as the basis for land registration. This research uses a normative juridical approach. The results of the study show that the position of the Statement of Physical Control of Land Plots (Sporadik) when referring to the basic agrarian law (UUPA), Sporadik is an initial process or basis of rights to obtain recognition or certificate of rights to a plot of land. Sporadic documents are included in the unregistered category, only as a condition for registering land and the legal consequences of a physical statement of land parcels or sporadic letters in carrying out land registration will result in the granting of a certificate of proof of land rights which is generally called a land certificate to the party concerned and acts as a strong means of proof of the land rights he holds.

Abstract

This study focuses on the study of the Problem of Bad Loans of Financial Institutions in various agreements and the factors that affect the creation of bad loans in various agreements in Makassar City, South Sulawesi Province. The type of research is empirical legal research (nondoctrinal), which is research that observes social phenomena in society, in this case the problem of bad loans of financial institutions in various agreements. In addition, it also examines the factors that affect the occurrence of bad loans at financing institutions in various agreements in Makassar City, South Sulawesi Province. The influencing factors are, standard contract (regulation) factors, provit, legal awareness, business failure and the Covid 19 factor. The results of the study concluded that 1). The frequency or quantity of bad loans at financial institutions in Makassar City is quite high. 2). Factors that affect the occurrence of bad loans at financial institutions in Makassar City are standard contract (regulation) factors, provit, legal awareness, business failure and the Covid 19 factor.

Tujuan penelitian menganalisis Penerapan Pasal 32 Ayat (2) PP 24 Tahun 1997 Tentang Pendaftaran Tanah Mengenai Asas Rechtsverwerking dan untuk mengetahui, menganalisis, dan menjelaskan Faktor-Faktor apa yang mempengaruhi Penerapan Pasal 32 Ayat (2) PP 24 Tahun 1997 Tentang Pendaftaran Tanah Mengenai Asas Rechtsverwerking. Penelitian ini menggunakan tipe penelitian hukum empiris. Hasil Penelitian ini menunjukkan bahwa: (1) Penerapan Pasal 32 Ayat (2) PP 24 Tahun 1997 Tentang Pendaftaran Tanah Mengenai Asas Rechtsverwerking dapat dilihat dari Eksistensi dan Pengaturan Asas Rechtsverwerking dalam Pendaftaran Tanah di Indonesia, juga bagaimana persyaratan Penerapan Asas Rechtsverwerking dalam peraturan Perundang-undangan, selain itu Asas Rechtsverwerking juga telah diterapkan dalam Yurisprudensi serta dalam kasus pertanahan di Kabupaten Wajo. dan (2) Bahwa terdapat beberapa Faktor yang mempengaruhi Penerapan Pasal 32 Ayat (2) PP 24 Tahun 1997 Tentang Pendaftaran Tanah Mengenai Asas Rechtsverwerking di Kabupaten Wajo, yang pertama adalah Faktor Substansi Hukumnya dan yang kedua adalah Faktor Struktur Hukumnya. The research objective is to analyze the Application of Article 32 Paragraph (2) of PP 24 of 1997 concerning Land Registration Regarding Rechtsverwerking Principles and to find out, analyze and explain what factors influence the Application of Article 32 Paragraph (2) of PP 24 of 1997 concerning Land Registration Regarding Principles Rechtsverwerking. This research uses an empirical type of legal research. Abstract

Tujuan penelitian menganalisis efektivitas program pendaftaran tanah sistematis lengkap (PTSL) dalam rangka percepatan pendaftaran tanah pada kantor Badan Pertanahan Nasional Kabupaten Soppeng. Penelitian ini merupakan jenis penelitian hukum empiris. Hasil penelitian menunjukkan bahwa 1) Efektivitas deklarasi desa lengkap sebagai wujud akhir pelaksanaan pendaftaran tanah sistematis lengkap di Kantor Pertanahan Kabupaten Soppeng belum berjalan dengan efektif. Hal ini ditunjukan dengan masih tingginya masyarakat yang belum mendaftarkan tanah miliknya. Efektivitas program pendaftaran tanah sistematis lengkap (PTSL) dalam rangka percepatan pendaftaran tanah pada kantor Badan Pertanahan Nasional Kabupaten Soppeng berdasarkan indikator efektivitas program pendaftaran tanah sistematis lengkap yang diukur dengan 4 (empat) indikator yaitu: Ketepatan Sasaran Program, Sosialisasi Program, Pencapaian Tujuan Program, Pemantauan Program. 2) Faktor-faktor yang mempengaruhi belum efektifnya pelaksanaan pendaftaran tanah di Kabupaten Soppeng adalah sebagai berikut: Kesadaran Masyarakat, Sistem kompetensi yang belum sempurna, Kurangnya tenaga teknis operasional, Tanah yang belum terdaftar merupakan objek sengketa, Tidak adanya sanksi yang tegas dari Pemerintah dalam hal ini Badan Pertanahan Nasional apabila pemilik hak atas tanah tidak mendaftaran kepemilikan tanah tersebut. The research objective is to analyze the effectiveness of the complete systematic land registration (PTSL) program to accelerate land registration at the Soppeng Regency National Land Agency office. This research is a type of empirical legal research. The results of the research show that 1) The effectiveness of a complete village declaration as the final form of implementing complete systematic land registration at the Soppeng Regency Land Office has not been carried out effectively. This is shown by the high number of people who have not registered their land. The effectiveness of the complete systematic land registration program (PTSL) in the context of accelerating land registration at the Soppeng Regency National Land Agency office is based on indicators of the effectiveness of the complete systematic land registration program as measured by 4 (four) indicators, namely: Accuracy of Program Targets, Program Socialization, Achievement of Program Objectives, Program Monitoring. 2) Factors that influence the ineffective implementation of land registration in Soppeng Regency are as follows: Public Awareness, Competency system that is not yet perfect, Lack of operational technical personnel, Land that has not been registered is the object of dispute, Lack of strict sanctions from the Government in case This is the National Land Agency if the owner of the land rights does not register the ownership of the land.

Abstract

Tujuan penelitian menganalisis penilaian pembuktian kesaksian de auditu dalam perkara perceraian di Pengadilan Agama Makassar Kelas IA dan faktor –faktor yang mempengaruhi efektivitas kesaksian de auditu dalam perkara perceraian di Pengadilan Agama Makassar Kelas IA. Tipe penelitian yang digunakan yaitu empiris. Hasil penelitian ini menunjukkan bahwa: (1) Kesaksian de auditu dapat digunakan dalam perkara perceraian, tetapi kekuatannya sangat rendah atau kurang efektif Hakim cenderung menggunakan kesaksian ini sebagai pelengkap, bukan bukti utama. Oleh karena itu, pihak yang berperkara disarankan menyediakan bukti langsung atau saksi yang memiliki pengetahuan langsung atas peristiwa yang disengketakan.: (2) Faktor-faktor yang memengaruhi efektivitas kesaksian de Auditu (kesaksian berdasarkan apa yang didengar dari pihak lain) dalam memengaruhi putusan hakim meliputi aspek hukum, teknis, dan non-teknis. Diantaranya ialah, kesesuaian dengan sistem hukum yang berlaku, Keterkaitan dengan alat bukti lain, kualitas sumber informasi, keterampilan saksi dalam menyampaikan informasi, penilaian Hakim (diskresi Hakim), serta konteks kasus. The research objective is to analyze the assessment of the evidence of de-audit testimony in divorce cases at the Makassar Class IA Religious Court and the factors that influence the effectiveness of de-audit testimony in divorce cases at the Makassar Class IA Religious Court. The type of research used is empirical. This research shows that: (1) De-audit testimony can be used in divorce cases, but its power is very low or less effective. Judges use this testimony as a supplement, not the main evidence. Therefore, litigants are advised to provide direct evidence or witnesses who have direct knowledge of the events in dispute.: (2) Factors that influence the effectiveness of de Auditu testimony (testimony based on what was heard from the other party) in controlling the judge's decision include legal, technical and non-technical aspects. Among them are, conformity with the applicable legal system, linkages with other evidence, quality of information sources, witness skills in conveying information, judge's judgment (judge's discretion), and case context.

Tujuan penelitian menganalisis perbuatan dan pertanggungjawaban pidana anak yang berkonflik dengan hukum dengan delik kecelakaan lalu lintas yang korbannya meninggal. Jenis penelitian ini menggunakan jenis penelitian normatif. Hasil penelitian bahwa Dalam kasus anak yang berkonflik dengan hukum ada aspek-aspek hukum pidana dan alasan-alasan penghapus pidana yang perlu diperhitungkan secara cermat untuk memastikan keadilan dalam penegakan hukum, mengingat peran teknologi dan informasi yang semakin maju dalam kehidupan Masyarakat. Dalam mempertimbangkan perlindungan hukum terhadap hak tersangka selama proses penyelidikan dan penyidikan, penting untuk memastikan bahwa hak-hak tersebut tidak boleh dikurangi atau dirampas guna memastikan tercapainya keadilan, ketertiban, kepastian hukum, kemanfaatan, dan kedamaian. Hal ini merupakan prinsip yang mendasari hukum acara pidana dalam memberikan keadilan kepada setiap individu. The research objective is to analyze the criminal actions and responsibilities of children who conflict with the law due to traffic accidents in which the victim dies. This type of research uses normative research. The research results show that in the case of children in conflict with the law, there are aspects of criminal law and reasons for the abolition of crime that need to be carefully taken into account to ensure justice in law enforcement, considering the increasingly advanced role of technology and information in society's life. In considering the legal protection of suspects' rights during the inquiry and investigation process, it is important to ensure that these rights are not reduced or taken away to achieve justice, order, legal certainty, benefit and peace. This principle underlies criminal procedural law in providing justice to every individual.

Abstract

This research focuses on the study of the Problematics of Land Acquisition for Development for the Public Interest in the Makassar City Region of South Sulawesi Province and the factors that influence the implementation of Land Acquisition for Development for the Public Interest in the Makassar City Region of South Sulawesi Province. The type of research is empirical legal research (nondoctrinal), which observes social symptoms in society, in this case, the Problems of Land Acquisition for Development for the Public Interest in the Makassar City Region of South Sulawesi Province. In addition, it examines the factors that influence the problems of land acquisition for development for the public interest in the Makassar City Region of South Sulawesi Province. The influencing factors are legal structure, legal awareness/understanding, economic, and cultural factors. The research results are as follows: 1) Implementing land acquisition for development for public interest increased in Makassar City Area, South Sulawesi Province, but is not yet optimal. 2) Factors affecting the implementation of Land Acquisition for Development for Public Interest increased in Makassar City Area of South Sulawesi Province: legal structure, awareness, cultural, and economic factors. The expected results or research outputs are 1).
