Abstract

The formulation of the problem in this research is how the government should implement the Constitutional Court Decision regarding forest control by the state in protecting the constitutional rights of affected citizens. This research uses a form of normative legal research with a statutory regulatory approach related to the process of determining an area or land as a forest area. The result is that the state’s claims to areas that have customary law rights must be protected, respected and fulfilled by the rights of customary law communities; as long as the rights of customary communities actually exist and their existence is recognized. Constitutional Court Decision No. 34/PUU-IX/2011 revised Article 4(3) of Forestry Law No. 41/1999, impacting subsequent forestry legislation, like Law No. 11/2020. It upholds indigenous community rights, granted based on statutes and without national interest conflicts. If such rights exist, the government must first negotiate fair settlements with rightful holders. Thus, these communities rights are granted based on the provisions of statutory regulations invitation and does not conflict with national interests according to the Constitutional Court Decision.

Abstract

Peranan Bawaslu dalam penyelesaian sengketa antara Peserta Pemilu tahun 2024 dan Penyelenggara Pemilu diatur dalam Pasal 468 ayat (2) UU Pemilu, yang menetapkan bahwa Bawaslu, Bawaslu Provinsi, dan Bawaslu Kabupaten/Kota harus menyelesaikan sengketa proses pemilu dalam waktu paling lama 12 (dua belas) hari setelah menerima permohonan. Pengaturan ini penting agar setiap langkah dalam proses penyelesaian sengketa dapat dilakukan dengan baik, meskipun dalam waktu yang terbatas. Penelitian ini menggunakan pendekatan yuridis normatif. Menggunakan bahan hukum primer seperti peraturan perundang-undangan dan Putusan Mahkamah Konstitusi, serta bahan sekunder dari literatur kepemiluan, penelitian ini menemukan bahwa Bawaslu memiliki fungsi strategis dalam menyelesaikan sengketa pemilu. Kewenangan Bawaslu mencakup mediasi dan ajudikasi sesuai dengan Undang-Undang Nomor 7 Tahun 2017 dan Peraturan Bawaslu Nomor 9 Tahun 2022. Selain menangani pelanggaran administratif dan politik uang, Bawaslu juga berperan dalam mencegah pelanggaran melalui edukasi masyarakat. Proses penyelesaian sengketa dilakukan secara cepat, efisien, dan tanpa biaya, baik secara langsung maupun daring. Tahapan penyelesaian mencakup pemeriksaan permohonan, mediasi, dan ajudikasi. Putusan Bawaslu bersifat final dan mengikat, dengan mekanisme koreksi bagi pihak yang dirugikan. Eksistensi Bawaslu mencerminkan prinsip checks and balances dalam demokrasi konstitusional untuk menjamin integritas dan keadilan pemilu. Namun, Bawaslu menghadapi tantangan seperti meningkatnya volume sengketa, penafsiran ganda norma hukum, kendala teknis, dan keterbatasan sumber daya manusia dalam pelaksanaan Pemilu 2024

Abstract

Budaya perusahaan China, yang sering kali menekankan hierarki dan loyalitas, dapat memengaruhi penerapan perlindungan hak-hak pekerja. Sebagai contoh, dalam konteks hubungan industrial, norma budaya yang menekankan kepatuhan terhadap atasan dapat mengurangi keberanian pekerja untuk menyuarakan hak-hak mereka. Situasi ini berpotensi menciptakan ketidakadilan dalam perlakuan terhadap pekerja lokal, yang seharusnya dilindungi oleh regulasi ketenagakerjaan yang berlaku. Di Indonesia, angkatan kerja Bukan hanya mencakup warga negara Indonesia, melainkan juga mencakup pekerja pendatang yang dirujuk sebagai Tenaga Kerja Asing (TKA). Berdasarkan Pasal 1 angka (2) UU Ketenagakerjaan, tenaga kerja didefinisikan sebagai setiap pribadi yang kompeten dalam mengerjakan suatu tugas untuk memproduksi komoditas dan layanan, baik dalam rangka memenuhi kebutuhan pribadi juga untuk khalayak ramai. Penelitian ini mengadopsi pendekatan kualitatif dengan metode deskriptif. Strategi ini ditetapkan demi memperoleh pemahaman yang mendalam sehubungan dengan fenomena  jaminan secara yuridis bagi pekerja Indonesia dalam konteks integrasi budaya dan norma terhadap Sumber daya manusia non-nasional, khususnya yang memiliki latar negara asal perusahaan China. Dari sudut pandang hukum ketenagakerjaan, regulasi terkait pemanfaatan TKA dimaksudkan guna memastikan dan menyediakan kegiatan kerja yang pantas diberikan kepada WNI. Pasal 28 D ayat (2) UUD NRI 1945 menggarisbawahi bahwa setiap orang memiliki kebebasan untuk bekerja dan menerima imbalan serta dilindungi melalui perlakuan yang adil dan manusiawi dalam hubungan industrial. Selain itu, Pasal 28 I ayat (4) UUD NRI 1945 menekankan komitmen negara, khususnya aparatur negara, dalam menjamin perlindungan, pengembangan, pelaksanaan serta realisasi hak asasi setiap individu.

Abstract

Indonesia's economic growth is still centered on the island of Java, thus demanding the Government to conduct development outside Java. PT Hutama Karya (Persero) received a mandate from the Government to develop and build the Trans Sumatra Toll Road through Presidential Regulation No. 100/2014 was then amended through Presidential Regulation No. 117/2015. With the construction of toll roads on the island of Sumatra, economic growth there is hoped to increase. With the Trans Sumatra Toll Road, a rest area is needed to support road users when traveling. PT Hutama Karya entered into a lease agreement with tenants in the managed Toll Road rest area to rent out rental space in the rest area. This study aims to determine whether the laws and regulations regarding the PT Hutama Karya (Persero) OPT Division Rest Area Agreement have fulfilled the Legal Aspects of the Agreement and the Legal Aspects of Justice.

Abstract

Provision of road infrastructure at local and regional level is still having a problem in financing and public private partnership (PPP) still cannot solve the problem. Project bundling for PPP is a great option to improve the financial feasibility of smaller value projects. It may be appropriate for the PPP legal framework to provide and support bundling, to make project bundling run smoothly, in order, and achieve its original purpose. This paper is trying to see if the laws and regulations for PPP can provide and support project bundling. The methods used are normative juridical by legislation approach and conceptual approach. This paper concludes that the law providing PPP cannot yet support project bundling properly, caused by the lack of law and inconsistencies in Indonesian Ministerial Regulations that regulates PPP. This calls for a law revision or at least an intervention by policies to support bundling for smaller projects.

Abstract

This study aims to describe the procedures and barriers associated with compensating disease sufferers who are not eligible to receive the COVID-19 vaccine. The research method used is normative research, which focuses on analyzing legal aspects based on legal regulations, including Presidential Regulation Number 99 of 2020, concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Overcoming the 2019 Coronavirus Disease (COVID-19) Pandemic, as well as regulations other relevant matters. Research data was obtained through literature study and document analysis, including primary and secondary legal materials. Data analysis was carried out descriptively and qualitatively with a deductive approach, which refers to general legal principles. The research results identified various obstacles, including technical problems such as a lack of public discipline in undergoing health checks before receiving vaccination and a lack of compliance from medical personnel who manage vaccination procedures per established guidelines. As a result, some groups of people who should not receive the COVID-19 vaccine still receive vaccination, which can ultimately cause side effects. The research also highlights Presidential Regulation Number 14 of 2021 concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Overcoming the COVID-19 Pandemic, which provides compensation guarantees following applicable regulations if a Post-Vaccination Adverse Event (AEFI) occurs which has the potential to cause disability or death in sufferers of the disease who are not eligible to receive the COVID-19 vaccine. The results of this research provide a deeper understanding of the challenges and obstacles in implementing COVID-19 vaccination, especially in the context of disease sufferers who do not meet the requirements to receive the vaccine, as well as the importance of guaranteeing compensation in AEFI situations that have the potential to have profound impacts.

Abstract

This research employs a normative juridical approach with a focus on legislative analysis. It evaluates how formal defects and ethical violations by judges impact legitimacy and public perception. The main findings indicate that these two decisions cast doubt on constitutional compliance and legal validity, highlighting the need for stronger review mechanisms and oversight to uphold the integrity of the Constitutional Court (MK). The purpose of this study is to identify the impact of formal defects and ethical violations by judges in Constitutional Court Decision No. 90 and Constitutional Court Honorary Council (MKMK) Decision No. 2/MKMK/L/11/2023 on constitutional legal principles in Indonesia. The conclusion shows that legal validity, constitutional compliance, finality, and the binding nature of Constitutional Court decisions, along with the integrity and reputation of the Constitutional Court, play significant roles in Indonesia’s constitutional law. It was found that Constitutional Court Decision No. 90 and MKMK Decision No. 2 of 2023, related to formal defects and ethical violations, have a significant impact on the legitimacy and public perception of the constitutional justice system. Although the finality and binding nature of Constitutional Court decisions are fundamental to legal certainty, a review mechanism is needed in certain situations, especially when formal defects or ethical violations occur. Formal defects and ethical violations can erode public trust and pose serious challenges to the dignity of the constitutional judiciary.

Abstract

The development of an area that has an impact on the community's economy and the fulfillment of the community's basic needs requires the development of road infrastructure that supports the distribution process to run quickly and efficiently. This development is to fulfill the mobility of the community so that they become mutually connected with other regions in order to create acceleration of regional development. The state in meeting the infrastructure needs for the development of the region is expected to be able to improve the surrounding economy and other areas that are connected to the construction of the road infrastructure. Based on the provisions of Law Number 38 of 2004 concerning Roads in Article 43 it states that toll roads are built to facilitate traffic in developing areas, to increase mobility and distribution of basic needs and industrial commodities. Toll roads are one of the infrastructures that are considered effective in meeting the mobility needs of the community. The construction of the toll road is a development project that requires a large amount of money. The government provides funding concessions for Business Entities appointed to carry out the construction of toll roads. One of the financing instruments that can be used by Business Entities in meeting the funding needs for Toll Road development is syndicated bank loans. Syndicated bank loans can be used with a guarantee, one of which is a Government Guarantee or Government Guarantee. The aim of this research is to know and understand the legal standing of government guarantees in syndicated bank loans. The legal theory used is Normative Law Theory to find the truth based on the applicable positive law. This legal research method is empirical juridical based on the school of sociological jurisprudence based on normative law by observing laws and regulations. The results of the study found that syndicated loans are different from single loans in circulation in general. Syndicated credit begins with the stages of offering credit to syndicated participants (participants), giving mandates, memorandum information, meeting prospective debtors to obtain syndicated credit approval, signing the credit agreement and ending with publication. Guarantees on syndicated loans are preferred creditors who have the right to pay off credit first.

Abstract

Sertipikasi kepemilikan tanah memiliki peranan yang sangat penting, tidak hanya dalam memberikan kepastian hukum kepada pemiliknya, tetapi juga dalam melindungi hak-hak masyarakat secara luas. Pembuktian terhadap kepemilikan sertipikasi tanah sebagai perlindungan hukum terhadap hak konstitusional warga negara. Tanah, sebagai sumber daya alam yang terbatas dan bernilai ekonomi tinggi, memerlukan regulasi yang jelas untuk melindungi hak-hak masyarakat serta mencegah terjadinya konflik dan sengketa. Penelitian ini menggunakan metode yuridis normatif, yang memungkinkan peneliti untuk menganalisis peraturan perundang-undangan dan norma hukum yang berlaku, serta mengeksplorasi interaksinya dengan hak-hak konstitusional masyarakat. Dengan pendekatan ini, penelitian dapat memberikan wawasan mendalam mengenai pelanggaran konstitusi dan pengabaian hak masyarakat dalam pendaftaran tanah. Kurangnya akses masyarakat terhadap informasi tanah dapat dianggap sebagai pelanggaran konstitusi, terutama jika pemerintah tidak menyediakan sistem yang transparan dan akurat. Sehingga diharapkan peranan aplikasi sentuh tanahku diharapkan dapat menjadi sumber informasi dalam perihal informasi pertanahan. Sertipikasi tanah merupakan pemenuhan hak konstitusional warga terkait informasi kepemilikan tanah. Dengan meningkatkan akses informasi dan akurasi data tanah, pemerintah diharapkan mampu mengurangi potensi konflik, memberikan kepastian hukum yang lebih kuat, serta meningkatkan kepercayaan masyarakat terhadap sistem pertanahan yang efektif dan terpercaya.

Abstract

Kementerian Energi dan Sumber Daya Mineral memiliki wewenang penuh atas penetapan kebijakan pengelolaan Mineral dan Batubara. Minerba One Data Indonesia (MODI) dioptimalkan oleh Direktorat Jenderal Mineral dan Batubara sebagai digitalisasi sistem pemusatan data pemegang IUP, dan baru mulai wajib diterapkan sejak diterbitkan Kepmen ESDM No. 78.K/MB.01/MEM.B/2022 di tahun 2022. Sehingga, masih dibilang hal yang baru bagi perusahaan pertambangan dan menimbulkan kebingungan di kalangan pengusaha pertambangan. Penelitian ini bertujuan untuk mengetahui pengaturan hukum dan dampak hukum atas kebijakan MODI bagi pemegang IUP. Metode Yuridis Normatif digunakan pada penelitian ini yaitu menelaah norma hukum yang berlaku. Dari hasil penelitian, didapat bahwa adanya kebijakan MODI ini merupakan tindak lanjut dari UU Minerba 2020 berikut peraturan turunannya di Kepmen ESDM No. 15 tahun 2022 dan Kepmen ESDM No. 78 tahun 2022. Sampai saat ini belum ada pengaturan sanksi secara langsung bagi perusahaan yang tidak melaksanakan kebijakan MODI. Namun, terdapat dampak jika perusahaan tidak melaksanakan kebijakan MODI yaitu, tidak bisa menggunakan aplikasi Minerba One Map System (MOMS), tidak bisa menyampaikan RKAB pada E-RKAB, tidak bisa melakukan kewajiban pembayaran di E-PNBP, dan tidak bisa melaporkan perubahan direksi dan/atau komisaris kepada ESDM. Semua hal tersebut dapat berakibat pengenaan sanksi administratif bagi pemegang IUP,
